1 - The revolution is back in FranceMain milestones

2005: implementation of 2003 directive

2007 after the issue of a report on the "intangible economy", the Government set up an agency (APIE) to optimise the impact of the State's intangible assets and to help national administrations to detect their reusable PSI, to monetize and to promote them

2009: for the first time, the FR Government use the acronym PSI in a document (“France Numérique 2012 program”)

2010 : The Guidance Council of public publishing and information (COEPIA) is created under the initiative of the Prime Minister. It is a major place where public & private sector can share concert experiences and find a balance between pros/cons. It also give administrations the means to distribute their content (pricing strategy, authors right, anonimyzation, format,

2010: the city Rennes open its data, followed by Brest, Paris, Marseille, Montpellier, Bordeaux...

24/11/2010: The Government announces the portal will open by the end of 2011

21/02/2011: The Prime minister creates Etalab, a new service (6 people) in charge of the Data.gouv.fr project

26/05/2011: a circulaire (internal note into the administration) of the Prime minister o stresses the importance of open data for FR industry, o Determine that the rule of free access to PSI will become the standard,

payable the exception,o Encourage all public administrations and institutions (and regions and cities

if they wish) to put their content on data.gouv.fr, o Promote the usage of a free licence, o Create an Etalab correspondant in each public institution, o Pleade for reuseable formats,

26/05/11 : a decree (more important legal value than a circulaire) determines that public holders already charging for their PSI before the 1st of July 2011 are allowed to continue…..until the 1st of July 2012

BUT : in the meantime, those public bodies will have to present a case to the COEPIA to explain why and on which “exceptional” cost they built their pricing strategy.

All the other public bodies that had no pricing list (because no data available) before the 1st of July 2011 will also have to “sing for their supper” if they want to charge.

The Prime minister will publish a decree for every payable content avaialble after the 1st of July 2012.

2 - Doing business with national data Are administrations “proud” to see people or companies using their data?

Which quality? Wihich responsibility of administrations?

Administration could be afraid to put good data for free, preferring to expect an agreement from PM…that may never come…and that take France to a new PSI blocking situation

For the PSI holders that intend to charge the, the complexity will be on:

o Pricing model, exceptional cost definition(outside public service mission)

o the concept of recovery cost seems to be forgotten

o Cascade licences

o Personal data & anonymisation

o Authors right of public agents (loi 2006-961 from the 1st of August 2006)

o Public task definition and State role limitations

o Control of reusers

APIEFollowing the implementation of the PSI Directive into French law

and after the issue of a report on the "intangible economy", the Government set up in 2007 an agency to optimise the impact of the State's intangible assets and to co-ordinate work among French Government Ministries, as well as to support the administrative services in terms of management of their intangible assets. This organisation APIE[1], Agence du patrimoine immatériel de l’État.

CADAThe mission of the organisation, Access Commission to

Administrative (CADA in French), since 2005, makes a recommendation when there is a conflict between a private company and a public information producer or gives advice when a public producer, who receives a re-use demand, asks for help. This commission received very few questions about re-use (only 7% in 2010). All the answers were favorable to the re-users.
