Alcantarea Giant landscape bromeliads: the high-impact solution to full sun, unirrigated, large container planting problems, with instant WOW factor. Featuring spectacular 1.5m flower spikes and a smooth-edged, hard-leafed circular form; they grow equally well in gardens or highly-exposed apartment planters, in soil depth to 300mm. Elevated planters offering view lines from underneath the plant sometimes feature a coloured reverse. Seen from above, the bromeliad’s formal, flat rosette habit is also impressive.Combine with cordylines, heliconia and gingers – smooth leaf margins make easier passage in high traffic areas and are safer for small children.

Alcantarea imperialis Rubra A spectacular and truly tough feature plant requiring little water or fertiliser once established. The luxuriant red underside of the broad leaf deepens in cooler weather and brightens any surrounding environment.Full sun but suitable for shade.Dimensions: 2m X 1.5m.Flowers: A branching spike reaching up to 3.5m tall covered in hundreds of delicate white flowers. The flower stem will last up to twelve months on the plant. Copious amounts of nectar bring Honeyeaters, Wattlebirds, Friarbirds and Silver Eyes.Foliage: Maroon underside with grey broad leaves. When grown in the shade it appears greener. More intense colour displayed through the cooler months. Thornless.Uses: Use in large containers around the pool or on apartment balconies to heighten tropical themes. Alcantarea imperialis Peter TristramA massive, full sun bromeliad with broad crimson leaves, certain to become a focal point in any landscape. A true giant in the bromeliad world and the largest imperialis clone cultivationed in Australia.Full sun but suitable for shade.Dimensions: 2.5m X 2.0m.Flower: Creamy white flowers with a deep red bract on a spike that can reach 3.5m.Foliage: Between imperialis Rubra and imperialis Purpurea and appears greener in shade. Thornless.Uses: Where a more intimate scale is desirable, use close to the most viewed point; or at the end of a long sight line to punctuate the view.

Alcantarea extensaThe striking silvery grey foliage of this giant demands attention when set among dark greens and reds. Golden flowers are a bonus, as are the appearance of purple markings at leaf tips with winter’s cooler night temperatures. Full sun but suitable for shade.Dimensions: 2.0m X 1.5m.Flower: Creamy yellow flowers with pink red bracts on a spike to 2m lasting 12 months on the plant.Foliage: Deep green with slight mottling, very wide corrugated leaves. Thornless.Uses: Wonderful feature or large container plant that contrasts well against feature walls in strong colours, or for defining larger gardens.

Alcantarea glazouianaLooking for a plant that will tolerate high sun and wind exposure? This amazing Brazilian native is not only hardy but also boasts impressive grey foliage and fragrant night-blooming flowers.Full sun but suitable for shade.Dimensions: 1.5m X 1.5m.Flowers: 3–5 years producing a flower spike to 2m, which is multi- branching with pink bracts and white flowers that open in the evening with sweet perfume.Foliage: Light silvery grey smooth foliage. Thornless.Uses: Excellent for use in sea walls, within the first dune zone and in poor sandy soil. Tolerates constricting containers but prefers well-drained soil.

Alcantarea heloisaeOne of the few bromeliads with perfumed flowers, an unusual variety that is not often seen commercially. Strappy thick grey green leaves that can be covered by a white chalk, when grown hard, grace this sun-hardy beauty. Full sunDimensions: 1.5m X 1.5m.Flowers: Bright yellow scented flowers 50mm across on a maroon branching spike to 2.5m. Foliage: The thick grey-green leaves are often coated with a soft white chalk and colour in the cooler winter months to maroon in the margins and the tips.Uses: Faultless for use in the landscape, a tough tropical specimen with the added feature of being water wise. Full sun to lightly shaded positions, it will tolerate all positions with appealing, attention-grabbing foliage.

Alcantarea reginaStriking full sun bromeliad, which grows to approximately 2.0m diameter. Collected in Minas Gerias. Suitable for shade, high impact and water wise. Thornless.Full sun, but suitable for shade.Dimensions: 2m + acrossFlower: A long lasting flower spike that extends 2 m above the plant. Foliage: A slender green long leaf that arches to the ground. Uses: An excellent specimen plant in a container or feature plant in a small garden. Suitable for sun or shade it makes an excellent large filler plant in the garden.

Alcantarea odorata Coming from the dry inland areas of Rio de Janeiro and Espiritio Santo States, in Brazil, this species is adapted to all day full sun positions. It grows naturally on steep rock outcrops.Full sunDimensions: 1.5- 2m across.Flowers: produces an impressive branched flower spike 2-3m tall with gold flowers that have a lovely fragrance, hence the species name.Foliage: the blue-grey waxy foliage is a natural adaption to conserve water and reflect the harsh tropical sun.Uses: Feature plant or large container specimen. When planted in a raised position with full sun it shows off the waxy foliage.

Aechmea mulfordii Malva Tolerates winter sun but prefers dappled mid day to afternoon sun in summer to retain colour. Silvery mauve foliage growing to 1.5m tall with orange flower spike.Dappled mid day to afternoon sun in summer or winter sun.Dimensions: 1.5m X 1m.Flowers: Orange flowers on a tall spike to 1.5m lasting 6 months on the plant. Foliage: Long strappy leaves of mauve with a silver coating are the most striking feature of this bromeliad. The plant pups profusely, forming a dense habit when left to grow naturally. The leaves are edged have sharp spines.Uses: Excellent for adding fascinating colour to the landscape. Perfect for use in either the sheltered garden or as a container plant that is away from traffic.

Vriesea platynema X fosterianaGreen with strong texture is the best way to describe these. The variations in patterns are subtle to the undiscerning but will be fascinating to the astute. The gorgeous patterns will tempt you to stay and examine them.Shade to dappled light.Dimensions: 1m X 1m.Flower: Creamy white flowers on a spike that can reach up to 1m, usually open at night.Foliage: Patterned green with stripes. Variation is common and adds to it as an interest plant.Uses: As a garden plant it inserts texture to shaded areas and the variation in patterns make it useful as a filler or small container plant. These are grown for the patterned foliage.

Neoregelia Correa-AraujoiA tough, giant bromeliad from coastal Brazil that thrives in sunny positions and provides colourful accents to green garden areas with its splattered red on gold foliage. Full sun but suitable for shade.Dimensions: 1.2m across.Flowers: White rosette in the throat of the plant. Foliage: Is green to gold with splashes of red on a broad leaf. Uses: Lovely accent plant able to tolerate all day sun when acclimatised.

Neoregelia Gee WhizBrilliant red on yellow-green leaves surround astonishing mauve flowers: a classic large ornamental bromeliad that offers a stunning summer display of colour. Full sun during winter, dapple light to shade.Dimensions: 1.2m across.Flower: Mauve flower rosette in the throat of the plant.Foliage: A stripy red leaf with a lower profile than the Alcantarea’s.Uses: Use where sight lines look directly down or in near view to the planting, so the viewer appreciates the ultra-flat open rosettes with strong pink ‘halos’ around the central water-holding tanks. Also, mount long, impressive lines of these plants on ‘fallen’ tree trunks in full sun.

Neoregelia cv KnockoutA block of solid red colour that impacts in shaded positions. In a sea of green this is a dazzling plant that is enhanced by its fabulous purple flowers.ShadeDimensions: 1.2m across.Flower: A magenta rosette in the throat of the plant.Foliage: An outstanding light magenta. When the plant is pupping it appears as a cluster. Uses: Feature plant for the shaded garden, that needs impact.

Neoregelia Bossa NovaAnother variegated clone of Neoregelia compacta from BrazilFull sun to full shade.Dimensions: A spineless plant that spreads over time as a colourful groundcover.Foliage: Bossa Nova stays green and white until it’s sporadic flowering then a pink-red blush can be seen down the throats of the mature plants.Uses: Excellent groundcover for shaded areas.

Neoregelia ShebaVariegated clone of N. compacta. Green and white foliage with pink blushing all year round.Full sun to shade.Dimensions: A spreading variety with each plant achieving up to 40cm across.Flower: Magenta rosette in the throat of the plant.Foliage: Thornless bromeliad with a sleek appeal, it is a hardy plant for the sun or shade. The leaves commence as green with a cream edge and evolves to a blush of soft pink on the foliage. Uses: An exceptional climbing bromeliad that is ideal for planting at the base of a tree, rock wall or similar situation. The pups emerge at an angle higher than the base of the mother plant, which makes it possible to be trained as a climber or it can be used as a ground cover. Ideal groundcover in root run soils under palms or other hard sites.

Aloe barberaeTallest of the tree aloes, this specimen stands alone in drier landscapes where a striking multi-branching tree is called for. Rich corked bark gives the tree a distinctive texture and its foliage shares a similar growth habit to the pandanus.Full sunDimensions: Tree to 18m with a trunk up to 3m in width in the wild but far less, at around 4-6 m in cultivation. Flowers: In autumn and winter, with a swollen appearance to the orange pink flower. It resembles the Red Hot Poker.Foliage: Thick fleshy thorned green leaves arch from the terminals of the branches. Again a Pandanus comes to mind but its solid leaves of a richer green and quicker growth habit distinguish them.Uses: Use with hard-edged modern architecture where a stark, severe form is required. Especially arresting against intensely coloured feature walls. Will tolerate poor soil, low water and neglect typical of commercial settings – both in-ground or in large containers.

Aloe feroxA single trunked tree aloe, which thrives in harsh conditions and gives a sculptured feature to a landscape. Dry, hot positions with little water are perfect for this robust looking specimen. The extraordinary orange red inflorescence makes this variety a distinctive plant.Full sunDimensions: A small tree to 2m generally grows slightly taller in its natural habitat.Flower: The inflorescences are branched into 5 to 10 erect racemes with tubular orange red flowers.Foliage: The greyish green broad fleshy leaves turn reddish when drought- stressed. The leaves have dark brown spines along the edge and occasionally on the upper and lower leaf surface.Uses: Prospers in areas of full sun, moderate watering during the growing season and with good drainage. Container specimen, cactus gardens or used in rock gardens, this is the perfect impact specimen. Strong features and textures create a specimen plant for the dry look landscape.

Aloe marlothiiAn interesting single stem tree aloe that flourishes in inhospitable conditions, and produces incredible branched flower racemes. Sometimes confused with Aloe ferox.Full sun Dimensions: A small tree to 4 m generally but it has been noted as reaching 6 m on rare occasions in its natural habitat.Flowers: Intense orange to red flowers are produced on racemes that are commonly spreading on a multi branching stem. The stem is generally produced at the head of the plant, giving it a crowning glory of concentrated colour against the dull shade of the leaves.Foliage: Thick fleshy leaves are studded with dark brown thorns. The thorns are concentrated mainly along the edge of the leaves and the underside. The old leaves are not shed by the tree and cling to the trunk forming a petticoat of dry brown.Uses: A hardy individual that withstands dry, harsh, hot conditions and requires little to no irrigation. It is tough enough to withstand frost and tolerate rocky hard ground, and well-drained soil.

Vriesea gigantea and Vriesea gigantea NovaThese two plants occur in the mountains behind Rio de Janeiro. They tolerate a wide range of climates as summers are hot and winters are quite cool, getting down to o’, where they naturally occur.Dappled or filtered sun.Dimensions: Vriesea gigantea 1.5m across x 1.5m high. Vriesea gigantea Nova 1m across.Flower: a branched flower spike to 1.5m tall with night blooming cream flowers.Foliage: patterned green foliage.Uses: adds texture to shaded areas.

Pachypodium gaeyiiA truly striking tree, its thick barrel-shaped trunk is covered in cross-barbs with fantastic pink-ribbed, silver-grey foliage. It thrives in hot dry positions and bears a small white flower. Full sunDimensions: It has a similar growth habit to Pachypodium lamerei but is a taller tree. The tallest recorded was 10m in its native habitat of Madagascar.Flowers: White delicate flowers, similar in appearance to frangipani flowers but much smaller.Foliage: Straps of silver grey leaves which can grow to 40 cm in length and compliments the grey barrel shaped trunk, hang from the terminals of the branches.Uses: An eye-catching feature tree excellent for a dry hot position where little access creates a harsh environment. Will flatter the succulent garden design with its size, shape and excellent colour.

Pachypodium lamereiWith fragrant frangipani-like flowers, this barrel-shaped tree exudes character. Accompanied by a thorny trunk the deciduous tree flowers while bare of leaves and thrives in the harshest of environments by storing water in its trunk.Full sunDimensions: Reaching to 6m with a trunk covered in clusters of three spines, which spiral around the trunk.Flowers: White fragrant blooms similar to the frangipani in the warmer months.Foliage: Long straps of green leaves that are deciduous, leaving an amazing barrel of spines on the trunk visible in winter.Uses: An ideal plant for semi-arid and sub-tropical themes and looks appealing planted with agaves, aloes and kalanchoes.

Euphorbia poysean Thai hybridsThese are ‘lucky plants’ planted at the front door of Thai dwellings to bring positive forces to those within. A resilient, continuously flowering plant.Full sun to part shade.Dimensions: A compact bushy shrub 30-60cm in height and widthFlowers: The bright colour on these plants comes from the vividly coloured bracts surrounding the insignificant yellow flowers. With an extensive range of colours from white to yellow, green, pink and red and almost all of the combinations in between, it adds amazing colour to the garden.Foliage: Lush green leaves envelope the thorned stems making it appear as a mass of flowers and leaves with no apparent branch structure.Uses: In beach-side locations where sandy soil, fast-drainage and parched conditions make alternatives difficult, these can be used as a spiny, flowering hedge across front boundaries. Good for non-irrigated spaces and semi-arid/ sub-tropical themed gardens.

Crinum procerum Red FoliageA fabulous tufted foliage plant with thick fleshy pointed leaves and spectacular red foliage. Enormous heads of stunning fragrant white and pink flowers burst open in spring and summer making it an irresistible addition to the landscape.Full sun to part shade.Dimensions: The rich textured leaves reach up to 1m and clumping habit give the plant width.Flowers: Large white with pink ribbed flowers appear in the spring and summer. Thin long petals give the fragrant bloom a delicate appeal, which stands out against the strong red colour of the leaves.Foliage: Long strands of luxuriant red to crimson leaves arch from the plant and with a clustering habit it creates a wonderful mass planting effect.Uses: A robust, colourful solution for any garden situation where colour is needed. A resilient addition to the garden, keep moist in a well drained position and they will tolerate heavy soils.

Heliconia Kawauchi Tall growing Heliconia with an astonishing rich red upright flower. The deep red flower clings to the stem and appears between the foliage of abundant green leaves.Shade to full sun. Dimensions: 3m – 5m. They are taller when in shade and seeking the light.Flower: Vibrant red bracts with a trace of yellow on the edge. The upright flower is produced in early spring and the magnificent red catches the eye, with the flower reaching 45cm and staying on the plant for 3-4 months. The odd flower is formed during the year on large mature clumps.Foliage: Abundance of tall spatulate leaves forming a dense clump as they mature, and display best when protected form strong winds.Uses: Often seen as clumps to form screens or create privacy in the landscape, used frequently in Balinese style gardens or to add the tropical lush feel. Heliconias do best in frost-free areas and in rich organic soils kept moist during the warmer months of the year.

Heliconia rostrataThe vibrant red and yellow hanging flowers make this the most popular Heliconia in Southern Queensland. The amazing long lasting flowers that will last from late November until May are a must for the tropical garden.Shade to full sun.Dimensions: Vary depending on the amount of light. From 1.3m in hard sunny spots to 3m if they are in shade and searching for light.Flowers: Remarkable red and yellow hanging down more than 600mm. They have been imitated with fake plants but nothing can surpass the real thing growing in the garden. Foliage: Long spatulate leaves that cluster up from the ground and form a mass of soft lush green. Uses: As limited as your imagination, as a screen, feature plant, used as filler, under trees and excellent for narrow confined areas that are protected from strong winds, like light wells.

Heliconia caribaea FlashA spectacular claw shaped, upright flower. Will tolerate cool conditions. A beautiful specimen for wind protected gardens. The red bracts have a yellow edge. The flowers can be used as cut flowers or simply appreciated on the plant.Full sun to semi shade.Dimensions: 3m – 5m tall with a clumping habitFlowers: The red cheeks of each bract fade to yellow on the cone. There are 8 – 10 bracts per spike, that are upright in formation. Many people collect Heliconias for their classic shaped flowers and for use as cut flowers.Foliage: The large spatulate leaves have a wax like coating on the stems and the bottom of the leaves. Uses: An excellent solution for screening or a feature plant. As with most Heliconia the uses for these plants are endless and only limited by areas of strong winds, which may damage the large paddle, shaped leaves.

Cordyline fruticosa NegraOne of the few true black leaf plants suitable for full sun, this dramatic plant gives height to a landscape and the occasional flash of red against its dark foliage.Full sun to half sun for best colour.Dimensions: 3 – 5m in good conditions.Foliage: Sensational black broad leaves up to 1m long that cluster from the stem giving a dense coverage when pruned. Tops can be cut off and replanted to assist in creating a mass planting effect.Uses: When planted as a screen or barrier, or to conceal the inner faces of boundary fences, the negra forms a brilliant backdrop for planting of every colour. Especially effective behind bright variegated foliage.

Cordyline Fire FountainVibrant red foliage complimented by symmetrically arranged foliage enhances the landscape with this tough tropical beauty. With the onset of the cooler winter temperatures the foliage colour deepens, providing colour in the traditionally drab months of winter.Full sun to bright semi shade.Dimensions: Best kept trimmed to under one metre to maintain a fuller appearance in the landscape. Foliage: Strong rich deep red coloured leaves spill to the ground and give a shock of colour to the garden. Perfect for drawing the eye and becoming a focal point when used in mass planting situations.Uses: Perfect foliage plant with lustrous rich red leaves that give an instant impact with solid blocks of colour in the garden. To keep them looking full, prune yearly, and during winter months the tops can be planted directly back into the ground to help create a massed planting effect. Cordyline fruticosa Peter BuckFamous old variety from Hawaii, with broad burnt orange leaves that illuminate the garden. The amazing colour of the foliage lifts the green foliage around it and creates a focal point.Dappled light or full sun in the mornings.Dimensions: Best kept to a height of 1.2m or taller if a background species where other foliage hides the bare trunk.Foliage: Startling burnt orange which takes on a pinkish tinge during the cooler months. The foliage is the main feature of the plant and keeping the ground moist during the hotter months will ensure the marvellous colour.Uses: Principally as a feature colour in the garden, as the surrounding green enhances the startling burnt orange. Nestled amongst the shrubbery it is an excellent draw card that will lure you to look closer.

Agave desmettiana VariegataCovering most planting positions from sun to shade this compact beauty adds appeal to the landscape. A striking leaf with yellow margins with an upright habit and urn shaped rosettes, with the added bonus of thriving on minimal water.Full sun to shade.Dimensions: Reaching a height and spread of 1m.Flower: On a spike that appears after 8-10 years in the ground and stands 2.5-3m tall with pale yellow flowers. Foliage: Fine spines with a variegation of yellow on the margin of green thick leaves that form small offsets around the base of the plant during the growing season.Uses: Makes an ideal container plant for patios, decks etc due to the attractive foliage. Being a water wise plant it is perfect for the current climate or for the drier style garden, with the added advantage of being able to tolerate irrigation if necessary.

The leaves are wavy and spined with small offsets being produced around the base of the plant during the growing season.Uses: Will tolerate very dry, xerophytic conditions if required but grows happily in better conditions which will speed up its growth rate. Use in limited soil depth down to 300mm or unirrigated as a tall textural groundcover at the front of planting space. Also makes an excellent deterrent for security sensitive locations and pedestrian traffic guidance where people would normally “cut the corner”.

Agave gypsophila Ivory CurlsAn improved variegated form of Agave gypsophila that originated in South East Queensland at the nursery of well know plantsman Stan Walkley.Full sun to shade.Dimensions: reaching a height and spread of 1m.Flower: a flower spike will appear in 4-6 years reaching a height of 3-4m with a beautiful golden flower.Foliage: stunning blue-grey foliage with an ivory edge when grown in full sun. Agave vilmorinianaA sculptured, elegant addition to the drier garden or landscape with delicate arching leaves. Once fully established it has an aura of octopus tentacles weaving through the garden or gracefully cascading from a large container.Full sun to partial shade. Dimensions: A small plant to 1m tall with a spread of 1.5m. Flowers: The inflorescence is capable of reaching 3 to 5m tall with the advantage of growing vertically without arching. The yellow-white flowers compliment the sculptured feature and highlight the unique appearance. This gem will bloom from 7 to 10 years after planting.Foliage: Light grey-green, curving leaves develop into long deep arches emanating from a central point and cascading to the ground. Thornless.Uses: An enchanting sculptured specimen that thrives with little irrigation in drier landscapes. Delightful as a potted specimen plant (where it is not brushed up against often) preventing damage to the long slender leaves.

INTERPRETATION1. In these conditions: A. “Greenstock Nursery” means Greenstock Nursery Pty Ltd ACN 010 688

356 of 70 Wades Rd,Bellmere QLD 4510, which is the seller of the goods.

B. “Purchaser” means the purchaser of the goods specified in the credit application or invoice as the case may be.

C. “Goods” means the products and, if any, services provided to the purchaser from time to time.

D. Nothing in these conditions shall be read or applied so as to exclude, restrict or modify or have the effect of excluding, restricting, or modifying any condition, warranty, guarantee, right or remedy implied by law (Section 74H, of the Trade Practices Act Cth 1974) and which by law cannot be excluded, restricted or modified.

2. These conditions (which shall only be waived or varied in writing signed by Greenstock Nursery) shall prevail over all conditions of the purchaser’s order to the extent of any inconsistency.

TERMS OF SALE3. The goods sold by Greenstock Nursery are sold or provided on these terms

and conditions.GREENSTOCK NURSERY QUOTATIONS4. Unless previously withdrawn, Greenstock Nursery quotations are open for

acceptance within the period stated or, where no period is stated, within seven (7) days after the receipt of the quotation.

SHORTAGE5. The purchaser waives any claim for shortage of any goods delivered if a claim

in that regard has not been lodged with Greenstock Nursery within seven (7) days from the date of receipt of the goods by the purchaser, or its agent.

SPECIFICATIONS6. (I) All specifications, drawings and particulars of weights or dimensions

submitted by Greenstock Nursery are approximate only and any deviation shall not be taken to vitiate any contract with Greenstock Nursery or form grounds for any claim against Greenstock Nursery.

(ii) The descriptions, illustrations and performances contained in catalogues, price lists and other advertising matter do not form part of the Contract of Sale of the goods. Where specifications, drawings or other particulars are supplied by the purchaser, Greenstock Nursery price is made on estimates of quantities required. Should there be any adjustments in quantities above or below the quantities estimated by Greenstock Nursery and set out in the quotation, then any such increase or decrease shall be adjusted on a unit rate basis according to unit prices set out.

DELIVERY7. Greenstock Nursery will not be liable for late delivery or non delivery of

goods sold and under no circumstances will Greenstock Nursery be liable for any loss, damage or delay occasioned to the purchaser or its customers arising from late or non delivery or late installation of the goods.

LOSS OR DAMAGE IN TRANSIT8. (I) Greenstock Nursery is not responsible for any loss or damage to goods

in transit. (ii) Greenstock Nursery will render the purchaser such assistance as may

be necessary to press claims on carriers providing the purchaser has notified Greenstock Nursery and the carriers in writing immediately the loss or damage is discovered on receipt of goods and will lodge a claim with the carrier within three days of the date of receipt of the goods.

GUARANTEE9. (i) Except as provided herein, all express and implied warranties,

guaranties and conditions under statute or general law as to merchantability, description, quality, suitability or fitness of the goods for any purpose or as to design, assembly, installation, materials or workmanship or otherwise are expressly excluded.

(ii) Greenstock Nursery will not be liable for physical injury, loss or damage or for consequential loss or damage of any kind arising out of the supply, layout, assembly, installation or operation of the goods arising out of Greenstock Nursery’ negligence or in any way whatsoever.

(iii) Greenstock Nursery’ liability for breach of a condition or warranty implied by division 2 of part V of the Trade Practices Act 1974 (other than section 69) is hereby limited to:

(i) In the case of goods, any one or more of the following: (a) The replacement of the goods or the supply of equivalent

goods; (b) The repair of the goods; (c) The payment of the cost of replacing the goods or of

acquiring equivalent goods; (d) The payment of the cost of having the goods repaired; or (ii) In the case of services the supply of the services again; or (a) The payment of the cost of having the services supplied

again.10. Greenstock Nursery’ liability under section 74H of the Trade Practices Act

1974 is expressly limited to a liability to pay to the purchaser an amount equal to:

(i) The cost of replacing the goods; (ii) The cost of obtaining equivalent goods; (iii) The cost of having the goods repaired, whichever is the lesser amount.PRICES11. Unless otherwise stated, all prices quoted by Greenstock Nursery will

include a component for the Goods and Services Tax.PAYMENT12. (I) The purchase price in relation to goods will be payable on or before

the 30th day of the month, next following the delivery of the goods unless other terms of payment are expressly stated here in writing.

(ii) Interest on overdue accounts shall be chargeable at the rate of 12% per annum (and compounded three monthly) from the date of each invoice to payment. Any failure on the part of Greenstock Nursery to insist or require payment of interest on any outstanding account will not constitute a waiver of its rights to subsequently require payment of interest on that, or any other account.

RETENTION OF TITLE CLAUSE13. (a) Greenstock Nursery reserves the following rights in relation to the

goods until all accounts owed by the purchaser to Greenstock Nursery are fully paid:

(i) Legal ownership of the goods; (ii) To enter the purchaser’s premises (or the premises of any

customer, associated company or agent where the goods are located) without liability for trespass or any resulting damage and re-take possession of the goods; and

(iii) To keep or re-sell any goods repossessed pursuant to (ii) above. (b) If the goods are re-sold, or goods manufactured using the goods

are sold by the purchaser, the purchaser will hold such part of the proceeds of any such sale as represents the invoice price of the goods sold or used in the manufacture of the goods sold in a separate identifiable account as the beneficial property of Greenstock Nursery and will pay such amount to Greenstock Nursery upon request.

(c) Notwithstanding the provisions above, Greenstock Nursery will be entitled to maintain an action against the purchaser for the full purchase price and the risk of the goods will pass to the purchaser upon delivery.

PURCHASER’S PROPERTY14. Any property of the purchaser under Greenstock Nursery’ custody or control

will be entirely at the purchaser’s risk as regards loss or damage caused to the property or by it.

RETURNED GOODS15. Greenstock Nursery will not be under any obligation to accept goods

returned by the purchaser and will do so only on terms to be agreed in writing in each individual case.

GOODS SOLD16. All goods to be supplied by Greenstock Nursery will be as described on the

purchase order agreed by Greenstock Nursery and the purchaser and the description on the purchase will prevail over all other descriptions.

CANCELLATION17. No order may be cancelled except with the consent in writing and on terms

which will indemnify Greenstock Nursery against all losses.PLACE OF CONTRACT18. The contract for sale of goods is made in the State of Queensland and the

parties agree to submit all disputes arising between them to the Brisbane Registry of any such Court as is competent to hear the matter.

SEVERABILITY19. If any provision of this document is unenforceable in accordance with its

terms, any provisions which are self sustaining are, and continue to be, enforceable in accordance with their terms.
