The following issues are raised for consideration by the Authority: Council supports the granting of a Planning Scheme Amendment and Development Permit for the following reasons: a) The sites are in a suitable location for horticultural development. b) The sites are of appropriate size to service horticulture uses. provided the following issues are adequately addressed: a) Council has concerns with the planned design for Manton Valley Road, Acacia Gap Road and Mocatto Road to form a four way intersection. The speed limit on Manton Valley Road and Acacia Gap Road is 80km/hr and the speed limit on Mocatto Road is 90km/hr. As such, Australian Standards require a 200m separation between the intersection of Manton Valley Road with Acacia Gap Road and the intersection of Mocatto Road with Acacia Gap Road. Therefore, Council requests the alignment of Manton Valley Road be redesigned to ensure that the intersection of this road with Acacia Gap Road is 200m from the existing intersection of Mocatto Road with Acacia Gap Road. As under the current

proposal Manton Valley Road divides Section 222 and Section 223, it is

recommended that the proposed parcel boundaries be realigned appropriately in respect to the revised road layout.

Should the application be approved, the Council requests the following conditions be included as Condition Precedents in any Development Permit issued by the consent authority:

a) Council requires that Manton Valley Road be redesigned such that the intersection

with Acacia Gap Road is located a minimum of 200m from the intersection of existing

Mocatto Road and Acacia Gap Road.

Should the application be approved, the following conditions pursuant to the Planning Act and

Council's responsibility under the Local Government Act are also recommended for inclusion in

any Development Permit issued by the consent authority.

b) Litchfield Council requests that the Authority require a monetary contribution is paid to Litchfield Council in accordance with its Development Contribution Plan for

roads and drainage to upgrade infrastructure as a result of this development. The site falls within Development Contributions Plan for Roads and Drainage - Catchment

Area 12A. The developer will be required to pay Litchfield Council a contribution

towards roads and drainage works in accordance with the above Catchment Area.

c) Engineering design and specifications for the proposed and affected roads, including

street lighting, stormwater drainage, vehicular access, pedestrian/cycle corridors,

street-scaping and landscaping of nature strips, shall be to the approval of the

General Manager Infrastructure and Planning, Litchfield Council, with all approved

works constructed at the developer's expense, to the requirements of Litchfield

Council.

Note: Design drawings should be approved by Litchfield Council prior to

construction of the works.

d) Soil erosion control and dust control measures must be employed throughout the

construction stage of the development to the satisfaction of the consent authority.

e) All existing or proposed easements or reserves required for the purposes of

stormwater drainage, roads, access or for any other purpose, shall be made available

free of cost to, and in favour of, Litchfield Council and/or neighbouring property

owners.

Should the application be approved, the following notes are recommended for inclusion in any

Development Permit issued by the consent authority.

a) Inspection fees and charges may apply in accordance with Litchfield Council's

current Municipal Plan. Additional information can be found at

www.litchfield.gov.nt.au .

b) A Works Permit is required from Litchfield Council before commencement of any

work within the road reserve, which would include creation of any driveway

crossover connecting to Litchfield Council's street network.
