The major oil company’s profits do not represent the profits of the independent gasoline retailer. ExxonMobil 1Q profit jumps 38 percent

New York -- ExxonMobil Corp. says its quarterly profit increased 38 percent as oil prices rose in the first three months of the year.The Irving, Texas, oil giant reported a profit of $6.3 billion in the first three months of the year. That

compares with $4.55 billion in the same period last year. Revenue jumped 41 percent to $90.25 billion from $64 billion. Exxon's profit relied heavily on its exploration and production operation. Oil prices surged over the past 12 months, jumping from a low of $33 a barrel in the first quarter of 2009 to more than $80 a barrel this year.Shell Reports Positive First Quarter 2010 Results

Houston -- Driven by higher energy prices, operational and production performance and the company's growth programs, Royal Dutch Shell reported yesterday that its first quarter 2010 results improved considerably compared with year-ago levels, and its profitability increased from the low levels seen in the fourth quarter of 2009.

First quarter 2010 earnings, on a current cost of supplies (CCS) basis, were $4.9 billion vs. $3.3 billion a year ago. Quarterly CCS earnings, excluding identified items, were $4.8 billion compared to $3.0 billion in the first quarter 2009, an increase of 60 percent. Chevron doubles 1Q income on higher oil pricesNew York -- Chevron Corp. says its first-quarter profit more than doubled as oil prices soared over the past year.The San Ramon, Calif. oil company reported income of $4.55 billion for the first three months of the year. That compares with $1.84 billion in the same part of 2009. Revenue increased 33 percent to $48.18 billion.ConocoPhillips Report Solid Q1 Earnings Houston Texas -- ConocoPhillips reported a $2.1 billion profit for the first quarter 2010, more than doubling from last year, reflecting significantly higher crude oil prices and lower operating costs amid improving market conditions.

Chevron Confirms First Oil From Perdido DevelopmentWorld’s deepest offshore production facility marks milestone in the deepwater U.S. Gulf of Mexico. Chevron Corp. has announced its the Perdido deepwater project, located in the U.S. Gulf of Mexico, has started crude oil and natural gas production.Production from the Great White, Silvertip and Tobago fields using the Perdido hub is expected to reach full capacity of 130,000 barrels of oil-equivalent per day after the drilling of additional wells.

"Perdido represents the industry's first production from the Lower Tertiary, where Chevron has made multiple discoveries and is a leading leaseholder. This project's success paves the way to develop further opportunities in this important new area," said Gary Luquette, president, Chevron North America Exploration and Production Co.Tethered in nearly 8,000 feet of water, Perdido is the world's deepest offshore oil and gas drilling and production spar and is 60 miles beyond any existing developments in the Gulf. Several new technologies were specifically developed for Perdido, including a means to separate crude oil and natural gas at the sea floor rather than on the platform. Chevron is at the forefront of efforts to develop crude oil and natural gas from the Lower Tertiary. Chevron began front-end engineering and design for the Jack and St. Malo fields last year and expects to sanction the project this year. The company also plans to further evaluate its Buckskin discovery in the Lower Tertiary through appraisal drilling activities in 2010.

First Compressed Natural Gas Pump Opens in Oklahoma City The Total Express convenience store added the alternative transportation fuel to its gasoline pumps.Oklahoma City – Oklahoma City residents can now fill up with compressed natural gas with the addition of a CNG pump at a Total Express convenience store, the Associated Press reports. At the opening ceremony on Monday, Oklahoma energy secretary Bobby Wegener and state environmental secretary J.D. Strong touted CNG as a viable alternative fuel. Strong filled up his CNG-powered Honda during the event. “CNG is by far the cleanest fossil fuel out there,” said Strong. Wegener pointed to the use of CNG in cars as a way to lower America’s dependence on foreign oil. Using CNG as a transportation fuel reduces emissions and create jobs, too, Wegener said. Total Express business development manager Todd Kelly said the company would open another CNG-equipped convenience store this fall. Kelly said CNG could be the answer to high gasoline prices. Monday’s prices had CNG for $1.49 per gallon and gasoline at $2.79 per gallon. Total Express also will consider adding more CNG locations in the future. “I’d like to see it sooner rather than later,” said Kelly.

Has Gasoline Posted Its Seasonal High Already?Nationally, the average price for regular grade gasoline spiked to a $2.858 gallon 17-month high on April 12, according to the Energy Information Administration which surveys for this information, and wholesale costs have increased in most of the country's metropolitan markets since. Iceland's volcanic Eyjafjallajokull that has grounded tens of thousands of flights in Europe has dented global demand for crude oil. Such a scenario sees lower demand for crude oil that would exert downward price pressure in global oil markets.The latter is the U.S. government's fraud allegations against Wall Street titan Goldman Sachs, which triggered a global sell-off in stocks and commodities when the lawsuit was made public April 16. Financial dealer Goldman Sachs lost billions of dollars in value that day, while the global market is seen reevaluating its risk appetite, which could mean less speculation in the oil markets.Nearing $90 a barrel earlier, many in the market had expected a price pullback, arguing that the rally in oil was running ahead of fundamental factors. These market observers said that the oil market was climbing on expectations for robust growth in fuel demand when data showed a far more sluggish pace in consumption while inventory levels stay stubbornly high. In light of the Securities and Exchange Commission's (SEC) civil lawsuit against Goldman, some analysts argue that speculative long positions in the oil market, which is a bet for higher prices in the future. What Increases and Decreases Gasoline Prices!Mother Nature, greed, an accident at a refinery, Maintenance at a refinery, Inventory down, Increase inventory less than expected, middle east rumors, innuendoes, negative news, anticipation of increased demand, Commodities Exchange speculators gamble are some of the reasons why gasoline prices increase. There is a way to bring prices down; conserve, drive less and when demand is down, inventory increases. The increases are quick and the decreases are very slow (up like a rocket and down like a feather). In the month of April there has been 18 changes up and down in the price of wholesale gasoline mostly up.

Senate Climate Bill May Include New Gasoline TaxWashington, D.C. -- Some Senators are considering a new tax on gasoline climate bill now before Congress. According to the Los Angeles Times, the tax of approximately 15 cents per gallon was conceived with input from oil companies, including Shell, BP and ConocoPhillips.To attract support, the bill will also include an expansion of offshore oil drilling and new incentives for nuclear power plant construction, according to the report.

Although historically, oil companies opposed gasoline taxes as harmful to consumers, in this case, the tax is expected to cost them far less than more onerous proposals to reduce greenhouse gas emissions currently in the House climate bill, passed last year.The bill's sponsors foresee the tax funding a variety of emission reducing programs, including helping manufacturers reduce energy use and boosting wind and solar power installations by electric utilities.

Heartland Hacker Sentenced to 20 Years in Prison Judge aims to send a messageBoston -- A Miami hacker received two 20-year sentences this past week for stealing millions of credit-card numbers from 7-Eleven convenience stores, TJX Cos., regional grocer Hannaford Brothers Corp. of Maine, and other major retailers, as well as for breaking into the computer systems of two other unnamed retailers.In Boston Friday, U.S. District Court Judge Douglas Woodlock sentenced Albert Gonzalez to 20 years and a day in prison, plus a $25,000 fine, according to a report in the Boston Globe for his role in stealing an estimated 130 million card numbers largely from Heartland Payment Systems Inc., one of the nation's largest processors of credit and debit card payments.The new sentence will run simultaneously with the 20-year term imposed for stealing millions of card numbers from TJX Cos. of Framingham, BJ's Wholesale Club Inc. of Natick, and other major retailers, according to the report.Woodlock said he wanted to impose a significant sentence to punish Gonzalez and deter other hackers from committing similar crimes. Woodlock noted that Gonzalez would probably not be released until he was in his mid-40s.Maybe this sentence will deter other hackers from this crime and destroying people’s lives.

Florida Oil Holdings Buys 24 BP Sites Orlando, Fla. -- Scottsdale, Ariz.-based Florida Oil Holdings LLC purchased 24 ampm convenience stores in Lake, Orange and Osceola counties last month for $33.5 million, marking its entry into the Central Florida market, the Orlando Business Journal reported.The purchase represents all the BP stations with ampm convenience stores in central Florida, Mark Murgash, who manages fuel distribution, real estate and construction for Florida Oil Holdings, told the

paper. The purchase which was conducted as separate transactions by different business entity names in early March was part of a 20-year franchising agreement with BP Products North America Inc., the report stated. Florida Oil Holdings is a sister company to Arizona Oil Holdings LLC and Georgia Oil Holdings LLC, which also own and operate convenience stores in Arizona and Georgia, respectively.The company retained all store-level employees and plans to grow the ampm brand in the Orlando market, Murgash told the newspaper. "We still need to get our feet under us [with the new acquisitions], but we're always looking for opportunities," he said.The sale is part of BP's previously announced plan to sell its retail fuel and convenience store sites to local wholesale distributors or franchisees, BP spokesman Scott Dean said in the report.

Who Spends the Most on GasolineState-by-state breakdown shows some consumers spending up to 11% of their incomeNew York -- Everyone grumbles when prices at the pump rise, but some drivers pay more depending on where they live. A new study shows how gas-price spikes hurt the wallets of drivers in some states more than in others.On average, Mississippi drivers spent more than 6% of their annual income on gas in 2009, compared to drivers in Connecticut and New York who spent just 2.5% of their income on gas, according to the Natural Resources Defense Council (NRDC) study, as reported by LiveScience.com. But a price spike similar to the one in July 2008 would have worsened the imbalance: Mississippi drivers would have seen driving costs shoot up to 11% vs. 4.3% for Connecticut and New York.Among the 10 states that paid the most proportionally for gas were Mississippi, Montana, Louisiana, Oklahoma, South Carolina, Kentucky, Texas Maine, Georgia and Idaho. The 10 states that paid the least proportionally for gas included Florida, Washington, Pennsylvania, New Jersey, Colorado, New Hampshire, Maryland, Massachusetts, New York and Connecticut.

North America’s Cheapest gasoline prices With gasoline prices rising in both Canada and the United States, its time to see where the cheapest prices are and where they aren't. The cheapest states remain those who are most familiar with the lowest prices. South Carolina lands the title for cheapest, while neighbor North Carolina is half way down the list, at 20th cheapest. The spread between the two is nearly fourteen cents. South Carolina, as mentioned, takes 1st for the South. New Jersey takes 2nd cheapest for the Northeast, Oklahoma takes 3rd for the Midwest/Plains, Colorado takes 4th cheapest for the Rockies, and Missouri takes 5th cheapest for the Midwest. The West coast is the highest.On the other hand, Hawaii easily takes the title for most expensive gas in the United States, averaging $3.553 per gallon, nearly 90-cents higher than South Carolina. Alaska takes 2nd for most expensive, coming in at $3.374 per gallon. About thirty cents separates the continental U.S., with California easily taking the 3rd most expensive spot, followed by #4 Washington and #5 Idaho. With just one exception, Colorado, the cheapest five states all have among the lowest gasoline taxes per gallon, with an average of 35-cents of each gallon being tax. Colorado state taxes average closed to 41-cents per gallon.

Changing Times

Many years ago when almost all of the traditional gasoline stations were operated by individuals who were small business owners leased from major oil companies, your windshield was cleaned, oil, tires checked and more. After the first crude oil embargo (early 1970’s) something changed; non traditional gasoline stations popped up, discounters like Costco, Sams, Wal-Mart, grocery markets, even a restaurant (Jack In The Box) and the oil companies started to company operate retail gasoline stations in direct competition with their lease dealers. The level playing field wasn’t level anymore (do I have to explain). Their main objective was to eliminate their franchise dealers.In 1978 Petroleum Marketing Practices Act (PMPA) federal statute became law. The purpose was to level the playing field!!! Violation after violation of the PMPA was their strategy because the dealer had to file suit against their oil company to stop the violations. In most cases the financial cost was too much and the strategy of zone pricing, increased rents, transfer of responsibility for many of the oil company’s responsibility to the dealer and to many to mention. Before the oil companies got into the retail gasoline station business, the dealers were persuaded to give free trading stamps, free 2 litter Coke/Pepsi with gasoline purchases, free car wash with full-ups, free air, water and all kinds of programs that cost the dealers money. When the oil companies company operated the retail gasoline stations; all the freebees were gone.Now the oil companies are divesting their real estate and violating PMPA by not giving the franchise dealer the first right of refusal to purchase the dealer station. A group of independent service station dealers from Massachusetts filed suit against Shell Oil Co. and Motiva Enterprises LLC and won a $3.3 million dollar judgment that went all the way to the U.S. Supreme Court who overturned a federal appeals court ruling. The oil company strategy was to financially strap the franchise dealer and many went out of business and many just turned their keys over to the oil companies without any compensation for their years of hard work and sacrifice. It was hard to understand why the oil companies turned on their own franchise dealers. The change should have included their dealers who sacrificed many years of their life.

Satellites Covered With Tinfoil ScamA group of individuals are covering the satellite receiver with tinfoil. This is done to circumvent credit/gift card approvals. A phone line backup will not always work with gift cards. The card will be approved by the system but the charge will not be deducted from the gift card nor be credited to your account. The group will come in one by one or in pairs and attempt to purchase large quantities of Newport Cigarettes and will present several gift cards and credit cards until the system approves one of them. One of the individuals is a truck driver from a national trucking company. Subjects are operating along interstate 55 in Illinois and in St. Louis.

ExxonMobil CEO's total pay falls in 2009Irving, Texas -- The Associated Press has found that compensation for Exxon Mobil's CEO fell 9 percent last year as he company struggled with a plunge in petroleum consumption. Rex Tillerson received $21.7 million in total compensation last year. That compares with $23.9 million in 2008. Refineries struggled amid a global decline in oil and gas demand.The AP's executive pay calculation, based on a regulatory filing, aims to isolate the value the company's board placed on the CEO's total compensation package. The figure includes salary, bonus, incentives, perks and the estimated value of stock options and awards.

ExxonMobil Loses Top Seat to Wal-Mart on Fortune 500Mass retailer unseats Major Oil for top slot in Fortune 500 rankingBentonville, Ark. -- Wal-Mart Stores Inc. managed to unseat Exxon Mobil Corp. in the 2010 edition of Fortune magazine's "Fortune 500" ranking. Wal-Mart has held the top spot on the ranking seven out the past nine years.The fall in commodity prices removed half-a-dozen energy production, oil refining, and pipeline companies, and bumped last year's No. 1, ExxonMobil ($285 billion), into second place, far behind the new leader, Wal-Mart ($408 billion).Bentonville, Ark.-based Wal-Mart managed to lift revenues, on top of a big increase in 2008, by attracting bargain-hungry customers from competitors with remodeled stores and inexpensive private-label goods, offering everything from frozen pizza to patio furniture in one stop. A single trip also meant less spending on gas. The result: Earnings surged 7% to $14.3 billion.

N.J. Retailer to Pay Back Wages, FinesLabor Dept. secures $3.9 million in wages for station employees; $100,000 in finesPiscataway, N.J. -- The U.S. Department of Labor has obtained a judgment against a Piscataway, N.J.-based Raceway Petroleum Inc. and Nicholas Kambitsis to pay $3.9 million in unpaid overtime wages and liquidated damages to more than 700 of their former and current employees, predominantly gas attendants. Raceway Petroleum, with gas stations located throughout central and southern New Jersey, along with its owner Nicholas Kambitsis, will also pay $100,000 in civil penalties."This action underscores our commitment to pursuing all available legal means to ensure workers receive their proper wages," said Secretary of Labor Hilda L. Solis. "The Labor Department will not tolerate employers who violate the rights of workers and attempt to circumvent the law."More than 25 witnesses testified during three weeks of trial before a jury in the U.S. District Court, District of New Jersey. Some employees described working as many as 100 hours a week. For part of the period covered by the lawsuit, Raceway deducted up to two hours of breaks daily.Many of the employee witnesses testified that they got less than one half hour of break time each day. The consent judgment resolves a lawsuit filed by the department in 2006. An investigation by the Wage & Hour Division found that beginning in June 2002 Raceway and Kambitsis violated the Fair Labor Standards Act (FLSA) by failing to pay their employees time and one-half their regular hourly rates when they worked in excess of 40 hours in a workweek and by failing to keep accurate time and payroll records. It was later determined that the defendants failed to come into compliance through December 2009.

PIN Debit Fees Go Up  Visa increased PIN debit fees by nearly 30 percent.Arlington, Va. – Beginning April 16, Interlink, the personal identification number (PIN) debit network run by Visa, increased by nearly 30 percent its fees for PIN debit transactions. “It is unacceptable that Visa continues to increase fees at a time when our country needs to protect the hardworking Americans who provide jobs in our communities,” said Leslie G. Sarasin, president and CEO at the Food Marketing Institute (FMI), in a press release. “Swipe fees are hurting small independent businesses and grocers the most because they pay some of the highest rates and have no choice about whether or not to accept debit cards to remain competitive.”

FinCEN Announces Launch of FinCEN Updates E-mail Subscription News ServiceThe Financial Crimes Enforcement Network (FinCEN) today announced the launch of FinCEN Updates – a new, free e-mail subscription management service designed to keep the financial industry, the media and the public informed of news, rulemakings, advisories and other developments at FinCEN. This new secure e-mail subscription management service permits users to customize their updates, which enables them to receive e-mails related to the topics to which they have subscribed.

FinCEN Updates allows users to choose their subscription preferences. Subscription items include advisories, guidance, news releases, rulings, enforcement actions, and current career opportunities at FinCEN. Users can add or delete subscription items themselves, and have the option to password protects their accounts for increased security. Users can opt to have FinCEN Updates sent immediately, daily, weekly, or monthly to their e-mail accounts or directly to a wireless device.

Executive Order 10-99 is in affect (Emergency Management Deepwater Horizon)

1)  Executive Order 10-99 was issued April 30th, 2010, declaring a state of emergency due to the threat of Crude Oil leak threatens Florida’s. The order was signed April 30 and will expire June 29 and is in response to the oil well fire in the Gulf. The only counties affected are between Pensacola and Port St. Joe plus Franklin, Wakulla, Jefferson, Taylor, Dixie, Levy, Citrus, Hernando, Pasco, Pinellas, Hillsborough, Manatee and Sarasota counties. Price gouging laws are in effect.

This order will expire June 29th 2010 unless extended within that time.  

As I have mentioned on many occasions it is absolutely imperative that you maintain accurate records and have them available to respond to inquiries that will no doubt be made in advance of possible subpoenas. Those records should extend back to 30 days prior to the original declaration. Comply with any requests you may receive.

The law requires you to maintain the same margin of profit for each grade of gasoline whether prices go up or down. The ‘State of Emergency’ will end on June 29th, 2010 unless the Governor extends the ‘State of Emergency’ with a new Executive Order.
