    RESOLUTIONNO5RESOLUTION OF THE INDIO WATERAUTHORITY OF THECITY OF INDIOCALIFORNIA DECLARING A WATER EMERGENCY AND SETTINGREGULATIONS AND RESTRICTIONS FOR THE SUMMER CONSERVATIONPERIODJITLY 2 5THROUGHOCTOBER3 2 5WEAShe IndioWater AuthorityIWAurrently provides potable water serviceto approximately twentyivequare miles ofthe Coachella Valleywthaervice population ofnd

    WHEREAS summertime demand from July 2 5 through October 3 2 5represents the highest demands for theCtyater systemduring the year and

    WHEREAS priority for potablewater must be given to humanconsumptonomescuse sanitation and fire protection and

    WHEREAS because of current delivery conditions the requirements for water forhuman consumption sanitation and fire protectionmay notbe met absent certain regulations andrestrictionsonhe useofwater during this period oftheyear and

    WHEREAS the City is experience experiencing tremendous growth in residential andcommercial development which developments presently use potable water delivered throughtemporarywater meters for grading dust control street washing and construction and

    WHEREAS the IWA hasdetermined that the problems wthin the water delivery systemcreateapotential water shortage emergencyconditionwthin its service area andAShe IWA has determined that public benefit requires that enforceableconservationmeasuresbe in place which allow regulations and restrictionsonwater useassetou inWater Code Section 3S etseq and

    WHEREAS such regulations and restrictions are set out in Exhibit A attached andincorporated here andWEAShe IWA has conducted aduly notice hearing onsuch regulations andrestrictions atwhich all partiesweegivenanopportunitytobe heard toprotest suchdeclarationofemergencyand present their respective needso

    NOWTHEREFOREthe BoardofDrectors ofthe Indio WaterAuthority resolvesasfollows Alrecitals set out above aretrue and correct and represent the findings ofthe IWA for

    the public benefit

    Awater shortageemergencyhereby isdeclared for the periodfrom uly 2 5 throughOctober 2 5 the SummerConservationPeriod3 The RegulationsandRestrictions set out inExhibit Ashall be ineffect during that period

    oftime toprovide for conservation ofwater throughpriorities in its allocations and shallsupersede any and all conflicts rules regulations oordinances as provided in WaterCode Section357

    Water Conservation egulations andRestrictions

    Effective July 2 5 through October 3 2 5 the following regulations and restrictions shallbe ineffect These regulations and restrictionsarebasedupon priority ofusewth domesticsanitation and fire protectionusessharing top priority

    Domestic Use There shall be no restriction at present on domestic use of waterNotwithstanding the IWA Board reserves the authority to make the following restrictionsmandatory in the event that consumptoneduconoals are not me Residents areencouraged to reduce overall consumption byResidential landscaping andnonotable uses Residents voluntarilywll be encouraged tominimize irrigation and avoid overspray and runoff Car washing and driveway washingshould be curtailed Installation of low flow showerheads and change ovetolow flushtoiletsifnot alreadywll be emphasized

    3 Industrial andCommercialUsersIndustrial and commercial userswll be encouraged tominimize irrigation avoid oversprayand runofffromtheirfacilities The IWABoard reservesthe right to adopt furthermandatoryrestrictions in the event that voluntary measures to not result inaeduction of ofconctionAlirrigation must be restrictedto9MthroughMdailytomaximize

    irrigation benefits andminimize excessive evaporationb Any otherhighwater demand processes that canbe swtched tohese hours should dosoMaintenance washing should be curtailedd Water conversation devices suchaslowflowtoiletsshould be installed during anyrestroom remodelingeCooling towersmust be inspected for leaks and all leaks fixedAlwater based processesshould be evaluated for leaking and potentialwater savingsf Where other sourcesofwater other than the potablewaersystem canbe used theyshould be activated during this periodg Large commercial irrigators such as golf coursesand cemeteries shouldevaluate existingirrigation rates and attempt to optimzetheir demand

    4 ConstructionWaterUsersConstructionwater meters for grading dust control filling water trucks street cleaning

    etc wll not be available for the Summer Conservation Programperiod Current metersmust be returned tohe City onobefore uly 2 5 In the event that aonstructionmeter is not removed the City is authorized toenter private property to emovesuchmeter and such Construction Water User wll not be eligible toreceive aconstructionmeerafter the Summer Conservation Programperiod ConstructionWater Userswill beexpected to swtch toothermeansofprovidingPMontrol including but not limitedto useofAlAmerican Canal Water subject tothe necessary permits existing privatewater wells andnewtemporary irrigation wellsb No construction water meters wll be provided during the Summer ConservationProgramCommencing November 2 5 Construction Water Users may apply for newconstructionmeterswhich shall be grantedbased uponpolicies to be adopted by IWAd Existing ConstructionWater Users that believe they cannot swtch toother sourcesshallprepare astatement giving the reasonswhy they cannot swtch and submit it totheDrector ofPublic Works Cost alonewill not be anacceptable reasonfor granting anexception Such ConstructionWater Users shall apply for anexception prior to the Tuly 2 5 implementation date ofthe Summer Conservation Program Any meter providedas anexceptionwll be restricted tonomorethan 35 gallonsperminute by placement ofagate valveandorifice plateoneachmeter at the cost oftheuseThemeterwill alsobe equipped wthanappropriate backflowdevice The City reservesthe right to rescindthe approval of the temporary construction meters at any time if that approval willcompromse the available supplyofdomesticwater for the City

    5 Newdevelopmentwater meters In the event that the potable water distribution system isnotcapable ofproviding expanded potablewater service tonewconstruction in the City ofIndiothe Indio Water Authority wll consider suspension of the installation of additional watermetersuntil the end ofthe SummerWater ConservationProgram
