Facilitator: David C. Mann

David C. Mann is an accomplished speaker and

trainer on the subjects of communication and

change who shares the secrets he learned during

his 25 years as a theatre actor and director. David

has worked for General Mills, Hartford Life, Boston

Scientific, Merrill Lynch, HealthPartners, Mayo

Health System, and Volt Workforce Solutions,

among others. He has been a featured speaker

on communication for numerous associations and has created and presented

customized keynote performances. David received a bachelor’s degree in speech

from Northwestern University and a classical acting diploma from the London

Academy of Music and Dramatic Art. He has been a high school theatre teacher and

created a writing and performance program for the Guthrie Theater’s education

department. David lives in St. Anthony, MN, with his wife and two sons.

The best lawyers agree that without skilled delivery, the soundest arguments fail.

This session illuminates the secrets of presenting complex material with the ease

of a conversation. To engage a colleague, client, court personnel, opponent or jury,

a successful advocate identifies the essentials, says it directly and leaves out the

smokescreens. Learn how to use vocal inflection and body language to tell the story.

With concepts drawn from performance and years of public speaking, David Mann

will show how to present engaging presentations for prospective client interviews,

mediations and arbitrations, depositions, witness preparation, openings, witness

interrogation, closings, and oral arguments.

Facilitator: Ed Hatch

Ed Hatch has influenced others from his work

counseling at-risk teenagers in a suburban

Washington, D.C. public school system to his work

as a top producing salesperson. He also has had a

job managing more than 100 employees, worked

as senior vice president of sales at Fred L. Mckee

Realty and was the co-owner of a real estate firm.

For the past 20 years, he has been a speaker/

trainer for associations, institutes, 5-star hotels

and corporate executives throughout North and South America, Europe, Asia

and Africa. Ed’s message of the applied dynamics of human communication

has particular application to the work of trial lawyers or transactional attorneys,

where communication comes first in preparing cases and influencing outcomes.

In business and personal relationships, strongly felt differences can result in conflicts

that turn into a desire to win, even at the expense of others. These differences don’t

go away as we work our way down the road from confrontation to agreement. So

to “win” the cooperation of others when there is strong disagreement you have

to master negotiating principles which are supported by both research and

experience. Ultimately, if people are critical to your success, you must know and

master the means to win their hearts as well as their minds. Successfully guiding

your client and/or opposing counsel to an agreement will come when you can

clearly, convincingly and persuasively show them the benefits of winning “them

over,” not winning “over them.”

This program offers insights from three professionals:

Amanda Buzo will give an update on Medicare.

Bonnie Kantor-Burman will discuss modernizing Medicaid reimbursement in

Ohio, implications for long-term services and supports, prioritizing funding for

home-and community-based services, creating a unified long-term care system

in Ohio, nursing facility reimbursement reform and development of a Medicare

Medicaid integrated-care delivery system.

Janet L. Lowder will discuss Medicaid for children and the disabled and provide,

among other topics, an overview of Healthy Start/Healthy Families, Medicaid for

the disabled and home and community-based waivers.

Facilitators:

Amanda Buzo focuses her practice on estate

planning, with a concentration on issues affecting

the elderly and special-needs families. She

also practices in the area of probate, including

guardianship, special-needs trusts, wrongful

death, minor and incompetent settlements, and

decedents’ estates. She was recognized as a 2010

Rising Star by Ohio Super Lawyers and frequently

writes and speaks on the elderly and people with disabilities. Amanda received

a Bachelor of Science degree from Ohio State University and a law degree from

the University of Akron School of Law.

Bonnie Kantor-Burman, the director of the

Ohio Department of Aging, is working to reform

the quality and efficiency of our health care

system and to strengthen and widen long-term

care options that give elders more health-care

choices. She believes in the concept of preventive

gerontology, a wellness and behavioral driven

model of life and care across the lifespan. Before

joining the department in January 2011, Kantor-Burman was executive director

of the Pioneer Network, a national center for the development of long-term care

delivery systems. She also has worked as director of the Office of Geriatrics and

Gerontology at The Ohio State University. She earned her doctorate in health

policy and management from Johns Hopkins Bloomberg School of Public Health.

Janet L. Lowder is an authority on Medicaid issues

and estate planning for families with special needs.

She has represented individuals; handled local and

statewide litigation and has represented agencies

and county programs serving the elderly and the

disabled. Janet is president of the Special Needs

Alliance, an invitation-only national network of

lawyers dedicated to disability and public-benefits

law and special-needs planning, and is co-chair of an American Bar Association

committee on long-term care and Medicaid. She received the Cuyahoga County

Board of MR/DD’s 2000 Top Hat Award and the 2009 President’s Award from

DAY 1 - 4/24/12 8 – 11:30 A.M.

Conflict Management in the Arab Uprisings

How should the United States engage in conflict management in light of the Arab

uprisings, given our own recent history coupled with the region’s contemporary

realities? What are the take-aways for the legal profession, in particular regarding

engagement in an international setting? Colonel Philip J. Dermer shares his insights

and lessons learned from his career in the military, and thoughts on relevance to

the legal practice. Participants will consider several critical questions impacting the

international arena, including how should the U.S. engage in conflict management

regarding the Arab uprisings? What can be learned from the past? What are the

relevancies and appropriate lessons for the legal field?

Facilitator: Colonel Philip J. Dermer, Ret.

Colonel Dermer, whose career spans 30 years, is

one of the Army’s foremost Middle East regional

experts. His service in military and civilian arenas

is spread over challenging spectrums, including

national levels of the U.S. government and vital

international venues. He has extensive coalition-

building experience working with international

counterparts to foster the Middle East Peace

Process as well as the rebuilding of Iraq’s critical national security institutions.

He has advised, mentored and written extensively for the nation’s senior military

and civilian leadership. He is a graduate of the National Defense University, Ft.

McNair, Washington D.C., Georgetown University and the University of Montana.

In 1971, 31-year-old White House Deputy Counsel Krogh was tasked with

finding and stopping White House leaks and became head of the Special

Investigations Unit. Through prison, disbarment and reinstatement, he

learned there are drastic consequences when noble aspirations, internal

loyalties, external pressures and ethical codes collide. The rules of professional

conduct often say what not to do, but rarely explain what to do. It’s easy

to turn down a capital murder case if you know you’re not competent to

defend the person charged, but what do you do when your practice group

leader or your most lucrative client compels you to do something you’re just not

sure of? Krogh will give you the questions you must answer before taking on such

projects and tell you of the positive consequences of saying no.

Facilitator: Egil “Bud” Krogh

Bud Krogh was White House deputy counsel when

he was told to find and stop security leaks. He

became head of the Special Investigations Unit that

later became known as the “White House Plumbers”

and the rest is history. Of the various White House

conspirators, Krogh alone pled guilty and refused

to trade inside information for a reduced sentence.

He was disbarred and went to prison. In 1980,

Krogh successfully petitioned to be readmitted to the bar and has since practiced

law. In January 2009, Krogh joined the Center for the Study of the Presidency

and Congress as a senior fellow on leadership, ethics and integrity where he is

developing initiatives to promote civility, character and inclusive public leadership.

DAY 1 - 4/24/12 12:30 - 4 P.M.

Why Employers Get Sued and

Using Your Hiring Programs as Risk Avoidance Tools

This high-energy session will explain the hiring process and how to avoid risks and

liabilities. Key mistakes and short comings that lead to the majority of employee

and former employee lawsuits will be analyzed. Employment agreements,

independent contractor agreements, policy manuals, performance evaluations,

workplace investigations and administrating discipline discharge decisions will

be covered. The session’s second part will show you how to design your hiring

processes and use them to avoid risks and liabilities. Time will be spent creating

a hiring program to identify the best candidate and implement the most effective

proactive and remedial measures to avoid claims, liability and other business loss.

Facilitator: Richard Hooker

Richard Hooker has significant experience in

traditional labor relations, state/federal agency

work, employment litigation, union election

campaigns, unemployment insurance taxation

matters and arbitration of employment disputes.

He is a mediator for the U.S. District Court, Western

District of Michigan, and the Michigan courts, and

he is an arbitrator and mediator with National

Arbitration and Mediation, Inc., American Settlement Centers and the National

Arbitration Forum. A lawyer with Varnum, a Michigan law firm, Hooker received

his Bachelor of Arts degree from Denison University and his law degree from

Washington & Lee University School of Law.

DAY 1 - 4/24/12 12:30 - 4 P.M.

National Security Law Update: Drones, Detainees,

and the Iranian Nuclear Program

This session is an introduction of the domestic and international law bases for

use of force (war powers, U.N. Charter, law of armed conflict). Discussion will be

about the application of these legal bases to the ongoing issues of U.S. drone strikes

in countries such as Pakistan and Yemen; the indefinite detention of so-called

enemy combatants in the war against Al-Qaeda; and the potential conflict that

may be looming due to Iran’s pursuit of a nuclear weapons program. The session

also will show why these topics are relevant to private/commercial law attorneys.

Facilitator: Daniel G. Donovan

Daniel G. Donovan, an international law specialist, is a supervisory attorney-

advisor in the Joint Staff Hampton Roads (Virginia) branch of the Office of the Legal

Counsel to the Chairman of the Joint Chiefs of Staff. He provides legal advice and

counsel to three Joint Staff Deputy Directorates and a Joint Staff Support Element.

He previously served as principal deputy to the Joint Force Judge Advocate,

United States Joint Forces Command, captain in the U.S. Navy’s Judge Advocate

General’s Corps and was Deputy Assistant Judge Advocate General of the Navy

for International and Operational Law. Daniel received the Defense Superior

Service Medal, the Bronze Star Medal, and various theater and campaign ribbons.

His Master of Law degree in international law is from Georgetown University Law

The New Reality of Business: The Lawyer’s Active Role

in the Transformation of the Corporation

Few of us will have a Microsoft client. However, in an era of rapid technological and

cultural change, many of us could assist the next Google. To realize such a rare

opportunity, you must understand the increasingly creative and entrepreneurial

strategies and language of business. Capture this unique chance to broaden your

skill set to win and serve clients in this changing world. Since 1981, more jobs have

been created — and more wealth generated in the developed world by emerging

new companies than was generated a century ago by all the Fortune 100 companies

combined. This session provides indispensable and practical insight into areas of

business that are critical to furthering your understanding and appreciation of

the needs of your important current and prospective clients.

Power and Influence for Lawyers: How to Use it to

Develop Business and Advance Your Career

Personal and professional success for lawyers, in the office, courtroom,

negotiations, and beyond, depends on much more than having a high level of legal

skill. Attaining success is more likely for lawyers who learn how to identify and

develop their personal power bases and use those bases to influence strategies to

reach goals, such as developing a book of business or finding your next job. This

program includes lectures, discussions and experiential exercises and is based on

the presenter’s book, “Power and Influence for Lawyers: How to Use it to Develop

Business and Advance Your Career.”

Facilitator: Susan Letterman White

Susan Letterman White helps lawyers learn

how to build better teams, hold better and more

productive business meetings, notice and seize

strategic opportunities, make decisions that lead

to results, improve conversations/relationships

with clients and colleagues, and improve business

performance. She practiced employment litigation

and counseling law for 20 years and was a managing

partner of a Philadelphia law firm before earning her Master of Science degree

in organization development from American University, where she is a faculty

member. Susan is the author of “Power and Influence for Lawyers: How to Use

it to Develop Business and Advance Your Career.” She is certified to administer,

interpret, and facilitate individual and group learning with the Myers Briggs Type

Indicator®, among other leadership development and conflict management

training programs.

Problems Solved!

Putting Your Personal Innovation Skills Into Practice

Defining and resolving problems is at the heart of our system of law. In this

dynamic and fun course, Lydia Quarles demonstrates the tools and then puts you

into a position to practice new skills to identify problems with people and situations

and make them go away. Learning problem-solving skills and practicing their

replication will help you resolve cases with more speed and better results. This

session will teach you how to assist clients in recognizing their legal problems; how

to be pro-active in discovery; how to develop a witness’s ability to deflect rather

than personalize; how to address the concerns of a tribunal; and how to fashion,

address and deflect personnel problems with your litigation team, office staff and

Whether you’ve spent years working in someone else’s firm or are fresh out of

law school, the temptation to start your own law firm is always there. But starting

your own firm also can be a big risk, particularly when you’re giving up a six-figure

salary – or delaying the payback of a six-figure degree to do it. The good news is that

it doesn’t take a lot of money, as long as you keep costs low but it will take a lot of

determination, discipline and courage. The Road to Independence starts with you.

Panelists: Franklin J. Hickman, Anne Meyers and Nathan Wills

Franklin J. Hickman is a shareholder in the law firm of Hickman & Lowder Co. L.P.A. He has focused his career on legal issues affecting persons with mental disabilities. He is on the faculty of the medical and law schools at Case Western Reserve University where he teaches law and psychiatry. He was named an Ohio Super Lawyer for 2012.

Anne Meyers founded her firm in 1995 and managed its growth through August, 2011. Few people will master communication, yet most lawyers believe that they have

done so by the time they reach middle school and their patterns of communication

never radically change. Lydia Quarles offers a reflective prescription for improving

your communication with clients, judges, juries and your own partners and

associates — the kind of tonic that will make a critical difference in the success

of your law practice. Whether you are writing, speaking, standing still, or flailing

about, the construction of your delivery is every bit as important as your content.

In this tip-packed course, Lydia will share teachable methods for getting your point

across. After this course, your next memo will be tighter, your next appearance

more emphatic, even your next conversation will lead to more understanding.

Join your colleagues, strengthen this critical skill and enhance your value as an

advocate and counselor.

Facilitator: Lydia Quarles

Lydia Quarles, a civil trial mediator, is a senior

policy analyst at the John C. Stennis Institute of

This workshop lays out the breakthroughs in brain science. We have learned that

people’s decision-making process is more intuitive and sensory-emotive than

conscious and rational. Emotions aren’t just “noise.” Each emotion has its own

meaning, including the fact that trust is the opposite of contempt. Moreover, an

individual’s personality traits are revealed through how they most typically emote.

This session will discuss how law firms can best use facial coding, the most

accurate, non-invasive means of identifying people’s emotional response, to best

market itself. Discussed will be the use of facial coding to understand opposing

witnesses and one’s own, how to read the receptivity of jury members and judges,

and how oneself and opposing counsel come across in terms of emotive styles and

personality traits in order to be more persuasive.

Facilitator: Dan Hill

Dan Hill is an authority on the role of emotions in

consumer and employee behavior with more than

a decade of experience operating his scientific,

emotional insights consultancy: Sensory Logic,

Inc. One of the company’s unique research tools

is facial coding. A frequent speaker at business

conferences and seminars from coast to coast, as

well as in Europe and Asia, Dan’s blue-chip clients

have included Target, Toyota, Reebok, Whirlpool, American Express, Capital One,

Hershey, Lego, Nokia, and GlaxoSmithKline, among dozens of other major brands.

Dan’s books include “Body of Truth: Leveraging What Consumers Can’t or Won’t

Say” and “Emotionomics: Leveraging Emotions for Business Success”, which was

chosen by Ad Age as one of “10 Books You Should Have Read in 2009.” Dan’s latest

This program is carefully designed to help you get the most out of your cases and

your practice. Legal reasoning is applied logic. While your logical intuitions may well

be strong enough to generally permit smooth navigation through webs of complex

legal arguments without error, unfamiliarity with logic and argument limits your

analytical oversight, making you vulnerable to committing or overlooking mistakes

of reasoning that can affect the outcome of cases. Professor Douglas Lind

recognizes that you have precious little time to study logic as an independent

subject. This course provides short and concise descriptions of argument forms

and logical fallacies (errors of reasoning) most relevant to legal practice.

Facilitator: Douglas Lind

Douglas Lind is an attorney, professor of

philosophy, and a phenomenal CLE leader.

In addition to his work with The Professional

Education Group, Douglas is a faculty member at

the National Judicial College and has contributed

to the CLE efforts of bar associations, law firms

and government entities across the nation. He

teaches courses in the philosophy of law, ethical

theory, and logic at The University of Idaho. He also has served on the faculties

of the University of Pennsylvania, Temple University Law School and Villanova

University. He is the author of “Logic and Legal Reasoning” and his articles are

published in legal journals both in the U.S. and internationally. He practiced in the

Office of the Attorney General of Missouri and in private practice in Philadelphia,

specializing in environmental law, toxic torts and American Indian Law. He earned

You can’t turn around these days without seeing or hearing something related

to social media. Everyone seems to have a Facebook page or a Twitter handle

or a blog. But what about lawyers? Some lawyers refuse to participate in social

media, rejecting it as a non-professional pursuit, while others have tried to

use social media but have concluded that it doesn’t do anything for them.

Still others would like to use social media but don’t know where to start. This

program will provide an overview of the ways lawyers can use social media to

build their practices. We’ll show you how lawyers can maximize the impact

of their presence on social media platforms and provide specific examples of

both productive and unproductive use of each of the major social media tools.

Facilitators: Ross Fishman and Allison C. Shields

Ross Fishman is “one of the country’s leading experts on law firm marketing,” according to Lawyers Weekly. Virtual law practices allow lawyers to more efficiently and responsively serve their

clients. They can also help lawyers achieve greater professional satisfaction and

financial success than some have found in more traditional practices.

Most lawyers and firms will adopt some form of a virtual concept in the coming

years, whether it is a full virtual platform, outsourcing work, or providing unbundled

legal services. The key for lawyers is to learn what will be best for their practice and

to serve their client base.

Facilitators: Chad E. Burton and Lisa Solomon

Chad E. Burton started his legal career in the big

law firm world before he created a solo practice.

His interest in technology and law practice

management sparked the concept of Burton Law,

a virtual law firm model which is growing beyond its

Ohio roots. Chad regularly speaks on topics such

as practice management, iPads for lawyers, social

media and virtual law issues.

Lisa Solomon is the author of many published

articles about appellate practice and procedure,

and has also written extensively about the field of

contract lawyering. A nationally-known speaker,

she frequently presents continuing legal education

courses about legal writing and contract lawyering.

Her innovative law practice has been featured in

wide, varied, effective and affordable. The ability to combine digital dictation with

speech recognition has wide appeal to all lawyers – whether working at your desk

Faceoff: Blogs, Websites, Facebook, Google+, LinkedIn,

Twitter – Where to Start; Where to Focus

Social media is “all the buzz,” with an equal amount of information and

misinformation regarding how lawyers and firms can benefit. Sure, the early-

adopters dove in, but what are realistic expectations for a “normal, busy” lawyer?

How much time should you spend on social media to achieve the desired results?

Should law firms use Facebook? How do blogs differ from websites and do law

firms need both? Do LinkedIn recommendations help attract clients

or ethics complaints? This fast-paced, entertaining, and interactive session

answers these questions and more. Attendees will leave with a social media

plan of action to achieve their goals.

The bio or “about” page is one of the most viewed pages on a lawyer’s website.

On social media, the bio or profile helps new connections or potential followers

make decisions about whether or not to interact with you. Your “elevator speech”

is your spoken bio and it can make or break a new relationship with a potential

client or referral source. But despite its importance, the bio is an often overlooked

marketing tool and many lawyers give it short shrift. In this session, you’ll learn

the elements of a good bio and how to tailor that bio to the particular platform,

whether it is your website, a social media profile, or your spoken introduction.

Learn the common mistakes lawyers make when creating their bio and how you

can avoid them.

DAY 3 - 4/26/12 2:15 - 4 P.M.

Managing Change and Adoption of Technologies

Ray Kurzweil stated, “An analysis of the history of technology shows that

technological change is exponential, contrary to the common-sense ‘intuitive

linear’ view. So we won’t experience 100 years of progress in the 21st century—it

will be more like 20,000 years of progress (at today’s rate).” Accordingly managing

change in a law office will be a major issue facing all lawyers in the near future. We

will examine strategies for adapting how you now practice law to take maximum

advantage of imaging technology. We will also propose best practices in moving

your practice from an analogue (paper) orientation to a digital one.

Facilitators: Dave J. Bilinsky and Joseph L. Kashi

David J. Bilinsky is a practice management consultant and lawyer for the Law Society of British Columbia, and is an adjunct professor at Simon Fraser University teaching an online graduate-level course in the Applied Legal Studies program. of law in innovative ways that provide service excellence. He writes regularly for publications in the USA and Canada including being a core contributor to the award-winning blog www.slaw.ca and his own blog, www.thoughtfullaw.com.
