Thanks to the latest Beavis and Butthead movie and its platinum-selling theme song Lesbian Seagull, the MTV generation has discov-ered the melodic voice of Engelbert Humperdinck – a name older audiences know well.

Humperdinck will perform for a multi-generational audience at the King Center for the Performing Arts in Melbourne on Thursday, March 24 at 8 p.m.

Born in Leicester, England as Arnold George Dorsey, “The Humper” has nine siblings. At the age of 11, he began to study saxo-phone. In a local pub at 17, he performed an astounding

A bout of tuberculo-sis threatened to silence the man born to a woman with an operatic voice, but with his manager, he decided to take drastic action.

Thus, Engelbert Humperdinck came into be-ing. Secure in his own self-image, with a strong sense of humor, he has not looked back or questioned the wisdom behind the unusual name. His famous sideburns and flashy leather outfits and bare chest as a backdrop to oversized necklaces were his signature in England before Elvis Pressley and Tom Jones

Grammy’s, Humperdinck received the 1988 Golden Globe Entertainer of the Year award. Among his career accomplishments are a star on the Hollywood Walk of Fame, 63 gold records and 24 platinum records. Remaining popular with the audience that made him famous, he has become successful with a younger group, primarily

through his appearances on MTV.

Humperdinck’s music and success have revolved around romance, perhaps due to his enduring marriage of 45 years. Together they have four children and nine grandchildren.

Indian River Colony Club was one of the few develop-ments in Viera when it was created 25 years ago and nearly 1,300 residents in 771 homes celebrated that bit of history with a full slate of activities Feb. 19 and 20.

A not-for-profit, Florida chartered corporation, the 160-acre IRCC was founded in 1986 to provide members with affordable housing and recreational facilities to sup-port an active retirement life-style. It was originally meant for retired officers, but now has retired enlisted and civil-ian residents.

“The interesting story is that there really wasn’t anything here 25 years ago,” said silver anniversary event chairman Skip Taylor. “They

had to drive in on a dirt road from Wickham. They actually started building in 1989 and now we think we have some-thing special out there.’’

He said the IRCC Foundation, which helps take care of ailing and elderly employees and residents, sponsors the anniversary celebration.

“We’re using the 25th anni-versary to raise money for the foundation. We should be able to raise about $6,000. We‘ve been working on this since June. It‘s a military commu-nity so it‘s a military plan that we implemented,’’ Taylor said.

An 8 a.m. gate ceremony kicked things office, including the reading of a proclamation on the milestone by Brevard County Commissioner Mary Bolin.

Golf, tennis and Bocce tournaments, live music and an arts and crafts show were highlights of the weekend-long event. A silent auction of a quilt with all the IRCC street names on it was a huge hit.

“The community celebrates its anniversary every five years, but the 25-year thresh-old has caused more planning for a bigger event,” Taylor said.

Sunday’s activities began with a 10 a.m. memorial ser-vice with a formal banquet at 6 p.m., both at Colony Hall.

An essay contest had resi-dents answering the question “Why living in IRCC is like living in paradise.”

“They’re really proud of their community,’’ Taylor said.

hosted its Spring Kickoff party at Suntree Master Homeowners Association soccer field on Spyglass Hill Road in February.

The event featured a pro-fessional D.J., the Viera High School cheerleaders and fireworks.

Parents can purchase on the club website, everything they need for their players including soccer balls, shin guards and cleats.

“Last year, we talked about making it easy for people to sign up and get everything they need in one trip,” said Udo Schenatzsky, president

of the club. “We have a pack-age ready for you when you come. It’s very convenient.”

The club is U.S. Soccer Cup affiliated, which brings costs down, according to Schenatzky.

The club offers several different programs includ-ing one designed for chil-dren who have never played soccer before and one for children with disabilities. Fun Soccer is for children older than 14 where there is no coaching. Also, Viera Soccer Club has a travel league.

Players receive a jersey and the club pays the insurance for the players.

“It always was my dream to create a family club, so people can feel it’s their club

and they are connected,” said Schenatzky.

One of the ways he does this is by having players and their families participate in community service projects.

“We went to the Watersong facility to entertain the elder-ly people,” said Schenatzky. “We brought some pop-up goals and had the little kids play some games. The resi-dents really liked it.”

The club also supports the Suntree Rotary Park by doing a park cleaning every spring.

The club has an office in Suntree located at 1300 Bedford Drive, Viera.

Charity Rock: Thought it already was the law,

so I would be in favor of it, but hopefully not to encourage

speeding while passing.

Pete Scianna: It should be the law. I

know it seems to be the practice already, but we have to move over to the left side if police or emer-

gency vehicles are stopped on the right side.

Lisa Jewell: I thought it was truly already

a passing only lane. And also, should not be for big trucks. Seems to be common sense

safety.

Mike Katsarakes: I always thought it was a pass-

ing lane--to keep traffic flowing--so I would be in favor of it.

Mary Parker: I don’t think a new law is nec-

essary. We already have enough laws and the left lane seems to be

for passing only anyways.

“They may know the right call, but are not sure about it, so they’ll check with the other umpire. You’ve always got to be watching your position. It’s like chess. You have to think two or three moves ahead,’’ he said.

The inclusion of junior umpires is welcome and they are backed up 100 percent by an adult coordinator. He said coaches and spectators are not allowed to yell at the umpires.

“The kids actually pick it up faster than the adults. They love it. We’re out here to make good citizens and to develop good behavior and good citizenship. Everybody should set a good example,’’ he said.

each season, sometimes as a refresher course for those that have done it before. The most impor-tant thing is the fairness of the game,” Carroll said.

Being an umpire is a special privilege volun-teers take seriously.

“We have a love for the sport and a love of the kids. We don’t let egos get in the way and I think the kids learn the game bet-ter. Once they get into it they’re hooked. We’ve trained a lot of people so most games have three or four umpires. It’s always important to make the right call,’’ Head said.

“We think we have a very good team,” coach Fred Sutton said. “We think we’ll be able to compete for championships. That’s our goal.”

Just like the Viera boys tennis team, the Hawks girls feature a very young starting lineup. Twin sisters Stephanie and Dana Hatchett oc-cupy the top two spots. The third and fourth spots go to freshman Tori Pinchera and sophomore Katie Roslonowski.

The fifth spot belongs to senior Katie Mullins, though sophomore Hannah Via is pushing her.

Viera’s remaining roster consists of Yube Ferraro, Katie Wallace and Nicole Rivera.

The Hawks also have two excellent doubles teams—Stephanie Hatchett

and Roslonowski and Dana Hatchett and Pinchera—that could help them pull out the close matches.

“I think they’re going to be a tough out, both teams,” Sutton said. That should easily make the Hawks among the favorites in Class 3A,

District 13, where they compete against Melbourne and Eau Gallie along with Celebration, Harmony, Liberty and St. Cloud.

The Cape Coast Conference tournament is set for March 22nd with the district tournaments scheduled for April 4-8. The state tournament runs from April 18-20 at Sanlando Park and Lake Brantley High School.

Sutton believes the key for the Hawks will be how well the players can adjust to the different styles of play they could encounter during

matches.“I think the key is going to be strat-

egy, against the different types of games they’ll see from their compe-tition,” Sutton said. “Maybe they’re playing someone who’s a good pusher, or they’re playing someone who is a good serve and volleyer.

“They have the basic skills, but strategy is something new for some of them. Others have played in tourna-ments, so they’re ahead in that area.”

Viera’s youth will be

served

BY CARL KOTALA Their starting lineup consists

mostly of sophomores, and there isn’t a single senior on the roster. However, that doesn’t mean the Viera High boys tennis team isn’t dangerous.

With excellent depth and three returners from last year’s district championship team, plus the addi-tion of two key players, Viera could be ready to compete with some of the better teams in the county.

Sophomore Kyle Logue, a re-turner from last year, will play No. 1 singles for the Hawks. Junior Felix Alscher, a foreign exchange student from Germany, occupies the No. 2 spot.

Stepping in at No. 3 singles is another sophomore returner, Davis DeRuiter. The third returning soph-omore, Tristian Mignogna, occupies the No. 4 spot. The ifth spot could be in lux, but at the start of the year, it’s freshman Chris Bula.

The rest of the roster includes Ryan Garwood, Ryan Colon, Danny Hanrahan and Charlie Johnson.

“Having three returners starting, and then putting the foreign exchange student and the lefty freshman in the mix … the outlook is pretty good,” Hawks coach Steven Schleicher said.

Schleicher added the team has beneited from two things. First, the boys and girls practice together—not separately as most schools do—so they not only have a team atmosphere, they also push each other. The Hawks have gotten tremendous support from county tennis pros, particularly from Suntree Country Club, which sends a pro out once a week to work with the team.

That should certainly help give the Hawks a leg up in Class 3A, District 13, where they compete against Melbourne and Eau Gallie along with Celebration, Harmony, Liberty and St. Cloud.

If the Hawks can get through the districts again, they’re hoping to advance deep into the state playoffs for the second season in a row.

VIERA VOICE Carl KotalaThe Viera High boys and girls tennis teams are young and talented, led by (l-r) Kyle Logue, Dana Hatchett , Stephanie Hatchett and Felix Alscher. Feb. 14, 2011, Viera High School.

Viera soft ball expects another long postseason

run BY CARL KOTALA

The Viera High softball team had quite a run last season, and from all appearances, the Hawks aren’t about to slow down in 2011.

Not only does Viera have nine players back from a team that went 25-6 last year, winning the district title and advancing to the Class 5A regional finals, but they also have two big-time hitters who missed last season with knee injuries, back in the lineup.

Sounds like a recipe for success, all right.

Hawks coach Dale Pierce, who has done a wonderful job of building Viera into a Brevard County softball power, said his team is eager to get another shot at reaching the regional final and beyond.

The Hawks certainly have the goods to get there.Senior pitcher Kinsey Simmons was the Florida Today

Player of the Year last year, posting more than 150 strike-outs. The power pitcher, who has tremendous location with her pitches, is also a defensive standout.

Pierce, who wants to make sure Simmons is fresh for the end-of-the-season stretch run plans to use pitch-ers Ana Breeden and Kate Callinan to help share the load on the mound.

While the Hawks have the talent on the mound, they’ve also got plenty of talent to back it up.

Senior catcher Alex Breeden has committed to South Alabama and se-nior center fielder Kaci Vassallo has committed to Lynn University.

Junior shortstop Shay Richardson has matured and gotten stronger and was really ripping the ball early in the season. The Hawks are also expect-ing big things from junior Lindsey Bishop, who will move to third base this season.

As if Viera weren’t loaded enough, the return of senior first baseman Kelly Kush and junior outfielder/des-ignated hitter Ashley Jodoin, both who missed last season with knee injuries, should bolster the Hawks’ lineup.

VIERA VOICE Carol Kotala Viera High’s (back L-R) Kinsey Simmons, Alex Breeden and Kaci Vassallo give Kelly Kush (center) a lift on Wednesday, Feb. 9, 2011 in Viera Regional Park. The Hawks reached the regional fi nals last season and have their sights set even higher in 2011.

contenders for their respec-tive district titles by the end of the season.

The Hawks won the district

girls title last season. The boys won it two years ago and inished second in 2010.

Hawks coach Dave Costello said, “I think once the time comes around, toward the end of the season, some of these young kids that we have are going to improve. We’ll be competitive.”

Costello said practice was going well as Viera prepared for its season opener at home on Feb. 24 against Melbourne Central Catholic, Space Coast, Heritage, Palm Bay and West Shore.

It will be the irst of 11 meets the Hawks will take part in as they prepare for this year’s Class 3A, District 13 event, which will be April 18 at Merritt Island High. The Cape Coast Conference meet will be held on April 7, at Astronaut High School.

With roughly 30 return-ers from last year’s boys and girls varsity teams, plus an inlux of young talent, Viera hopes this will be another successful late season run.

The boys have one of the state’s top distance run-ners in senior Harsha Torke, and one of the county’s top hurdlers and long jumpers in senior Sean Applewhite. Junior Kevin Mall is a top-notch shot putter and senior Dennis Hooper is a county

favorite in the intermediate hurdles.

Other top boys include se-nior Kevin Brodur in the pole vault, junior Justin Gorbea in the 400 meters and senior John Campbell, who excels in the distance running events. Senior Matt Audo is a stand-out in the 400 meters.

Sophomore Jackie Stengel is an accomplished sprinter and long jumper for the girls team. Junior Hazel Lockard is one of the county’s top hurdlers. Senior Jenna McElhinney is the returning district champion in the high jump and has a chance to make it two in a row.

Junior Haley Gethin is a top distance runner. Junior Carolyn Kreuzkamp is one of the team’s best throwers. Sophomores Cierra Fisher and Hanah Clor excel in the hurdles. Another sophomore, Kelsey Dolan, will be a con-tender in the mile and also as part of the Hawks’ 4x800 meter relay.

Viera Baseball is “fun again”BY CARL KOTALA

Viera High baseball coach Jason Burchield sums up the atmosphere surrounding his team this season with three simple words.

“It’s fun again,” Burchield said.

With strong pitching, an improved defense and the maturity that comes with experience, the Hawks are hoping this is the year they can break through following an 11-16 season in 2010. There are 11 players back from that team, including six starters.

“All these guys, all the returners, these are the guys that I ran with when they were freshmen and sophomores,” Burchield said. “We knew going in it was going to be a process.”

With senior right-hander Jesse Schullstrom, junior Kenton Herring and sophomore David McKay, Viera is leaded on the mound.

“There’s not a clear cut No. 1 right now,” Burchield said. “At any given time, any one of those guys could be our No. 1. Between those three guys, we really like our pitching. I look for that to be one of our strong points.”

Senior catcher Cody Adams, who hit .320 last year, should provide leader-ship on and off the ield and will be one of the key pieces on offense. So will junior third baseman Jimmy Emker, a 6-foot-4 lefty who will hit clean up and should be the Hawks’ big RBI man.

VIERA VOICE Carl KotalaL-R: Senior pitcher Jesse Schullstrom, senior catcher Cody Adams and sophomore pitcher David McKay are key members of a Viera High baseball team that is expecti ng big things in 2011. Feb. 9, 2011, Viera Regional Park.

Steven Martinez, a sopho-more shortstop who was a spring break call-up from the JV team last season, gives Viera an excellent defensive presence at shortstop. He teams with another sopho-more, Kyle Post, to make the Hawks much better up the middle.

The key, however, will be how much improvement Viera’s hitters can show at the plate.

“We’ve got to hit better,” Burchield said. “I think our pitching and defense are go-ing to be there.”

Surgical Robots Continued from page 1

VIERA VOICE George WhiteDr. John Bomalaski is among the growing number of surgeons at Holmes Regional Medical Center qualified to use the daVinci robot.

The daVinci surgical ro-bot arrived at Holmes in late summer and required surgeons to be trained before using it. The first daVinci surgery was in early October.

During robotic surgery, the surgeon sits at a console a few feet from the patient and an-other member of the surgical staff stands at the operating table with four jointed robotic arms overhead. The surgeon makes several small incisions, and inserts a microscopic camera and miniature instru-ments through the openings.

Dr. John Bomalaski has already done 40 surgeries as the controller of the daVinci robot, now at a rate of two or three a week.

“There are cases that would typically have required major abdominal surgery. With this tool, I’m able to get into very small spots. I’m still doing the same procedures but I can now do more complicated cases,’’ he said.

The improvement has to do with how long, stick-like instruments are used for

laparoscopic surgery, he said.“We now have a much bet-

ter range of motion to do the surgeries better. Before we had limited angles,’’ he said.

Also better is the fact that the robot has a 3-D camera. This improved vision and con-trol gives surgeons a means to remove only the cancerous tumors and leave the rest of the organ intact, he said.

“It’s just like using your own eyes. The visual is very good. It makes my job easier, so I do a better job,’’ he said.

The daVinci robot is state-of-the-art, but the future of the technology looks promis-ing, he said.

“It’s been around prob-ably six or eight years, so it’s still kind of in the beginning stage, but this is the top-of-the-line. Just think about what it’s going to be like in 10 years,’’ he said.

Also using the daVinci robot at Holmes is urologist Dr. Andy Zabinski.

“We’re not doing different surgeries, it’s just using a dif-ferent tool,’’ Bomalaski said.

So far, the success rate has been very good and there’s been a dramatic decrease in recovery times, down from more than three days to a day and a half following surgery, Bomalaski said. V V

See the daVinci robot at the Tech Know Expo on March 29 at Viera High School. For infor-mation, call 321-242-1235.

On Wednesday, Feb. 2, The Retreat at Watersong held a topping out ceremony for two new assisted living buildings in their neighborhood.

A topping out ceremony, sometimes called a topping off, commemorates when the last beam is placed at the top of a building or may refer to the overall completion of the building’s structure. It usually includes the placing of an ever-green tree upon the structure to symbolize growth and bring luck.

The construction crew, mem-bers of the Watersong commu-nity, representatives from Senior Living Communities and Viera leaders celebrated with speeches, food and drinks culminating with the placement of a small tree on the roof of one of the buildings.

For more information, call Watersong at 321-253-7440.

He proposed to her on the morning news during a “Surprise at Sunrise Valentine’s Day Proposal Special Event” on Feb. 14, 2002 and they married 3 months later.

Army careers separated them briely, but once they

retired and move to Florida, they have remained together.

Mr. and Mrs. Pishdad received a photo pack-age by Amanda Stratford Photography.

The Media Center at Ralph M. Williams, Jr., Elementary School was turned into an exhibit cen-ter for more than 100 post-er-style science displays from students ranging from third grade to sixth grade.

According to school prin-cipal, Cynthia Ford, this event culminated with the 12th Annual Science Fair Awards Ceremony that was scheduled to include a Star Party sponsored by The Brevard Astronomical Society. accountability and events like the ball help them learn how to act and how to dress for a formal event. “They learn the proper way to go through a receiving line,” Thomas said.

The JROTC Raider A Team took first place from among 18 teams in regional, which Thomas said is remarkable for the first year program.

JROTC instruc-tor Master Sgt. Michael Sonnenschein said, “It is most satisfying is to be able to impact these kids’ lives. We’re with them as teach-ers five days a week. It’s just been fabulous to see the turnaround. They’ve learned to respect their parents better at home. They are attributing it to

our program.” After notic-ing a rise in the student’s grades, Sonnenschein said he is excited to hear a stu-dent tell him, “This is the first time I’ve received As and Bs on my report card.”

Sonnenschein said, “I just hope to be able to impact these kids’ lives to where when they graduate from high school, they can head off to college and be suc-cessful young men and women.”

our celestial neighbors had to be cancelled. But cloudy skies did not

hold down the crowd or the enthusiasm of those attend-ing the ceremony.

For their projects, students chose a subject/question before making a hypothesis. After research, bibliogra-phy, materials, procedures and determining variables students tested, graphed, drew conclusions and then summarized their indings. After which, the students determined the best way to display their results.

The three main categories at the event were biological, physical and environmental.

Third grade student Trey Golden came up with: How does age affect how well your memory is? Fourth grader Mark Lightner’s project was: How will keeping a banana apart from the bunch affect the ripening process? Sixth grade students Maddie Dale and Tabby Chick collaborated on: Does the amount of time we use chips in a hamster’s cage affect the pH value of the chips? Another team project, from Jennifer Riposta and Laura Rosenbalm ex-plored how: Does the length of an airplane’s wings affect the lift and speed determin-ing the distance it lies.

Assistant Principal Tami Lanterman announced the irst, second and third place winners in the different cat-egories, as Principal Cynthia Ford presented ribbons and medals to the young scien-tists of Williams Elementary School.

These students can only guess at the wonders that await them as they mature into adults, but wonder they do, and will continue to do so, thanks to projects like the Star Party.

By KEN PREVITI Good vibes is the new-

est way to attain and main-tain good health and good fitness.

Vibes:New Age Fitness has moved into Viera to present the latest technology for a healthier and fitter you. The foundation of the program is the revolutionary Power Plate fitness machines, state-of-the-art devices that help users stretch, strengthen, massage and relax their bodies. This pat-ented technology and world-wide franchise is popular in Europe, especially in the Scandinavian countries.

Everyone’s body is stimu-

lated as a natural response to vibration. “Vibes” uti-lizes this natural response to enhance each person’s level of fitness and level of general health. The Power Plate technology transmits energy waves throughout the body that activate mus-cle contractions between 25 to 50 times per second, much faster than any other methods commonly used. These monitored sessions enhance overall health even when engaged in as little as 15 minutes a day, three times a week.

Husband and wife own-ers, Moshe and Rhonda Almog personally oversee the needs and progress of the men, women and chil-dren who benefit by the Power Plate program.

“We provide one-on-one attention for everybody whatever their needs. Older people, body builders, children and adults with medical conditions such as circulatory disorders or osteoporosis, weight watchers and a whole range

VIERA VOICE Photo by Cathy Heinz

Suntree students Kadie Zulon (Center) and Josiah Cruz (far right) answered the call for models for the 2011 Boomer|Senior Guide adding their youthful enthusiasm to the sunset photo shoot.

www.vieravoice.com Viera Voice • March 2011

improve my technique and the ability to produce pictures and other examples of my work. Over the last 10 years I have run a half-dozen half marathons and one full marathon. I’ve encouraged others to take up this activity and through it I have met many people and have been able to support the Leukemia and Lymphoma Society. Because of knee surgery, I have been told to limit or eliminate my running. If I could do one more thing, I would love to run a sec-ond marathon.

Can you share a tip with our readers as they prepare to begin working on their 2010 taxes?

It is begin with the end in mind. If you understand how a transaction will impact your tax return prior to implementing this transaction, you will be able to do a better job of preparing your income tax return.

If you could go back in time and give some advice to yourself, what would it be?

A career is made up of so many interactions and experiences that all come together. My best advice is to learn from each of those experiences and develop a strategy to improve the services and relationships you have with others that you come into contact with during your business career.

Two of the ive core values of Hoyman Dobson are: family and friends irst, and relationships, leadership and creativity. What does this mean to you?

In 2010, Accounting Today recog-nized Hoyman Dobson as one of the “Best Accounting Firms To Work For.” It has always been important to the leaders of Hoyman Dobson that we create a positive work environment for all of our team members. Winning this award by a national publication, based on input from our team mem-bers, shows that we are living our core values. I am very proud of this.

Chas Hoyman Just out of high school, Chas Hoyman

was working at an Eau Gallie lawnmow-er and bicycle shop when a mechanic suggested he major in accounting at the University of South Florida the next fall.

He became managing director of Hoyman Dobson Certiied Public Accountants in 1984. Then, the com-pany had three owners and four employees. Today, there are seven owners and 50 employees.

Hoyman said he has been involved in many community activities with the goal to be in select organizations and work into a position of leadership within those organizations as a way to give back to the Brevard County community.

Of the many non-proit organizations your company is involved with, which one is your “darling?”

The United Way of Brevard has to be that darling organization at this time. Through the efforts of so many in our community, we have surpassed our 2010 campaign goal of $6.8 million. Our campaign raised $6,882,000, which is a 2.4% increase over the prior year. My wife Vonnie and I are thrilled with this result. This will allow the United Way to con-tinue funding 67 health and human services programs at 42 agencies in our county.

In addition to your career and family, which of your interests would you like to improve?

Since my senior year at the University of South Florida, I’ve dabbled in photography and enjoyed it immensely. With the new digital equipment and the software that goes along with it, there is so much to learn to

of others benefit from our wellness programs,” Moshe said.

“Standard exercise utilizes 40 percent of muscle iber. With Power Plate technology enhanced exer-cise, 97 percent of muscle iber is utilized,” Rhonda said.

“That means that a 20-minute workout gives you the beneits of an hour and a half or other exercise, while stimulating circulation much more eficient-ly,” Moshe said.

Visit vibesnewageitness.com for additional in-formation, testimonials and explanatory videos of the methods and beneits or visit for a free tour and introductory workout at 5445 Murrell #103 in Viera. Call 321-305-6952 for more details.

These great blue herons are involved in building a nest at the Viera Wetlands. Each individual stick or branch is delivered by the male and installed in the tree by the female. Soon, the pair engages in a bill clap-pering duel, clasping their bills together and repeatedly moving their heads back and forth. The performance cul-minates in the female clench-ing the male’s bill in her own--a somewhat aggres-sive behavior. During this spectacle, all the feathers on their crests, necks, chests, and backs stand erect. Subsequently, the dimen-sions of the body parts are exaggerated, transforming

the texture of the feathers as they bristle. This ritual and other nuptial displays occur during the early winter breeding season at the wet-lands. V V

Viera Voice is proud to bring you a new monthly column called Association Living. Written by Frank Kneiser, CMCA, AMS.

The general manager of the 4,500-home Suntree Homeowners Association will discuss the many aspects and variables of Association Living. Kneiser has been a licensed Community Association Manager in Florida since 1990. He is not an attorney, however, a requirement of his Community Association Manager’s license is to stay abreast of the Florida Association laws. Legal questions should be re-ferred to your attorney.

BY FRANK KNEISER

There are several differ-ent types of associations in Florida. Often, owners will use HOA as a generic term for their associations. HOA is actually an abbre-viation for Homeowners Association and is gov-erned by statute FL720. Homeowners usually own

the lots surrounding their homes and a percentage of common areas and ameni-ties of the association.

Condominium Associations fall under statute FL718. Owners own only everything inside the paint of their units. The association owns every-thing outside of the paint, including the building(s), common areas and ameni-ties and each owner shares a percentage of ownership.

FL723 regulates Mobile Homes. Owners usually own their mobile homes and pay rent to a park owner in order to use the common areas and amenities. In some cases, owners own their mo-bile home and the associa-tion owns the common areas and amenities. In this case owners share a percentage of ownership and most provi-sions of FL720 would apply.

Cooperative Associations, regulated by FL719, are less common. Owners buy shares in the co-op, which owns all units, build-ings, common areas and amenities.

These associations gen-erally have some things in common, such as being governed by a board of di-rectors, usually elected by members. The board has a fiduciary duty to carry out all of the provisions of the articles, declaration and by-laws. Members pay as-sessments for the mainte-nance and management of common areas and ameni-ties. Associations are usu-ally referred to as “Deed Restricted” which means owners are required to and agree to abide by all rules and regulations found in the declaration and by-laws.

MARCH BUSINESS TIP: “Facebook is more than a social site. It is rapidly becoming a business visibility and building tool. According to a study conducted by Rice University’s Jones School of Business, consumers who become fans of a busi-ness’ Facebook page spend more money at that business.
