• CCC first introduced in 1999 for: Singly-built detached house only
• Government in 2005 decided to apply CCC to all buildings
• WG under JKT : - How to trust the professionals - Questions of Professional Indemnity Insurance (PII) was raised - should hold all stakeholders responsible and accountable including COWs. - follow OSC 2002 : only 6 technical departments clearance

• CFO by local authorities replaced by CCC to be issued by the Principal Submitting Person (PSP) on 12 April 2007
• Aim of CCC to cut short the delays caused by Local Authorities and towards self regulations by the professionals
• CCC can only be issued by PSP after:-
• All certifications by the respective parties (professionals, contractors, licensed tradesmen) based on prescribed forms (Form Gs) under the Matrix of Responsibility and Accountability are secured.
WHO CAN BE THE PRINCIPAL SUBMITTING PERSON (PSP) ?
Either a Prof. Architect (Ar.) or a Prof. Civil Engineer (Ir.) depending on the type of projects agreed between Board of Architects and Board of Engineers.
Refer to the Joint Memorandum by BAM and BEM as per BEM Circular.

(Currently undergoing amendment between BEM and BAM. )
DUTIES OF PSP
• To prepare and present planning and building plans to PBT for approval.
• Inform PBT of the commencement of construction works on site.
• Supervise construction works at site and ensure that laws and technical conditions of the PBT are followed.
• Report building breaches, explain reasons of breach and ensure breach is rectified during construction.
DUTIES OF PSP
• Present work resumption notice to the PBT.
• Ensure Form Gs are duly certified by bona fide Professionals practising through ACPs/ECPs registered with BAM/BEM, at various stages of the works and when all the essential services have been provided.
• Issue CCC upon satisfactory completion of the works and after all conditions have been complied with, confirming the building is safe and fit for occupation.
• Deposit a copy of the CCC to the PBT and BAM/BEM within 14 days of issue.
PENALTIES ON PSP IN SECTION 70(27) OF STREET, DRAINAGE AND BUILDING ACT
• Not a PSP but issues a CCC
• Issues a CCC without all the relevant forms
• Issues CCC in contravention of a direction by PBT
• Make any false or fraudulent declarations
• Uses any forged, altered or counterfeit declaration,
certificate and application
• Occupies or permits to be occupied any building without
a CCC
• Fine not exceeding RM 250K or to imprisonment not
exceeding 10 years or to both.

FORM F1 (PARTIAL COMPLETION)
• Q2 When can Form F1 (Partial Completion) be issued?
• Only when phased completion of an integrated development has been submitted for approval by PBT at Building Plan approval stage.
• There shall be no adhoc decision to issue Form F1, if the PSP is pressured by the developer or turnkey contractor near the project end when delay is anticipated.
• Separate Form F should be issued for each phase of a housing development or a large integrated factory project, and not Form F1.

No person shall submit any Building Plans, reports and specifications for the underlisted works and or services, unless he is an Architect, except for any engineering works required (excluding any standard engineering works), such engineering plans and specifications shall be submitted by a Professional Engineer.

SECTION 7A(1) OF REA
• Notwithstanding section 7(1), a sole proprietorship,
partnership or body corporate may practise as an
Engineering consultancy practice and recover in any court
any fee, charge, remuneration or other form of
consideration for any professional engineering services
rendered by it pursuant to its practice as an Engineering
consultancy practice carried on by virtue of this section, if
it is registered with the Board as an Engineering
consultancy practice and has been issued with a certificate
of registration.
SECTION 15(1) OF REA
• Sec 15 (1) The Disciplinary Committee may make any
order (sub section 1A) against a registered person if :
(m) if he causes or suffers any sole proprietorship,
partnership or body corporate in which he is a sole
proprietor, partner, director or shareholder to
practice as an Engineering Consultancy Practice prior
to its registration by the board.
FIRST CASE OF ENGINEER DEREGISTERED FOR FOLLOWING REASONS:-
• Failure to deposit copies of CCC to PBT and BEM.
• Allowed the building to be occupied without CCC.
• Falsified the receipt date stamp of PBT OSC for Form G13 to
G21 in order to mislead the developer.
DISCOVERIES FROM CCC SUBMISSIONS
• Sole proprietor firms or individual PEs operating without ECPs registered with BEM.
• Use of forged PE stamp to sign Form Gs.
• Fraudulent engineers - names not on BEM list.
• Engineers signing Form Gs under wrong disciplines.
• Engineers still not knowing or bother to get information from BEM website on CCC process resulting in a lot of mistakes in their submissions.
• Engineers not responding in timely manner to BEM's notifications for explanations or clarifications.
FUTURE DIRECTION FOR CCC
• The amendment to Registration of Engineers Act in 2015 has
introduced Inspector of Works (IOW) and BEM is in the
process of registering them.
• BEM will seek the revision of Form Gs to include another
space for the SP’s site supervision staff to sign for greater
accountability.
