RESOLUTION NO. 1988-37

RESOLUTION REQUESTING THE MEMBERS OF THE GENERALASSEMBLY REPRESENTING WEAKLEY COUNTY TO INTRODUCEAPPROPRIATE LEGISLATION TO PROHIBIT THE HUNTING OFDEER IN WEAKLEY COUNTY WITH RIFLES USINGCENTER-FIRE AMMUNITION OF .24 CALIBER OR LARGER

WHEREAS, Tennessee Code Annotated, Section 70-4-116 (al,makes it unlawful in th~ State of Tennessee to hunt deer withany rifle using rim-fire cartridges or with a rifle loaded withcenter-fire ammunition of less than .24 caliber; and

WHEREAS, on October 12, 1970, the Weakley County QuarterlyCourt (now Board of County Commissioners) adopted a resolutioncondemning the hunting of deer in Weakley County with highpowered rifles and requested the Tennessee Fish and GameCommission (now Tennessee Wildlife Resources Agency) to issue aproclamation prohibiting the hunting of deer in Weakley Countywith high powered rifles; and

i WHEREAS, the Tennessee Fish and Game Commission honored theresolution and issued a proclamation prohibiting the hunting ofdeer in Weakley County with high powered rifles; and

WHEREAS, on April 21, 1980, the Board of CountyCon@issioners again condemned the hunting of deer in WeakleyCounty with high powered rifles and requested the TennesseeWildlife Resources Agency to continue the proclamationprohibiting the hunting of deer in Weakley County with highpowered rifles, and said resolution was honored by the Tennesseewildlife Resources Agency; and

WHEREAS, on July 18, 1988, the Board of County Commissionersof Weakley County soundly defeated a resolution requesting theTennessee Wildlife Resources Agency to permit deer hunting inWeakley Couhty with high powered rifles; and

WHEREAS, despite the action of the Board of CountyCommissioners, the Tennessee wildlife Resources Agency voted topermit the hunting of deer in Weakley County with high poweredrifles beginning in August of 1989; and

WHEREAS, a group of concerned citizens of Weakley Countyhave approached the elected members of the Tennessee GeneralAssembly representing Weakley County and req~ested thatlegislation be introduced which would prohibit deer hunting inWeakley County with high powered rifles; and

WHEREAS, the elected members of the Tennessee GeneralAssembly representing Weakley County have agreed to introducesuch legislation provided that the same is supported by a 2/3majority of the membership of the Board of County Commissionersof Weakley County; and

WHEREAS, the Board of County Commissioners of Weakley Countybelieves it to be in the best interest of Weakley County for thelegislature to prohibit deer hunting in Weakley County with highpowered rifles.

NOW, THEREFORE, BE IT RESOLVED by the Board of CountyCommissioners of Weakley county, Tennessee, assembled in regularsession on the 17th day of October, 1988, that:

1. The Board of County Commissioners of Weakley County,Tennessee, hereby requests that appropriate legislation beintroduced in the 96th General Assembly prohibiting the huntingof deer in Weakley County, Tennessee, with rifles usingcenterfire ammunition of .24 caliber or larger.
