Positive Changes - Aaron Garcia

In life there are giversand takers on many oc-casions I have been ableto pass on our thanks toindividuals and groupsfor their generous sup-port to our clients andthe organisation as awhole. However on this occas-sion it saddens me toreport the theft of thelittle Japanese Warriorstatue.

This beautiful JapaneseWarrior statue has takenpride of place in the gar-dens of the IndependentLiving Units at StMichaels since 2011.The statue had beengenerously donated bythe parents of one of theresidents and was posi-tioned in the garden infront of their unit. The Warrior was morethan just a statue, it

pated in the LauncestonTen as a member of theSt Michaels WalkingTeam. Aaron com-mented “I did the coursein 1 hour 16 minutes.”This is a wonderfulachievement for Aaronand again demonstrateshis personal growth. After this Aaron ap-proached Disability Sup-port Manager DonaldRichards requesting atrip to the football withhis friend to watch Haw-thorn and North Mel-bourne play. This is the first time hehad ever been to agame let alone at such alarge event and when hewalked through thegates and he saw thelarge crowd, he stopedwith amazement andsaid “there are lots ofpeople here Donaldwhat do I do?”Donald’s kind words ofencouragement were“Aaron they are here forthe same thing as youare, which is to watchthe football match andenjoy it, don’t worryabout it” “So Aaron whatare you going to do?”Aaron to his credit wentthrough the gates, thor-oughly enjoyed thegame, brought histeams jacket and capand enjoyed the atmos-phere, excitement andthe experience which heshared with a friend. These are things andexperiences that we alltake for granted, where

as this was a big thingfor Aaron!Aaron continues to learnhow to communicateeffectively, what hewould like to achieveand just wants to begiven the opportunity toparticipate like every-body else in the commu-nity.More recently whilst onschool holidays, he vol-unteered a whole day toassist in the develop-ment of garden areaaround the round aboutat St Michaels. This in-cluded working side byside with a member ofthe St Michaels BoardGlen Cornish.Glen was very im-pressed with Aaron’swork ethic and ability toget in and get the jobdone. “He just wouldn’tstop until the job wasdone” Glen said.Aaron then took Glen tothe Student Accommo-dation and made him acup of tea, which wasessentially unheard of.Donald Richards com-mented “Aaron contin-ues to make great pro-gress, he has certainlycome a long way.”Aaron then took the op-portunity to pass on histhanks “to St Michaelsfor all their help.”“I have now got friendshere at St Michaels whoI like catching up withand just hanging outwith”, Aaron stated.

SHOULD ICONTEST A

WILL?

In a recent case inHobart, a 41 year oldwoman (the claimant)received $200,000.00from the estate of herfather who abandonedher at the age of 3.

This amounted to ap-proximately one third ofher father’s estate.

The Supreme Courtfound that, apart from achance meeting be-tween the claimant andher father, she had notseen her father for 40years and he had madeonly a modest financialcontribution to her up-bringing. The Judgesaid “largely because ofher mother’s poor finan-cial situation, the appli-cant decided to seekemployment rather than

continue her educationat tertiary level. Hadtheir financial situationbeen better, the appli-cant said she wouldhave attended univer-sity and studied law.”

When the claimant‘sfather died he left hisentire estate to hiswealthy step son.

The step son fought theclaimant‘s claim, partlyon the basis that herfather had no moralobligation to leave heranything but the Judgedisagreed.

The Judge said “I amtotally un-persuadedthat anything the appli-cant did or failed to dowould warrant a finding

that she forfeited orabandoned her moralclaim on her father. Hesimply abandoned hisdaughter emotionallyand physically andmade only one contribu-tion to her mainte-nance.”

More and more Tasma-nians are contestingWills than ever before.Disinherited childrenand disgruntled spousesare letting the Courtswork out for them ifthey have been unrea-sonably deprived of afair share of the de-ceased’s estate.
