Terms and Conditions for Postpaid Subscription AgreementBy completing and executing the Service Registration Form, whether digitally or in writing or through any other mode as may be prescribed, You (as the customer) are deemed to have acceptedthese terms and conditions and agree that it shall form a binding agreement ("Agreement") between Yourself and YTL COMMUNICATIONS SDN BHD (Co. No: 793634-V) for the Service andaccompanying Service Plan which You have selected in the Service Registration Form.
1. Provision of the Service(a) Approval. The provision of the Service shall be at Our sole discretion and is provided to You subject to the terms and conditions herein together with any other terms relevant to the Service Planas selected by You in the Registration Form (details of Service Plans are available at www.yes.my). (b) Acceptable Use Policy. You agree to use the Service in accordance with Our AcceptableUse Policy (available at www.yes.my/legal). (c) Privacy Policy and Data Protection. You expressly agree to and accept the terms of our Privacy Policy (available at www.yes.my/legal).(d) Scope of Service. The Service enables Internet access, voice calls and SMS within such locations or areas as may receive coverage from Our 4G WiMAX network.(e) Network CoverageInformation. For network coverage information, You may go to www.yes.my/coverage or contact our YesCare Center at 018-333 0000. (f) Promotion. If the Service is provided under a promotion or part of a bundled plan, then the relevant promotion and/or bundle terms and conditions shall apply in addition to or in substitution of the terms and conditions in this Agreement. (g)Disclaimer.TheService is provided on an "as is" and "as available" basis. We shall not be liable for and make no express or implied representations or warranties of any kind in relation to the Service including butnot limited to: (i) availability, accessibility, timeliness and uninterrupted use of the Service and (ii) sequence, accuracy, completeness, timeliness or the security of any data or information transmittedusing the Service or provided to You as part of the Service.(h) IP Address. In relation to the provision of internet access Service, We will only provide private IP address. Nothing herein obligates Usto provide a specific public IP address (static or dynamic) unless otherwise expressly stated in the Service provided to You and in which case it may attract additional charges from You.
2. Service Package Plan(a) Service Activation. The Service shall be deemed to commence upon its activation, which shall be notified to You in accordance with these terms. (b) Deposit. If required, a deposit may becollected upon registration of the Service and shall be held to Your credit and repaid to You free of interest within forty five (45) days after termination subject to deduction of any amount due to Usfrom You. We reserve the right to deduct from the refundable deposit any amount due and payable to Us at any time and may request You to make further refundable deposit payment to maintainthe required deposit amount. (c) Contract Period. Unless otherwise terminated by You in writing, the Service will continue automatically upon expiry of the Contract Period on a month to monthbasis. Early termination fees as stipulated in clause 11(b) herein shall be imposed against You if You terminate the Service before the expiry of the Contract Period, if any. (d) Credit Limit. Themaking of voice calls and/or SMSes shall be subject to such credit limit as may be determined by Us at our discretion ("Credit Limit"). When You reach Your Credit Limit, You will be barred frommaking voice calls and sending SMSes via Your account. You will be solely responsible to monitor Your Credit Limit and We will not be held responsible in any way if You are barred from using theService or part thereof for exceeding the Credit Limit. (e) Data Capacity Allocation. Unless augmented by Data Add-ons, exhausting Your Data Capacity Allocation before the due date of Your nextData Capacity Allocation shall result in reduced bandwidth of Your Service (throttled down). (f) Data Add-ons. Provided Your account has not been suspended or terminated, Data Add-ons may be
