!The close of this "#th century finds eery trade$ ocation$ and profession open to women$
and eery opportunity at their command for preparing themseles to follow these occupations.
A ast amount of the household drudgery that once monopoli%ed the whole time andstrength of the mother and daughters has been taken outside and turned oer to machinery in ast
establishments.&he who can make for herself a place of distinction in any line of work receies
commendation instead of condemnation.
't is especially worthy of note that along with this general adancement of women has comea marked improement in household methods. (oman)s increased intelligence manifests itself in

!That woman)s physical structure and the performance of maternal functions place her at a
disadantage in the struggle for subsistence is obious. This is especially true when the burdens ofmotherhood are upon her . . . . and as healthy mothers are essential to igorous offspring$ the
physical well-being of woman becomes an ob1ect of public interest and care in order to presere the
strength and igor of the race.
&till again history discloses the fact that woman has always been dependent upon man.*ducation was long denied her$ and while now the doors of the school room are opened and her
opportunities for acquiring knowledge are great$ yet een with that and the consequent increase of
capacity for business affairs it is still true that in the struggle for subsistence she is not an equalcompetitor with her brother.
There is that in her disposition and habits of life$ which will operate against a full assertion
of those rights.Differentiated by these matters from the other se2$ she is properly placed in a class by
herself$ and legislation designed for her protection may be sustained$ een when like legislation is
not necessary for men and could not be sustained.! &ource: The &upreme 3ourt decision inMuller
