2009 VERSION OFMASSACHUSETTS HIRDFORM RELEASEDTheCommonwealth ofMassachusettsDivision ofHealthCareFinance andPolicy has recently released the 2009 version of itsHealth InsuranceResponsibilityDisclosure (HIRD) form. TheMassachusettsHealthCareReformAct (HCRA)makes employerswith 11 ormore full-time equivalent employees responsible fordistributing and collecting signed employeeHIRD forms. Althoughemployers neednot use the state’sHIRD form, theywill want toreview the 2009 form, because any alternative form that they usemustcollect the same information. A copy of the formcan be foundhere:http://www.mass.gov/Eeohhs2/docs/dhcfp/g/hcr/employee_hird_2009.pdf.

HIRD FORM REQUIREMENTSMassachusetts employeeswhowaive grouphealth coverage or declineto participate in an employer’s Section 125 cafeteria planmust sign aHIRD form. Even those employeeswho arewaiving coverage becausethey have coverage through another sourcemust sign the form.Employeeswho choose to drop coverage, during the year or at openenrollment, andnewly hired employeeswhodecline coverage, alsoneed to sign theHIRD form. Employees participating in an employer’sgrouphealth plan, orwho are ineligible for both the employer’s grouphealth plan and its Section 125 plan donot sign theHIRD form.

The employermust collect the signed employeeHIRD formwithin30 days after the close of the applicable open enrollment period forthe employer’s health insurance or cafeteria plan, or by September30 each year, whichever is earlier. Employees who drop coverage atany point during the yearmust sign the formwithin 30 days ofdropping coverage. For new hires who decline coverage, the formmust be signedwithin 30 days following the end of the initialenrollment period.
