The course enables students to develop knowledge, skills, values, and behavioral alternatives useful in management and the settlement, or resolution of a variety of conflicts.

The emphasis of the course is on alternative dispute resolution -- the set of non-litigious collaborative processes, which include fair hearing, negotiation, mediation, and arbitration.

The primary purpose of the course is to help students learn new and effective ways to resolve disputes.

I will emphasize application of material to interpersonal, organization, and business disputes.

We will investigate the formal and informal methods of dispute resolution including: negotiation, litigation, administrative hearings, arbitration, mediation, ombudsperson, summary jury trial, private judging, and fact-finding.

The investigation includes consideration of thePhilosophies of each method. Strategies and weakness of the various methods. Simulation and observation of selected methods.

Upon successful completion of the course students should be able to

•Articulate a definition of alternative dispute resolution and understand the advantages and limitations of the various methods commonly used.

•Outline and undertake an approach to dispute resolution, which focuses on the interests of the parties rather than on rigid positions.

•Understand and use alternative methods of dispute resolution.
