WHAT IS A DBE AND WHY DO WE HAVE THIS PROGRAM IN PLACE?

DBE is a for profit business that is 51% minority or woman owned, whose management and daily operation is controlled by one or more socially or economically disadvantaged persons.

The DBE Program was developed to give small minority and women owned companies equal rights to Federally Funded DOT Projects

Create a level playing field for Minority/Women owned companies

Remove Barriers to DBE’s for Federal Participation

Development of firms to compete outside of DBE programs

Provide flexibility to DBE firms through development

HOW DO YOU GET DBE CERTIFIED

Certification needs to be completed in firm’s home state prior to applying in any other state

Go to Wyoming Department of Transportation’s DBE Program’s Website to apply:

Certification can take up to 90 days depending on complexity of documentation requirements

We are the only Certifying Agency in the State of Wyoming

CHANGES THAT ARE CURRENTLY BEING IMPLEMENTED

In January of 2011 US DOT passed new mandates for the DBE Program

Some of the changes include:

Changing PNW from $750,000 to $1.3 Million

To grant reciprocity for DBE’s so once they are certified in their “home” state you can apply for certification

CERTIFICATION REQUIREMENT QUICK LIST

Applicants must show that they meet size, group membership, ownership, and control standards by all requested documentation

Eligibility is based on social and economic disadvantage

To ensure that only genuinely disadvantaged individuals participate, there is a $1.32 Million personal net worth (PNW) cap. (excluding principle residence and interest in the applicant firm) This changed from $750,000 effective Jan, 2011.

You would need to show you own and control the company

You will also have to be able to demonstrate a “Commercially Useful Function” meaning you can prove the company can do the work you are requesting to be certified in

Your company would also be verified through an onsite visit (either from me in Wyoming or your states DBE representative)

ONCE YOU ARE CERTIFIED

You may bid on WYDOT Projects as a Sub-contractor

You cannot bid as a Prime contractor until you complete a pre-qualifications packet which can be requested through the Construction Office at 307-777-4056

Your name is added to the DBE Directory, which provides advertising for your company

You may request Free copies of Project Plans

Your name will be added to the Invitation to Bid mailing listing

There is training available through a partnership with the Small Business Administration/Wyoming Entrepreneur PTAC

PRIME CONTRACTORS QUICK LIST OF RESPONSIBILITIES TO DBE’S

Prime Contractors are required to solicit DBE Companies for work that is available for subcontract opportunities. These solicitations must be documented .

They also must provide ample time for DBE’s to respond with a bid price

Prime Contractors may provide assistance in reading plans, specifications, and contract requirements

Prime Contractors Cannot do work that was subcontracted to the DBE

Prime Contractors Cannot provide equipment to DBE’s unless there is a formal leasing agreement, and DBE’s must use their own forces to complete work

Prime Contractors are required to pay subcontractors through DOT’s Prompt Payment E-139 Process

BEING DBE CERTIFIED IN WYOMING CAN INCREASE YOUR ABILITY TO GET WORK.

Wyoming is an aspirational goal State. We have an overall annual goal of 5.06% that must be met

We do not have contract goals on WYDOT projects but strongly encourage the use of DBE’s

We are a race neutral program (meaning we do not specify 1 minority race over another)

DBE’s are required to bid competitively just like any other subcontractor wanting work

If for any reason the DBE program does not meet it’s goal we would then turn to contract specific goals on all DOT work
