Executive Summary:

Council is in receipt of correspondence requesting Council's views and/or requirements in relation to an application for the permanent road closure of an area of about 3.04 Hectares of Jay Road adjoining Lots 2 and 3 on SP237170, Mourilyan Harbour. Recommendation:

“That the Department of Natural Resources and Mines be advised that: Council does not object to the permanent closure of part of an area of about 3.04 Hectares of Jay Road adjoining Lots 2 and 3 on SP237170, Mourilyan Harbour as shown on Plan of Lot 1, TSV17136 dated 20/09/2017.”

Background: Council received a letter dated 13 October 2017 from the Department of Natural Resources and Mines (DNRM) regarding an application for the permanent closure of an area of about 3.04 Hectares of Jay Road adjoining Lots 2 and 3 on SP237170, Mourilyan Harbour. The purpose of the closure is to include the proposed area within the existing adjacent freehold farming/aquaculture property and to address potential biosecurity issues. The surrounding properties are in the Rural Zone of the Cassowary Coast Planning Scheme 2015. The subject section of Jay Road provides access to Lot 1 on AP12180 which is state land, located adjacent to a tributary (Lot 4 on AP7423) which feeds into Mourilyan Harbour. In accordance with Council's Road Closure Applications Policy, Council objects to an application to close a road where: • The subject road is an esplanade or otherwise provides access to a Watercourse or place

of public interest where practical access is not available from another point within the vicinity.

The road provides access to Lot 1 on AP12180 which is state land, located adjacent to and providing access to Lot 4 on AP7423 which is a watercourse or place of public interest. However alternative access to Lot 4 on AP7423 is available from Lot 325 on SP131199, being Mourilyan Harbour. Lot 1 on AP12180 would become landlocked as part of the permanent road closure, however Lot 1 on AP12180 is not considered to be a watercourse or place of public interest under Council’s Road Closure Applications Policy.

Therefore, the proposed permanent closure of an area of about 3.04 Hectares of Jay Road adjoining Lots 2 and 3 on SP237170, Mourilyan Harbour is supported in accordance with Council's Road Closure Applications Policy. Coast to facilitate getting people and goods around our community. 4.2. Undertake robust and accountable financial, resource and infrastructure planning and
