OPENING SESSION & KEYNOTEThis session kicks off with the welcome message from NALA President, Jill I. Francisco, ACP, and leads into our keynote session. More information to come on the keynote!

AFFILIATED ASSOCIATION ANNUAL MEETING & AWARDSIf you are a member of a NALA Affiliated Association, then this meeting is for you and we encourage you to attend. Elections for the 2020-2021 Affiliated Associations Director and Secretary will take place during this meeting. Alabama Association of Paralegals will present the 2020 Affiliate Exchange Program on “How to Establish a Certified Paralegal Review Course,” and the 2020 Affiliate Award recipients will be announced.

ANNUAL MEMBERSHIP MEETING & AWARDSThis meeting is open to everyone but will occur during a ticketed lunch. Meeting-only badges can be obtained at the Registration/Help Desk. Several NALA business activities will occur including the announcement of the results of the 2020 NALA Election. This meeting will feature exciting updates and information regarding NALA’s goals, programs, and services. The recipients of the various NALA Awards Program will also be honored.

This session will assist those preparing for the Certified Paralegal Exam candidates in reviewing for the real estate and property component of the Exam. It will introduce the attendee to the historical development of real estate law and the evolution of modern principles and practices. The session will examine basic ownership rights and other real property interests such as estates, landlord and tenant rights, easements, and restrictions. This session will cover real estate purchase and sale transactions and other methods of obtaining interests in real property. Attendees will become acquainted with documentation such as purchase contracts, leases, deeds, mortgages, and liens. Due diligence topics such as title insurance and survey will also be discussed. Upon completion of this session, participants will understand the fundamentals of real estate and property law and will be familiar with the essential elements of real estate transactions.

Due Diligence for the Transactional Paralegal

The due diligence process provides the transactional paralegal an exciting opportunity to investigate the facts about a transaction, piece of property, business, or individual; perform legal research; use verbal and written communication skills; and expand their knowledge of the matter at hand. This session will cover the due diligence process conducted by paralegals for real estate, financing, merger & acquisition, and other types of transactions. It will discuss the purposes of due diligence, the parties involved, and the types of property concerned. It will review various types of searches and reviews, with a special focus on real estate reviews.

Upon completion of this session, participants will have a working knowledge of the legal, financial, and operational purposes for due diligence reviews. Attendees will be familiar with the roles played by buyers, sellers, lenders, borrowers, and others in the due diligence process. They will also understand the methods of gathering, organizing, and presenting the results of due diligence assessment.

By 2040, more than 14 million Americans will be 85 years old or older. As our population ages, courts are increasingly called on to appoint guardians when elderly persons can no longer manage their own affairs. This session will discuss the unique challenges of this rapidly growing area of the law.

Do We Need the Second Amendment

This 2nd Amendment session will focus on the purpose behind the 2nd Amendment while exploring and understanding what is meant by the “Right to Bear Arms.” Additionally, we will explore Gun Control, whether 2nd Amendment rights should continue to exist where mental health awareness plays a role, and states with tough and lax Gun Control Laws. We will analyze and debate some key Supreme Court rulings under the 2nd Amendment including some recent mass shootings, Stand Your Ground cases, and what could have been done to prevent these shootings from occurring.

Skills of an Indispensable Paralegal

There are three kinds of crucial traits that paralegals need to be effective in helping their lawyers. These traits are dependability, flexibility, and durability. Dependability is at the core of your success. As a paralegal, you are part of a big team made up of your lawyer, you, other paralegals, your client, and court personnel, all of whom are trying to accomplish a similar goal. It is not much different than a sports team. Growing up, most of us learned that being part of a team means we need to be able to depend on each other; whether we are winning or losing. Flexibility is also crucial to what you do. There will always be something that you didn’t anticipate; you might have to work late, maybe a last-minute motion on the Friday before a three-day weekend, and as a paralegal, you don’t know when the tsunami is coming. Flexiblity means understanding that you must adapt to situations and adapt to them very quickly. And lastly, you must have durability. This is a tough job. Work as a paralegal can include long hours and can be very stressful. You are gone from your family and people you love for weeks at a time, not really sleeping a whole lot, and disrupting your rhythms. We must become durable people to do that. Your practice is a marathon, not a sprint. Make sure you eat well, get enough sleep, and exercise when you can, so you are in fighting shape and are ready to go.

Multidistrict Litigation: Part 1

Part 1 will discuss the definition of Multidistrict Litigation (MDL) and recognize the difference between an MDL and a class action – including which types of cases are more suited for each. This session will also cover the process of how a case becomes part of an MDL including becoming familiar with the Judicial Panel on MDL. A discussion on how the Steering Committees are formed and how your attorney being selected will have a major impact on your role as his/her paralegal. After this session, you should be more knowledgeable about Case Management Orders, time-keeping, and other initial pleadings once the MDL is formed.

Multidistrict Litigation: Part 2

Part 2 of Multidistrict Litigation (MDL) discusses how to know what to do now that your case is part of an MDL. Learn the difference between a Long Form and Short Form Complaint and how to file documents in the MDL. Know the Rules of Discovery – including the Plaintiff Fact Sheet, Defendant Fact Sheet, and document production. Understand how the bellwether cases are selected and how that effects discovery, depositions, and trial preparation.

Risk and Variance of Cannabis Law

Over the last several years, the cannabis industry has enjoyed explosive, exponential growth. This is true for both strains of cannabis: federally legal hemp (0.3% THC or less) and federally illegal marijuana (more than 0.3% THC). The 2018 Farm Bill was a major turning point for the hemp industry because it significantly expanded the ability of states to develop hemp programs. Since passage, many of the approximately 40 states that have industrial hemp programs have altered the laws, regulations, and governmental guidance governing their programs, and several states that had no program previously, have since implemented one. This has led not only to variances in the requirements of law from state to state, but also in rapidly changing laws within a given state. Businesses and regulators in the hemp industry must pay close attention to remain informed on the current law in their states. In the marijuana industry, the number of states permitting adult-use or medical marijuana is growing every year. As with hemp, each state’s marijuana program is unique, and any entity interested in entering the marijuana business must be aware of the state-to-state differences in requirements of law. But with marijuana, there is another layer of complexity: it is federally illegal. This illegality adds additional risk that every interested business must understand and appreciate.

Jurisprudence and How Judges Rule on Cases

This session will focus on how courts sometimes use ethics in their rulings more than following the rule of law. It will discuss how courts have become a critical part of the public policymaking process and whether they should be exercising discretion to make decisions which have far-reaching consequences in terms of the distribution of benefits and burdens within society. Furthermore, this session will discuss Supreme Court Justices’ jurisprudence and what guides them in ruling the way they do. It will review some landmark Supreme Court cases and when Supreme Court Justices were guided by ethics more than the law.

Taking the High Road

The ability to ship cargo across the country is crucial to the success of the cannabis industry. This presentation will review some core features of transportation law before reviewing how states have followed or ignored that guidance with respect to shipments of federally lawful hemp moving through their borders. The presentation will use the lessons of state treatment of hemp shipments to forecast how states may treat marijuana shipments moving across their borders if marijuana is eventually made federally lawful. Some statutory language to address that issue will also be proposed.

The Future of the First Amendment

This session will focus on the purpose behind the 1st Amendment while exploring and understanding the Establishment Clause, the Free Exercise Clause, and Freedom of Speech including Freedom of the Press, the Right to Peaceably Assemble, and the Right to petition for a governmental redress of grievances. Additionally, we will analyze and debate some key Supreme Court rulings under the 1st Amendment and how 1st Amendment rights can lead to some unethical Supreme Court decisions.

The High Cost of Small Mistakes

This presentation focuses on how small mistakes can cost a high price. For example, a misplaced period or comma can change everything. This course offers suggestions and tips on how to proofread briefs and legal documents to ensure that all typos are corrected, comments are removed from documents, the document is scrubbed, and formatting is correct prior to filing or sending.

This session will be an overview of the current threat landscape. It will explain how hackers are gaining access to corporate (Legal) networks, identify risk factors, and discuss prevention and where the threats are originating from.

The Plea Bargain Trap

The vast majority of criminal cases (more than ninety percent) are resolved outside of the trial process through the plea-bargaining process ending in a guilty plea. Proponents of the current plea-bargaining system enshrined in the criminal justice system would argue that it allows criminal defendants options, saves time, and saves money, and that the criminal justice system would collapse without it. However, critics argue that the rush to resolve criminal cases through plea-bargaining jeopardizes the constitutional rights of defendants, who may be pressured to plead guilty when they are not guilty. This applies in particular to those defendants without adequate means to hire private attorneys. The objective of this presentation is to discuss the history of the plea-bargaining system, provide an overview of the current system, recognize the benefits and inherent problems with the plea-bargaining system, and how legal professionals can assist criminal defendants when faced with a plea-bargaining dilemma.

Wrongful Convictions: The WILLOW Project

Are there innocent people in jail? Are there people in jail who are technically “guilty” and yet are not morally or ethically culpable due to violence, coercion, desperation, low mental functioning, or even poverty? How do theories of punishment based on culpability comport with plea-bargaining? Is imprisonment always the best option for achieving societal justice? This session will deal with the theory, practice, and investigation of actual cases in which exoneration, commutation, and clemency are an issue. We will look at the results of past “mercy” cases in an attempt to ascertain what may be done in current situations where conviction integrity is questionable.
