approximately 3 to 4 weeks for the Managing Agent to process, once the application is

accepted as complete.

However, I am under a time constraint and I am requesting the Managing Agent expedite the

application will be processed by the Managing Agent within 72 hours of receipt of receiving my

completed application, and forwarded to the Board of Directors for consideration.

Amendment to Rules and Regulations of Park Manor Condominium

Pet Policy

Effective: November 1, 2017

Effective November 1, 2017 the following shall be added to the Rules and Regulations of the Park

Manor Condominium: “Provided that advance written approval is obtained from the Board of

Managers and full compliance with the requirements set forth below, Unit Owners may harbor not

more than two pets in their Units.”

The Board of Managers recognizes that pets contribute to our quality of life. Pets provide

companionship, as well as relief from the everyday stresses of our busy lives. Pets also contribute to a

“family-friendly” community, making our condominium more valuable for family ownership. For

this reason, it is the policy of the Park Manor Condominium (the “Condominium”) to permit the

ownership of pets. The policy of permitting ownership of pets must also denote the willingness, on

the part of the pet owners, to accept responsibility for the conduct of their pets in the building, as well

as on the surrounding grounds. Keeping a dog at the Condominium is a revocable privilege, not a

right.

“Pet” shall be defined as a domesticated animal of a species that is commonly kept as a household pet

in the community. A cat, dog, or canary is an example of a domesticated animal that is commonly

kept as a household pet. A monkey, snake or spider is an example of an animal that is not commonly

kept as a household pet in the community and they and other such creatures are not permitted in the

Units in the Condominium.

The breeding of any animals in Units or anywhere in the building is strictly prohibited.

Provided residents have obtained the prior written consent of the Board of Managers, residents may

house up to two pets (cats and/or dogs) in their Unit on the following terms and conditions:

1. Any resident who wishes to harbor a pet must apply and register each pet with the Board

of Managers through its managing agent. Once a pet is properly registered, no further

registration of that pet is necessary unless specifically requested by the Board of Managers

or its managing agent. Anyone who harbors a pet that has not been duly registered and

approved by the Board of Managers shall be subject to an administrative fee, which shall

be deemed additional common charges.

2. Every unit owner who desires to keep up to two dogs or cats in his or her apartment must

submit, in advance, an Application for Permission to Maintain Pet in Apartment (the

“Application”) for each prospective dog to the Condominium’s Board of Managers (the

”Board”) by delivery to the Condominium’s Managing Agent. The Application shall be on

the form approved by the Board of Managers, signed by the unit owner, and include a

photograph of each dog (which can be supplied upon approval). The Application will

include a statement that the unit owner and its tenant agrees to abide by these Rules, and

that the Board can revoke the privilege of keeping the dog(s) if one or more of them

becomes a nuisance . A dog will be considered a nuisance if it becomes the source of more

than two complaints in a 12-month period from two or more non-related unit owners,

barks excessively, bites someone, has a history of biting or aggressive behavior that has

not been properly addressed, creates noise due to lack of carpeting or otherwise, soils

common areas, or its owner does not follow these Rules.

3. All dogs must have a valid license from the appropriate governmental or quasi-

governmental agency and shall otherwise be in compliance with all governmental

regulations.

4. Dogs must be on a leash at all times when not in their own Unit.

5. Dogs and cats are not permitted to roam freely outside of their Unit and may not be tied up

or left unattended in any common area or on the Condominium grounds.

6. Dogs must enter and exit the building through the side entrances (Queens Blvd. alley exit

and 102nd Street exits) only; dogs may not be walked through the Lobby. Please walk

animals out to the street, so they do not damage any of the Condominium garden areas or

walkways. In the instance where a dog is not behaving properly and/or is disturbing

others in a passenger elevator, the dog owner must exit the elevator with his/her dog and

wait for another elevator.

7. Dogs are not allowed on the grass in the front of the Building, in the laundry room, or on

the roof. Dogs are allowed on terraces, but must be accompanied at all times by their

owner or caretaker.

8. Unit Owners are responsible for cleaning up after the pet and disposing of the waste in a

sanitary manner. Gently blot any stain and use plain water to clean up as best as possible.

Please report any accidents to the Porter or Doorman as soon as possible, so they can

follow up with appropriate additional cleaning and sanitizing.

9. Unit owners are limited to keeping a maximum of two (2) dogs or two (2) cats or one (1)

dog and one (1) cat in a unit. All unit owners keeping dogs or cats in the Building, as well

as their tenants, subtenants, caretakers and other occupants, shall all be subject to these

Rules.

10. Dogs will only be permitted if the adult weight of each dog does not exceed 30 pounds.

11. Pets must be spayed or neutered, as applicable.

12. Vicious dogs and animals with exceptionally strong bite strength are prohibited, including

but not limited to, Akitas, American Bull Dogs, Bull Mastiffs, Mastiffs, Chows,

Dobermans, German Shepherds, Pit Bulls, Pit Bull Terriers, Presa Canarios, Rottweilers,

Staffordshire Bull Terriers, Wolf Hybrids, or any mixture of these breeds.

13. The Animal Nuisance Law or Law of Quiet Habitability is to be obeyed. This law defines

“excessive noise” by any animal as “continuous or incessant for a period of ten (10)

minutes without stopping or for a half hour intermittently causing the disturbance of any

person, at any time, day or night.”

14. Harboring dog(s) in the Building shall not be allowed until express written consent has

been granted by the Managing Agent after submission of a proper application.

15. All unit owners, including their tenants, subtenants, caretakers and other occupants shall

act in a courteous manner towards others with their dogs in the common areas of the

Building. All dogs must be kept on a tight leash and close to its owner while in any of the

common areas, and be restrained from jumping on or sniffing others.

16. Unit owners must pay the Condominium a charge of $15 per month per dog. In addition,

unit owners are to pay for any costs assessed against them or their tenants as a result of

damage to the Building (e.g., torn carpeting), medical costs as a result of the actions of

their dog, and legal fees related to their keeping of a dog. The Board can refuse to allow a

sale, refinancing, alterations, or subletting of a unit if there are any such charges

outstanding and unpaid.

17. Fines of $50 per incident may be imposed by the Board against a unit owner if any of his

or her dogs urinate or defecate on, or otherwise soil in the common areas, any portion of

the building or the grounds outside of the building, unless the owner immediately cleans

the soiled area and notifies a Porter or Doorman.

Anyone wishing to report a violation of these Rules may do so at any time but only by submitting it

in writing or via email to the Managing Agent. All such reports must set forth the name of the

violator if known, the specific nature of the violation, and the time and location of the violation, and

must be signed and dated. Violations of these Rules may result in a warning to the violator from the

Board, and may also result in fines and the revocation of the privilege to keep dogs in the Building.

The Board shall be entitled to revoke permission to keep a dog at any time with or without cause. In

an instance where the privilege of keeping a particular dog is revoked by the Board and the dog

owner does not remove that dog within thirty (30) days, there will be a monthly administrative fee

assessed to said unit owner in the amount of $65.00 per month until the dog is permanently removed

from the Unit, plus any legal fees incurred by the Condominium in connection with the same. This

administrative fee will increase to $115 per month plus legal fees if that dog is not removed after six

months, and will continue until the dog is removed from the premises. In addition, such condition

may result in the Board refusing to allow said unit owner to keep a dog in the Building in the future.

The billing of increased fees shall not constitute a waiver of the Condominium’s rights to have the

dog removed or otherwise.

Nothing in these Rules shall violate any federal or state laws or regulations in connection with

officially-designated “service dogs,” which shall take precedence over these Rules. A “service dog” is

a type of assistance dog specifically trained to help people who have disabilities, such as visual

impairment, hearing impairments, mental illnesses (such as posttraumatic stress disorder (PTSD)),

seizure disorder, mobility impairment, and diabetes. Dogs whose sole function is to provide comfort

or emotional support do not qualify as service dogs.

No “babysitting” of dogs is allowed, and no “visiting dogs” (with the exception of aforementioned

certified service dogs) are allowed in the Building.

Each unit owner shall indemnify, defend and hold harmless the Condominium and its employees,

representatives, attorneys, agents and Board from and against any and all liabilities, losses, costs,

judgments, claims, demands, damages and expenses (including, without limitation, costs, damages to

Condominium property, claims by third-parties for personal or property injury, and reasonable

attorneys’ fees and expenses), resulting from or arising out of or relating to the actions of their pet(s).

A statement concerning these Rules is to be placed in all sales, subletting and refinancing packages.

No waiver of these Rules shall be effective unless such waiver is expressed in writing and signed by

the Managing Agent.

The following shall be deemed an amendment to the Rules and Regulations of Park Manor

Condominium.

Application for Permission to Maintain Dog in Apartment

As an owner of an apartment at the New York, NY (the “Condominium” or the “Building”), I desire

to maintain the dog(s) described below in my apartment. I understand that dogs will be allowed in the

Building upon written application and written approval from the Condominium’s Board of Manages

(the “Board”) for permission to maintain dog(s) in my apartment. This application and request for

approval is being sent prior to keeping the dog(s) described below in my apartment. I will be

responsible for the behavior of my dog(s).

I agree to abide by the Condominium’s House Rules for Dogs, and that the Board can revoke the

privilege of keeping dog(s) in my apartment if the Board determines that any of my dogs have

become a nuisance or have violated the House Rules for Dogs. Attached is a picture of each dog

proposed for occupancy.

apartment at their discretion for reasonable cause. I will remove any dog within 30 days of

receipt of written notification from the Board in connection with that dog, or pay an increased

charge of $50 per month plus any legal fees incurred by the Board in connection with that

dog. I agree that this charge will increase to $100 per month or part thereof if the dog is not

removed after six months.

7. I agree to enter the Building with my dog(s) and use the service and passenger elevators in

accordance with the Condominium’s House Rules for Dogs.

8. I agree that under no circumstances are any dogs allowed on the roof of the Building, on the

grass in front of the Building, or in the Building’s laundry room. Not following this agreement

may result in a revocation of the Board’s permission to keep dog(s) in my apartment.

In addition, the undersigned agrees to the following policy and procedures established by the Board of Managers: A prospective tenant(s) of a unit must pay the following deposit at the time that he or she submits a purchase or application to the Managing Agent: By certified check, bank, check or money order, the amount of One Thousand Dollars ($1,000.00), payable to The Park Manor Condominium. as a Carpet Security Deposit, which shall be refunded to the undersigned, subject to the conditions as hereafter provided.
