I. PROJECT BACKGROUND The Technical Vocational Education and Training Sector Development Program (current Project) was approved by the Asian Development Bank’s (ADB) Board of Directors on 26 September 2014, in the amount of Special Drawing Rights (SDR) 19,428,000 (USD 30 million equivalent), and comprised of a policy-based loan (USD 7 million equivalent) and a project loan (USD 23 million equivalent). The current project became effective on 09 January 2015. The Agence Française de Développement (AFD) had expressed interest in providing co-financing to the current project during the preparation stage, but the scope and administration of AFD co-financing was not finalized by the time of ADB’s loan approval. Subsequently, on 17 June 2015, the AFD Board of Directors approved additional co-financing to the current Project through a loan of USD 15 million equivalent to the Royal Government of Cambodia (RGC), to be administered by ADB. The overall Technical Vocational Education and Training Sector Development Program (the Project), which includes the current project and the proposed additional co-financing, will support RGC to address equity and quality issues facing the technical vocational education and training (TVET) system through: (i) increased access to TVET programs, particularly for women and the poor; (ii) improved quality and relevance of the TVET system; and (iii) strengthened governance and management of TVET delivery. The Project supports RGC’s commitment to the development of high-quality, skilled and capable human resources in order to meet the immediate and long-term needs of economic growth and socio-economic development. Impact

The impact of the Project will be increased employment of TVET certified workers. The outcome of the Project will be an accessible, demand-driven TVET system responsive to continuing and emerging labor market demands. While the Project’s impact and outcome statements will remain unaffected, the additional co-financing will benefit additional number of youth, including more vulnerable youth and females, in Cambodia. II. RESETTLEMENT CATEGORIZATION

2.2. ADB's classification system Prior to civil works implementation, all regional and provincial training centres have been screened and classified, using ADB's classification system as follows:

! Category A: A proposed subproject is likely to have significant involuntary resettlement impacts, 200 or more persons will be physically displaced from home, 200 or more persons lose 10% or more of their productive or income generating assets, or 200 or more persons experience a combination of both.

! Category B: A proposed subproject includes involuntary resettlement impacts that are not deemed significant.

! Category C: A proposed subproject has no involuntary resettlement impact.

2.3. Subprojects category and progress The workshop buildings, woman dormitory buildings, new buildings or classrooms and upgrading buildings have been built and upgrading in their existing campus in according with the procurement process/plan. The buildings have been constructed on the existing campus and no land acquisition is expected. There is no involuntary resettlement. Thorough assessment also indicated that no indigenous people are residing within institutions campus and its vicinity. By using ADB's Classification System, the subprojects are classified under category C, it does not require Resettlement Action Plan but just Resettlement Categorization Reports that ready prepared to attach to bidding documents for civil work implementations. During this first semi-annual monitoring report, there have been nine (9) workshop buildings are implementing civil work including Kandal, Kampong Speu, the Poly Technic Institute of Preah Sihanouk, Pursat, Battambang Institute of Technology (BIT), Banteay

Meanchey, National Poly Technic Institute of Angkor (NPIA) in Siem Reap, Kampong Thom and Kampong Cham PTCs.

III. GRIEVANCE REDRESS MECHANISM A grievance redress mechanism (GRM) will be established to receive and facilitates the resolution of complainants, and grievances on the implementation of the project/subproject. The GRM will comply with the requirements of the ADB SPS (2009) and will aim to provide a time-bound and transparent mechanism to voice and resolve social and environmental concerns linked to the project/subproject.

As a general policy, the implementing agency will work proactively toward preventing grievances through the implementation of impact mitigation measures to the anticipated impacts and address potential issues before they become grievances. Also, information of the GRM should be included in the public information campaign of the project/subproject.

3.1. CommunicationChannelThe DGTVET, implementing agency of the project/subproject will provide a number of formal and informal channels through which comments and/or complaints on the construction activities can be received. These include:

On-site contacts: A notice board will be posted at each site with the name and contact details of the contractor, site engineer and TVET institutions director. These notice boards will be placed in a visible area known to the public and should be presented in the local language (Khmer).

3.2. TypeofGrievancesAny complainant will be able to submit a grievance with DGTVET or through local authority or the provincial training center if they believe that activities connected to the implementation of the project/subproject, specifically during the construction phase, is resulting to serious impact on the community, the environmental, or on the quality of life. Grievances could include:

Negative impacts on a person or a community (i.e. noise pollution, dust emissions, disruption of classes) Damage on private properties including land, tree or other building dangers to health and safety or to the environment.

Damage to infrastructure such as road degradation: Failure to comply with standards or legal obligations, Harassment of any nature and improper conduct or unethical behavior, Threat to the peace and security in the public TVET institutions and local community.

3.3. GrievanceResolutionProcessComplainants during the construction phases. The following steps outlined the procedures on receiving and facilitating the resolution of:

- 1st Level Grievance: Field-Level Resolution. In case of grievances that are immediate and urgent in the perception of the complainant, the contractor and/or site engineer will provide the most easily accessible or first level contact for quick resolution of grievances. A meeting may be held among the AP, Contractor, officials or community relation officer of PTC, commune/Sangkat council chief to discuss the whereabouts of the complaint. Immediate remedial action on the AP is expected from the contractor. The resolution of the complaint should be done within one week.

- 2nd Level Grievance: If no understanding or amicable solution can be reached within seven days from filing the complaint, the AP can elevate the complaint to the public or community relations officer of the Department of TVET Management. The Department of TVET Management is under the Directorate General of TVET, which is directly responsible for the operation and maintenance of public TVET institutions. Resolution of the complaints should be

done within 15 days.

- 3rd Level Grievance: If no understanding or amicable solution can be reached within fifteen days from filing the complaint, the AP can elevate the complaint to the Project/subproject.

Coordination Unit (PCU) safeguards officer. The PCU in consultation with appointed officers/specialists will resolve the complaints within 30 days.

- Judicial Process and ADB Accountability Mechanism. Despite the project GRM, an aggrieved person shall have access to the country's legal system at any stage, and accessing the country's legal system can run parallel to accessing the GRM and is not dependent on the negative outcome of the GRM. In the event that the established GRM is not in a position to resolve the issue, the affected person also can use the ADB Accountability Mechanism (AM) through directly contacting (in writing) the Complaint Receiving Officer (CRO) at ADB headquarters or the ADB Cambodia Resident Mission (CARM). The complaint can be submitted in any of the official languages of ADB’s developing member countries. The ADB Accountability Mechanism provides a forum where people adversely affected by ADB-assisted projects can raise issues and seek solutions to their problems and report alleged noncompliance of ADB’s operational policies and procedures. It consists of two separate but complimentary functions: consultation phase and compliance review phase.

3.4. DocumentationofGRMAt any stage of the GRM, the contractors and the assigned secretary of the GRC and PCU should document all complaints recorded including the contact details of the complainant, date of filing the grievance, nature of grievance, minutes of meeting, agreed corrective action or resolution and signed statement of resolution or satisfaction from the complainant.

The number of grievances recorded and resolved and the outcomes will be disclosed in the office of the project implementation unit, TVET institutions, as well as reported in the monitoring reports submitted to ADB during the construction and operation of the Project/subproject.

Periodic review and documentation of lessons learned

The PIU designated safeguards focal person or community relations officer will periodically review the functioning of the GRM and record information on the effectiveness of the mechanism, especially on the project’s ability to prevent and address grievances.

3.5. CostsThe executing agency will be responsible for all administrative fees and legal fees that will be incurred in the resolution of grievances if the APs win their case.

3.6. GrievanceFollow-upDGTVET or MLVT may contact the complainant at a later stage to ensure that the activities continue to pose no further problems. If issues were not completely resolved, new complaints will be treated as new grievance and re-enter the GRM process.

So far, there is no complaint yet regarding social safeguards and environmental safeguards.

IV. METHODOLOGY The methodologies used in these periods are the following:

• Review of technical drawing, master plan, and location plan and other related documents to Project/subprojects of building constructions.

4.2. Meetingsandconsultations• Safeguards consultant together with Ministry/project involved staff had conducted

field visits to the subproject site/PTCs, meeting and discussions with primary stakeholder institutions and conducting screening checklists both social and environmental.

Safeguards consultant together with Ministry/project involved staff frequently conducted field visits to each subproject site before and during construction. During each field visit particular attention was paid to environmental aspects such EMP, environmental monitoring checklists, regardless resettlement issue during civil work implementation due to it is as category C:

4.3. On-jobtraining/capacitybuildingtoinvolvedofficers,andsiteengineers The capacity building/on-job training to involved officers of TVETSDP, site engineers on 27 April 2017 about social safeguards and environmental monitoring checklist, the trainees understand social and environmental safeguards and especially checklists in order to apply during civil work implementation and collection the completed forms for quarterly and/or semi-annual reports. Most trainees requested to have refresher training to their involved officers or new site engineers recruitment- so the safeguards training should be scheduled every six months periods.

V. PROJECT LOCATION The Master plans of each Institution has been designed in according with procurement plan such as workshop buildings, woman dormitory buildings, new classrooms, and the following is the master plans have been designed with (detailed building implantations) included the following: Kandal PTC, Kampong Speu PTC, Poly Technic Institute of Preah Sihanouk, Pursat PTC, Battambang Institute of Technology, Banteay Meanchey PTC, National Poly Technic Institute of Angkor/Siem Reap, Kampong Thom PTC and Kampong Cham PTC.

VI. ENVIRONMENTAL MONITORING RESULTS

6.1. Pre-construction Stage:

Non-compliance of the technical design to applicable national and international guidelines: Planning principles and design considerations will be reviewed and will be consistent with the Master Plan of the TVET institutions:

The final technical design of the workshops, woman dormitory, additional building and rehabilitation activities should take into consideration the following: (i) follow the suggested guidelines on building school facilities; (ii) construction of sanitation facilities should not be located near source of drinking water (at least 30 meters from the source of drinking water) and consistent with applicable national and international guidelines (i.e. World Health Organization’s Water, Sanitation and Hygiene Standards for Schools in Low-cost Settings); and (iii) follow applicable rules and regulations on structural integrity of building structures.

6.2. Construction Stage: During construction stage, the contractors have been responsible for site management including site enclosure/fencing, campsites and pollution from human waste, providing first-aid kids, occupational health and safety plan, safe water for drinking and cooking, reasonable water and sanitation. Contractors implemented the EMPs strictly, oversight by site engineers included monthly environmental monitoring checklist.

o Permits or agreement for obtaining the campsite installation and construction waste disposal within institutions’ campus:

The awarded contractors usually have informed the public TVET institutions’

director/management in order to introduce about her/his firm to undertake the construction workshop building in the institution, includes showing the master plan of institution and showing the detailed designs of the workshop building, the contractors have requested the institution directors/management to obtain the permission to install the campsite within the institution, rubbish bins have been provided by contractor/firm to dispose the solid waste from kitchen and the construction waste (usually less, just only cement bags and some plastic materials). Most institutions used the system of dumping and burning solid waste within their institutions; few institutions used the system of solid waste collection by municipality/private companies. The construction of workshop building could not generate much of solid waste; the workshop building is small, normally it is concrete and masonry works within enclosure of building site or nylon net fencing.

o Management of construction sites: After getting the permission from institutions’ director/management for installation of campsite, the contractor starts installation the common camps and warehouses, making from timbers, woods, planks, bamboo and covering by tarpaulin or similar materials, this is just temporary shelter for construction workers in short period of times (please see in the annex-3). At the same time, if the public TVET institutions did not have the toilet (water and sanitation) such as Siem Reap and Kampong Cham, immediately the contractor is building the toilet to ensure their construction workers are comfortable. And other sites used the existing toilet within the institutions (requested permission from directors). Due to this is just small workshop building, the heavy equipment or plants did not use, they used only common vibrators, cement mixtures, while storage for fuel, oil and construction materials are negligible, including the trucks for transportation of construction materials. Workshop building could not generate much of water pollution, it is negligible, and due to sewerage system is connected to municipality sewerage system and no spillage of oil and other lubricants.

The contractor is implementing of works at the established time (e.g. work during daytime 06.00 to 18.00, lunch time from 11:30 to 14:00). Installation of necessary construction signs in construction sites includes nylon net fencing surround workshop building to prevent children and/or animal enters into the site camp.

o Community and Security The contractor/workers need to be aware of and all sites have been applied the following general rules: (i) No alcohol/drugs on-site; (ii) Prevent excessive noise; (iii) No illegal activities such as, but not limited to gambling, and hunting farm

animals in the area; (iv) Trespassing on private/ commercial properties adjoining the site is forbidden; (v) No littering in the public TVET institutions; and (vi) Workers are not allowed to be loitering in the TVET institutions especially when

there are trainings or classes in adjacent building.

o Ready construction site:

- Restoration of the area of construction sites and camps when the building construction works are completed.

- Replanting/planting of finished work areas (cut one tree replanting two trees if any).

o Employment (unskilled labors) All the women unskilled each site said that they are happy to work with construction of workshop building because construction site nearby house and some light work such as reinforcement. Some women unskilled followed their husband as site manager, then they have been appointed as cook, and/or cleaner. The women are given the opportunity to work in the construction of workshop building for jobs that are suitable to them. The payment between unskilled men and women are slight different, it would say that, the unskilled men got $6 per worked day, while women got $5.5 per worked day, however, unskilled women are willing to obtain less then men because women worked as light works then men works. There is no child labor has been employed by contractor at site, during field investigations (1-5 August 2017), it is observed that there is few children at campsites followed their parents due to those children have their terms break/holiday, they will be back home for commencement of next terms academic year.

o Occupational Health and Safety Construction activities may cause harm and danger to the lives and welfare of workers. The contractor should prepare occupational health and safety plan (OHSP), which will be part of the contractor’s contract documents. The occupational safety plan should have provisions on:

(i) Providing personal protective equipment (PPE) like hard hats, safety gloves, ear mufflers to all workers;

(ii) Providing occupational health and safety training to all workers (i.e. first aid measures, prevention of malaria, diarrhea, HIV/AIDS);

(iii) Documenting safety procedures to be followed for all construction site activities;

(iv) Maintaining records of accident and the corrective actions implemented; and (v) Emergency response plan during fire, earthquake and other incidents. Provision of

first-aid facilities for the workers and at least one safety and health officer should be assigned in the construction area.

(vi) Provide adequate portable or permanent sanitation facilities serving all workers. (vii) Provide sufficient, safe, and easily accessible drinking water stations in the Program

area. The following photos indicated the first-aid kids provided by contractors.

VII.CONCLUSIONSANDRECOMMENDATIONS There is no major issue for the construction of workshop building during this semi-annual safeguards monitoring report.

o The contractors managed the environmental safeguards issues, however it

needs to further improvement and regular monitoring and oversight by site engineer consultants (employed by EA/Ministry).

o The negative environmental impact during construction phase is short term and minor. The significant impacts included dust control from civil works implementation, materials transportation, human waste, and solid waste generation from construction campsite, work safety and health, pollution from fuels and used engine oil. But, those impacts are minimized by strictly implementation of mitigation measure of IEE, and EMP and through regular monitoring.

o Environmental Management System has been established for the subprojects

and for each Contract Package. The Contractors and site engineers have cooperated in environmental management plan and monthly environmental monitoring checklist.

o Specific activities to minimize environmental impacts during construction have

been done by the Contractors.

o The monitoring results showed that the impacts of construction activities to the ambient air, noise, vibration and water are negligible.
