Delhi budget session from June 23 to 30NEW DELHI

The Aam Aadmi Party government on Thursdayannounced that the Budget Session will be held fromJune 23 to June 30 for remaining nine months of thecurrent financial year.

The decision was today taken in the Cabinet chairedby Chief Minister Arvind Kejriwal here.

"Government has prepared a draft of Budget and sentit to the Lt Governor for the approval of the CentralGovernment.

"In today's cabinet meeting, we have decided to holdBudget Session from June 23 to June 30," Deputy ChiefMinister Manish Sisodia told reporters here.

In the Budget, government will make a provision offund to continue electricity subsidy which will come toan end this month, sources said.

In March, the Delhi government had presented a vote-on- account in the Assembly for April to June to runtheir several financial schemes and announced plan tospend a total of Rs 37,750 crore in 2015-16.

Asked about the date of tabling budget in theAssembly, Sisodia said that government will soon makeannouncement in this regard.

In the vote-on-account, the AAP government had allo-cated Rs 21,500 crore for non-plan expenditure whilethe plan outlay was around Rs 16,250 crore.

The proposed non-plan expenditure is around Rs3,000 crore more than last year's allocation while planoutlay would be Rs 100 crore less than last years outlay.

AAP government to compensate sex-ual assault victimNEW DELHI

The NHRC on Thursday reiterated that the Delhi gov-ernment should pay Rs 1 lakh as compensation to aminor sexually assaulted by an employee of a govern-ment hospital in 2013.

The National Human Rights Commission (NHRC)had in January 2015 directed the Aam Aadmi Party(AAP) government to compensate the 15-year-old.

The Delhi government argued that the onus of provid-ing relief should lie on the accused.

"It was established that a minor girl was raped at thehospital by a staff who was a public servant. It amount-ed to violation of human rights of the girl, for which thestate is vicariously liable," the commission said.

"The commission, as per Section 18 (a) (i) of theProtection of Human Rights Act, 1993, can recommendthe concerned government to compensate the com-plainant. Therefore, the commission reiterated its earli-er stand for payment of monetary relief to the victim."

The NHRC asked the government to submit a compli-ance report along with the proof of payment within sixweeks.

AIIMS asked to review chargesheetagainst ex Dy DirectorNEW DELHI

In a significant move, the Union Health Ministry hasasked the Director of AIIMS to review the long-pendingcharge sheet against an ex-Deputy Director of the insti-tute Vineet Chaudhary over alleged administrativeirregularities.

"The Ministry of Health and Family Welfare hasasked Director AIIMS to undertake a preliminary deter-mination of whether charges against Chaudhary meritdisciplinary proceedings or not.

"AIIMS has received reminder on May 20, 2015 forurgently furnishing the requisite information to theMinistry," said a senior official at AIIMS.

A complaint was lodged at AIIMS Vigilance officeagainst Chaudhary by NGO Janhit Abhiyan inSeptember 7, 2012 for alleged irregularities in construc-tion work and recruitment etc.

The complaint was investigated by the then AIIMSChief Vigilance Officer Sanjiv Chaturvedi after whichseven charges were found proved against Chaudhary.

These included granting illegal extension to thenSuperintending Engineer of the institute, purchase ofland without proper sanction from government, disap-pearance of files related to the CVO, illegalities inappointment and payment to the consultants etc, saidthe official.

The charge sheet was forwarded to then HealthMinister Ghulam Nabi Aazad in November 2013 whoordered the Director of AIIMS to submit a report onoffences prima facie made out against Chaudhary.

"After that a draft charge sheet was submitted byDirector AIIMS in July 2014 to Harsh Vardhan (thenUnion Health Minister) who approved it in August2014.

"However, since then the charge sheet was pendingbetween Chief Vigilance Commission (CVC) andHealth ministry," the official said.

Meanwhile, the CVO AIIMS on June 5 informedAIIMS administration that the issues raised againstChaudhary do not appear to have a vigilance angle andthe Director of the institute may make a preliminarydetermination of whether the charges merit disciplinaryproceedings, said the official.

Delhi's Home Secretary, Chief MinisterArvind Kejriwal on Thursday conveyed toUnion Home Ministry that giving addi-tional charge to top bureaucrats was with-in the rights of his government and that itshould not interfere in such matters.

Senior IAS official Dharam Pal wasremoved as Home Secretary on Tuesdayand repatriated to the Centre by AAP gov-ernment. Principal Secretary of ServicesDepartment Rajendra Kumar was giventhe additional charge of the top post.

However, Lt Governor Najeeb Jung hadrejected Pal's transfer and asked him tocontinue while Kejriwal had asked Kumarto discharge his duties as Home Secretary.In something unprecedented, both Kumarand Pal have been working separately asHome Secretaries since yesterday.

In a letter to Home Ministry this morn-ing, Kejriwal said as per provisions of theConstitution and GNCT Act, the city gov-ernment was well within its right to give"additional or temporary charge" to seniorofficials. He also maintained that city gov-ernment, as per laid down provisions, hasa say in transfer and postings.

Meanwhile, the Home Ministry hasrevoked Delhi Government's order torepatriate Pal to the Centre terming it "abinitio void" and asserted that powers totransfer AGMUT cadre officers rests onlywith the Centre.

Pal was also Principal Secretary (Landand Buildings) and Delhi government hadappointed 1992-batch IAS officerAshwani Kumar to the post.

Delhi Chief Secretary K K Sharmatoday conveyed to Kumar about the HomeMinistry's directive.

"The orders number 296 and 297 standrescinded in compliance with the orders ofCentral Government," the Chief SecretaryK K Sharma said in his order today.

In its order, the Union Home Ministrysaid that it is the cadre controlling author-ity for AGMUT cadre, which is a jointcadre.

Pal was removed by the AAP govern-ment after he signed a notificationappointing Joint Commissioner of DelhiPolice M K Meena as new chief of Anti-Corruption Branch (ACB) following LtGovernor Najeeb Jung's order.

Jung on Monday had appointed Meenasuperseding Kejriwal's hand-picked chiefS S Yadav. The AAP government hadreacted sharply to the decision.

Special CBI Judge S CRajan granted one monthinterim bail to MLogapathy, an IRS officerof 2008 batch, on healthground on a personal bondof Rs one lakh with asurety of the like amount.

"Considering the reportsubmitted by medical offi-cer and in view of the sub-missions of counsel, theapplicant/accused MLogapathy is admitted tointerim bail for a period of

one month on furnishingpersonal bond in a sum ofRs one lakh with one sure-ty of the like amount," thecourt said.

Logapathy had soughtbail, saying he was arrest-ed on April 15 and wasnot required for any fur-ther interrogation by CBI.

His counsel argued thattwo co-accused havealready been grantedinterim bail on medicalground and health condi-tion of Logapathy, whowas suffering from seri-ous liver ailment, wasdeteriorating as he wasnot getting proper treat-ment in jail.

The defence counselalso said that daughter ofthe accused had sufferedserious head injuries andLogapathy was requiredto look after her.

Centre cancels Delhi govt order toremove Home Secretary

NEW DELHIThe Home Ministry has revoked the

said those opposing yogawere "enemies of humani-ty" and yoga has nothing todo with religion.

External Affairs MinisterSushma Swaraj had said acommittee which decidedthe common yoga protocolhad not included Suryanamaskar "because theywanted easy asanas (exer-cise) in it, which can beperformed by anyone."

Naik today said, "We didnot include Suryanamaskarto avoid controversy. And,moreover, it's difficult todo it. But Suryanamaskaris not religious. We wantthe whole event to gosmoothly."

"Shlokas are not compul-sory. Shlokas are merelyprayers but it is not com-pulsory. They can eventake the name of Allahinstead of chanting

shlokas. I request theMuslims to participate andunite the country," Naiktold reporters after meetinga delegation of Muslimorganisations.

Opposition has beenvoiced by some organisa-tions, including the AllIndia Muslim PersonalLaw Board, against per-formance of SuryaNamaskar, saying it isagainst their faith.

"We did not make any-thing compulsory. Even theHRD Ministry has merelyappealed to the educationalinstitutions. Few partiesare opposing it for the sakeof politics," Naik said.

Noting that yoga is amatter of pride and has"nothing" to do with reli-gion, the Minister said thatyoga unites people and isdone for fitness.

missing Indian CoastGuard Dornier aircraftenters third day, PrincipalSpokesperson, Ministry ofDefence, Sitanshu Karinformed that efforts tolocate the plane are onround-the-clock.

Kar, in a series of tweets,told that all areas of possi-bilities are being exploredby Indian Coast Guard andNaval ships.

"ICGDornier 12 CoastGuard and Naval shipsalong with patrol boats ofthe Coastal Security groupare continuing the search,"he tweeted. The aircrafthad gone missing nearKaraikal in Puducherry.

The Coast Guard hassought the Indian SpaceResearch Organisation'shelp to locate the missingaircraft with the help of itssatellites. According to theofficial, there was noupdate on test done onsamples of oil floating inKaraikal sea - an areawhere search was beingconducted. The coastalsecurity agency onWednesday said 15 highlyspecialised CoastGuard/naval ships and

several patrol boats ofcoastal security groupwere involved in thesearch operation.

Air sorties too have beencarried out to locate themissing aircraft.

Queried about tower sig-nals of cellphones of theaircraft's crew, a CoastGuard official told IANSthat no such signals werereceived. The crew includ-ed Deputy CommandantVidyasagar piloting theaircraft, his co-pilot andDeputy Commandant MKSoni andnavigator/observer SubashSuresh, all in their 30s.

The missing aircraft wasdeployed for surveillancealong the Tamil Naducoast and Palk Bay. It tookoff from Chennai airportaround 6 pm on Mondayfor a surveillance sortiebut did not return.

An official statementissued on Tuesday said thelast contact with the air-craft was made at 9 pm onMonday. The last knownlocation of the aircraft, asper Trichy radar, was offKaraikal in Puducherry,where it was tracked till9.23 pm, 95 nautical milessouth of Chennai.

From being a "problem", the dung has nowbecome an asset that is being monetised and isbeing used for the ecologically beneficialinvention of 'cow-dung bricks' or as manure infarms and cremations in form of 'cow-dunglogs', she said.

Thursday passed a resolu-tion condemning PrimeMinister Narendra Modi'srecent remarks on theIndian role in creation ofBangladesh.

The resolution waspassed unanimously, andcondemns the recentprovocative and hostilestatements by Indian lead-ers against Pakistan,Pakistani media reported.

The resolution rejectedIndia's “hegemonic mind-set” and stressed thatPakistan will never allowIndian forces to violate itsterritory. During the dis-cussion on the resolution,political leaders empha-sised that the armed forcesof Pakistan would give abefitting reply to anyincursion attempt by India.

The resolution came aday after India said its sur-gical strikes insideMyanmar to exterminatemilitants were a messageto other neighbours, indi-rectly implying a warningto Pakistan.

23% samples test positivefor 'lead' poisoning

He said leadpoisoning is tested usinghigh sensitivity technologycalled ICPMS (InductivelyCoupled Plasma MassSpectrometry) andGraphite Furnace Atomicabsorption spectrometry.Blood, serum and urinesamples can also be testedfor lead. In growing chil-dren, it causes low IQ,hyperactivity, attentiondeficit, learning disabili-ties and anaemia, he said.

"Lead poisoning can behard to detect even peoplewho look healthy can havehigh levels of lead. At highlevels of exposure, leaddamages the brain and cen-tral nervous system andcan lead to coma, convul-sions and even death.Signs and symptoms oflead poisoning usuallydon't appear until danger-ous amounts have accumu-lated," Warghade added.

In the land of the cobra andthe snake-charmer, the cobrafinds itself in the middle of

an unlikely controversy.Cloaked under the privilege of“religion and culture”, the newdraft National Wildlife Policy,framed by the Ministry ofEnvironment, Forests andClimate Change, suggestsamending existing laws to allowhunting of animals like cobras.Union Environment MinisterPrakash Javadekar has repeated-ly made statements sayingwildlife protection laws can beamended to accommodate “reli-gious and cultural practices”. Ahigh-level committee set up toreview India’s environmentlaws, led by former CabinetSecretary T.S.R. Subramanian,first suggested these amend-ments, stating they would beharmless to both man and beast.

The question is whetherendangered and protectedspecies, already illegallypoached, should be subjected tofurther commodificationthrough vague terms like “cul-ture” and “religion”. More prob-lematically, the question iswhether decisions that impactecology and non-human speciesshould be taken on lines thatwill likely favour one dominantcommunity, or custom, overanother. Both problems repre-sent the way certain animals areconstructed as familiar to us,even as friendly; even if the ani-mals are, in fact, dangerous,endangered, or hard to procure.At its centre is a person’s per-ception of the wild animal, how-ever removed from reality.

The wild as familiarHunting of most animals,

except notified vermin (likerats), is prohibited in India. Thisstems from strong conservationand preservation laws in inde-pendent India. However, thedraft of the new NationalWildlife Policy suggests that ifcruelty in hunting can beremoved, hunting should be

allowed. It states: “Traditionalpractices involving wild animalsare prevalent and in almost allcases, there are confrontationsbetween the enforcementauthorities and communities onthese aspects, [thus] it is desir-able to distinguish between“hunting” and specified reli-gious/cultural practices of com-munities involving wild/ sched-uled animals. The regulationsfor appropriate safeguards andprevention of cruelty can be pro-vided in the Act.”

The predecessor of this is theT.S.R. Subramanian Report,which recommends: “India has avaried and glorious cultural tra-dition; while there are manynational festivals, there are alsolocalised festivals which are ofgreat local importance in differ-ent States. Nature and animalworship has been part of thenational culture. Thus, forexample, Nag Panchami inmany States is celebrated andsnakes worshipped during fivedays in the Shravan month, as athousand-year-old tradition. It isto be noted that the snakes arenever harmed — indeed they areworshipped during this period.

A dispensation in the variousSchedules should be permittedto take into account such localpractices, and reflect them intheir approved schedules,through gazette notification.”

Both high-level documentssuggest that removing cruelty inthe capture or procurement ofthese animals can not only givethe animal respect but also fulfilcultural traditions. For a specieslike the cobra (or any wildsnake), this could not be furtherfrom the truth. For NagPanchami each year, tens ofthousands of snakes are cap-tured. Cobras, like many wildsnakes, do not take well to cap-ture. They are almost alwaysdefanged using stones or hotmetallic instruments and theirmouths are stitched up. They diedeaths that are always painful,and sometimes delayed.

The interpretation of certaintraditions, however, construethat the captured, livid, hissingcobra wants to be captured or isbeing adequately respected. Inreality, the hunting of snakes(cobras, rat snakes), birds (likeowls, parakeets) and other ani-mals always masks the death of

many more. For each bird orsnake in illegal captivity, thereare thousands that died duringthe capture or transportation.Several animals will not andcannot breed in captivity. Toprocure them for any culturalcustom, their capture from thewild will always be necessary.The Ministry’s moves try to castan accommodative sheen oncustom and culture, but the real-ity is invariably gruesome.

Sacred becoming profaneIn India, several animals are

deemed “holy”. This has led in amajor part to unsustainablepractices. Wild elephants arecaptured, beaten and broken, tocarry people or stand immo-bilised for hours on end,adorned with heavy and blind-ing ornaments. Snakes andconch shells are illegally “har-vested” for sale at scandalouslygreedy rates. For several wildspecies, their being sacred hasactually led to physical profani-ty. Should the EnvironmentMinistry broaden the cruelty ofhunting in the name of faith?And further, is it the job of theEnvironment Ministry to be thegatekeeper of which customs,

religions, and practices touphold or privilege over anoth-er?

It was reported recently thateight tribals from Jharkhand’sKhunti district have been lan-guishing in jail for months now,for sacrificing an ox, deemedholy by Hindus. The tribals wereunaware of the furore theiractions would cause, and theiractions were probably inadver-tent. However, amending thelaw as per the above suggestionswould mean knowingly allow-ing sacrifice, harvest and hunt-ing of some animals; and privi-leging one belief over another.Apart from having social ramifi-cations, it will also strengthenthe hands of poachers bybecoming, effectively, a smoke-screen for poaching itself. Tillabout 50 years ago, it was con-sidered ‘cultured’ for people tohunt tigers. British and Indianroyals and nobles hunted. Aswith other social evils, huntingtoo was deemed an anachronismand banned. We will be takingseveral steps back if we re-allowhunting, whether for ‘religioususe’ or otherwise.

Ultimately, one hopes cultureis something that evolves. TheNyishi tribals of ArunachalPradesh have learned toembrace artificial fibreglasscasques instead of hunting theendangered hornbills for head-gear — that is evolution. Similarsolutions should be found,instead of targeting the alreadydwindling wild animal popula-tions. The EnvironmentMinistry needs to show leader-ship in protecting biodiversity.Towards this end, it shoulduphold hunting restrictions,instead of considering changeswhich will be cruel, regressive,and fetishise species. The onlyright answer is in creating newand evolved cultures.

In the recently concluded sessionof Parliament, while some impor-tant Bills got passed, others had to

be sent to parliamentary committeesfor further scrutiny. Some of thedelayed Bills were termed as ‘gamechangers’ and the stock marketindices reacted negatively. The Billswere passed in the Lok Sabha butwere stalled in the Rajya Sabha sincethe government did not have thenumbers. Politics played an impor-tant role in all this but there are gen-uine reasons why a reconsideration ofthe stalled Bills may be beneficial forthe country.

A paper tigerLet us start with the so-called

“Black Money Bill” passed with easein both Houses of Parliament. Noparty wanted to be seen opposing itgiven the prevalent anti-corruptionclimate in the country. Since the Billseeks to bring back illegally stashedwealth from abroad, opposing itwould have appeared to be anti-national. It also passed easily becausemost realise that it will do little tobring back the ‘treasure’! The viewsof the high-profile activists fromwithin the ranks of the BharatiyaJanata Party (BJP), Ram Jethmalaniand Subramanian Swamy, make itclear that the Bill is a paper tiger.

It provides for stringent punish-ment of those Indians who holdundisclosed wealth and/or earnundisclosed incomes abroad.Excluded from its purview are Non-Resident Indians (NRI) who are gen-uine holders of wealth abroad andcan earn incomes there. They are notobliged to declare their assets orincomes to Indian authorities. So,Indians who are moneyed, work outan arrangement with NRIs to holdtheir wealth and show their incomesthrough legal arrangements.

Further, the provisions of the Billwill be applicable only if the govern-ment is able to detect incomes andwealth held abroad. The Bill has nomechanism for doing so. Hence, thedraconian punishment — a jail termand 300 per cent fine — can hardlybe implemented. An amnesty scheme

is being offered to come clean. Therewill be no punishment if one disclos-es the assets and incomes abroad inthe specified period and pays thetaxes within six months. Thus, theinexperienced ones who had heldillegal wealth abroad in their ownnames and earned incomes on themwould have a chance to come clean.The HSBC list revealed that someIndians who did take out funds intheir own names have now gotcaught. The ‘experienced’ oneswould not have made the mistake ofholding funds in their own names.

The process of “layering” has beenavailable for a long time. It hides aperson’s identity by using shell com-panies in tax havens to transfer funds.It is no surprise then that the Swissgovernment revealed that Indianshold only Rs.14,000 crore in Swissbanks. This is mostly legitimatemoney, of Indians, and in their ownnames. The black wealth of most‘experienced’ Indians would beparked there via shell companies intax havens and hence not be countedas Indian money. The largest amountof money in Swiss banks belongs tothe British since they own the largestnumber of tax havens.

The loophole of amnestyThe Bill contains no mechanism to

identify funds going out or being heldabroad. The government arguesrepeatedly that it will get informationvia the Double Taxation AvoidanceAgreement (DTAA) or TaxInformation Exchange (TIE) agree-ment with a number of governments.However, these agreements havebeen in place for more than twodecades; it is ironic that under them,there has been no information onblack wealth holders. Further, theseagreements are about the declaredincomes of individuals and not abouttheir undisclosed wealth or incomes.Hence, this argument does not holdwater.

Bill does hold out a threat that ifanyone is caught, the penalties willbe harsher than for those with blackwealth detected in India. There maybe a deterrent effect but since thebrief of clever lawyers, charteredaccountants and bankers is to deviseways to hide incomes, it can only bea losing battle. Thus, the most signif-icant aspect of the Bill is the amnestyto those to come clean who may havemade the mistake in the past of put-ting money in their own names. It isno wonder then that the Bill waspassed in Parliament.

A blow against corruptionThen, there is the Whistleblowers

Bill, crucial in exposing rampant cor-ruption in the country. While it is dif-ficult for people outside to unearthcorruption in institutions, insiders areoften in the know and can reveal itsextent provided they have protectionunder the act. But the amendmentsproposed will make action on com-plaints by whistle-blowers more dif-ficult, and they can face prosecution.Together, both these will dissuadepeople with information from comingforward to expose wrongdoing. Isthis the intention of the government?Corruption works to the disadvantageof the vast majority of Indians and ifthe amendments to theWhistleblowers Bill are passed, theywill be the sufferers.

Affecting the small sectorThe introduction of Goods and

Services Tax (GST) in the country isbeing promoted as the biggest taxreform in India and a game changer.It is supposed to provide a seamlessunified market for business, raiseGDP growth by 1 per cent, tax-GDPratio by 2 per cent, reduce the cost ofindigenous goods by around 10 percent and lead to the consolidation ofmanufacturing to reap economies ofscale. However, the Bill proposingthe constitution amendment to enablethe implementation of this reform has

been sent to a parliamentary commit-tee, thus delaying its implementation.The United Progressive Alliance,which introduced this idea, has nowbacktracked since it does not wish togive the BJP-led NationalDemocratic Alliance (NDA) anadvantage. Opposing it on genuinegrounds are the manufacturing Statesthat are worried about loss of rev-enue.

However, the real problem withGST in India is not being addressedby any of the political parties. Indiahas a large, unorganised sectoremploying 93 per cent of the work-force. The small and tiny units underit produce locally and sell locally.The unified market sought to be cre-ated is of little help to them. Actually,they will lose as large-scale produc-tion gains. This will slow downemployment generation and aggra-vate underemployment and distressin the farm sector. Excess labour infarming typically gets absorbed in theunorganised sector; if that sectordeclines, rural distress can onlyincrease.

The small-scale sector that wouldbe outside the GST net would not beable to sell to the large-scale sectorbecause it would not have receipts forpayment of Value Added Tax.Further, the unorganised sector can-not afford computerisation ofaccounts to calculate the value addi-tion and pay tax on it. That is why itis kept outside the GST, but thatwould now be to its disadvantage.

Finally, there are contradictions inthe argument being made for GST.The tax-GDP ratio can only rise ifmore tax is collected but then priceswill rise leading to a slowdown indemand so that GDP growth rate can-not rise as claimed. Further, if theGST tax rate is not raised to the rev-enue neutral rate (RNR), then tax col-lection will fall and the tax-GDP ratiocannot rise. Thus, the macro-levelstory shows that either way, there is acontradiction in the government’sargument. It is for this reason that theStates are right to worry about apotential loss of revenue. Clearly,GST is being introduced for the ben-

efit of large businesses and wouldwork against the interest of the small-scale sector and the majority in thecountry.

Marginalising the farmerThe Land Acquisition Bill is also to

further the interests of big businessesand a part of creating the “ease ofdoing business”. In the process, theland owning-farming community isbeing sought to be marginalised.Farming is not just work but also away of life and when the village com-munity — with all its drawbacks —is broken up, then people are forcedto give up a way of life. Manymigrate to urban areas with fewassets, to an alien and polluted slumenvironment and suffer a deteriora-tion in their living conditions. Shouldthese people not have the right to beconsulted? In the past, excess landhas been acquired cheap and hasbecome an investment for big busi-ness. In Gurgaon, land was acquiredby big developers in the 1980s anddeveloped for commercial and resi-dential purposes rather than foressential purposes. The developersgot advance information andacquired large parcels of land at acheap rate in connivance with politi-cians. In fact, a Chief Minister gotover a lakh acres of land notified foracquisition. But for the fall of thegovernment this would have gonethrough at the expense of the farmers.

In brief, the Land Bill and the intro-duction of GST will further margin-alise the already marginalised. TheBlack Money Bill and the proposedamendment to the WhistleblowersBill will together make the task ofunearthing black incomes in India orabroad more difficult, in turn addingto the difficulties of the commonman. When the NDA came to power,the Finance Minister had argued thatbeing pro-business is not being anti-poor, but the government’s actionsseem to contradict that.

After months of sparring by means of official noti-fications, rounds of litigation, and orders of trans-fer and dismissal of various officers, the seeming-

ly endless battle for the control of Delhi between the AamAadmi Party and the BJP-led Central government hastaken an ugly turn with the extraordinary arrest of JitenderSingh Tomar. The Delhi Law Minister, who allegedlyholds two fake educational degrees, resigned hours after acourt sent him to police custody.

It must be said that the AAP has handled the issue ofMr. Tomar’s qualifications with a complete lack of politi-cal nous.

This has been the subject matter of a case in the DelhiHigh Court after the issue came up in February, and theparty could have either asked the Minister to step downtill he was cleared of the charges, or simply made hisdegree diplomas public on its website. It might be saidthat the AAP deserves sympathy in its ongoing face-offwith a Goliath of a Centre, but lapses such as these are butanother reminder that it could no longer really claim to bea party with a difference.

The Delhi Police have gone strictly by the letter of thelaw in ordering the arrest. However, the manner in whichthey have gone about the process has left no one in doubtthat it has essentially been a show of strength against apolitical party that is determined to put an end to corrup-tion.

To arrest Mr. Tomar the Delhi Police sent a posse of 40officers, and then deployed heavy security around thepolice station where he was being held.

The police worked late into the night to file a firstinformation report, got it signed by Lieutenant GovernorNajeeb Jung around midnight, and then appeared at Mr.Tomar’s residence around 6 a.m. to make the arrest. Thesudden drive and determination to arrest on the basis ofcharges of forgery a person who is hardly likely to goabsconding, made it seem politically motivated.

The governmental tussle over Delhi has meanwhilereached its zenith, and one battleground is the State’sAnti-Corruption Branch.

The Lt. Governor recently created a senior post in theACB so that he could post an officer of his choice who,incidentally, was conducting the investigations when afarmer committed suicide at the venue of an AAP rally.The AAP cried foul and ordered him sent back.

That order was cancelled by the Lt. Governor. In retal-iation, the AAP transferred out the official who hadappointed him.

All of this points to just another bizarre turn to a bizarresituation where the two governments just seem to be itch-ing for a fight. The people of Delhi, interminably caughtin the crossfire, may be the only real losers.

Myanmar strike...state and when an attack is imminent.The Myanmar hot pursuit appears to have

taken a leaf from the United States’ pre-emp-tive doctrine and attacked militant outfits inMyanmar in defiance of sovereignty and itcould be said even international law. Thestate has gone further and asserted that theMyanmar operation was not an isolated one;it would hold in the future too against hostilestates and groups.

What can be inferred and extrapolated fromthis activism by the Indian state?

First, it would appear, India is not reluctantover the projection of force across borders.The architect of this activism, if press reportsare to be believed is Ajit Doval, the NationalSecurity Advisor to the government. Thismeans that India’s National Security doctrinehas undergone a radical shift and departure. Ithas shifted gears from being reactive toaggressive. The approach meshes and gelswith India’s aspirations for regional hegemo-ny.

Second, at the risk of repetition, it meansthat force is once again de rigeur in interna-tional relations. However, the major insightappears to be that regional hegemons or aspi-rational regional hegemons will take it uponthemselves to settle conflicts and disputeswithin the ambit of their respective regions.This would be a departure from past practiceof taking recourse to pleading with or seekinghelp from global powers for dispute settle-ment or conflict resolution. In this sense,force and power projection become the locusaround which states settle or arbiter their con-flicts and from a broader perspective and can-vas accrues from United States’ relativedecline and even quasi isolationism.

The third point that flows from this is the'security dilemma' and the attendant armsraces become prominent again. The securitydilemma is a spiral that accrues when onestate’s attempts to maximize security andpower induces the other state or states to dothe same. Arms racing are a natural concomi-tant to the security dilemma. The world or atleast the South Asian region is then back tosquare one. The region now risks being aheavily militarized region with potentialimplications for the alliance system(s) in theregion.

All this suggests a bleak future for the sub-continent. But the major consequences willbe between archrivals India and Pakistan.Will the Doval doctrine and the signalinginherent in it make Pakistan cower?

Unlikely is the answer. The Pakistani stateis primed for conflict with India. And towardthis end, Pakistan to gain parity with Indiahas acquired nuclear weapons. This neutral-izes India's superiority in conventional forcesand leads to a deterrence paradigm betweenthe two countries. So India is unlikely toreplicate the Myanmar experience withPakistan unless it wants to disturb and throwout of kilter the deterrence balance that holds.Disturbing this would axiomatically lead to anuclear conflagration in the region-a prospectthat rationality suggests both countries shouldshy away from. The statements emanatingfrom the Indian state’s defence establishmentthen are in the nature of rhetoric and postur-ing.

Or , in the least, one would hope that it ismere posturing. If , however, there is more tothe statements other than signaling, there arereasons for despair. The subcontinent will fallvictim to a more militarized rivalry and couldwell become the 'most dangerous place on theearth'. This is a condition that serves none andshould be averted. Prudence then dictates thatsobriety and a sense of proportion informsinter state relations both in the subcontinentand the world at large.

High alert...election is due soon.Sources said Doval, who will visit

Myanmar soon, will brief the Myanmareseleadership about the circumstances leading toIndia taking the bold step of ordering surgicalstrike against militants operating from thatcountry’s soil.

There have been reports that India informedMyanmar about the Army’s strike only aftercompletion of the operation and that upset theMyanmar leadership.

Passengers, who witnessed the violence,alleged that following the death of a CISFjawan, some CISF personnel went on a ram-page chasing away passengers and other offi-cials with lathies.

After the violence, Karipur airport wasclosed to traffic and three flights were divert-ed to Kochi's Nedumbassery airport, leavingaround 400 passengers stranded.

Airport security still continues to be withCISF and state police have not taken chargeof it, officials said.

An international space trioclimbed into a Russian Soyuzspacecraft on Thursday and

left the International Space Stationafter 199 full days in orbit to begintheir delayed return to Earth, NasaTelevision showed.

Expedition 43 Commander TerryVirts of Nasa, Samantha Cristoforettiof the European Space Agency andRussian cosmonaut AntonShkaplerov gave a hearty hug tothree crewmen remaining aboard theISS before sealing themselves intothe Soyuz TMA-15M spacecraftshortly after 0700 GMT.

Three hours later the Soyuzundocked from the Rassvet moduleat the $100 billion (roughly Rs.6,39,868 crores) space outpost, aim-ing to land in central Kazakhstan at1943 local time (1343 GMT).

"All Soyuz systems are operatingin excellent fashion. No issues what-soever at this stage," Russia'sMission Control near Moscowreported as the spacecraft floated

away from the ISS.The crew's departure left Russian

cosmonauts Gennady Padalka andMikhail Kornienko and Nasa astro-naut Scott Kelly on their own until atleast July 23, when cosmonaut OlegKononenko, Nasa's Kjell Lindgrenand Japan's Kimiya Yui are due tolaunch. Kornienko and Kelly areabout 2.5 months into a planned year-long stay on the station, a first for the15-nation programme. Nasa is cur-rently interested in accumulatingmedical data about long-term effectsof microgravity in a space station asit lays the groundwork for eventualhuman missions to Mars.

Virts, 47, who had one previousspace shuttle mission before flying tothe space station last November,turned over command of the stationto Padalka, 56.

Padalka, the first four-time ISScommander, will return to Earth inSeptember after a cumulative total ofsome 878 days in orbit, more thanany other person. "No matter how

many flights you have it's always like... a first flight," Padalka said duringthe ceremony, broadcast by Nasa."Hopefully, everything will be asscheduled and we'll be looking for-ward to meeting the next crew."

The launch of the station's nextcrew, which had been slated for lateMay, was postponed for two monthsdue to questions about the RussianSoyuz rocket used to carry the pas-senger capsule into orbit.

A different version of the rocketfailed to deliver a Progress cargocraft on April 28, and harmlessly fellinto the Pacific Ocean in early May.

As a precaution, Russia delayed thelaunch of the new crew and kept thecurrent team in orbit for an extramonth to minimize the amount oftime the station would be half-staffed. The belated homecomingleaves Cristoforetti as the newrecord-holder for the single longestspaceflight by a woman, eclipsingNasa's Sunita William's 195-dayflight in 2006-2007.

NEW DELHIThe tax issues facing the

Formula One Indian GrandPrix will have to be sortedfor the return of the high-profile race, its promoterSameer Gaur asserted onThursday.

Both Gaur and F1 supre-mo Bernie Ecclestone hadearlier targeted a 2016return but Jaypee SportsInternational (JPSI) chiefhas now said it is best towait for the outcome of thetax case heard in BombayHigh Court.

"We are waiting for theincome tax issues to besorted and once they aresorted, we will be back ontrack. It is the most impor-tant issue facing the race.

The Formula One Groupwill also know what theirobligations are (in India)when the tax case issolved," Gaur told PTI.

Before the first race tookplace in 2011, F1 hadmoved Authority ofAdvanced Ruling (AAR) toascertain whether its

income is taxable in India.The tax issue and red tapesurrounding the eventeventually led to the racebeing dropped after three

editions. Gaur said hecould only talk about thepossible return date for theIndian Grand Prix once thecourt decides on the case.

"It is very difficult for meto predict. It could be 2016if the case is decided intime else we will have tolook at 2017. It all dependson the outcome of the case.

"The issue basically is onthe tax liability of theFormula One Group,whether they have to paytax here in India or inEngland, mainly coveringthe income generated fromlicensing fee and income ofthe teams and drivers," hesaid when asked about thepressing problem for therace.

Nawaz Sharif letter thanks Robert Mugabefor sending cricket team to Pakistan

Robert Mugabe for sending Zimbabwean cricketteam to Pakistan and help revive international crick-et in the country after six years, officials said onThursday. "The government and people of Pakistanare grateful to you for your leadership, vision andsolidarity with Pakistan and Pakistani cricket forhelping make this entertaining cricket contest a real-ity," Sharif wrote in a letter to Mugabe.

Sharif talked about the successful tour and theenthusiasm displayed by cricket fans in Pakistan.

"I am sure you have been informed about thetremendous enthusiasm of the Pakistani fans whopacked the stadium on all the matches, waving notjust Pakistani flags but also those of Zimbabwe," he

wrote in the letter dispatched yesterday from PrimeMinister House.

Sharif said the successful tour would pave way forother teams to play cricket in Pakistan.

"The successful series has now paved way forPakistan to host other teams and to be reintegratedinto the mainstream of international cricket," he said.

Cricket returned to Pakistan after six years whenZimbabwe played two three ODIs and two T20s inLahore last month.

The bilateral series, the first after an attack on SriLankan cricket team in 2009, ended with Pakistanwining both the T20s and clinching the ODI series 2-0 as the final match was washed out.

The tour went ahead despite a suicide bombing nearthe stadium in Lahore on May 29.

Days after lead wasfound in instantfood Maggi that

had raised concerns overpacked food items, ananalysis of blood samplescollected over a period ofone year from across thecountry has revealed thatover 23 per cent of the totalsamples tested positivewith lead poisoning.

According to a WHOstudy, lead exposure is esti-mated to account for1,43,000 deaths per yearwith the highest burden indeveloping regions.

Recently, popular noo-dles 'Maggi' has comeunder regulatory scannerafter samples collected invarious parts of the countrywere found containingadded monosodium gluta-mate (MSG) and lead inexcess of the permissiblelimit and its sale banned inmany states.

"A pan-India analysis of733 blood samples collect-ed over last one year hasrevealed that 23.47 percent (172 samples) of thetotal samples tested posi-tive with Lead poisoning,"Dr Sandeep Warghade,Consulting PathologistMetropolis Healthcare told

reporters here.Lead poisoning is a

cumulative toxicant, par-ticularly harmful to youngchildren and can affectmultiple body systems, hesaid.

The analysis was doneby the MetropolisHealthcare.

He said lead poisoning istested using high sensitivi-ty technology called

ICPMS (InductivelyCoupled Plasma MassSpectrometry) andGraphite Furnace Atomicabsorption spectrometry.Blood, serum and urinesamples can also be testedfor lead.

In growing children, itcauses low IQ, hyperactiv-ity, attention deficit, learn-ing disabilities andanaemia, he said.

"Lead poisoning can behard to detect even peoplewho look healthy can havehigh levels of lead. At highlevels of exposure, leaddamages the brain and cen-tral nervous system andcan lead to coma, convul-sions and even death.Signs and symptoms oflead poisoning usuallydon't appear until danger-ous amounts have accumu-

lated," Warghade added.He said major sources of

blood lead include leadedcontaminated soil, drink-ing water, petrol emissions,household dust, batteryrecycling, silver refining,paints (especially yellow),pigments, printing presses,ceramic pottery glazes,cosmetics, colours (includ-ing vermilion, spices, Holicolours), crayons andpainted pencils, plantfoods.

Warghade cautioned thatlead poisoning cases inyoung children are high asthey tend to lick or eatlead-containing paint whenit peels off the walls orwhile playing with toys.

Lead from a mother'sblood can pass to the foe-tus during pregnancy, pos-sibly giving rise to geneticdisorders.

"Exposure of pregnantwomen to high levels oflead can cause miscarriage,stillbirth, premature birthand low birth weight, aswell as minor malforma-tions. Women with highblood lead levels developearly osteoporosis, lowerbackache, joint pain andpersistent anaemia," hesaid
