BOOKING FORM
1. The organisers, and its designated servants or agents, reserve the right toalter or add to these Rules and Regulations as may be necessary forcompliance with any laws or with any directions given by the Owner/Lessorof the Exhibition Site, and generally for the efficient running of the Exhibition.The “Exhibitor” includes all employees and/or Agents of any company,partnership or individual exhibiting and the term “Exhibition” shall mean The PNG Industrial & Mining Resources Exhibition.2. The Exhibitor agrees to comply with all directions and legal requirements of all Government bodies and with these Rules and Regulations during the currency of the Exhibition.3. Allotment of space to an Exhibitor, which will then constitute a licensee toexhibit and not a tenancy, will follow acceptance of an Exhibitor’s application.The Organisers reserve the right at any time to alter the site, shape or position of the floor plans as may be necessary for the best interests of the Exhibition. A cost adjustment will be made to any Exhibitor in the event of reduction of their display space.4. Exhibits must fall within the scope of the exhibition. No other exhibit or products (including demonstration machinery) are to be displayed without prior written consent of the Organisers.5. Payment Terms are agreed as follows:25% of the total rental at the time of bookingFinal 75% paid 10 days prior to the Trade Show commencement.6. Withdrawals: If Organisers agree to release the Exhibitor from their obligations under Agreement in exceptional circumstances, then in that event the Exhibitor will be liable to pay 50% of all monies due under the Agreement. This special proviso will lapse if less than eight weeks remain before the opening of the Exhibition, whereupon all monies due from the Exhibitor to the Organisers shall become payable forthwith upon demand.7. To contractual price (unless otherwise stated by the Organisers) does notinclude the following:- Connections for electricity, water, gas, waste, compressed air, etc.- Loading and handling equipment and staff- Stamp duty levied on this Agreement- Advertising Catalogue or Handbill- Telephones- Insurance- Dressing of stand- Cleaning of exhibits.8. The design of all stand and exhibits and their weight in character is subject to the prior approval of the Organisers Their construction, erection and dismantling shall be carried out under the supervision of and subject to conditions laid down by the Organisers. Any stand considered not to be in the best interests of the Exhibition may be removed or altered by the Organisers at the expense of the Exhibitor.9. All plant, machinery and exhibits must comply with statutory requirements as to safety and particularly in the case of the storage of petrol, explosives, and other flammable materials. No article of a dangerous character shall be taken into the Exhibition except with the Organiser’s prior written approval.10. The Organiser reserves the right to refuse any person admission to theExhibition without assigning any reason.11. The Exhibitor is at all times during the exhibition:a. Required to keep their stand open to view and properly staffed by competent representatives.b. Responsible for the maintenance of their stand and display space in a clean and tidy condition.c. Required to conduct any business only from their display space and to keep passageways in front of their display space free from obstruction.d. Prohibited from disposing of or parting with stock on display for cashpayment (including food, drink, tobacco or promotional aids), unless priorwritten consent is obtained from the Organisers.e. Prohibited from holding or allowing to be held at auction, lottery, game ofchance or sideshow, unless prior written consent is obtained from theOrganisers.f. Prohibited for sublicensing, sharing or parting with possession of theirdisplay space.
g. Prohibited from engaging outside contractors or himself employing personsnot being financial members of the appropriate union for the purpose of anyconstruction or demolition on the Exhibitor’s stand or Exhibition site.h. Prohibited from operating any type of machinery or equipment at a soundlevel, which, in the Organisers sole opinion because of its loudness, is likely tocause nuisance or annoyance in neighbouring Exhibitors or visitors.i. Prohibited from doing anything which, in the opinion of the Organiser,may bring discredit upon the Exhibition.12. The Exhibitor undertakes to have their display space ready, with all exhibitsavailable for display and completed by the time specified by the Organiserspreceeding the opening of the exhibition. Should the balance of costs due tothe Organisers not have been paid, the Exhibitor will not be permitted to occupytheir stand, and will forfeit to the Organisers all their rights under this Agreementand the Organisers shall be entitled to take possession and use the space fortheir own purposes and may allot their space to another Exhibitor.13. (a) Third Party Claims (Public Liability)is responsible for all personal injury or damage to property arising inconnection with the Exhibitor’s display area howsoever caused directly orindirectly by them or any contractor, sub-contractor, servant or any agent,licensee or invitee of theirs or any act of omission of any such person or by anyexhibit, machinery or other article or thing of theirs in the possession of or useof theirs or any servant or any agent, or theirs or (if erected by the Exhibitor orcontractor by his or his workmen or agents) by the stand-fitting contractor. TheExhibitor will indemnify the Organisers in respect of each and every such claimand all actions, proceedings, costs, claims, and demands in respect thereof.The Exhibitor must take out adequate insurance in respect to all such claimsand produce the premium receipts on demand.(b) Responsibility for the Personal Injury or Damage to Property (employersLiability). The Organisers shall be under no liability for personal injury to the Exhibitor or their servants or agents, invitees or licensee howsoever caused not for the loss of or damage to exhibits or other property of the Exhibitor, their servants, agents, invitees, or licensees howsoever caused. The Exhibitor is accordingly advised to take out all necessary insurances.14. Handbills, advertisements and printed matter are subject to the approval of the Organisers, who also reserve all photographic rights to the Exhibition.15. If the holding of the exhibition or the supply of any services by the Organisers is prevented, postponed or abandoned by reasons of fire, store, lightning, national emergency, labour dispute, strike, lockout, civil disturbance, explosion, inevitable accident, or any cause not within the control of the Organisers whether of the same sort or not, or the Exhibition site becomes wholly or partially unavailable for the holding of the Exhibition, the Organisers shall not be liable in any way whatsoever for any expenditure or liability or loss including consequential loss incurred by the Exhibitor.16. Following acceptance by the Organisers of the Exhibitor’s application for display space, should the Exhibitor be then unable or unwilling to perform their part of the agreement, or fail to comply with these Rules and Regulations, or otherwisebreach the Agreement, the Organisers may retain the deposit paid as liquidateddamages and reimbursement of management costs and other fees andexpenses incurred by the Organisers. The Exhibitor shall thereafter beprohibited from occupying their display space and stand and shall immediatelyremove the exhibits from the Exhibition site in accordance with the Organiser’sdirections. Alternatively, the Organisers may do so at the Exhibitor’s cost anddispatch such exhibits to the address stated in the Exhibitor’s Order Form.17. All exhibits are subject to a general lien in favour of the Organisers for sums,whether unpaid costs of space or otherwise, due from the Exhibitor to theOrganisers.18. The Exhibition Information Manual sent to all Exhibitors well in advance ofthe Exhibition dates shall be as binding on the Exhibitor as if its provisions werecontained in these contractual details insofar as they may-be applicable.19. Verbal agreements shall be valid only after written confirmation.20. The Exhibitor agrees that all photos and video recorded during the Exhibition can be used for any marketing purpose at the discretion of the Organiser.
