    NOTICE OFAUCTION AND SALE OF SURPLUS REAL PROPERTY NOT NEEDEDFOR PUBLIC USE LOCATED IN EWING TOWNSHIP, MERCER COUNTY, NEWJERSEY

    PLEASE TAKE NOTICE that the following properties owned by the Township of

    Ewing by have been deemed not needed for public purposes and shall be sold at public auction.The public auction of the property shall be held by the Business Administrator or his designee atthe Council Chambers, Ewing Township Municipal Building, 2 Jake Garzio Drive, Ewing, NewJersey, on August 3, 2010 at 10:00 a.m.

    A. 170 Somerset Street, Block 182, Lot 169 containing an existing residential structureB. 20 Trent Street, Block 1, Lot 13 containing an existing residential structureC. 1009 Southard Street, Block 6, Lot 15 containing an existing residential structureD. 65 Troy Avenue, Block 35, Lots 522, 523 & 524 to be consolidated to create one

    building lot (IP-3 Zone)E. Orchard Street, Block 254, Lots 21 & 22 to be consolidated to create one

    building lot (R-2 Zone)F. Rose Street, Block 245, Lots 33, 34, 35 & 36 to be consolidated to create onebuilding lot (R-2 Zone)

    G. 30 Broad Avenue, Block 257, Lots 8, 9, 10 & 11 to be consolidated to create onebuilding lot (R-2 Zone)

    H. 58 New Hillcrest Avenue, Block 74, Lots 53 & 54 to be consolidated to create onebuilding lot (R-2 Zone)

    I. Orchard Street, Block 254, Lots 14, 25, 26, 27, 28, 29 & 30 to be consolidated tocreate one building lot (R-2 Zone),

    J. 1000 Pennington Road, Block 61, Lot 8, and

    PLEASE TAKE FURTHER NOTICE that the sale shall be subject to the followingterms and conditions;

    a. The public auction of the property shall be held by the Business Administrator orhis designee at the Council Chambers, Ewing Township Municipal Building, 2 Jake GarzioDrive, Ewing, New Jersey, on August 3, 2010 at 10:00 a.m.

    b. Bids shall be received for each property starting at $25,000.00 with the exceptionof 1000 Pennington Road for which the minimum bid shall be $1.00.

    c. Upon the close of bidding for each property, the highest qualified bidder, shallsubmit cash or certified check in the amount of 10% of the bid and shall immediately execute anoffer to purchase at its bid price, which offer shall include the terms and conditions specifiedherein. Said offer shall be irrevocable for sixty (60) days from the date of the public sale.

    d. All bids shall be subject to the review and approval of the Township Councilprovided that Township Council reserves the right to accept the highest offer or reject any and allbids including the highest bid for each respective property.

    e. Conveyance of the title shall be by Quitclaim Deed, subject to the provisions of N.J.S.A. 40A:12-13 and the bidder must be prepared to close title within 60 days from the dateof acceptance of the bid. The Township reserves the right to extend this 60 day time frame asnecessary.

    f. At closing of title, bidder shall submit payment in the form of cash, bank check orcertified check for the balance of the purchase price. The successful bidder shall be responsiblefor the recording of the Deed.

    g. In the event the bidder should fail to close title in accordance with its obligationsthe initial ten (10%) percent deposit shall be forfeited as liquidated damages.

    h. The property shall be conveyed subject to restrictions and easements of record,such facts as an accurate survey will disclose, and local, county, state and federal regulations,including but not limited to those relating to zoning and development and any and all municipalor private utility improvements (both below and above ground), easements or rights of access,

    whether recorded or not, as may be necessary to effectuate and service said utilities.i. Each property shall be sold AS IS. The bidder is charged with the exercise of

    due diligence with respect to every state of facts, whether of record or not, that may affect theproperty. The Successful Bidder agrees to accept the awarded property in its "AS IS" conditionwithout warranties including but not limited to the environmental status of the property orcontingencies.

    j. Inspection of any dwellings located on any property shall be coordinated with theBusiness Administrator.
