On behalf of the Missouri Public Service Commission, Isubmit to you its annual report for the fiscal year. July 1. 1968,through June 30. 1969.

This report contains a summary of the function of eae-boffice of the Commission and a list of the cases considered by theCommission during the fiscal year.

The number of public utility and transportation mattersbrought before the Commission was greater than in previous years,and was accompanied by an uncommon volume of public utility rateincrease requests.

In a typical year the Commission may be asked to con­sider two or three utility rate increase requests. which requireconsiderable time and effort. During the fiscal year of this report.25 such cases were before the Commission.

The same expansion in work load has been experiencedduring the past year by regulatory agencies in other states and atthe federal level.

The Missouri Public Service Commission decided nine ofthe 25 rate increase cases during the fiscal year. and seven caseshave been decided since the end of the fiscal year. In 10 of those16 cases, the rates determined by the Commission were lower thanthose requested.

Consumers accustomed to stable utility bills have expressed con­cern over these rate increases.

The rate increases granted were needed to facilitate continualgrowth and the provision of service under changing cost conditions.

Over the span of the past 10 years, Missouri public utilities haveexhibited significant growth. For example, electric utilities in Missourihad plant in service totaling $2 billion by the end of 1968. Similarly, bythe end of 1968, the Missouri telephone industryls plant in service totaled$1. 2 billion.

The stability in utility rates customers had come to expect wasdue to two factors: technological innovations and population growth thatoffset less extreme increases in the price level. As the decade ended,however, utilities confronted with accelerated inflation experienced a reduc­tion in net revenues as those two factors no longer offset rising costs.

An indication of the overheated nature of the economy was theincrease in the prime interest rate--the rate charged large borrowers bylending institutions--which climbed from 5 per cent in 1965 to the presentlevel of 8.5 per cent.

Utilities no longer able to cope with the rlsmg costs of capital,labor and materials requested relief through increased rates.

In these rate cases, the Commission assures a balance of consumerand utility interest by carefully analyzing all available data prior to makinga decision.

In the years ahead, the Commission will continue to exerciSe itsauthority to the maximum benefit of all Missourians.

Chairman Wiiliam R. Clark, a Democrat, was thefirst member of the Public Service Commissionappointed by Governor Warren E. Hearnes, takingoffice July 1, 1965.

Chairman Clark, a member of the NationalAssociation of Regulatory Utility Commissioners,serves on its Executive Committee and its committeeson Communications, Coordination of CongressionalAct iv ities and State Use of Interim SeparationsProcedures.

He is Chairman of the Governor'sRailroad-H ighway Grade Crossing Safety Committeeand the Transportation Task Group of the MissouriEmergency Resources Management Planning Board.

Chairman Clark also serves on the MissouriHighway Reciprocity Commission, the Missouri Oiland Gas Council and the Governor's CoordinatedCommittee on Traffic Safety.

Prior to his appointment to the PSC, theChairman was engaged in the general practice of lawin Columbia. He had served as Corporation Counselunder the late Secretary of State Walter H.Toberman. He is a Colonel on Governor Hearnes'staff.

Chairman Clark is a graduate of the Universityof Missouri schools of Law and Business and PublicAdministration, and Kemper Military Academy.

He was a U. S. Air Force combat pilot in WorldWar II, and earned the Distinguished Flying Cross andthe Air Medal with Oak Leaf Cluster. He retired fromthe Air Force Reserve in 1967 with the rank oflieutenant colonel after 25 years' service.

Chairman Clark was born March 27, 1921, andwas reared in Windsor, Missouri.

Vice-Chairman Marvin E. Jones was appointedto the Public Service Commission by GovernorWarren E. Hearnes on April 15, 1967.

Before joining the Commission, Vice-ChairmanJones was engaged in the private practice of law inDexter with the firm of Powell, Jones and Ringer. Heearlier was manager of the District Claims Office atDexter for MFA Insurance Co., supervising claimadjustments in Southeast Missouri.

Vice-Chairman Jones is a member of theExecutive Board and is Second Vice President of theMidwest Association of Railroad and UtilitiesCommissioners.

He is a past president of the Stoddard CountyBar Association, and was a member of the Board ofDeacons of the First Baptist Church of Dexter. He isa Democrat and is a Colonel on the staff of GovernorHearnes.

The Vice-Chairman was born June 8, 1921, inBernie, and attended Southeast Missouri State Collegeand the University of Missouri School of Business andPublic Administration. He received his LL. B. degreefrom the University of Missouri School of Law.

During World War II, he served as a bombernavigator with the 15th Air Force, winning the AirMedal with four oak leaf clusters and the PurpleHeart with two oak leaf clusters for his combatservice in Italy.

Commissioner Charles J. Fain was appointed tothe Pub Iic Serv ice Comm ission on October 1, 1965,by Governor Warren E. Hearnes.

He was a partner in the firm of Fain and Rea,Attorneys at Law, Branson, engaged in generalpractice before his appointment to the Commission.

Commissioner Fain, a Republican, served twoterms in the Missouri General Assembly as aRepresentative from Taney County, and was SpeakerPro Tem during his second term. He was the authorof the legislation creating Missouri's first LittleHoover Commission and later served with that group.

He serves as a NARUC Cooperator with federalregulatory agencies. He also is a member of Secretaryof Transportation Volpe's Task Force on RailroadSafety. He served two terms as City Attorney forBranson and is a former president of the BransonChamber of Commerce. He is a member of theMissouri Bar, Taney County Bar, the Bar Associationof St. Louis and the American Bar Association.

He holds an LL. B. degree from the Universityof Missouri School of Law and a masters degree inlaw from George Washington University, Washington,D. C.

In World War II, Commissioner Fain was aU. S.Air Force combat navigator in the Central PacificTheater.

He was born September 26, 1919, in Chandler,Arizona, and was reared in Branson, Missouri.

Commissioner Howard Elliott, Jr., wasappointed to the Public Service Commission on April15,1967, by Governor Warren E. Hearnes.

Prior to his appointment, Commissioner Elliottwas engaged in the private practice of law in St. Louiswith the f.irm of Boyle, Priest, Elliott & Weakley. Hewas active in civic and education activities, and was amember of the Committee of Forty, whichestablished in St. Louis and St. Louis County the firstjunior college district in Missouri.

Commissioner Elliott is a member of theNational Association of Regulatory UtilityCommissioners and serves on its Committee onElectric and Nuclear Energy. He also is a member ofthe Midwest Association of Railroad and UtilitiesCommissioners, the Bar Association of St. Louis, theC~le County Bar, the Missouri Bar and the AmericanBar Association. He is a Republican.

He attended Brown University and is a graduateof the Washington University School of Law. Heserved in the U. S. Army from 1956 to 1958.

Commissioner Willard C. Reine was reappointedto the Public Service Commission for a full term byGovernor Warren E. Hearnes on April 29, 1969. Hewas first appointed to the Commission on April 16,1968, to serve the rema inder of the term ofCommissioner Donal D. Guffey, who resigned.

Commissioner Reine previously was ChiefCounsel for the Missouri Department of Revenue, andhad served as Assistant Chief Counsel for the MissouriDivision of Insurance.

He is a member of the Committee onEngineering, Depreciation and Valuation of theNational Association of Regulatory UtilityComm issioners.

From 1960 to 1965, Commissioner Reine wasengaged in the general practice of law in East Prairie,and was Assistant Prosecuting Attorney forMississippi County and City Attorney of East Prairie.

He is a past president of the State YoungDemocrats, and served as National Committeeman forthat organization. He is a Colonel on the staff ofGovernor Hearnes.

Commissioner Reine, the youngestCommissioner, was born April 19, 1935. He is agraduate of Central Missouri State College and theUniversity of Missouri School of Law.

The cItizens of Missouri are assured of goodtransportation and utility service at reasonable pricesas a result of the work of the Missouri Public ServiceCommission.

The Commission also must ensure that thecompanies it regulates stay in sound financialcondition so they can provide service and offer acompetitive return to investors.

When conflicts arise between consumers andcompanies over rates, service or other matters, theproblem is brought before the Commission. TheCommissioners are able to settle some casesinformally. When this cannot be done, the issue ispresented in a formal hearing.

In Fiscal 1968-1969, the Commission was askedto consider an unusually large number of rate increasecases, the result of inflationary pressures that droveup the costs of labor, materials and capital for thecompanies.

The companies requested rate increases because,with increased plant investment, their revenues werenot rising as rapidly as their costs.

EFFECTS CONSIDERED

The work of the Commission affects everyMissourian, and careful consideration was given to theeconomic effect of each case. In several instances, theamount granted by the Commission was less than thatrequested.

Decisions are made by the Commission after thetranscripts and evidence have been studied along withthe recommendations of the PSC staff of attorneys,engineers and other experts.

In utility cases, the Commission determines abase on which the companies' rates are computed.The Commission then sets a rate of return, which isthe ratio of earnings to investment. Rates of returnare not the same for all companies because ofvariations in the financial structures of the firms.

Inits Report and 0 rder, the Comm ission givesthe total amount of the increase or decrease anddirects the company to file rates in conformity withthat amount.

RATES REVIEWED

The rates are reviewed and are approved orrejected. If approved, they may be adjusted later if itis found they are at variance with the amount theCommission allowed. Transportation cases areconducted in a similar manner, with some variationsin rate computation.

Through continuing surveillance, theCommission staff keeps informed of the companies'operations and takes appropriate action whenCommission rules and regulations are violated.

The staff resolves many consumer complaints orirregularities discovered through surveillance. This isdone through correspondence with the company or ininformal conference with the staff and the partiesinvolved.

If the staff cannot ach ieve an equ itable solution,the Commission takes up the case.

In addition to rate cases and complaints, theCommission considers changes in authority,abandonment of service and company financialtransactions that require Commission action.

During the fiscal year 1,509 applications werefiled with the Commission and 728 cases were heard.The Commission issued 5,029 orders.

PSC REPRESENTS MISSOURIANS

As well as being a regulatory agency, the PublicService Commission represents the citizens ofMissouri outside the state.

The PSC appeared a number of times during thefiscal year in matters before Federal regulatorycommissions, such as the Federal Power Commissionand the Federal Communications Commission.

Chairman William R. Clark, a member of theCommunications Committee of the NationalAssoclation of Regulatory Utility Commissioners,presented testimony in December, 1969, to the U. S.Senate in opposition to an FCC decision.

The FCC approval of a $237 million reductionin interstate telephone tolls, Chairman Clark said,would benefit interstate callers at the expense of localtelephone users.

Judge Clark told the Senate CommerceCommittee that the Southwestern Bell TelephoneCompany was granted a $30.6 million rate increase inMissouri shortly before the FCC decision wasannounced, and the Bell System had intrastate rateincreases pending in many other states.

The committee was told by Chairman Clark thatthe Senate should pass a bill giving state commissionsa voice in allocating interstate costs, and should staythe FCC decision until the bill was approved.

The Missouri Commissioners sometimes areasked to assist the Federa I bod ies. Judge Charles J.Fain sat with the ICC in the fall of 1969 when thatagency heard the railroads' request for a 6 per centnationwide freight rate increase.

COMMITTEE SERVICE

The PSC Commissioners serve on national,regional and state committees dealing with regulatorymatters. 1n cooperation with regulatory agencies ofother states and the Federal government, the PSC hashelped with the solution of joint problems anddevelopment of new ideas in utility regulation.

The present Secretary is Sam L. Manley.

As administrative officer of the Commission, theSecretary is responsible for personnel and propertymanagement. He administers the Oath of Office toCommission employes and affixes the OfficialCommission seat to Commission documents.

The Secretary tests and interviews prospectiveemployes and keeps personnel records.

PUBLIC INFOR.MATION OFFICE

The Public Information Office works with theSecretary in issu ing publ ications and news releasesconcerning PSC activities.

The Commission is required by statute topublish Public Service Commission Reports, acompilation of significant Commission decisions, andthe Annual Report.

The PSC Reports are prepared with theassistance of the Reporter of Opinions and are firstissued in monthly advance sheets for which

subscribers pay $15 annually to cover printing costs.The PSC Reports are later published in boundvolumes.

Three other publications are issued wh ich aresold by subscription.

A register of bus and truck cases filed eachmonth costs $12 per year.

Two \ists of bus and truck companies operatingin Missouri are available by subscription at five dollarseach per year. One lists the companies alphabeticallyby name, and the other lists the companies under thecounties in which they are located.

The docket of the next week's cases is issued bythe Secretary's offlce each Fdday. The docketcontains the nature and number of the cases andother pertinent information.

All orders, transcripts and other Commissiondocuments are printed in the Secretary's print shop.The bound PSC Reports are printed by private firmsunder contract.

The General Counsel is the attorney for thepublic in proceedings before the Commission andrepresents the public and the Commission in thecourts.

The present General Counsel is Jeremiah D.Finnegan.

Advice and opinions are provided to Missouriansby the General Counsel concerning their rights underpublic Service Commission law and the legal methodsand procedures for protecting those rights.

At the direction of the Commission, the GeneralCounsel may commence and prosecute actions andproceedi ngs in the name of the State.

During the fiscal year, 809 cases were presentedto the Commission by the General Counsel. Twelve ofthe proceedings were rate cases that required lengthypreparation, briefing and hearing.

Fifteen cases were appealed; 12 to the CircuitCourt and three from the Circu it Court to the KansasCity Court of Appeals. The General Counsel filed onestatutory penalty action and one injunction action,and was required to answer a declaratory judgmentaction.

Five of the cases were pend ing at the end of thefiscal year. The Commission and the citizens ofMissouri were represented by the Office of GeneralCounsel before the Interstate Commerce Comm issionin 10 proceedings, most of them passenger traindiscontinuances, and before the Federal PowerCommission in two rate cases.

Official opinions are rendered by this office forthe public, the Commission and the PSC staff. Duringthe past year, 18 opinions, each requiring extensiveresearch and review, were issued by the Office ofGeneral Counsel. The opinions are head noted,indexed and filed for quick reference.

HEARING EXAMINERS DEPARTMENTS

Each Commissioner is assigned a hearingexaminer who prepares tentative Reports and Ordersand assists the Commission during hearings. When theCommission wishes, Hearing Examiners may presidein place of Commissioners at proceedings in whichevidence is taken. This section is directed by theChief Hearing Examiner, who also supel"\lises theReporter of Opinions and the Reporting Department.

The Hearing Examiners and the Reporter ofOpinions are attorneys, and three of them areassociate Joint Board members of the tnterstateCommerce Commission. In this capacity, the threerepresent the state by hearing cases for the ICC.

The Reporter of Opinions edits and proofreads allReports and Orders and prepares head notes tor theselected cases published in the Public ServiceCommission Reports.

REPORTING DEPARTMENT

The Reporting Department staff records formalproceedings before the Commission and preparestranscripts of most cases. Transcripts were notrequired in 33 cases during the fiscal year.

Transcripts were prepared for 301 cases, a totalof 28,920 pages. The department sold 48,915transcript pages.

may waive the requirement for cargo insurance,usually if the cargo is of comparatively low value.Contract carriers may obtain a waiver on cargoinsurance upon agreement with the shipper.

This section maintains case files on each carrierand also keeps a file of all motor carrier applicationsto the Interstate Commerce Commission foroperations in Missouri.

The remainder of the budget is appropriatedfrom the State General Revenue Fund and the PublicService Commission Fund, which is supported byassessments from utilities.

LICENSE AND RECORDS SECTION

The monthly collections for sticker sales areshown in Figure 1.

Annual license stickers are issued by this sectionfor a fee of $25. The stickers are required on allmotor vehicles operating under Commissionauthority, except those who are covered by areciprocal agreement Missouri has with 27 otherstates.

The License and Records Section this year begana system through which licenses may be obtained bytelegram. These are honored by enforcement officersfor up to 24 hours pending receipt of the annuallicense stickers. A total of 742 wires was issuedduring the fiscal year.

Sticker sale receipts for the fiscal year totaled$990,255; a 14.6 per cent increase over the previousfiscal year total of $863,573. The collections aredeposited in the State Highway Department Fund,from which a portion of the Commission's budget isappropriated.

Many who allow their insurance to lapse do notintend to resume operations. The permits orcertificates of 262 carriers were cancelled du ring theyear for failure to reinsure.

A total of 3,267 reminders was sent to carrierswhose insurance had been cancelied. The authority of1,101 carriers was suspended for failure to reinsure.By June 30, 1969,661 of the suspended carriers filedsatisfactory evidence of insurance and was reinstated.

The Commission requires insurance companiesto give 30 days' notice before a carriers' insurance iscanceUed. The notice is forwarded to the carrier, whomust provide the Commission with proof ofcontinued coverage if he wishes to avoid suspension.

Carriers operating under Commission authoritymust file with the Insurance Section an appropriatecertificate of insurance. If a carrier fails to comply,his authority is suspended.

The officers do not have arrest powers and sowork closely with the Missouri State Highway Patrol,which makes arrests for violations of Commissionlaw, rules and regulations.

Information concerning violations, changes inauthority or accidents is shared among the PSCinspectors, the Highway Patrol, the InterstateCommerce Commission and the Department ofTransportation.

The officers traveled 214,805 miles during thefiscal year, making 1,855 contacts with certificatedcarriers and conducting 1,408 truck safetyinspections.

Their main objective is the promotion of safetyon Missouri highways and the curtailment of illegaltransportation.

Ten field inspectors, each of whom has anassigned area in the state, investigate operators todetermine whether they comply with Missouri Busand Truck Laws.

The Chicago, Burlington & Quincy and theChicago, Rock Island & Pacific railroads requested a10 per cent increase in passenger coach fares to takeeffect August 1, 1968. The Atchison, Topeka andSanta Fe and the Kansas. City Southern railroadsasked for a 10 per cent raise in first class and coachfares, effective June 15, 1969. The Missouri PacificRailroad requested a 5 per cent increase in passengerrates, also effective June 15.

In the belief that the increased fares would helppreserve passenger service, the Commission permittedthe fares to become effective as filed.

DISCONTINUANCE DENIED

The Commission turned down Missouri Pacific'srequest to discontinue its passenger trains between St.Louis and Kansas City. The railroad appealed to theICC and was given permission to drop two of the fourtrains. The Public Service Commission, the City ofJefferson City and the United Transportation Unionobtained an injunction in December, 1969, in U. S.District Court and the trains were to continue to runwhile the court studied the case.

The Norfolk and Western Railway was permittedto discontinue its two remaining passenger trainsoperating between Kansas City and St. Louis after the

Commission found that few persons between themetropolitan areas were using the service, alternatecarriers were available and the company was losing asubstantial amount of money on the trains.

The Pullman Company was dissolved as a resultof declining service, and on January 1, 1969, therailroads that wished to continue pullman operationsstarted using their own sleeping cars.

RAILWAY EXPRESS

Railway Express Company during the yearincreased its class and commodity rates due to higheroperating costs that would have caused a deficit ofabout $42 million in the fiscal year.

REA continued to transport most of itsshipments in its own trucks under the 'Hub Plan'established in 1968. Because of a lack of intrastatemotor carrier authority and su itable rail service insome areas, the company maintained its embargo onintrastate shipments to a number of cities and townsin Missouri.

The total track mileage of Class 1 railroads inMissouri was 10,889 mi les as of December 31, 1968,a decrease of seven miles from the previous year'stotal. There were no major abandonments. Trackmileage of each Class 1 railroad is shown in Figure 2.

TRUCK RATE REQUEST

There was no general increase in truck ratesduring the year. The Middlewest Motor FreightBureau filed a 5 per cent increase in rates onshipments of less than 1,000 pounds and a 3 per centincrease on larger shipments.

A hearing was held in June, and the case waspending at the close of the fiscal year. Also pendingwere two applications for increases in dump truckrates.

Most intercity bus carriers filed a 10 per centincrease in fares to become effective April 15, 1969.

The Commission suspended the increase and began aninvestigation. The suspension was removed on April25, but the investigation continued. A nationwideinvestigation of bus fares also was being conducted bythe ICC.

The bus lines filed a 10 per cent increase in busexpress rates to become effective June 10, 1969. Thatincrease was suspended and set for hearing.

The operating revenues of the major bus lines inMissouri rose 3.8 per cent over 1967 levels, whileoperating expenses increased 4.5 per cent. Theaverage expense of 56.8 cents per mile was 3.8 centsabove the 1967 average.

The Commission is assisted in implementing itsjurisdiction over public utilities and railroad safety bythe Office of Utilities.

The Director of the Office of Utilities is F. D.Hequembourg, who coordinates the work of twodepartments, Accounting and Engineering.

The experts in these departments investigate thephysical and financial structures of companies, andpresent their findings and recommendations to theCommission.

This work includes determination of rates ofreturn, depreciation, costs and the safety andadequacy of service. Railroad matters other thansafety are the responsibility of the Office ofTransportation.

ACCOUNTING DEPARTMENT

The accounting procedures of utilities underCommission regulation are controlled by theAccounting Department, which also keeps theaccounts of the Commission.

The utilities must use a standard accountingsystem that facilitates the work of the department inchecking the companies' annual reports and makingaudits.

Audits and investigations conducted by the staffare in three categories: comprehensive office audits ofannual reports; audits in conjunction with rateinvestigations, and compliance audits.

Special investigations and statistical studies alsoare made by the staff.

About 250 annual reports from utilities arereceived by the Commission each year. These reportsreflect the financial condition of the companies andprovide operating statistics that are invaluable to theCommission.

The staff reviews the reports and assists theutilities with problems in connection with thepreparation of the reports.

AUDIT RESULTS

Rate aud its, performed either in theCommission's offices or in the field, provideinformation about the original cost of the propertyused by the utility, the financial condition of thecompany and the adequacy of the firm's records.

During the fiscal year, the AccountingDepartment concluded 12 audits and examinations;six were major audits. The department currently isworking on 13 audits and examinations that areexpected to be completed during the 1969-70 fiscalyear.

The utility consulting firm of Troupe, Kehoe,Wh iteaker and Kent was employed by theCommission to perform three audits during the yearand to represent the PSC before the Federal PowerCommission in a case involving Panhandle EasternPipe Line Company.

A list of the audits made by the consulting firmand their cost is shown in Figure 2.

The case before the FPC resulted in a reductionof the company's rates and a refund of an additional$102,000 over the excess charges estimated to havebeen collected by the pipeline company. Theconsu Iting fi rm was paid $12,866 for its service.

SECURITIES EXAMINED

Uti I ities may issue securities only withCommission approval and upon payment of anauthority fee to the Commission. Securities issuesfirst are examined by the Accounting Department.

Du ring the fiscal year, the Commissionauthorized issuance of securities valued at$229,784,107. New capital expenditures represented$229,404,107 of that amount, and refunds ofoutstanding indebtedness amounted to $380,000.

The type and amount of the securities issued areshown in Figure 3.

Authority fees of $52,176 and miscellaneousfees of $17,089 were collected and credited to theState General Revenue Fund.

A portion of the Commission's budget isappropriated by the General Assembly from thePublic Service Commission Fund, which is maintainedwith assessments from utilities.

The assessments are made annually by theAccounting Department. The rest of theCommission's budget is appropriated from the StateHighway Department Fund, in which the Commissiondeposits motor carrier annual license fees, and theState General Revenue Fund.

The Cost Accounting Section allocates theassessments on a base of the companies' grossrevenues during the prior year. The assessments aresubject to Commission approval.

The utilities were assessed a total of $1,251,045for the present fiscal year. Any surplus is carried overto the succeeding fiscal year.

A breakdown of the assessments is shown inFigure 4.

ECONOMIC RESEARCH

The Commission created during the fiscal yearthe Economic Research Department, which provideseconomic and financial analyses of Missouri utilities.

Testimony concerning public utility rate ofreturn is prepared by the department for use in ratecases before the Commission.

The Econom ic Research Department isdeveloping a "Framework for Analysis" series thatpresents the economic and financial concepts neededin evaluating public utilities.

The program includes informal seminars fordiscussion of issues in the series and other topics.

In order that all information within theCommission may be efficiently used, the departmentcatalogues and cross-indexes all data and circulates alist of new articles, pu blications and informationreceived.

A procedure is being developed for obtaining as

quickly as possible additional information notmaintained by the Commission.

Specific analytical reports concerning particularphases of public utility operation are prepared by thedepartment.

An automated system for publishing continuingand ad hoc reports on aspects of public utilityregulation is being considered. The reports wouldcover evaluation of utility profit levels, productpricing and other performance-related topics.

ENGINEERING DEPARTMENT

The Engineering Department staff of engineersand technicians investigate utilities and review tariffs.

Included in their duties are property studies ofcompanies' depreciation, original cost and trendedoriginal cost less depreciation. More than 10 of theseextensive examinations were made during the yearand the reports were important in the considerationof rate cases.

The Engineering Department ensures that theutilities operating in the state provide safe andadequate service.

The engineers investigate any natural ormechanical incident that causes major servicedisruptions in uti Iity or railroad operations. Electricalpower outages, gas explosions and other emergenciesare studied and a report is made to the Commission.

The department reviews rough drafts of certainSession Orders and Reports and Orders of theCommission, and often prepares ,the rough drafts ofsuch orders for the Commission.

D u ri ng the fiscal year, the departmentinvestigated and answered complaints or requestsfrom consumers concerning service, safety, disputesand other matters.

Several members of the department serve on theGovernor's Emergency Resources Management Planas key operating officials. This plan was establishedfor use in the event of nuclear attack or naturaldisaster.

The staff enforces PSC General Order No.45--the Missouri Natural Gas Safety Code·-whichpublic gas utilities in Missouri must follow.

Gas utility customers in the state are assured ofsafe delivery of fuel as a result of efforts of the GasSafety Section of the Engineering Department.

The Commission Chief Engineer, a member ofthe ASME Conference Group, participates inmeetings concerning the society's gas safety code.

RAt LROAD SAFETY SECTION

During the fiscal year, the staff made more than450 inspections and met frequently with publicofficials and railroad representatives to discussproblems.

Investigations are conducted regularly by theRailroad Safety Section to see that railroads inMissouri comply with the Commission's RailroadSafety Code.

Accidents, particulary those in which personsare killed or injured, are given special attention, andthe staff makes routine inspections of operatingequipment and property.

In reviewing these investigations, the departmentendeavors to determine whether expanded regulationswould prevent future problems.

During the year, the Chief Engineer andmembers of his staff have attended conferences andcourses to stay well-informed of technologicaladvancements in the gas industry and of the work ofother regulatory bodies in promotinq safety in the

industry.

In cases where it appears Commissionregulations have been violated, the staff gathersevidence for use in enforcing the regulations.

Only one safety complaint was received duringthe year. The staff investigated, and the utility wasdirected to replace 875 feet of gas main.

There were five incidents during the year atutilities in which a fatality, an injury or at least$1,000 property damage occurred. Investigationshowed that only one was the fault of the utility. Theothers were caused by employee carelessness, arson orfacility damage by another utility.

GAS SAF ETY SECTION

The facilities of all 21 of the gas utilitiesoperating in 450 Missouri cities and towns wereinspected during the fiscal year to ensure that thesafety code was being observed.

The Missouri Gas Safety program is designed toencourage gas utilities to develop better preventivemaintenance programs to reduce leakage. Severalutilities as a result have instituted improved corrosionand production control.

Two engineers in the department devote fulltime to the development of code requirements forsafer operating practices, the investigation ofaccidents and complaints, and the inspection of gasfacilities.

The en£jineers inspected safety featu res andcompany maintenance programs, and reviewed leaksurvey records and procedures.

Complaint investigations are made when reportsindicate that an unsafe condition exists at a utility orthe utility may be using operating procedures inviolation of the Missouri Gas Safety Code.

General Order No. 45 is comparable, and insome areas more stringent, than the USAS631.8-1968 Gas Transmission and Distribution Codefor Pressure Piping published by the AmericanSociety of Mechanical Engineers (ASME).

The U. S. Department of Transportation,following passage of the Natural Gas Pipeline SafetyAct of 1968 by Congress, adopted PSC General OrderNo. 45 as the interim code for all Missouri gassystems.

CONSTRUCTION APPROVED

It approved the construction of 28 gradeseparations, the construction or relocation of ni necrossings, the installation of gates at four crossingsand the placing of flashing signals at 16 crossings.

A special committee to investigate highwaygrade crossing accidents was appointed by GovernorWarren E. Hearnes shortly after he took office andthe governor named PSC Chairman William R. Clarkto head the committee. The Commission staff assistedthe committee in its investigations.

Upon the recommendations of the Governor'sRailroad Highway Grade Crossing Committee,experimental warning signals were installed atcrossings considered dangerous. It is anticipated thatmore of these signals will be installed.

In a related investigation, members of theEngineering Department staff worked with adiagnostic team that evaluated all grade crossings inMissouri. Other members of the team represented therailroads, the State Highway Department, the StateHighway Patrol and the Federal Bureau of PublicRoads.

The group is correlating its findings and IS

expected to issue a report in 1970.

SANITARY SEWER UTILITIES

Regulation of sewer utilities has posed newproblems for the Department since the Commission'sauthority in this field was renewed by legislation in1967.

The most serious complaint in sewer regulationconcerns sewage backup in a customer's home. Aswell as being a health hazard, this type of incidentoften requires extensive repair.

A cooperative effort with the utilities is beingmade by the Department, but some problems haveproved difficult to solve.

The majority of complaints, the staff has found,result from conditions caused by vandalism, illegalconnections of pipes carrying more water than asystem can accomodate, and breaks left unrepairedand unreported to the utility.

These conditions are aggravated by heavy rainsthat overburden the sewers.

The Department is concentrating on certainsewer utilities to see that maintenance to correctthese situations is improved.

RATES AND TARIFFS DEPARTMENT

When a utility under Commission regulationwishes to change its charges to customers, it must filethe revised tariffs with the Rates and TariffsDepartment, which studies them to learn the extentand nature of the changes.

The staff makes recommendations to theCommission, and the tariffs are filed or suspended bythe Commission for further study of public hearing.

During Fiscal 1968-1969, the departmentprocessed 3,242 tariff sheets for new charges, changesin rates and tariffs and miscellaneous tariffinformation.

The department also handles many of the util itycustomer complaints and inquiries the commissionreceives. Approximately 4,500 responses were madeby the department to individuals and companiesduring the year in connection with tariffs, complaintsand other inquiries.

A major part of the department's work involvesconferences with consumers and with officials ofutility companies.

The department maintains a current file of allutility rates and other information necessary in theregulation of Missouri utilities. These statisticsprovide an indicator of the development of theutilities, a valuable aid in commission cases.

THE UTlUTlES' YEAR

The utilities under Commission regulationcontinued their rapid growth during the year, makingrecord investments in some instances to accomodategreater demands from existing customers and theneeds of new customers.

Despite the rising cost of money, the utilitiesare planning more expansions, as they must be able tosupply their services to all who request them.

The information given on the utilities in thissection is based on company annual reports for thecalendar year of 1968 unless otherwise indicated.

ELECTRIC

Investment by electric util ities in plant duringthe year reached a record $2,002,535,043, anincrease of 7.76 per cent over the 1967 total of$1,858,262,675.

They sold 27.28 billion kilowatt-hours ofelectric energy, a rise in production of 11.4 per centover the previous year.

Through increased efficiency of operation, theelectric util ities have held the Iine on rates and havemade reductions in ~~'Tle instances. The overallaverage cost of electric energy during the past yeardecreased $.0002 per kilowatt-hour from the previousyear.

Operating revenues of electric util ities inMissouri have increased by 111 per cent in the pastdecade, but the amount of energy sold during thatperiod has risen by more than 149 per cent. Otherstatistics on electric utilities are included in F j gure 5.

One of the greatest problems confronting theelectric utilities is high, short-term peak demandperiods. These usually occur during the summer whencustomers add air conditioning loads to the system.

This situation is being met in a variety of waysby the utilities, inclUding the use of stand-by

generating plants and inter-connection agreementswith other utilities and transmission companies forthe purchase of energy.

TELEPHONE

The number of telephones in the state has risenmore than 55 per cent in the past 10 years, reach ing atotal of 2,589,677 on June 30, 1968. That includes agrowth of 5.6 per cent--137,906 new telephones--inthe last year.

In Figure 6, the growth in the number oftelephones each year is shown. Additional statisticson the telephone industry are presented in Figure 7.

Over the past few years, the companies'investment has increased by $50 million to $100mi II ion annually, reach ing a record total of$1,204,761,505 in 1968.

Much of the telephone industry's constructionbudget in recent years had been allocated toimprovement of rural and urban party line service. Allcompanies have a goal of providing private line servicefor all customers inside the exchange base rate area,and rural service with no more than four parties perline.

Wide Area Sel'\lice Plans for St. Louis and KansasCity were placed in service during the past year,virtually eliminating interzone calls in those areas.

The industry is making full use of its energy andresources to implement new services, such as directdistance dialing, touch tone systems, improvedprivate branch exchanges and more sophisticatedtransmission and distribution facilities.

Underground installation of equipment isincreasing, a practice that reduces service and troubleproblems and improves the appearance of thelocation.

A new, universal emergency number--911-­which callers may dial for all public safety agencieswas to be put into use in a Missouri city for the firsttime in the fall of 1969. Other communities areconsidering the use of the number.

NATURAL GAS

Many areas of Missouri received natural gasservice for the first time during the past year, a resultof distribution facility expansion that ra ised thecompanies' investments to a record $404 million.

Investments during the past decade have almostdoubled while the number of customers increased byabout 25 per cent, an indication that more money isbeing invested per customer to provide more residentswith natural gas service.

Although gas rates have risen along with costs,the percentage of the rate increases comparesfavorably with the greater investment made by theqas utilities.

Interstate pipeline companies supply natural gasto distributors in MissoUri.bringing the gas from fields

to the west and southwest of the state. Allocations ofnatural gas supplies to the utilities are made by theFederal Power Commission.

The utilities have made improvements recentlyin the provision of 'firm' natural gas service tocommercial and industrial customers who previouslyhad been served on an interruptible basis.

Some gas customers in Missouri are takingadvantage of total energy installations that usenatural gas fuel. These units provide heat, electricity,hot water and air conditioning for a limited area.Several of these plants are operating in the state.

In Figure 8 and 9 statistics on the operation ofMissouri natural gas utilities during the past 10 yearsare shown.

WATER UTILITIES

The growth of suburban residential areas, newindustrial development and the increase in per capitausage of water have placed greater loads on the waterutilities.

In the past year, water utilities under PSGregulation increased their investments to $155million. about $17 million more than in the previousyear.

The rise in investment and revenues during thedecade is presented in F[gure 10.

Th is growth reflects the campa nies'development of new sources and establishment oftreatment plants.

The information in Figure 11 shows that thenumber of customers has increased at a ratherconstant rate during the decade, but the amount ofwater used has risen sharply in the last three years.

This trend is expected to continue, placing moredemands on the companies in the future.

WESTERN UNION

Western Union, one of the oldest utilities inMissouri, stilt derives much of its revenue fromtelegram messages but because of modernization andexpansion is offering leased systems and recordservice systems that provide more economical service.

Figures presented here are for the company'sentire operation because its intrastate system is soclosely connected to its worldwide network that thetwo are difficult to separate.

The company's investment during 1968 reacheda record of more than $600 million and its grossrevenues were a record $360,094,805.

Telegram messages produced less than 50 percent of total revenue and constituted less than 15 percent of the total message volume.

One of the major Western Union transactionsdu ring the past year was the acqu isition of theteletypewriter exchange service from AmericanTelephone & Telegraph and AT&T's associated 8ellSystems. Western Union plans to combine theteletypewriter (TWX) service with its TE LEX serviceto give subscribers a single integrated system capableof serving different types of customers.

SANITARY SEWERS

The Commission's authority to regulate sanitarysewer utilities was reinstated by legislation in 1967that replaced the old law, which had been ruledunconstitutional.

Since that time, the Commission has conductedan extensive program to locate and investigate sewercompanies that appear to be operating as publicutilities without Commission approval.

During the fiscal year, the Comm ission

certificated 12 sewer utilities, bringing the number ofcompanies under Commission regulation to 28.

STEAM HEAT

Steam systems have been in existence for manyyears, supplying energy primarily for space heating incertain areas of the large cities of Missouri.

There has been little expansion of the threesystems in Missouri, largely because the increasing useof natural gas as a space heating fuel has lowered thedemand for steam heat.
