Do you approve of a law summarized below, onwhich no vote was taken by the Senate or the Houseof Representatives before May 6, 2008?
This proposed law would reduce the state personalincome tax rate to 2.65% for all categories of taxableincome for the tax year beginning on or after January1, 2009, and would eliminate the tax for all tax yearsbeginning on or after January 1, 2010.The personal income tax applies to income receivedor gain realized by individuals and married couples,by estates of deceased persons, by certain trustees andother fiduciaries, by persons who are partners in andreceive income from partnerships, by corporate trusts,and by persons who receive income as shareholders ofS corporations as defined under federal tax law.
The proposed law would not affect the tax due onincome or gain realized in a tax year beginning beforeJanuary 1, 2009.The proposed law states that if any of its parts weredeclared invalid, the other parts would stay in effect.

Do you approve of a law summarized below, onwhich no vote was taken by the Senate or the Houseof Representatives before May 6, 2008?
penalties for possession of one ounce or less ofmarijuana with a new system of civil penalties, to beenforced by issuing citations, and would exclude
information regarding this civil offense from thestate's criminal record information system. Offendersage 18 or older would be subject to forfeiture of themarijuana plus a civil penalty of $100. Offendersunder the age of 18 would be subject to the sameforfeiture and, if they complete a drug awarenessprogram within one year of the offense, the same$100 penalty.would be notified of the offense and the option for theoffender to complete a drug awareness programdeveloped by the state Department of Youth Services.Such programs would include ten hours ofcommunity service and at least four hours ofinstruction or group discussion concerning the useand abuse of marijuana and other drugs andemphasizing early detection and prevention ofsubstance abuse.The penalty for offenders under 18 who fail tocomplete such a program within one year could beincreased to as much as $1,000, unless the offendershowed an inability to pay, an inability to participatein such a program, or the unavailability of such aprogram. Such an offender's parents could also beheld liable for the increased penalty. Failure by anoffender under 17 to complete such a program couldalso be a basis for a delinquency proceeding.The proposed law would define possession of oneounce or less of marijuana as including possession ofone ounce or less of tetrahydrocannibinol ("THC"), orhaving metabolized products of marijuana or THC inone's body.Under the proposed law, possessing an ounce or lessof marijuana could not be grounds for state or localgovernment entities imposing any other penalty,sanction, or disqualification, such as denying studentfinancial aid, public housing, public financialassistance including unemployment benefits, the rightto operate a motor vehicle, or the opportunity to serveas a foster or adoptive parent. The proposed law
would allow local ordinances or bylaws that prohibitthe public use of marijuana, and would not affectexisting laws, practices, or policies concerningoperating a motor vehicle or taking other actionswhile under the influence of marijuana, unlawfulpossession of prescription forms of marijuana, orselling, manufacturing, or trafficking in marijuana.

This proposed law would prohibit any dog racing orracing meeting in Massachusetts where any form ofbetting or wagering on the speed or ability of dogsoccurs.The State Racing Commission would be prohibitedfrom accepting or approving any application orrequest for racing dates for dog racing.Any person violating the proposed law could berequired to pay a civil penalty of not less than $20,000to the Commission. The penalty would be used forthe Commissions administrative purposes, subject toappropriation by the state Legislature. All existingparts of the chapter of the states General Laws
concerning dog and horse racing meetings would beinterpreted as if they did not refer to dogs.These changes would take effect January 1, 2010.The proposed law states that if any of its parts weredeclared invalid, the other parts would stay in effect.

QUESTION 1: Shall the Town of Hanson acceptsections 3 to 7 inclusive, of Chapter 44B of the GeneralLaws, as approved by its legislative body, a summary ofwhich appears below?
Sections 3 to 7 of Chapter 44B of the General Laws ofMassachusetts, also known as the CommunityPreservation Act (Act), establishes a dedicated fundingsource to acquire, create and preserve open space and landfor recreational use; acquire, preserve, rehabilitate andrestore historic resources; acquire, create, preserve andsupport community housing; and to rehabilitate andrestore open space, land for recreational use andcommunity housing that is acquired or created inaccordance with the Act.
In Hanson, the Act will be funded, beginning in FiscalYear 2009, by an additional surcharge of one and one half(1.5%) percent on the annual tax levy on real property andby matching funds provided by the state. The followingexemptions from such surcharge, permitted under Section3(e) of said Act, will apply: (1) property owned andoccupied as a domicile by a person who would qualify forlow income housing or low or moderate income seniorhousing in the Town; (2) $100,000 of the value of eachtaxable parcel of residential real property.
A taxpayer receiving a regular property tax abatement orexemption will also receive a pro rata reduction insurcharge. A Community Preservation Committee mustbe created pursuant to by-law and will makerecommendations on the use of the funds. Town Meetingmust approve any such recommendation before funds canbe expended. All expenditures pursuant to the Act will besubject to an annual audit.
