Cal/OSHA Offers 30-Day Silica Compliance Grace Period Employers Beware-Violations May Be Cited On September 23rd, the Respirable Crystalline Silica construction standard went into effect, establishing a new 8-hour time-weighted average of the Permissible Exposure Limit (“PEL”) of 0.05 milligrams per cubic meter and an action level of 0.025 milligrams per cubic meter, coupled with a plethora of additional safety requirements, which can be found in Title 8 section 5155, Table AC-1.
Cal/OSHA announced that they are following federal OSHA and providing a modified 30-day grace period for Silica enforcement, whereby Cal/OSHA will during this time carefully evaluate good faith efforts taken by employers in their attempts to meet the new construction silica standard.
Given the attention of the Table 1 approach, Cal/OSHA will focus on assisting employers in fully and properly implementing the controls in the table.
However, while Cal/OSHA will assist employers who are making good faith ef-forts to meet the new requirements to assure understanding and compliance, employers that are not making any efforts to comply may be considered for cita-tion. This follows federal OSHA’s approach regarding enforcement of their corre-sponding standard. Any proposed citations related to inspections conducted in this time period will require National Office review..
In other words, employers have to at least try to be in compliance with the new rules to be considered eligible to not be cited.

Frank Radoslovich has been a fixture of the construction law community in Sacramento for over two decades. Building in Rocklin By Joe, Patterson As the son of a general contractor, I know that forecasting potential job opportunities is ex-tremely difficult and an inexact science. This obviously adds a high-level of business risk for principals and employees. As a member of the Rocklin City Council, I know that Rocklin is a great place for members of the development community to continuously monitor for upcoming projects and ongoing economic development.
Among cities with more that 30,000 residents, Rocklin is the second fastest growing city in California. In 2016, the city’s population grew at an astonishing 4.5% fueled by top-tier schools, a safe and family-friendly environment, and a city council that values community investment. Additionally, Rocklin’s sales tax revenues grew 13.1% in the 4th quarter year-over-year while the rest of Placer County grew at 1.7%.
Because Rocklin is reaching build out, creating sustainable revenue sources is critically important. I believe the public investments in which Rocklin has committed will act as a catalyst for economic development and spur private investment. For example, Rocklin initiated (and mostly self-funded) the Whitney Ranch Parkway interchange which opened Rocklin’s Highway 65 corridor to south Placer and eventually Sacramento County.
In our downtown core, we just recently awarded a bid for our $2.58 million Quarry Adventures Park and our capital expenditure plan includes over $10 million in additional near-term investments adjacent to the park (such as a roundabout, new fire station, parking lots, etc). Our goal is to spur private investment which creates ongoing revenues (without raising taxes!) to support public services for Rocklinites. Early indicators suggest it will work.
In summary, Rocklin is not afraid to make public investment which ultimately leads to revenue growth. Without question, the end goal for me is to always benefit Rocklin residents and secure their futures - giving them the living environment they de-serve.
