Ancient Indian texts also contained precursors of modern conceptions of rights.
Kautilya’s Arthashastra (ca. 300 B.C.E.), in particular, provided an almanac of just
rulings for kings. For instance, judges were admonished to show integrity and
impartiality. “Judges and magistrates shall not impose a fine when it is not prescribed,
impose a fine higher or lower than the prescribed one, award physical punishment when
it is not prescribed.” As in the Hebrew Bible, kings were not regarded as high priests,
but in religious matters were subordinate to the Brahmins, who, like the Hebrew
prophets, retained for thousands of years their position as an intellectual aristocracy.
Though there were different punishments for civil offenses and criminal charges,
the Arthashastra includes no application of the talion law. With the exception of the
Brahmins, people might be sentenced to death (with or without torture) not only if they
committed murder or treason, but also if they robbed (more than ten cattle), stole the
king’s property or a soldier’s weapon, or damaged waterworks (as a result of a scuffle
or a dispute). For lesser crimes, mutilation or monetary penalty were in order, but there
was no “eye for eye, bruise for bruise” punishment corresponding to one’s offense.
Monetary fines, for instance, could substitute for the mutilation of a body part (finger,
nose, eye, hand, etc.). To elicit confessions of crimes, torture was an accepted form of
judicial investigation. Once again, Brahmins and holy men were spared that ordeal,
along with others such as minors, the aged, the sick, the debilitated, the insane, the
starving, and pregnant women.
