Re: Short meetings with newspaper publishers/editors

Three of the nation's largest newspaper chains will hold publisher/editor meetings in Washington soon and we recommend that you agree to a very short drop-by to the briefing we are scheduling for each group.

We also suggest a drop-by to welcome and have pictures with the board of directors of the American Newspaper Publishers' Association and their spouses. This could be at a coffee on the State Floor of the Mansion or in the Roosevelt Room.

With a total commitment of about 45 minutes spread across these four occasions, most of the newspaper publishing hier­archy of the nation would mix and be photographed with you. Many of these persons have not seen you as President. It will be the last time most of them would see you before the 1980 primary season is upon us.

Specifics:

1. The first drop-by would be with the editors and publishers of Cox Newspapers on Monday, November 20. Jack Tarver is very actively seeking this meeting. It would be in the Cabinet or Roosevelt Room and could take 10 minutes. The group numbers about 40. Cox owns dailies in 10 cities w£th a total circu­lation of 1.3 million.

2. The second would be with the ANPA directors and spouses. This group numbers about 42. It includes publishers from the Knight-Ridder, Gannett, Harte-Hanks, Dow Jones and Copley chains, and publishers from other major papers in Texas, Illinois, North Carolina, West Virginia, Massachusetts and Louisiana. The impact of this meeting would travel far beyond the directors, as the ANPA includes almost all of the 1,750 u.s. dailies in its membership. Date, Tuesday, December 5. Time asked, 15 minutes. It would be excellent if Mrs. Carter could join you here.

Th'e.y. cir­culate in seven major cities in Texas, California, Massa­chusetts, Maryland, New York and Washington. Total circu­lation is 2.2-million. Location, Cabinet or Roosevelt Room. Time needed, 10 minutes.

4. The last, on Wednesday, December 13, would be with the publishers of all 77 Gannett Newspapers dailies. This is the nation's largest in ntimber·of papers and second largest (3.4-million) in daily circulation. Location, Room 450 Old Executive Office Building or Roosevelt Room. Time needed, 10 minutes.

For a minimum time expended, these four meetings should have maximum impact at the top echelon of newspaper publishing.

MEMORANDUM TO THE PRES !DENT

SUBJECT: Presidential Reception for the Nation's Bench and Bar

I attach a memorandum from Professor Meador, who is in charge of our justice improvement program. You will find it of interest.

The American justice system badly needs the combined coordinated leadership of the President, the Attorney General, the Congress, and the Judiciary. Since February 1977, we have worked hard in the Justice Department to provide leadership for justice improvements and we have attempted to enlist the help of Congress, the judges and the bar. We have developed many new proposals, but their adoption has been uneven. We are continuing these efforts and plan to have a large justice package ready for introduction in January. I believe that affirmative assertion of Presidential leadership before the opening of the 96th Congress could significantly affect our chances of success.

My specific recommendation is ·that you host a White House Reception for the judiciary and the bar of the nation this fall, perhaps in early December. The Omnibus Judgeship Bill has been signed and the nominating panels will be starting to meet; the elections will be over; and the Congress will not be in session .•

This occasion could take the form of an early evening reception to which you could invite the State Chief Justices, the Jus,tices of the Supreme Court, the Chief Judges of the l:J. S. Courts of Appeals and selected other federal judges, the presidents of the major legal organi­zations (such as the ABA, the National Bar Association, the American Law Institute), the leadership of major public interest law groups and other diverse groups interested in the justice .system. Some government lawyers should be included such as the Counsel to the President, the Attorney General, and the Solicitor General among others. The Vice President, Speaker of the House, and the Chairmen of the House and Senate Judiciary Committees should also be included.

During the reception, you could make some informal remarks to the group stressing your dedication to improving the nation's justice system, to working cooperatively with the lawyers and judges of the country to

You approved my proposal that you send a memorandum to the President suggesting a reception for 'the nation's bench and bar. My sug.gested memorandum is attached. 1 hope that you will send forward something of this sort.

The President probably has one las·t remaining opportunity to claim credit for the justice :imp.rovements program on which we have been working since February 1977. As you know, we tried repeatedly over the last year to get him to make a speech outlining this integrated, comprehensive pragram. Instead, he made his Los Angeles speech in which he mentioned numerous items on which we are working, but the speech failed to convey any sense of a unified justice program. The substance of what he said in any event was lost in the press and bar reaction to his criticisms of lawyers. We are now shaping up the legislative program for the new Congress, and the President can still take an opportunity such as this reception, and perhaps some other occasion, to put forward a justice proposal as part of his administrative program.

If he does not do this before the end of the year, Senator Kennedy will take all of the credit for it. Ken Feinberg, of Kennedy's s.taff, has already been to see me twice. Las;t week he, Pat Wald, Ben Civiletti, and some members of my staff spent almost an entire morning going over all of the items on our program, plus a few additional ideas of Feinberg's. Apparently, Sena.tor Kennedy wants to introduce a comprehensive justice improvements package (or perhaps two packages) early in January and kick off the whole matter with great fanfare. He is thinking of having two weeks of hearings, to be led off by the Chief Justice and many of the illustrious figures of the bench and bar.

Unless the President says something first, it is inevitable that :i.t will look as though he is the only person in town with any foresight and leadership on this subject. The President will have lost a significant opportun.i·ty. The President can justifiably claim credit for a program launched· by his Attorney General in his Administration, and I believe strongly that it is in his political interest to do so.
