FORWARD MARKETS COMMISSION, MUMBAI
Highlights/ Important Developments for the fortnight from 1.9.2013 to 15.9.2013
• Total value of trading at the Commodity Exchanges during the fortnight, 1st September, 2013 to 15th September,
2013 was ₹ 3,31,595.36 crore. The cumulative value of trade from 1stApril, 2013 upto 15th September, 2013 during
the financial year 2013-14 was ₹ 62,29,765.81 crore. The corresponding figures for the previous year were
₹ 8, 90,172.47 crore and ₹ 80, 30,090.04 crore respectively.
• The Commission on 3rd September, 2013 imposed an additional margin of 5 % in all the base metals contracts,
namely Aluminium, Copper, Lead, Nickel and Zinc traded on the National Exchanges till further orders, to be made
effective from 9th September, 2013.
• In order to keep pace with the technological development and to take appropriate regulatory measures, the
Commission on 3rd September, 2013 constituted an ‘Advisory Committee on Technology’ which would advise the
Commission on various issues arising on use of technology including the following:
� System audit of exchanges / members.
� System audit for algorithmic and high frequency trading and to suggest proper checks and balances.
� Internet based trading using mobile devices and Direct Market Access (DMA).
� Integrated market surveillance system.

� Maintenance of data repository of trade, delivery, stock at warehouses, call recording at dealing room,
trading and settlement details etc.
� Wider dissemination of information on trading, price and delivery information to encourage participation by
farmers / hedgers.
� Migration of Regional exchanges to on line trading system.
� Any other issue arising from time to time.
The Committee will consist of following members:-
1. Shri Ashish Chauhan, M.D, BSE, Mumbai - Chairman
2. Shri Deepak Sancheti, Ex-General Manager, SEBI - Member
3. Shri Pravir Vora, Ex-Chief Technology Officer, ICICI - Member
4. Shri N. Ram, Ex-Chief Technology Officer, HDFC - Member
5. Shri Sujit Prasad, Chief General Manager, SEBI - Member
6. Chief Technology Officers of all National level Exchanges - Member
7. Representative from Commodity Participant Association, CPAI.- Member
The Committee will meet as and when desired by the Commission. Shri P.N. Tiwari, Director, FMC shall be
the convener of the Committee.

• The Commission, on 6th September, 2013 imposed 10 % special margin on long side of all the contracts of Guar
Seed and Guar Gum traded on National Exchanges till further orders, to be made effective from 11th September,
2013.
• The Commission on 6th September, 2013 directed all National Exchanges to make all investment of IPF trust
money in accordance with relevant provisions of Indian Trust Act 1882 and Section 11(5) of Income Tax Act, 1961.
• The Commission on 4th December, 2006 had directed the National Exchanges that Portfolio Management Services
(PMS) Activities are not permissible. It was further clarified that these directions were in relation to fund
management activities only. Since several complaints were received against members that Portfolio Management
Activates are still being taken in commodities market by putting small investor’s money at risk, the Commission
further decided on 11.9.2013 not to allow the following activities;
� any activity in the nature of promise of assured returns after a certain fixed time period (for example a month,
3 months or 6 months etc) or assured profits by the members or profit sharing activity.
� any activity without executing Member Client Agreement.
� any activity without presenting client with a Risk Disclosure document.
� any activity without proper orders from the client for managing his accounts/executing trade etc.

� any advertisement /publicity made by the member highlighting only the benefits of futures market without
highlighting the risk involved.
� any other activity which is ambiguous or misleading the client in any way.
• Since prices of Guarseed and Guargum contracts were volatile, the exchanges have been directed to forward day-
wise quantity traded and the position held by the top 25 clients on buy side and top 25 clients on sell side (volume-
wise) for the month of June 2013 to August 2013 in the prescribed format in all contracts of Guar Seed and Guar
Gum traded at the exchange within a week.
The Exchanges were also directed to forward the copy of KYC of all the top 25 clients giving their profile.
• The Commission, on 13th September 2013, has directed all the National Commodity Exchanges to have a broad-
based representation of all classes of shareholders on the Board of Directors of the Exchange to strengthen
corporate governance. In this regard the Commission has decided the following:-
(i) The representation of the Anchor investor on the Board of the Exchange shall not be more than the
proportion of its shareholding, which will be a maximum of 26% at the end of the fifth year of the
Exchange’s operation.

(ii) The representation of the class of Shareholders mentioned at 3(b) and 3(c) of the letter shall not be less
than one-half of the total number of Shareholder Directors. Further, any of these shareholders shall not
have more than one representative on the Board.
(iii) The representation of other classes of shareholders on the Board shall be as per their eligibility for
appointment on the Board.
The Exchanges have been directed to incorporate the provisions of the Guidelines dated 12th August, 2013,
including the amendments made vide this letter, in their Articles of Association and Bye-laws, by 30th September,
2013.
• The Commission on 13th September, 2013 removed restrictions from taking fresh positions in the last 5 trading
days of cardamom contract at MCX, Mumbai. With this, the trade participats in cardamom contracts are allowed
to take fresh position till expiry of the contracts.
• Development at National Spot Exchange Limited (NSEL):
As per the Settlement Schedule, NSEL disbursed some part payments on weekly basis i.e., ₹ 15.36 crore on
03.09.2013 & ₹ 13.45 crore on 10.09.2013 respectively.
