    Synopsis of Federal RegulationsApplicable to Migratory Bird Hunting

    Federal regulations regarding bird hunting are described inthe Code o Federal Regulations (CFR). These can be ound at www.gpoaccess.gov/c r/index.html. The regulations below can be ound at 50 CFR 20.21 unless otherwise noted. An electronic version o these regulations can be ound by downloading this booklet as a PDF at www.azg d.gov/rules.

    WEAPON Migratory game birds may be taken only with a10 gauge or smaller shotgun capable o holding not more thanthree shells unless it is plugged with a one-piece fller, inca-pable o removal without disassembling the gun, so the gunstotal capacity does not exceed three shells. Birds may also betaken by alconry, bow and arrow, or crossbow.

    MOTOR-VEHICLE RESTRICTIONS No person may take mi-gratory game birds rom or by means, aid, or use o any motor vehicle, motor-driven land conveyance, or aircra t o any kind.Special regulations govern handicapped hunters.

    WATERCRAFT RESTRICTIONS Migratory game birds maynot be taken rom or by means o any watercra t or other cra thaving a motor attached, or any sailboat, unless the motorhas been completely shut o and/or the sails urled, and itsprogress there rom has ceased. A watercra t under power maybe used to retrieve dead or crippled birds but no shooting ispermitted while the watercra t is underway. No person shalltake migratory game birds by means or aid o any motor drivenland, water, or air conveyance, or any sailboat used or thepurpose o or resulting in the concentrating, driving, rallying, orstirring up o any migratory bird.

    DECOYS, CALLS AND BAITING Migratory game birds maynot be taken by the use or aid o live decoys, recorded orelectronically amplifed bird calls or recorded or electricallyamplifed imitations o bird calls or sounds. It is illegal to takebirds by the aid o baiting, or on or over any baited area, wherea person knows or reasonably should know that the area is orhas been baited. An area is considered baited or 10 days a terthe complete removal o all bait. It is legal to take migratorygame birds, except water owl, coots and cranes, on or overlands or areas that are not otherwise baited areas, and wheregrain or other eed has been distributed or scattered solely asthe result o manipulation o an agricultural crop or other eedon the land where grown, or solely as the result o a normalagricultural operation.

    RETRIEVAL AND TAGGING No person shall kill or crippleany migratory game bird without making a reasonable e ort

    to retrieve the bird and retain it in his actual custody while inthe feld. Crippled birds must be killed immediately. Any birdsgiven to or le t with another person must be tagged by thehunter with a tag showing his signature, address, the numberand species o birds, and the dates they were killed. Pack-ages in which migratory game birds are shipped must showthe names and addresses o the sender and receiver, and thenumber and species o birds contained in the parcel. (50 CFR20.25, 20.36, 20.44)

    BAG LIMIT No person may, during any one day, take morethan one daily bag limit or possess more than one daily baglimit in the feld, or while returning to the car, hunting camp orhome. (50 CFR 20.24, 20.35)

    IMPORTATION For in ormation regarding the importationo migratory game birds killed in another country, huntersshould consult ederal regulations. One ully eathered wingmust remain attached to all migratory game birds being trans-ported between the port o entry and the hunters home or toa migratory bird preservation acility. No person shall importany migratory game birds rom any country except Canadaunless such birds are dressed, drawn and the head and eetare removed. Special regulations govern consignment to anapproved and licensed taxidermist. No person shall importmigratory game birds belonging to another person. (50 CFR20.61 through 20.66)

    SEASON AND HOURS No person may take migratory gamebirds during the closed season. Migratory game birds may betaken only during hours open to hunting. (50 CFR 20.22, 20.23)

    ONE FEATHERED WING Sportsmen should note that oneeathered wing (or head or sandhill crane only) must be le t

    attached to all migratory game birds until they reach their fnaldestination.

    NON-TOxIC SHOT No person may take ducks, geese(including brant), or coots while possessing shot (either in shot-shells or as loose shot or muzzleloading) other than approvednon-toxic shot. For a list o approved non-toxic shot, see www.

    Monuments and military areas

    The Grand Canyon-Parashant, Vermilion Cli s, Sonoran Desert ,Ironwood Forest, and Agua Fria National Monuments are opento hunting. Camp Navajo in Unit 6B is open to hunting only toproperly licensed members o the Arizona National Guard andCamp Navajo civilian personnel holding a valid Camp Navajohunting permit. Season dates and regulations must be obtained

    rom the Arizona National Guard. The Fort Huachuca Army Gar-

    rison in Unit 35A is open to hunting only to properly licensedmilitary and Fort Huachuca civilian personnel holding a validFort Huachuca post hunting permit. Season dates and specialregulations must be obtained rom Fort Huachuca.

    The Florence Military Reservation (training areas B and D: theareas north and south o Cottonwood Canyon Road) in Unit37B is subject to short term closures due to military opera-tions, including live fre operations, and requires coordination with the Florence Military Reservation or hunting access. Forspecifc closure dates or any other access concerns, contact theFlorence Military Reservation at 602-267-2062. A map o the

    Waterfowl Hunters Arizona BaldEagles Need Your Help

    Annually on Dec. 1, 22 closures are enacted statewide to pro-tect breeding bald eagles. These closures restrict human activity within the nest area so the resident bald eagles will have theopportunity to success ully breed. We are asking or your assis-tance to avoid bald eagle breeding areas while you are hunting water owl, as your presence and the noise rom discharging

    your frearm may cause a disturbance to the breeding pair. Thebald eagles are laying eggs during the later part o the water-

    owl season and are very sensitive to human activity.

    The bald eagle is protected by the Bald and Golden EagleProtection Act, the Migratory Bird Treaty Act and various otherstate and ederal laws.

    ducks and geese. This stamp or priv ilege will automatically register the holder or theederal Harvest In ormation Program or the

    taking o ducks and geese. Persons 16 years

    o age and older must have in their posses-sion a valid Arizona Migratory Bird Stampor privilege when taking coots and commonmoorhens pursuant to A.R.S. 17-333.03 andR12-4-203.

    5. Hunting is not permitted in Unit 26M in theollowing described area: those private lands

    lying just north o the Town o Cave Creek inSections 10, 11, 12, 14, and 15 o Township 6North, Range 3 East.

    What terms do I need to understand?

    Migratory Birdsare birds protected by ederal law as a result o

    treaties signed with other countries. Protected migratory birds arelisted in Title 50 Code o Federal Regulations, Section. 10.13. Thislist includes almost all birds ound in the United States with theexception o the house sparrow, eral pigeon (commonly calledrock dove), European starling, Eurasian collared-dove, mute swan,and upland game birds (which are protected by state laws).

    All migratory birds are protected. However, a subset o migratorybirds classi ed as migratory game birds and may be hunted inaccordance with State and Federal regulations. The list o mi-gratory game birds includes species o ducks, geese (including

    brant), swans, doves and pigeons, cranes, rails, coots, gallinulesand moorhens, woodcock and snipe, i there is an open season.

    Daily baglimit means the maximum number o migratory gamebirds o a single species or combination (aggregate) o speciespermitted to be taken by one person in any one day during theopen season in any one speci ed geographic area or which adaily bag limit is prescribed.

    Aggregate daily bag limit means the maximum number omigratory game birds permitted to be taken by one person inany one day during the open season when such person hunts inmore than one speci ed geographic area and/or or more thanone species or which a combined daily bag limit is prescribed.The aggregate daily bag limit is equal to, but shall not exceed, thelargest daily bag limit prescribed or any one species or or anyone speci ed geographic area in which taking occurs.

    Possession limitmeans the maximum number o migratory gamebirds o a single species or a combination o species permittedto be possessed by any one person when law ully taken in theUnited States in any one speci ed geographic area or which apossession limit is prescribed.

    Aggregate possession limit means the maximum number omigratory game birds o a single species or combination o spe-cies taken in the United States permitted to be possessed by anyone person when taking and possession occurs in more thanone speci ed geographic area or which a possession limit is

    prescribed. The aggregate possession limit is equal to, but shallnot exceed, the largest possession limit prescribed or any oneo the species or speci ed geographic areas in which taking andpossession occurs.

    Personal abode means ones principal or ordinary home ordwelling place, as distinguished rom ones temporary or transientplace o abode or dwelling such as a hunting club, or any clubhouse, cabin, tent or trailer house used as a hunting club, or anyhotel, motel or rooming house used during a hunting, pleasureor business trip.

    Migratory bird preservation acilitymeans:

    (1) Any person who, at their residence or place o business andor hire or other consideration; or

    (2) Any taxidermist, cold-storage acility or locker plant whichor hire or other consideration; or

    (3) Any hunting club which, in the normal course o operations;receives, possesses, or has in custody any migratory gamebirds belonging to another person or purposes o picking,cleaning, reezing, processing, storage or shipment.

    Normal agricultural planting, harvesting, or post-harvest

    manipulation means a planting or harvesting undertaken orthe purpose o producing and gathering a crop, or manipula-tion a ter such harvest and removal o grain, that is conductedin accordance with o cial recommendations o State ExtensioSpecialists o the Cooperative Extension Service o the U.S. Depament o Agriculture.

    Normal agricultural operation means a normal agricultural plant-ing, harvesting, post-harvest manipulation, or agricultural practicethat is conducted in accordance with o cial recommendations oState Extension Specialists o the Cooperative Extension Servio the U.S. Department o Agriculture.

    Normal soil stabilization practice means a planting or ag-ricultural soil erosion control or post-mining land reclamationconducted in accordance with o cial recommendations o StatExtension Specialists o the Cooperative Extension Service o tU.S. Department o Agriculture or agricultural soil erosion contr

    The ollowing is a synopsis o Federal Regulations that pertain to the hunting o migratory game birds. Persons requiring more in ormation should go to: www.access.gpo/nara/c r/. Were they will fnd a complete version o 50 CFR Part 20. When State law is di erent rom the ollowing Federal

    law the hunter must comply with the most restrictive law.

    Baited area means any area on which salt, grain, or other eedhas been placed, exposed, deposited, distributed, or scattered, ithat salt, grain, or other eed could serve as a lure or attraction

    or migratory game birds to, on, or over areas where huntersare attempting to take them. Any such area will remain a baitedarea or ten days ollowing the complete removal o all such salt,grain, or other eed.

    Baitingmeans the direct or indirect placing, exposing, depositing,

    distributing, or scattering o salt, grain, or other eed that couldserve as a lure or attraction or migratory game birds to, on, orover any areas where hunters are attempting to take them.

    Manipulation means the alteration o natural vegetation oragricultural crops by activities that include but are not limited tomowing, shredding, discing, rolling, chopping, trampling, fattening,burning, or herbicide treatments. The term manipulation does notinclude the distributing or scattering o grain, seed, or other eeda ter removal rom or storage on the eld where grown.

    Natural vegetation means any non-agricultural, native, or natu-ralized plant species that grows at a site in response to plantingor rom existing seeds or other propagules. The term natural vegetation does not include planted millet. However, plantedmillet that grows on its own in subsequent years a ter the yearo planting is considered natural vegetation.

    What hunting methods are illegal?

    No persons shall take migratory game birds:

    With a trap, snare, net, ri e, pistol, swivel gun, shotgun largerthan 10 gauge, punt gun, battery gun, machinegun, sh hook,poison, drug, explosive, or stupe ying substance;

    With a shotgun of any description capable of holding morethan three shells, unless it is plugged with a one-piece ller,incapable o removal without disassembling the gun, so itstotal capacity does not exceed three shells.

    From or by means, aid, or use of a sinkbox or any other typeo low foating device, having a depression a ording the huntera means o concealment beneath the sur ace o the water;

    From or by means, aid, or use of any motor vehicle, motor-driven land conveyance, or aircra t o any kind, except thatparaplegics and persons missing one or both legs may take

    rom any stationary motor vehicle or stationary motor-drivenland conveyance;

    From or by means of any motorboat or other craft hmotor attached, or any sailboat, unless the motor has beencompletely shut o and/or the sails urled, and its progresthere rom has ceased;

    By the use or aid of live birds as decoys; although nto, it shall be a violation o this paragraph or any person totake migratory water owl on an area where tame or captivelive ducks or geese are present unless such birds are and have

    been or a period o 10 consecutive days prior to such takingcon ned within an enclosure which substantially reduces theaudibility o their calls and totally conceals such birds romthe sight o wild migratory water owl;

    By the use or aid of recorded or electrically ampli edor sounds, or recorded or electrically ampli ed imitations obird calls or sounds.

    By means or aid of any motor driven land, water, or- veyance, or any sailboat used or the purpose o or resultingin the concentrating, driving, rallying, or stirring up o anymigratory bird;

    By the aid of baiting, or on or over any baited areaperson knows or reasonably should know that the area is orhas been baited.

    It is legal to take migratory game birds including water-owl, coots, and cranes, on or over the ollowing lands or

    areas that are not otherwise baited areas:

    Standing crops or ooded standing crops (including aqu

    Standing, ooded, or manipulated natural vegetation; oharvested croplands; or lands or areas where seeds or grainshave been scattered solely as the result o a normal agriculturalplanting, harvesting, post-harvest manipulation or normal soilstabilization practice;

    From a blind or other place of concealment camou agnatural vegetation;

    From a blind or other place of concealment camou ag vegetation rom agricultural crops, as long as such camoufag-

    ing does not result in the exposing, depositing, distributing orscattering o grain or other eed; or

    Standing or ooded standing agricultural crops where ginadvertently scattered solely as a result o a hunter enteringor exiting a hunting area, placing decoys, or retrieving downedbirds.
