UAA grows 27% in 2014 – Best in Nation

The National Apartment Asso-ciation reports that the Utah Apartment Association now

represents over 96,000 units in the state of Utah, an increase of 21,000 units - up 27% over one year ago!

"I'm so pleased that we grew so much this year in the number of units we represent. It just adds clout politically when we are on Capitol Hill to be able to say we represent so many units," said Steve Randall, 2014 Chairman of the Utah Apartment As-sociation Board of Directors. "It also shows that people are noticing what the apartment association does for them."

erage to protect their possessions, however, according to a recent Apartments.com survey of renters, 58% of respondents indicate they do not have renter’s insurance.

20% of renters nationwide say they are required by their landlord or property manager to carry renter’s insurance. Survey results indicate that more renters would like their management company or landlord to require renter’s insurance for all renters. More than 36 % of respon-dents say they would be more in-clined to rent an apartment that re-quires renter’s insurance.

Ask The Director: Tenants Getting Divorced

Dear Paul,I have been renting to a couple for

about 16 months (they just signed a new, year long lease 3 months ago). I was talking to the tenant next door to them and she told me that they are getting di-vorced. What should I do?

Jeremy W.

Dear Jeremy,First, I would advise you to not get

in the middle of their divorce, which is likely to be messy and emotionally charged. Your only responsibility as a landlord in such situations is to be professional and courteous to both

parties.Hopefully your tenants are able to

reconcile, but if they aren't then it is likely that at least one will want to move out. Here are some situations that you might face:

• One tenant moves out, but the lease is kept intact and the rent keeps coming in.If this happens, then don't worry

about what is going on.

• One tenant wants out of the lease.If the tenant who is staying can af-

ford the rent on their own, then get in writing from all parties that you

are canceling the old lease, and sign a new lease with the tenant who is staying behind. Make sure to cash out the deposit to both parties (let them work out who gets what) and take a new deposit from the remain-ing tenant.

• Both tenants want the other one to moveUnless they mutually agree who

gets to stay, you are under no obliga-tion to pick sides. Let their lawyers work it out. Until then they are both liable to see that full rent is paid ev-ery month.

• Both tenants want out of the lease (or the one who wants to stay can't afford the rent).As with any other tenants who

want out of the lease, you are under no requirement to let them leave. If you would like to work with them, you can offer to let them move out if they “replace themselves” by finding you a new qualified tenant to move in. Once the new tenant has signed a lease, you can authorize them to leave.

• They move out without telling you

In this case you can re-rent it im-mediately and deduct/charge them any charges related to re-renting the unit (including lost rent) until it is ei-ther re-rented or the lease ends.

One last thought: if one party is a victim of domestic abuse, you must allow them out of the lease with pay-ment of 45 days rent as a cancelation fee. You can then evict the perpetra-tor and charge them rent until you get a new tenant.

Many landlords get so in-volved in the Asset Man-agement part of their busi-

ness that they forget that they should also be engaged in customer service. Keeping tenants happy is difficult, but it is important.

How does keeping tenants happy affect your bottom line? Well, be-cause turnover is the largest cost that landlords face you can end up losing lots of money if you don’t find a way to manage it. Turnover costs come in two ways: lost rent because the place is sitting empty while you are trying to find a new tenant, and turnover expenses (including direct costs like advertising, cleaning, maintenance and labor costs, and indirect cost to you in time and energy to get the place re-rented).

According to estimates, the aver-age turnover can cost between $2,500 and $3,500 dollars. This is even scar-ier when you consider that the aver-age turnover rate in Utah (accord-ing to a study done by the National Apartment Association) is almost

78%!Now, some of that is not prevent-

able. Some tenants move because they are getting married, going into the military or to school, are moving to another state for a job, or are buy-ing a house. However, somewhere in the neighborhood of 70% of ten-ants move because they aren’t sat-isfied with where they are living or because they got a better offer some-where else.

The key to keeping these tenants is convincing them that you are the best landlord they will ever have. To do that, you should know what ten-ants want from you and what they want to get out of the property. Ac-cording to recent survey of tenants, the top 5 things that tenants say they want are:

• A responsible and dependable Landlord

• A safe and secure place to live

• An attractive building to live in

• An apartment in good condition

• A sense of community where they live

The same survey also looked at the top 5 complaints from tenants, which include:• Maintenance not being done• Landlord not communicating

with them• Neighbors causing problems• Safety concerns• Rent/Deposit/Fees being too

highConsidering how you can bet-

ter communicate with your tenants

enables you to be the “responsible and dependable landlord” that is the number one thing they want. There are also numerous other ways that you can get your tenants to renew their lease that are simple and yet ef-fective.

The first priority is to invest mon-ey in retention rather than into leas-ing and marketing. Setting aside some of your income to maintain the

The Utah Apartment Associa-tion has announced the dates and times for sixteen Good

Landlord classes along the Wasatch Front. This is in an effort to help those who need to complete the class before the end of the year in order to receive a discount on their business license.

Designed several years ago as a compromise to prevent cities from charging extreme disproportionate impact fees, the Good Landlord Pro-gram has been a fantastic success. Cities, some of which were skeptical that training landlords rather than just charging them would work, have seen significant drops in the number of crimes committed in rental prop-erties – which has in turn translated into fewer police and other city re-sources taken up by rental properties and significant savings to the tax-payers. Tenants now have access to many more trained and professional landlords who are better at maintain-

ing their properties. Neighborhoods have become significantly less hos-tile to landlords, who they now can trust to maintain their properties and not rent to tenants who will cause problems and decrease property val-ues.

The biggest beneficiaries, how-ever, have been the landlords. In addition to a certificate which they can use to get a discount on their business license (which is sometimes a significant discount), landlords get timely training and updates on what has changed re-garding the laws and best prac-tices in the Rental industry. The class also includes information on resources available to landlords that they can use to save signifi-cant amounts of money and pre-vent problems. And perhaps most importantly, the class is specifi-cally designed to help landlords minimize their losses, increase their profits, and significantly limit their risk – annually saving landlords and property managers hundreds of thousands of dollars

throughout the state.It is a testament to the value of the

class that a great many landlords and real estate professionals in communi-ties throughout the state that do not require business licenses have taken and benefited from the Good Land-lord class. We are proud to continue

The Utah Apartment Association is classified

by the IRS as a “501 C-6 Trade As-sociation”. A trade association, also known as an industry trade group, business association or sector asso-ciation, is an organization founded and funded by businesses that oper-ate in a specific industry.

According to Wikipedia. “An in-dustry trade association participates in public relations activities such as advertising, education, political do-nations, lobbying and publishing. However, its main focus is collabo-ration between companies, or stan-dardization. Associations may offer other services, such as producing conferences, networking or chari-

table events or offering classes or educational materials. Many asso-ciations are non-profit organizations governed by bylaws and directed by officers who are also members.”

The part I want to focus on is that the UAA is governed by bylaws and directed by officers who are also members. In November, the 2015 UAA Board will be installed. That board will consist of thirty-three UAA members who come from di-verse backgrounds. There will be landlords who own and manage single family homes and small rent-al properties. Others will own and manage large apartments. Some will be vendors who provide products and services to the industry. Many have multiple years of experience and great expertise in property man-agement.

And though they are a diverse group they will unite as one entity

to plan, direct and fulfill the mission of the Utah Apartment Association, which is that we should stay “Utah’s leading advocate and resource for the owners, real estate profession-als, developers, management teams, suppliers and service providers dedi-cated to quality rental housing.” On the board, no one person has more power than the other. Even the board chair has no authority to make deci-sions or act for the board except that granted them by the board.

There will occasionally be differ-ences on the direction to proceed, how to allocate the precious funds of the association, and how to al-locate the limited time of staff and volunteers. But they will be resolved because each board member will shed any personal agenda and learn to work as a team for the benefit of all members. The UAA does have a small staff but the strategic plan, our

mission and goals, and ALL major decisions are made or supervised by the UAA board.

In addition to board members, there will be another 150 UAA mem-bers who serve on committees like government affairs, events, mem-bership and education. Committees also include a number of volunteers who will spend thousands of hours devoted to carrying out the work of the UAA.

What a renter’s insurance policy covers

Renter’s insurance policies typi-

cally cover a tenant’s personal pos-sessions from loss from water dam-age, fire, theft or vandalism. Policies

also cover common liabilities that can be caused by tenants. “For in-stance,” says Scott, “it would cover if a tenant’s dog bit someone, if a ten-ant’s grill caught a structure on fire, if a tenant’s son shot a bb through someone’s window or vandalized someone’s car.”

If residents purchase renters in-surance that does not cover common damage events, landlords will not achieve true “risk transfer” to the in-surance company. When researching renters insurance, properties should look for programs that offer:• Coverage for resident-caused

water damage such as over-flowing bathtubs or sinks.

• Optional contents coverage for both burglary and theft occurrences. Many policies only cover burglary occur-rences.

• Resident liability coverage available as a cost-effective option for residents that may not own many possessions and do not want contents cov-erage.

• Post-occupancy claims pro-vide the property with the ability to submit claims for damage after a resident moves out and is usually available for 30 days after the resident vacates the unit.

How to implement a policyScott says most people think rent-

ers insurance is very expensive. On the contrary, he says, most policies are $10-15 a month. You can begin by starting to require all future tenants to get Renter’s Insurance as a condi-tion of the lease. You can also verify

that they have insurance by requiring that you be included on their policy so that you will be notified if a claim is made or the policy is canceled.

Other benefits of requiring rent-er’s insurance

One reason many owners are re-quiring renter’s insurance is that it can help reduce their own insurance premiums. Many insurance compa-nies give discounts to landlords who can demonstrate that they require renters insurance, since so many claims on rental properties are resi-dent caused. In addition, requiring renters insurance can allow owners to increase their deductibles, which also creates insurance savings.

There is also a compelling custom-er service reason for requiring rent-er’s insurance. If a resident were to suffer loss of property because they had no insurance, even if they don’t hold a grudge and blame you for the loss, the expense of replacing all of their personal belongings will make it unlikely that they will be able to afford to stay. You may lose a good resident over something that could have been avoided. Requiring rent-er’s insurance can be in the best in-terests of not just landlords, but other residents and the tenant themselves.

No matter where your prop-erties are located, criminals may be lurking. One way to

add security is through surveillance cameras. High Definition surveil-lance cameras conform to standards which can stand up in court as evi-dence, and surveillance cameras are no longer cost prohibitive and only for the high rent districts.

According to the Utah Depart-ment of Public Safety there were an estimated 40,000 reported incidents of burglary, robbery, and vandal-ism last year in Utah. Many of those crimes happen on apartment proper-ties.

In apartments, cameras can have the effect of making residents feel saf-er, but they can also reduce property damage to the landlord. A Califor-nia Center for Research in the Inter-est of Society (CITRIS) study found that cameras were very effective in reducing property crimes within 100 feet of the camera. Graffiti, property damage and theft are an extremely costly item on many apartment com-munities’ financial statements.

A recent study by the Urban Insti-tute found that, if monitored prop-erly, video surveillance systems re-

duced crime at a cost effective rate. One example was in Baltimore, where cameras were installed in high crime areas and the cost savings in damaged property and victimization was $1.50 for every $1 spent. The key is they must be properly monitored.

New technologies make monitor-ing easier and much less expensive. Newer systems allow you to re-ceive photo text alerts on your smart phones and/or e-mail messages with pictures when motion is detected – all in real time. You can watch your properties over the Internet from anywhere in the world on a Smart-phone, tablet, or computer – record-ed or in real time.

Another benefit of surveillance cameras is the ability to use footage to catch perpetrators of crime. Po-lice departments routinely use vid-eo footage to help catch criminals, which is some cases can led to res-titution to the damaged apartment owner.

Some other possible benefits of having security cameras on your property:

• They can provide evidence in court to protect you from potential “slip and fall” lawsuits

• You can see who comes and goes and at what time of day

• Activity can be saved to your hard drive for future reference

Other things to consider:

• Do you have a no-pet policy and wondered if a tenant is breaking the rules? Now you can get the proof.

• Afraid more people are residing at your apartment than are on the lease? You can track how many people regularly stay overnight.

• Worry about an elderly tenant? If you haven’t seen activity for a while, you can go knock on their door.

• Expecting a delivery or outdoor contractor? Be alerted when they arrive.

• Concerned about suspicious activ-ity on the premises? Automati-cally record and easily share with the police.Surveillance cameras are worth

looking into. They can help you at-tract renters and give them peace of mind. They can help you reduce property damage and enforce your rules. Most importantly, they can re-duce your costs in damage, tenants fleeing because of safety concerns,

ore people who rent their homes are feeling the finan-

cial squeeze following the recession, with younger renters and people in the West feeling the most “cost burdened,” according to new research from the Carsey Institute at the University of New Hampshire.

The research was conducted by Jes-sica Bean, vulnerable families research associate at the Carsey Institute, and is presented in the brief “Renters More Often Burdened by Housing Costs Af-ter Recession.” Renters are considered “cost burdened” if they spend more than 30 percent of their income on rent and utility costs.

“Increased need among American renters indicates that strong public hous ing programs are necessary to protect individuals from becoming overbur-dened. However, this research also dem onstrates that the lowest-earning house-holds experienced the smallest increas-es in cost burden over time, indicating that without the housing programs al-ready in existence, America’s most vul-nerable households likely would have fared even worse,” Bean said.

The key research findings are as follows:

Nationwide, nearly half (49 percent) of all renters were “cost burdened” in

2010, spending more than 30 percent of their income on housing costs, with the highest rates occurring in the West and in central cities.

In all regions and across all place types, the percentage of renters who were cost burdened increased between 2007 and 2010.

The largest increase in cost-burdened renters occurred in rural places, up 4.3 percentage points by 2010, compared with increases of 3.4 and 2.9 percentage points in suburban places and central cities, respectively.

Renters under the age of 25 were most often cost burdened both pre- and post-recession, with nearly 60 percent of young renters spending more than 30 percent of their income on rent in 2010.

In all regions, the largest increase in the proportion of renters who were cost burdened occurred among those with a household income between $20,000 and $50,000.

Carsey Institute: Renters Feel Financial Squeeze After Recession

One of the most popular re-sources that the Utah Apart-ment Association provides is

the collection of 22 legal forms pro-vided to the members. Many mem-bers feel that if all they got for their dues was the forms that they would still be getting a great deal.

The UAA forms are not only pop-ular, they are extremely useful. The association regularly consults with an attorney to ensure that all of the forms represent the current best practice and take into account new

state and federal laws and city ordi-nances, as well as evolving court in-terpretations. By using the updated UAA forms you insure that you have the best tools you need in order to protect yourself from liability and ensure your rights are upheld.

What happens if you are using an older version of the forms? Well, the older versions still (usually) work just fine, but when you have the op-portunity you should start using the new forms. This is especially impor-tant to do with the lease, so when you renew a lease with your tenants you should check to see if a new ver-sion is available.

The most popular forms are those that landlords use on a regular basis with every tenant: the rental appli-cation, residential rental agreement (aka. "Lease"), and the Move in/Move out form. In addition to these forms the UAA has specialized forms (such as pet addendums, garage leases and others things), legal forms (like the different three day eviction notices) and renters forms (available for free on our website for renters and the general public).

You can get all of the UAA forms online from our website for free if you are a member of the association. Simply log into www.uaahq.org and

go to the members section and look at the forms tab. Some of the forms are also available to fill out online and generate as a pdf that you can print or send to your tenants electronically. If you have questions about how to use the UAA website or need assis-tance, feel free to call the UAA staff any time.

You can also get hard copies of the forms, most of which are pro-duced with a nice carbon copy back-ground which makes it easy to give the tenant one and keep one for your records. There is a small charge for getting these forms from the associa-

a few significant accomplishments:• Streamlining eviction law, speeding up eviction from 45 to 21 day average• Strengthening collection law for bad tenant debt including allowing landlords to collect a 40% collection fee if accounts are sent to an attorney• Standardizing and simplify-ing state landlord tenant law to one state standard instead of 242 city ones• Prohibiting rental inspec-

tion fees and reducing frequency of rental inspections to only cases of cause or complaint.

property only makes sense, and using a portion of that to upgrade and im-prove the property is a best practice that most landlords should follow. That being said, a tenant is far more likely to feel that a place is “home” rather than just a “house” that they happen to be renting if you involve them in the process of selecting what upgrades and improvements are go-ing to be made. That doesn’t mean you should turn the process over to them or let them dictate what you will do, but rather means asking for their feedback and seriously consid-ering it.

Next, you might want to consider creating a budget for “ongoing mar-keting” for your current tenants. Mindy Williams from RentandRetain.com once told a story of an apartment community in Wichita, Kansas who arranged to have chocolates mailed to every tenants for their birthday. Once, they sent a Birthday Chocolate to a lady who had moved out. Since

the chocolates were mailed first class, the present was forwarded. Imagine receiving chocolate from the apart-ment community where you had just moved from! This resident was so touched that she moved back as soon as her lease was up.

Finally, you should consider what gifts or concessions you might give to your tenants in order to convince them to lock themselves into a new lease with you. Some landlords do simple things, like take over a plate of cookies and a reminder to renew the lease. Others are more extravagant, offering things like a $50 dollar gift card, airline miles or even a rebate on the first month’s rent to the tenants who renew the lease. Ultimately, if you can keep the tenant even for one more year you can more than make up for the expense if you plan your gifts and concessions well.
