19. Off-loading facilities of acceptable standards must be available and easily accessible by normal trucks and game-trailers. Should the Buyer off-load game in an area not accessible by normal trucks, the Buyer shall be obliged to receive the animals at the nearest accessible site and will be responsible for transferring the animals from such site at own risk and using own transport and/or equipment. Animals for export from Namibia, other than to Botswana and to South Africa, must be received at an accessible and suitable site within Namibia.

20. Ownership of animals will not pass to the Buyer until the full purchase price plus any applicable interest, calculated at the prime lending rate charged by First National Bank from time to time plus 5% (five percent), has been paid to Namagri and the game dealer has received payment in full for transport of the animals.

21. In the case of animals purchased per catalogue, any animal in a visible poor condition, with debilitating injury or patent sign of disease must be noted and the points of concern stipulated on the delivery note. All/any costs incurred in obtaining a veterinarian certificate after death after delivered on transport regarding the purchased animal shall be borne to the Buyer.

22. If not all the animals as purchased are delivered to the Buyer within 3(three) months period unless other conditions to the contrary are specified for certain lots or animals, then the proportionate purchase price in respect of such undelivered animals will be refunded to the Buyer, unless the parties have agreed otherwise in writing except for certified pregnant animals as mentioned above.

23. Should it become impossible for the Seller to meet any prescribed permit conditions due to a regulatory or other change in such conditions at any time after the auction and not due to any act or omission of the Seller, then and in that event the Buyer shall be entitled to a refund of the full purchase price, upon written request thereto.

24. The Buyer chooses his/her domicillium citandi et executandi at the address given on the signed Registration Form which reference thereto is regarded as being incorporated herein.

25. The Buyer and the Seller consent to the jurisdiction of the Magistrate’s court in any action pursuant hereto.

26. Any legal fees arising from breach or non-compliance of the ‘Conditions of Sale’ by the Buyer will be borne by the Buyer and will be paid on an attorney/client basis.

27. The Auctioneers will be entitled to the agreed commission in respect of each lot or animal/s sold on the condition that the money is received and that the animal/s is delivered. Commission due to WRN will be calculated and paid over after agreed commission of Auctioneer is deducted. If game is not sold at Auction, but after Auction or within 7 days thereafter to any person/agent present at auction, commissions is still due by Seller to Auctioneer and WRN.

28. Buyer must give clear instructions after auction to Auctioneer if the tags of matured males should be removed or not while loading but before transportation. If no instructions Buyer agree that animals is delivered in manner that Seller send them.

29. Breeding groups will consist roughly out of an adult bull, more females than males, up to 40% young animals except if specified otherwise in catalogue.

30. Make sure to complete a roadmap for delivery at Auctioneer with any special instruction upon delivery.
