Pol icy. The pol icy of t h e Serv ice is t o provide refuge access and/or a s s i s t ance t o l eg i t ima te producers of audio and/or v i s u a l recordings. Such a s s i s t ance o r access w i l l not be provided i f production opera t ions a r e incompatible with refuge o r Service ob jec t ives . P r i o r i t y considerat- i on is extended t o producers of w i l d l i f e and na tu ra l resource r e l a t e d audio o r v i s u a l mater ia ls . Producer 's c r eden t i a l s w i l l be v e r i f i e d by t h e appropr ia te Publ ic A f f a i r s Off icer .

Objectives. Audio-visual (A-V) coverage of Service f a c i l i t i e s can inc rease publ ic understanding of America's w i l d l i f e and of t he Serv ice ' s r o l e i n managing and p ro t ec t i ng n a t u r a l resources. Program ob jec t ives a re :

A. To promote publ ic understanding of America's w i l d l i f e and t h e Serv ice ' s r o l e i n managing and p ro t ec t i ng these resources through t h e Nat ional Wi ld l i f e Refuge System.

B. To make refuge resources a v a i l a b l e t o w i l d l i f e o r i en t ed users .

C. To minimize c o n f l i c t between audio-visual production, o the r publ ic use a c t i v i t i e s , and w i l d l i f e .

D. To s tandard ize and coordinate responses t o reques t s t o f i l m o r record a t NWRS f a c i l i t i e s .

E. To p lace on-s i te superv is ion of audio-visual product ions with t h e refuge manager, t o t h e ex t en t possible.

Author i t i es . Regulations concerning fi lming and recording a c t i v i t i e s a r e es tab l i shed i n 43 CFR, S u b t i t l e A, Sect ion 5.1. Regulat ions regarding employee conduct and use of government f a c i l i t i e s and equipment a r e es tab l i shed i n 43 CFR 20.735-12 and 43 CFR 20.735-16. Regulations regarding d i s tu rb ing v i o l a t i o n s ( l i g h t and sound e q u i p e n t ) , a r e es tab l i shed i n 50 CFR Subpart G.

Def in i t ions . The following terms and t h e i r d e f i n i t i o n s w i l l a i d persor r n e l i n i n t e r p r e t i n g t h i s d i r e c t i v e on audio-visual productions.

A. - Film. Film is defined a s s t i l l photographs, motion p i c tu re s , and videotapes.

B. Recording. Recording i s t h e audio component i n motion p i c t u r e and video production, and audio-tape recording.

C. Casual photography. Casual photography is any type of v i s u a l recording performed by amateur owner/operators of photographic equipment. Casual photography i s gene ra l l y exempt from permit requirements. For example, v i s i t o r s t ak ing photographs fo r t h e i r personal use.

News photography. News photography inc ludes audio-visual productions f o r news and publ ic a f f a i r s , s t i l l s , motion p i c tu re s , video, records and audio tapes, such a s produced f o r t e l e v i s i o n , newspapers, magazines, e t c . Examples of nevs events a r e emergencies, such a s a plane c ra sh o r f i r e , a commemorative event , o r appearance by a publ ic f i g u r e , o r an e rupt ing volcano o r o the r unusual, non-recurring na tu ra l phenomenon.

Commercial photography. V i s u a l recording by f i rms o r ind iv idua ls (o the r than nevs media ;epresentat ives) who in tend t o d i s t r i b u t e t h e i r photographic product. Crea t ion of educa t iona l entertainment o r commercial e n t e r p r i s e would be included i n t h i s category, a s would adve r t i s ing audio-visuals f o r t h e purpose of paid product o r s e r v i c e s pub l i c i t y . A l l a d v e r t i s i n g photography r equ i r e s an A-V Product ions Permit. Advertisements must no t imply endorsement by - t h e Service.

16.5 Respons ib i l i t i e s .

Washington Office. The Washington Off ice , Of f i ce of Endangered Species, reviews and approves o r disapproves r eques t s t o f i l m o r record endan- gered spec ies . Contacts respons ib le S t a t e and Federa l agencies i n ca ses involv ing non-Service lands. N o t i f i e s Washington Off ice of Pub l i c A f f a i r s , and regional o f f i c e concerning dec is ions about fi lming/ record ing endangered species .

Regional o f f i c e . The regional d i r e c t o r is respons ib le f o r approval of permit app l i ca t ions f o r commercial audio-visual productions, approval of bond and general l i a b i l i t y insurance c o s t s (See Sec t ion 8, below.), providing audio-visual guidance when requested by t h e re fuge manager, and reviews reques ts t o f i l m endangered species which a r e forwarded t o t h e Washington Office.

Refuge manager. The refuge manager i s s u e s Spec ia l Use Permits f o r commercial photography a c t i v i t i e e - ( a f t e r rece iv ing reg ional approval), forwards reques ts t o f i l m o r record endangered spec i e s through- t h e r eg iona l o f f i c e , advises producers of commercial audio-visual product ions concerning permit a p p l i c a t i o n s and refuge r u l e s (See E x h i b i t e . 1 and 2 ) , and i n t h e case of news-gathering media, provides a s s i s t a n c e necessary f o r t he media t o accomplish i t s goa l i n a manner which minimizes t h e d i s rup t ion of Serv ice and refuge operat ions.

16.6 Issuance of permlts. Regardless of t h e permit requirement, a s ou t l i ned i n 1 6 . - 4 o v e , a l l audio-visual productions must be conducted pursuant t o app l i cab le r u l e s and r egu la t ions governing a c t i v i t i e s and conduct a t Serv ice f a c i l i t i e s . Refuge managers may i s s u e Spec ia l Use Permits a s needed, for 'news photographers, ca sua l photographers, Service personnel, and S t a t e cooperators. These permits may be used t o au thor ize

While a permit i s requi red f o r docu- mentar ies , t ravelogues, f e a t u r e s t o r i e s , e t c . , t h a t do no t involve news events, permit i s not required fo r photography ( ind iv idua l s using hand- held equipment, t r ipods , f l a s h bulbs and/or s t robe l i g h t s ) which does not involve t he use of products, and which does not r e q u i r e re fuge s t a f f a s s i s t ance o r supervis ion. Permits a r e not required f o r models, sets, props, l i g h t s , o r s imi l a r equipment which w i l l no t r e s u l t i n damage t o t he resource o r which w i l l not unduly c o n f l i c t with normal v i s i t o r use.

16.7 Guidance f o r audio-visual production permits.

A. Bond requirements. A bond o r cash depos i t i s required when an audio- v i s u a l permit i s issued. The purpose of t he bond i s t o a s s u r e t h a t t h e a r e a i s l e f t i n i t s o r i g i n a l condi t ion. A performance bond issued by a bonding company, a cash depos i t o r c e r t i f i e d check may be used f o r t h i s purpose. The c r i t e r i o n f o r s e l e c t i o n of t he form t h e bond w i l l t ake should be t h a t the re fuge manager has immediate access t o the funds.

The refuge manager has t he opt ion to set t h e bond requirement a t $0.00 (zero) i f he o r she a n t i c i p a t e s no damage t o t h e resource , clean-up, o r r e s to ra t i on . A bond i s not t o be used a s a penal ty .

A s a genera l gu ide l ine , bonds o r depos i t s w i l l be required i n amounts equal t o the estimated c o s t t o t he Government of clean-up o r res tora- t i o n t h a t would be required i f the permi t tee f a i l e d t o perform. Should t h e permit tee a c t u a l l y f a i l t o perform a l l o r any p a r t of t he necessary clean-up o r r e s to ra t i on , t h e refuge manager w i l l have t h e required work done, a s s e s s t he charge, deduct i t from t h e bond o r cash deposi t and r e tu rn t he balance, i f any, t o t h e permit tee . Cash depos i t s must be secured immediately and accounted f o r a t a l l times. News gather ing organiza t ions a r e exempt from formal permits and bonding requirements.

B. General l i a b i l i t y insurance. General l i a b i l i t y insurance w i l l pro- t e c t t h e U.S. Government from claims o r l i t i g a t i o n connected wi th i n j u r y o r damage r e s u l t i n g from t h e a c t i o n s of t he permi t tee o r h i s agents and employees. Another purpose of t h i s requirement i s t o avoid undue t o r t l i a b i l i t y t o t h e Government and t o a s su re t h a t t h e filmmakers a r e not judgement-proof i f a v i s i t o r i s in ju red through t h e negligence of t he permittee.

Filmmakers t h a t c a r r y e x t e n s i v e g e n e r a l l i a b i l i t y insurance may o b t a i n a r i d e r t o have t h e U.S. Government named as a d d i t i o n a l i n s u r e d . O t h e r s must o b t a i n t h e necessa ry coverage.

C. Use of government equlpment. Government equipment may be loaned o r r e n t e d t o a product ions company o r d i v e r t e d from i t s normal use f o r p roduc t ion purposes only t o persons who r e n d e r s e r v i c e s o r perform f u n c t i o n s t h a t f a c i l i t a t e o r supplement a c t i v i t e s and o b j e c t i v e s of t h e S e r v i c e .

D. S e r v i c e s u p e r v i s i o n . Audio-visual p roduc t ions au thor ized by permit must be s u p e r v i s e d by a Serv ice employee t o a s s u r e f u l l compliance w i t h a l l o f t h e terms and c o n d i t i o n s of t h e p e m i t .

I n t h e c a s e of a production invo lv ing s u b s t a n t i a l numbers of persons and equipment, superv i s ion w i l l be on-the-spot and continuous.

I n t h e case of product ions i n v o l v i n g few people o r minimal amounts o f equipment, o r t ak ing p lace i n areas where t h e r e is l i t t l e , i f any p o s s i b i l i t y of damage o r v i o l a t i o n of o t h e r permit requirements o r inconvenience t o the v i s i t o r , t h e r e f u g e manager o r h i e l h e r repre- s e n t a t i v e may s p o t check dur ing t h e p roduc t ion t o a s s u r e compliance.

I f t h e r e f u g e manager determines t h a t t h e i s s u a n c e of a permit would p l a c e over t ime burdens on t h e s u p e r v i s o r y c a p a c i t y f o r t h e a r e a , a s a c o n d i t i o n o f t h e permit , h e l s h e may r e q u i r e reimbursement f o r t h e c o s t o f a l l overtime superv i sory s e r v i c e s provided. The monies r e c e i v e d must be depos i t ed a s Misce l l aneous R e c e i p t s i n t h e General Treasury of t h e United S t a t e s .

E. Off-duty personnel . The p o t e n t i a l f o r c o n f l i c t of i n t e r e s t is g r e a t i n c a s e s where Serv ice employees are i n v i t e d t o work f o r product ions companies d i r e c t l y . The S e r v i c e p o s i t i o n i s t h a t employees may work, o f f du ty , f o r a product ions company i f t h e y do n o t perform o r appear t o perform o f f i c i a l d u t i e s . Off-duty employment r e q u e s t s must be approved by t h e r e g i o n a l d i r e c t o r .

Off-duty employment whi le i n uniform is n o t permit ted . Also, p e r sonne l engaged i n superv i s ion of t h e p e r m i t t e e a r e under no circum- s t a n c e s al lowed t o engage i n off-duty employment wi th t h e filmmaker.

F. Termina t lon o r d e n i a l of permits. I f warranted, i n c a s e s of d e l i - b e r a t e i n f r a c t i o n s of t h e terms of t h e permit , o r when resource damage occurs , A-V product ions may be suspended o r terminated. I f t h e r e f u g e manager determines t h a t a p e r m i t t e e d e l i b e r a t e l y made f a l s e o r mis leading s ta tements i n s e c u r i n g t h e permit , h e l s h e should in form t h e r e g i o n a l d i r e c t o r , and recommend a p p r o p r i a t e ac t ion . The f o l l o w i n g c i rcumstances may j u s t i f y permit d e n i a l :

16. Audio-Visual Product ions

(1) Superv is ion requirement$. I f t h e refuge manager determines t h a t t h e requirement f o r superv is ion w i l l p lace unreasonable burdens ou t h e supervisory capac i ty of t h e Se rv i ce s t a f f , t h e permit may be denied. Denial may be made i r r e s p e c t i v e of t he pros- pec t ive permi t tee ' s wi l l ingness t o pay overtime expenses.

(2) Dierupt ion of v i s i t o r a c t i v i t i e s . I f , i n t h e re fuge manager's opinion, t h e proposed A-V product ion w i l l c o n f l i c t unduly wi th t h e p u b l i c ' s normal use of t h e re fuge , t h e reques t should b e negot ia ted t o a l l e v i a t e t h a t impact, o r i f t h a t is not poss ib le , t h e r eques t should be denied.

(3) Resource damage. I f , i n t he re fuge manager's opinion, t h e pro- posed A-V production may p o t e n t i a l l y damage the resource , t h e r eques t should be negot ia ted t o a l l e v i a t e t h a t impact, o r i f t h a t is not possible , t h e reques t should be denied.

G. Fees. No f e e s a r e t o be charged for'A-V product ion permits. - H. C r e d i t l i n e s . The Service, through t h e Ass i s t an t D i r ec to r - Publ ic

A f f a i r s , r e t a i n s t h e r i g h t t o reques t app rop r i a t e c r e d i t e i t h e r i n n a r r a t i v e o r audio forms, and/or through use of t h e Serv ice symbol.

Prel iminary arrangements must be made with t h e Serv ice p r i o r t o applying f o r t he permit.

A pre-conference i s required with t h e refuge manager and t h e audio-visual production d i r e c t o r (o r producer, o r l oca t ions manager) a t which time r egu la t i ons and permit requirements w i l l .be discussed.

A t l e a s t one month's no t i ce w i l l be required t o process app l i ca t i ons t h a t could e n t a i l extensive d i s rup t ion of Serv ice a c t i v i t i e s . I n o the r cases , f i v e days' no t i ce w i l l be required.

Cancel la t ions o r changes f o r reasons o the r than the weather, i n scheduled f i lming da t e s may n e c e s s i t a t e t h r e e o r more working days no t i ce f o r rescheduling.

A v i s i t t o a l l proposed f i lming loca t ions with f i l m d i r e c t o r and the refuge manager w i l l precede t h e refuge manager ' a approval of l o c a t ions. Film loca t ions should be s e l e c t e d and approved before permit i s issued.

Presence of f i l m company must no t unduly i n t e r f e r e with normal opera t ion o r v i s i t o r use. Due t o the Serv ice requirement t h a t commercial audio- v i s u a l permits must be supervised by a Service employee, t h e number of hours o r days f i lming may be l im i t ed by t h e a v a i l a b i l i t y of Serv ice s t a f f .

A l l Serv ice regula t ions w i l l apply. Areas of s p e c i a l concern are:

Dogs, c a t s and o the r animals must be leashed o r otherwise con t ro l l ed a t a l l times. (See 11, below.)

A l l t r a f f i c regula t ions apply.

A l l veh ic les must s t a y on designated roadways.

Camping is allowed only with refuge manager permission.

Open f i r e s a r e prohib i ted , un l e s s s p e c i a l permission is given by t h e refuge manager.

The use of inflammables o r explosives is prohib i ted , except wi th w r i t t e n approval from t h e refuge manager. Production companies w i l l a r range f o r and cover the c o s t of f i r e f i g h t i n g equipment and personnel.

L i t t e r i n g i s prohibi ted.

Gathering of wood is permitted only with express refuge manager permission.

I f t h e product ion company d e s i r e s t o s t a y overnight on the refuge, arrangements must be made wel l i n advance with t he re fuge manager.

The product ion company i s respons ib le f o r any s e t s o r equipment l e f t a t t he l oca t ion s i t e f o r any length of time (overnight , e t c . ) .

I f t h e production company a n t i c i p a t e s t he need t o make numerous phone c a l l s , t he company must i n s t a l l a p r iva t e phone l i n e . Government phones may be used i n emergency s i t u a t i o n s only.

Production companies w i l l provide a l l t h e i r own ma te r i a l s , equipment and suppl ies .

A shooting schedule must be drawn up before permits a r e issued. Changes i n t he o r i g i n a l shoot ing schedule w i l l be permitted, sub j ec t t o approval by t he refuge manager, only when unforeseen circumstances occur, such a s weather, mechanical breakdown o r i l l n e s s .

Under NO circumstances w i l l f i l m companies br ing any animals--foreign o r domest=--to a Serv ice f a c i l i t y without p r i o r approval i n wri t ing by t h e refuge manager.

C red i t may be given t o t h e Department of t he I n t e r i o r and the Service, through t h e use of appropr ia te t i t l e o r announcement.

Whenever an audio-visual product ions company wishes t o use the Serv ice symbols, e s p e c i a l l y with t i t les , c r e d i t s , and s i m i l a r Song de l ibe ra t e exposures, concurrence from the D i r ec to r of t h e Serv ice is appropriate. I n c i d e n t i a l f i lming of t h e symbol is not prohibi ted, except where f i lming i s f o r adve r t i s i ng , promotional o r d i r e c t commerical purposes.

Production companies should be prepared t o provide t h e refuge manager with a l i s t of t he following information:

a. How many hours o r days w i l l be spent f i lming?

b. What s p e c i f i c l oca t ions w i l l be used?

c. What kind and how many veh ic l e s w i l l be used? L i s t a l l veh ic les - ( inc luding props) t o be used i n t he production. Arrangements w i l l be made f o r vehic les t o be parked a s c l o s e t o t h e f i lming a r e a a s possible . Locations manager and d r i v e r cap t a in w i l l agree, i n wr i t ing , with Serv ice s t a f f regarding what veh i c l e s (prop t ruck, personnel c a r r i e r s , d ress ing rooms, honey wagons, ca t e r ing t rucks , camera t rucks , generator vans, g r i p t rucks , e tc . ) a r e t o be allowed.

Any addi t iona l information r e l a t i n g t o the p r iv i l ege appl ied f o r by t h i s app l i ca t ion w i l l be furnished upon reques t of the refuge manager . No employee of the Service may work f o r the permit tee i n any capaci ty whatsoever while i n uniform o r d i r e c t l y involved i n supervis ion of t h e permittee.

No personal g r a t u i t y of any na ture whatsoever w i l l be of fe red t o any employee of the Government i n connection with the exerc ise of the p r iv i l ege granted.

A member of the Service s t a f f w i l l supervise the production within the Service boundaries. He/she w i l l have the au tho r i ty t o make a l l super- v i sory decis ions t o assure compliance with the permit, appl icable regu- l a t i o n s , and Service audio-visual production policy. Any overtime expense incurred due t o the necess i ty f o r such supervis ion w i l l be borne by the permittee.

The permit tee w i l l be required t o post a bond o r cash depos i t t o ensure t h a t the a rea i s l e f t i n a s good condi t ion a f t e r completion of production a s it was before. The bond o r depos i t w i l l be determined by the Serv ice refuge manager and w i l l be an amount equal t o t h e est imated cos t t o t h e Government of clean-up r e s t o r a t i o n o p e r a t i o n s t h a t would occur i n t h e event t h a t the permittee causes damage t o resource o r f a c i l i t i e s o r f a i l s t o c lean up t h e a rea s a t i s f a c t o r i l y . Return of the bond o r depos i t is subjec t t o compliance with the terms of t h i s permit.

The permittee, i n exercis ing the p r i v i l e g e s granted by t h i s permit, s h a l l comply with the regula t ions of t h e Department of t h e I n t e r i o r , the Service, and a l l Federal, S t a t e , county and municipal laws, ordinances, o r regula t ions which a r e appl icable t o t he a r ea of operat ions covered by t h i s permit.

This permit i s a revocable permit and may be revoked a t the d i s c r e t i o n of t h e Director of the Fish and Wild l i fe Service o r h i s designee upon 24 hours not ice, o r without not ice, i f damage t o resources o r f a c i l i t i e s i s threatened, notwithstanding any o the r term o r condit ion of the permit t o the contrary.
