Pennsylvania Abortion Control Act 1982 First requirement: (24 hour waiting period) women who wanted an abortion had to be given certain information at least one full day before the abortion took place.

Next, for those under eighteen, parental consent must be given. The only way around this rule was if consent could not be obtained, the court would then give a judicial bypass.

If a woman was married and seeking an abortion she must first notify her husband.

Original Jurisdiction

Declared Pennsylvania Abortion Control Act of 1982 unconstitutional.

Due to violation of privacy rights and due process.

Origin Case originated in the United

States District Court of Eastern Pennsylvania.

Appealed/sent to Pennsylvania Court of Appeals then to Supreme Court

Court of Appeals Decision was flipped saying all

provisions were constitutional except one; declared unconstitutional was that the spouse must be notified of the mother’s wishes

Supreme Court Decision

Ruled majority of the provisions were constitutional and upheld them. The only regulation that was “struck down” was that the mother had to have the consent of the husband or father.

Declared the right to get an abortion dealt more with a women’s “liberty” rather than her “privacy” rights.

Validity, Viability, & Undue Burden

Undue Burden: substantial obstacle in the path of a woman seeking an abortion before the fetus obtains viability-declared illegal.

Once fetus reaches viability abortion becomes illegal.
