ABOUT US The National Cooperative Union of India (NCUI), is the apex organization representing the entire cooperative movement in the country. It was established in 1929. The objectives of the NCUI are “ to promote and develop the cooperative movement in India, to educate, guide and assist the people in their efforts, to build up and expand the cooperative sector and to save as an exponent of cooperative opinion in accordance with cooperative principles”.

The National Cooperative Union of India being an apex organization of the Indian Cooperative Movement organized 16th Indian Cooperative Congress the highest forum of Indian Cooperative Movement on 25-26 June 2013 at New Delhi. Registration of the delegates took place a day before the event i.e. on 24 June 2013. The Congress was inaugurated by His Excellency, President of India, Shri Pranab Mukherjee. Shri Sharad Pawar. Hon’ble Union Minister of Agriculture and Food Processing Industries presided over the Inaugural Function. The other dignitaries

NABARD, NCDC, National Cooperative Federations, Secretary Incharge Cooperation, Registrar of Cooperative Societies, Senior Cooperators also participated in the Congress.

Dr. Chandrapal Singh Yadav, President of NCUI delivered the welcome address. In his welcome address, President NCUI highlighted the achievements of the cooperative sector and emphasized upon the crucial problems being faced by the cooperative sector in the country. He congratulated Union Minister of Agriculture and Food Processing Industries Shri Pawar for bringing the Constitution (Ninety Seven) Amendment Act giving

fundamental right to form Cooperative Society, which he described as a historic step for promotion and development of Cooperative Movement in India.

The Congress was attended by nearly 2000 delegates. In addition, 36 fraternal delegates from China, Japan, Nepal, Sri Lanka, UK, Bangladesh, Bhutan etc. participated in the event.

The documents released by the dignitaries during the 16th ICC were (i) Souvenir, (ii) Success Stories – cooperatives Surge ahead….. (tales of Success and achievement) (iii) Book on right to information and cooperative law.

The theme of the Congress was “cooperative enterprises Build a Better World”

The other subjects deliberated upon in eight (8) technical sessions in the Congress included Direct Tax Code- Income Tax Exemption to Cooperatives, Cooperative Legislation and Governance:

To make the deliberations more participative, each session was introduced with key note addressed by subject experts and the subject papers were presented by the resource persons.

To show-case the products of cooperatives, an exhibition of NCUI Cooperative Education Field Projects situated in Shimoga, Shillong, Jalandhar, Bilaspur, Moregaon, Aska, Kohima, Ahemdabad, Surendernagar, Manipur, Thoubal and Khurd was organized near the venue of the Congress. Efforts were made to show care the products made by the members of SHGs and their achievements on social front.

In the Valedictory Session Shri Shivraj V Patil Hon”ble Governor of Punjab and Administrator U.T. Chandigarh was the

Chief Guest. The Chief Guest presented awards to the best cooperative societies in different sectors. Hon’ble Union Minister of State (Independent Charge) for Chemical and Fertilizer Shri Srikant Jena was Guest of Honour. On this occasion KRIBHCO presented Rs.1.00 crore cheque to Union Minister of Chemical and Fertilizer in Relief Fund of Uttarakhand. Hon’ble Minister

of Cooperation. PWD and Irrigation, Government of UP Shri Shivpal Yadav presided over the Session. Shri Chandra Pal Singh Yadav, President, NCUI welcomed the guests. Dr. Dinesh, Chief Executive, NCUI placed draft recommendations which emerged from various technical sessions before the House for consideration.

cooperative movement in the country. The prime concern of the Congress were issues related to Direct Tax Code Bill of Ministry of Finance, Government of India and inadequate funds earmarked for education and training. Organization of new generation cooperatives by cooperative organizations in service sector to create employment potential, and enhancement of women and youth participation in cooperatives emerged as the other important recommendations. Several policy issues, policy initiatives, sectoral issues and issues related to HRD for strengthening the cooperatives emerged so that the cooperatives emerge as autonomous, democratic, professional and economically sound enterprises.

The following were the main recommendations/suggestions:

General cooperative policy & education & training

1. The cooperatives in India have made a significant contribution to the overall economic growth of our economy, especially in the sectors of agriculture, credit, sugar, dairy, textile, fisheries, distribution of fertilizer, agriculture input, storage and marketing. They are an important component for inclusive growth of our economy. However, their performance across sectors, activities and regions is variable. Hence, they need to reorient themselves to enhance their level of efficiency and meet the requirements of their core clientele – farmers, artisan, growers, producers and women. (National

Level Cooperative Organisation & multi-State Cooperative Societies, State Level Cooperative Federations)

2. Cooperatives must receive recognition as an important sector of our economy that serve marginalized and weaker sections. They must be made commercially viable in the areas where they can make an impact such as rural health, education, credit, water harvesting, tourism, communication and hospitality etc.

3. Cooperatives must be managed by adequately trained and enthuasiastic members. Cooperatives empower people, build capacities and develop capabilities. The Congress urges the Government for financial support for cooperative education and training activities in India.

4. In a globalised world, where India is placed in a better way to reap demographic dividend, the cooperative sector can play an important role in skill development amongst the youth. Some of the State Govts. have made training programmes compulsory for the employees of cooperative societies for getting their Annual grade increment and promotion. Kerala Govt. has already amended the relevant rules to make programme compulsory for the employees of cooperatives. This will create greater scope for professionalization.

5. Cooperatives have contributed to women empowerment by promoting self help groups, which organise various income generating activities, adult literacy and cooperative education programmes. 6. The Government step through enacting the 97th Constitutional Amendment thereby creating an enabling environment for the development of the cooperatives is indeed appreciable. But, to take initiatives further to the

grassroot level, the Congress urges the state governments to create enabling environment by amending state laws as and when it is necessary.

11. The agriculture sector in India has a large number of primary agriculture cooperative societies handling supply of agriculture inputs, credit, marketing and storage capacity. These cooperatives are organized by small and marginal farmers who face acute knowledge gap and deficiency in inputs in the delivery system. The Government of India and the state governments need to give adequate importance to the concept of cooperative education and training so that the members of the PACS residing in the villages are able to use modern technology, rural infrastructure and make use of market information and risk management.

Therefore, for any development related to the c o o p e r a t i v e sector, the State must participate effectively both in terms of money and manpower. Without effective participation of

Section 86 of the proposed Direct Tax Code Bill may kindly be made whereby the income from the business of providing banking credit facility to its members is exempted in respect of the incomes of a cooperative society engaged in banking activities, otherwise Section 80(P) as well as the proposed Section 86 of the Direct Tax Code Bill may be deleted and suitable amendments may be made in Section 10 of the Income Tax Act whereby the cooperative banks are completely exempted from Income Tax.

2. Interest/dividend received by cooperative societies either from other cooperative society or from others has to be fully exempted from Tax.

3. The provision of Tax to be deducted at source by a society from the customer shall not be applicable to cooperative societies.

4. In the proviso to section 36(1) (viia) specifically “co-operative Bank” should be mentioned next to scheduled bank or non-scheduled bank so that the assessing officer does not have any confusion on this front.

5. The following proviso may be added in section 36 (1) (viia):- “Provided that in the case of a scheduled bank or a non scheduled bank or a co-operative bank, the provisions for bad and doubtful debts in respect of NPAs as per the requirement of Reserve Bank of India shall be allowed as a deduction, specifically on the above mentioned lines. Necessary amendment may be made in the draft Direct Taxes Code, 2010 accordingly.

6. In section 80C (xxi) term deposit even with a co-operative bank should be eligible for tax deduction exactly on the same lines as that of a scheduled bank.

7. Amendment to section 43D to include applicability of the provisions to scheduled as well as non-scheduled co-operative banks.

8. The jurisdiction of Debt Recovery Tribunals may be extended to all cooperative banks-

9. Though, the Government of India interest subvention to cooperative banks for 2% is appreciated it will not make them viable until the interest subvention rate is 4.5%. Hence, a minimum of 3% interest rate should be continued as it was earlier so that the cooperative banks can operate as viable units.

10. Directives to various banks may issued for providing loan to NAFED. Presently, NAFED is availing loan at a higher rate of interest since agri-marketing activities of NAFED are not covered under the Priority Sector of Agriculture.

11. In case of housing societies, the deduction under the Income Tax Act, 1961 as available presently under section 80 P(2)(c)(i)and (ii) should be quantified not by the amount as mentioned presently in the section but the some may be qualified as a percentage of the total profits and gains attributable to such activities. The deduction in terms of the above section may be made at least at the rate of 50% of such profits and gains.

12. The proposed new section 80EE in the Income-tax Act, 1961 as proposed to be inserted by the Finance Bill; 2013 which provides for deduction in respect of interest on loan taken for residential house property should specifically mention that the loan issued from any cooperative bank to whom such interest is paid will also

13. In case of sugar societies, re–inclusion of sugar from the Schedule of Additional Duties of Excise (Goods and Special Importance) Act, 1957 to save the imposition of VAT in addition to excise duty is necessary.

18. No tax needs to be deducted from the works of labour cooperative societies as tax deduction at source under Section 194 (c) of IT Act.

Presently National Bank for Agriculture and Rural Development (NABARD) is providing concessional refinance facility to those registered labour cooperatives registered which are working in rural areas. However, it is stated that most of the works being awarded by work awarding agencies in urban areas should also be considered for concessional finance by NABARD.

20. The income-tax rates as mentioned in the First Schedule to the Finance Bill 2013 as applicable for the cooperative societies should be at the rate of NIL per cent on income up to Rs. 10 lakhs and at the rate of 10 per cent in case

the income of the cooperative society exceeds Rs. 10 lakhs.

21. In case of non-governmental organizations DTC bill provides maximum tax rates @20% only. The provisions of the Cooperative Act restrict voting right dividend declaration and non transfer of shares and hence the maximum tax rate for any cooperative which is promoting foods production, employment generation, health care, transport etc. per common man shall not exceed 20% as against the existing rate of 30%.

22. As per section 72 (A) of the Act regarding mergers and amalgamation of the companies the provisions also should be made applicable to cooperatives so that loss making cooperatives can be absorbed/amalgamated with the profit making cooperatives.

23. To enable cooperatives help better capital formation and further to improve Current Account Deficit, Indian citizens who are abroad (NRI) due to employment may be allowed to be the members of cooperative societies and they should have rights as other members. This helps cooperatives in their capital formation, and cooperatives can use the technical and management expertise of NRIs in this regard.

24. The activities of a co-operative societies, income from which are not to be included in total income, to be prescribed in view of Clause 10 of Direct Tax Code Bill, 2010 read with Item No. 47 of Sixth Schedule should be included in Clause 47 of Sixth Schedule itself. registered with the National Co-operative Union of India should also be provided exemption under this clause.

25. Under clause 294(2)(e) of DTC, 2010, co-operative societies should be given exemption from the provisions relating to acceptance/ repayment of loan/ deposit otherwise than by an account payee cheque or bank draft in excess of Rs. 50,000/- as these Societies are working at small level.

26. Third Schedule of DTC Bill, 2010 provides for deduction of tax on interest income at 10% at S. No. 3 of Schedule. Specific exemption may be provided in respect of TDS on interest income paid by co-operative societies to its members or any other co-operative society to bring it in line with the provision of Section 194A(3)(v) of Income Tax Act, 1961.

27. Data from the Co-operative Societies such as total number of societies working in the country, their nature, receipts generated, employment opportunities created, etc. should be collected in order to identify the contribution of co-operative societies to the nation.

cooperatives banks are scheduled and many state coop. banks and DCCBs are also non- scheduled, suitable amendments to the section 43D to include them has to be made to explicitly extend the benefits of the section to all non scheduled cooperative banks.

4. It is submitted that the cooperative banks may also be brought under the purview of the Debts due to banks and financial institutions Act 1993, so that they become eligible to approach DRTs for recovery of their dues.

5. In view of the above, to review and include urban cooperative banks within the ambit of the above subvention scheme in respect of housing loans.

6. The Federation has been requesting RBI to at least treat directors of urban banks on the same footing as directors of commercial banks in this regard and permit them facilities from their banks that are allowed as per B.R. Act. There is a case for full restoration of loan facilities to directors with a cap on the aggregate of such loans.

7. Claims of the depositors whose deposits are not covered should at least have same status with that of DICGC on the proceeds of recoveries of the banks whose licenses have been cancelled by RBI.

8. It is requested that cooperative banks that have become CBS compliance should also be

included as the eligible banks for the Direct Benefit Transfer Scheme.

9. There should be inclusion of Urban Cooperative Banks in the Central Sector Interest Subsidy scheme on Educational Loan for Economically Weaker Sections.

1. The basic ingredient required for the replication of Anand pattern in India is to reduce the involvement of government machinery, bottom up approach rather than top down approach, ensuring member participation and also developing committed and professional leaders.

2. The most important cooperative principle i.e. “Cooperation among cooperatives” if implemented in letter and spirit ensures the tapping of economies of scale. The basic requirement of ensuring cooperation among cooperatives is to build the mutual trust amongst the cooperatives, and create conducive policy and legal frame work for developing the professional management team.

present Cooperative Act relating to Housing Cooperatives. However, a Model Law on Housing cooperatives has already been drafted and approved by the Ministry of Urban Development and Poverty Alleviation and Ministry of Law, GOI. The same has been sent to all State Governments and the States like Delhi, Goa, J&K and Madhya Pradesh which have already initiated action on it. It is therefore, suggested that other State Governments should also consider the same.

laBoUr cooperativeS

1. As per recommendations of National Advisory Council on Labour Cooperatives constituted under the Chairmanship of Hon’ble Minister for Agriculture, Government of India, the skilled works upto Rs. 15 lakhs and unskilled works without any limit should be reserved for labour cooperatives.

2. 10% price preference should be given to labour cooperatives over the lowest tendered rates.

3. Labour cooperatives should be exempted totally from the levy of Sales Tax, Labour Cess, Income Tax and Service Tax by the State Governments, Ministry of Labour & Employment and Ministry of Finance, Government of India respectively.

4. Ministry of Agriculture, Government of India and Planning Commission should consider and approve Janta Personal Accidental Insurance Scheme for members of labour cooperatives to be implemented through NLCF during 12th Five Year Plan.

5. Ministry of Agriculture, Government of India should provide financial

assistance to NLCF to establish a permanent vocational training centre with boarding facilities in Delhi or any other suitable place in India for providing short and long-term skill development training to the members of labour cooperatives..

6. Ministry of Railways, Government of India should revive the Cooperative Cell in the Railway Board and revalidate the notifications issued earlier for granting the concessions and facilities to Railway labour cooperatives.

7. Ministry of Forest and Environment, Government of India should consider a long term working plan for the forest labour cooperatives working in Rajasthan, Gujarat and Vidharba region of Maharashtra

8. Cooperative organizations particularly National level Cooperative Federations should reserve their security, minor maintenance, civil construction and housekeeping jobs for labour cooperatives through NLCF. These organizations should also fulfill their outsourcing needs from NLCF.

9. Ministry of Agriculture, Government of India and NCUI should consider to reserve 25% of Education Fund for promotion of weaker sections cooperatives in the country.

coNSUMer aNd food prodUctioN – a role of cooperativeS

1. Steps should be initiated towards linkage of food production to consumers through cooperatives to avoid middlemen completely.

2. Crucial role should be given to consumer cooperatives in the proposed Food Security Bill of Govt. of India and NCUI may initiate necessary steps in this regard.

3. Public Distribution System (PDS) which was earlier with the cooperatives shall be restored in the country.

4. Stringent steps should be initiated to purchase stationery by govt. departments from consumer cooperatives only.

5. Steps should be initiated to re-define the consumer services and explore avenues such as health, education, child care, old Age homes and tourism sectors should be explored to provide services at lower prices to the consumers.

6. Steps should be initiated to make public distribution system smart and efficient by reducing transportation cost, co-create research and technology transfer, make farmers as partners in consumer cooperative movement, community management and collectivization, Farmer Field Schools (FFS), which adopt institutional mechanism like that of cooperatives, empower farmers through Information Communication & Technology (ICT).

7. Besides financial support, government should provide policy and operational supports to the consumer cooperatives.

8. Steps should be initiated to build a network of consumer cooperatives linked with the production and processing units located in different parts of the country. For this, a database should be created by NCCF.

9. More vegetables and fruit cooperative societies should be started through National Horticulture Mission and they should be linked be with consumer cooperatives.

areas such as rural, health, water harvesting and hospitality etc. In fact new emerging areas are also areas like power generation, production of supplementary fuel and service sector.

3. The weaker section of the community such as workers, fishermen, contract labour, weavers, women etc. have also been embraced by the cooperative movement to provide them gainful employment and to bring them out of the vicious circle of poverty.

4. In the field of social development the role of cooperatives has been quite appreciable. Cooperative hospitals, housing cooperatives, transport cooperatives, tourism cooperatives and consumer cooperatives have been rendering pivotal role in human development.
