AWARD 1. TITLE

This award shall be known as the Hairdressing and Beauty Services – Victoria – (Roping-in No. 1) Award 2003. 2. ARRANGEMENT 1. Title 2. Arrangement 3. Parties bound 4. Application 5. PARTIES BOUND This award is binding upon all of the employers listed in Schedule A in respect of all of their employees employed in Victoria who are eligible for membership of the Shop, Distributive & Allied Employees’ Association, engaged in the performance of work within the incidence of the award, and upon the Shop, Distributive & Allied Employees’ Association.

4. APPLICATION Subject to that which is otherwise provided for in this award, the provisions of the Hairdressing and Beauty Services – Victoria – Award 2001 (“the Award”), as varied from time to time, shall apply, with the exception of Clause 22 – Superannuation. 5. EXISTING EMPLOYEES Where a person has, prior to the date of this award been required to work ordinary hours greater than or in a different manner from that contained in this award, the employer and the employee should confer and seek to reach agreement on the translation to the terms of this award. The employer must advise each employee that the employee may be represented in such conferences. 6. OFFSETTING PAYMENTS UNDER CONTRACT OF EMPLOYMENT In application to each employee who commenced employment prior to the commencement of this award, the employer shall be entitled to offset any amounts paid under the employee’s contract of employment against any amounts payable under this award. For the purposes of this clause all payments made over the period of operation of the award pursuant to the contract of employment may be taken into account for the purpose of limiting any payment due under the award to whatever may be the deficiency between award entitlements for an employee for a period in dispute against the aggregate entitlement under the employee’s contract of employment for any reasonably corresponding period. Provided that this clause shall cease to operate in relation to any employee if and when the contract of employment of that employee is varied at any time after 6 months after the commencement of this award. 7. ANNUAL LEAVE LOADING During a period of annual leave an employee shall receive a loading of 17.5% on the rate of wage prescribed in Clause 14 of the Hairdressing and Beauty Services – Victoria – Award 2001. The loading prescribed in this clause shall not apply to proportionate leave on termination or to a casual employee. 8. RESERVED MATTERS Clause 28 – The penalty rate for ordinary work on Saturday. 9. OPERATION 9(a) Subject to the terms of sub-clause 9(b) of this award, this award is to operate from 17

May 2003 and shall remain in force for a period of six months. 9(b) The terms of Clauses 23.2.2, 28 and 29 of the award shall operate from 17 June 2003.
