No tender shall be accepted / opened in case of receipt after due date and time of tender, irrespective of delay due to postal services or any other reasons and the Corporation shall not assume any responsibility for late receipt of tender.

The tenders are to be submitted by the intending bidders with forwarding letter on their letter head showing list of documents attached with the tender duly signed by Authorized Person of their firm, affixing stamp of their firm, in single envelop with two separate sealed and super scribed envelopes as listed below:

Envelope No.1: Technical bid and Post Qualification bid data, details specification.

Envelope No.2: Price Bid.

Technical and post qualification bid details specification (envelope No.1) will be opened first and subject to evaluation based on the qualification criteria contained in the individual bid document.

Price bids (Envelope No.2) of bidders who are assessed and declared as substantially technically responsive on evaluation of the technical bid will be opened for further commercial evaluation.

The Earnest Money Deposit and tender fee will be accepted by Demand Draft on any Nationalized Bank only situated at “NADIAD”, drawn in favor of “GUJARAT ENERGY TRANSMISSION CORPORATION LTD.” Tender without EMD and tender fee shall be rejected. Two separate demand draft for Tender fee and EMD should be submitted with technical bid.

The GETCO reserves the right to award the work to one or more bidders, considering their technical and financial capacity OR to reject any/all tenders OR accept any tender without assigning any reasons thereof.

QULIFYING REQUIREMENTS

The tender documents are for two separate bids i.e. technical bid (i.e. qualifying bid) and price bids(i.e. commercial bid).

Following credentials shall be submitted with the technical bid for qualification.

A] TECHNICAL

1) Registration : Bidder should have registration in appropriate class (E2 & Above) with GETCO

2) Experience: Contractor should produce evidence of having experience in executing similar nature of work minimum amounting to Rs. 2,00,000=00 in one calendar year and they should submit Attested photo copy of orders secured from GETCO / Central / State Government / Railway / Semi- Government or any Reputed Firm and satisfactory completion certificate from respective department.

3) Electrical Contractor License : Bidder shall have valid Electrical license of respective state.

B] FINANCIAL

1. Latest bank solvency certificate from any nationalized bank of a sum of minimum 20 % of the estimated cost shown in the tender.

2. Separate provident fund code number towards your firm registered with Regional P. F. Commissioner.

3. Contractor should produce audited copy of the Balance sheet with profit and loss account of last three Years.

4. Attested copy of Power of Attorney, if any, for signing the bid documents.

5. The bidder shall be registered under the “GUJARAT VALUE ADDED TAX –ACT”.The certified Xerox copy of such registration under Gujarat VAT ACT indicating “TIN” shall have to be submitted along with bid by the bidder.

6. The Bidder should submit copy of S.T. registration certificate.

7. The Bidder should submit copy of PAN Card.

8. Income tax will be deducted as per Rules from the Bill.

SPECIAL INSTRUCTION TO BIDDER ::-

The tender should be submitted in sealed envelope on which it should be definitely indicated the name of work.

Bidder should quote price for supply items including all taxes as per Schedule – B1 & should quote percentage for work mentioned as per Schedule – B2 of the tender. Over all lowest will be considered as L1 party during commercial evaluation. Rates should be quoted on firm price basis.

Bidder must confirm their full acceptance to various terms & condition of GETCO specification. They should also confirm that offers are based strictly on the specification date in all respects.

An Earnest Money deposit of Rs 2880-00 shall have to be remitted by the bidder by way of DEMAND DRAFT payable to “GETCO” drawn on a schedule bank in NADIAD with the tender only. Cheques or any other form towards payment of Earnest Money Deposit will not be accepted and the bid will be disqualified. Registered contractor shall deposit the amount in accordance with the conditions of registration with the GETCO.

The bidder are required to quote only firm prices for all item No variation on price statutory or otherwise or raw material or finished products on any cause will be accepted.

The bidder should note that the completion of above work in all respect in accordance with the time limit given below is very important and should be strictly adhered to “Completion in 60 Days from the date of issue of letter for commencement of the work”.

The bidders should furnish a list of orders for similar work executed by them and clearly mention the name of the party for whom the works have completed. The reference of order number and date performance report of such works be furnished in attached bidding at schedule – ‘C’.

The bids should be valid for a minimum period of 6 months from date of opening.

The prospective bidder shall have executed satisfactory similar worked as large magnitude in time and have full fledge Engineering organization to handle this highly specialized skilled and intricate work and such experience will be one of the major consideration in evaluation and finalizing this tender.

The work covered under these specifications shall be carried out and governed by ‘Tender And Contract for works booklet appended herewith except where conditions specified in this specifications.

The contractor shall have a separate provident fund code of RPFC and the contractors who not posses separate P.F. code shall not be considered for acceptance of tender. Contractor has to submit such certificate show in separate P.F. Code along with tender.

CO-ORDINATION WITH OTHERS:-

Any more information like Detail specification of Items, Quality of Material to be used, Design concept, Plan of work to be executed etc of the proposed above mentioned work may be referred from the Dy. Engineer(Tech) Circle, NADIAD during the office hours.

The successful contractor shall have to sign an agreement as per GETCO’s rules on a stamp paper and necessary stamp duty charge shall be borne by the contractor. Before signing agreement contractor will have to pay security deposit as per GETCO’s rule.



The bid shall accompany by a covering letter in which the bidder shall give information as called for in the specification and any other points which he would like to consider along with the tender. If such covering letter is not received along with the bid, it will be presumed that the bidder agrees entirely with the specification and general Terms and Conditions of the contract booklet.

The work shall commence immediately after the order for commencement is issued.

Bidder shall indicate in Schedule-F the equipment in his possession and propose to bring to the site in case the work is awarded.

These section are supplementary to each other and the particulars and requirement so contained have in shall covering the executing of Civil works covered under this specification. The contractor shall have to use the best quality of material in the work as per the specification and relevant I.S. codes. In case GETCO desired to carry out any field test/laboratory test for any material required for the work, the contactor shall arrange for the same at his own cost. Further for, any finished work such as masonry, plastering, etc. if any testing is required same shall arrange for regular cube testing for all important concreting work, at his own cost. The contractor shall have to maintain the regular records for such testing & shall submit along with each R.A./FINAL bills.

The drawings attached with the tender are only for bid purpose. However contractor shall have to carry out the work as per the construction drawing or instructions issued form time to time for which GETCO shall not entertain any claim.

GETCO will not issue any materials. All other material required for completion of work shall be arranged by the contractor at his own cost Contractor shall have to bear the cost of transportation of such of material.

The testing of material if required shall be done by the contractor. The all testing charges shall be born by the contractor.

No collection of material shall be made before it is approved form the Engineer-In-Charge.Materials, if and when rejected by the Engineer-in-charge shall be immediately removed from site of work.

Approval to the sample of various materials given by the EIC shall not absolve the contractor from the responsibility of replacing defective material brought on site or material used in the work found defective at a later date. The contractor shall have no claim to any payment of compensation whatsoever on account of any such material being rejected by E.I.C.

SPECIAL CONDITIONS

Following are the GETCO’s special conditions for this project and wherever these special conditions contract with similar conditions in this tender document the following special conditions shall prevail.

1. ABRITRATION In view of Government of Gujarat’s directive the Arbitration clause provided at Sr. No. 30 of the Chapter in Booklet of ‘TENDER AND CONTRACTOR FOR WORKS’ in Tender specification and other related reference for Arbitration now stand deleted.

In its place, following clause is to be substituted.“ALL QUESTIONS, DISPUTES, DIFFERENCES, WHATSOEVER WHICH MAY AT ANY TIME ARISE BETWEEN THE PARTIES TO THIS CONTRACT IN CONNECTION WITH THE CONTRACTOR OR ANY MATTER ARISING OUT OF OR IN RELATION THERE TO SHALL, BE REFERRED TO THE “GUJARAT PUBLIC WORKS CONTRACTS DISPUTES ARBITRATITON TIRBUNAL, AS PER THE PROVIDISION OF THE GUJARAT PPUBLIC WORKS CONTRACTS DISPUTES ARBITRATION TRIBUNAL ACT, 1992”

1.1 The reference to arbitration proceeding under this clause shall not ::

Affect the right of the Engineer-In-charge to take possession of all or any tools, plants, materials and store, in or upon the work or site. Thereof belonging to the contractor procured by him and intended to be used for the execution of the work or any part thereof.

Preclude the Engineer-In –Charge from utilizing the materials purchased by the contractor in any work or from removing such material to other place, during the period the work is stopped or suspended in pursuance of notice given to contractor under General conditions.

Entitles the contractor to stop the progress of the work or carrying out the additional or altered work in accordance with provision of General conditions or the work where there is no specification.

Preclude the GETCO from getting the work done by another agency.

1.2 Neither party is entitled to bring a claim to arbitration latest by thirty days after the expiration of the defects liability period.

1.3 The provision of the Arbitration Act, 1992 Gujarat Public work contract Disputes Arbitration Tribunal Act, 1992 and rules made there under shall apply to the arbitration proceeding under the clause.

2. The payment shall be made against the work carried out as per the actual requirement.

3. The work is to be carried out as per our call and on site of our various projects under the control of this circle as per the instruction of EIC as and when required.

4. The party has to arrange for transportation for man & material at his own cost . The GETCO shall keep

cable ready (laid) for the above work at site required for this work. This offer should be valid for a period of One year from the date of opening of the tender and the work order issued by this circle based on party’s offer shall remain in force upto date.



5. The party has to start the work within 24 hours after receipt of instruction by phone / fax / telegram. In case of failure of the termination kit within the guarantee period same should be provided with New termination kit at free of material labour cost within two days. The rates should be inclusive of all taxes.

6. The Contractor’s rates should be firm and no variation clause is to be quoted by the contractor and GETCO will not accept the same during contractual period extended time if any.

7. THE GETCO WILL NOT PAY ANY TYPE OF ADVANCE INCLUDING MOBILISATION ADVANCE.

01 VALIDITY: The rates for the work quoted by the contractor will be valid for the period of SIX

MONTHS from the date of opening of the tenders.

02 PAYMENT OF SECURITY DEPOSIT:The contractor will have to pay the security deposit at 5%of the order value .On placing the order 2.5% will have to be paid in cash or Demand draft drawn in favour of GUJARAT ENERGY TRANSMISSION CORPORATION LTD. Within seven days from the date of the issue of work order and remaining 2.5% will be recovered from first two running bills.

03 SIGNING OF AGREEMENT: The contractor will have to sign agreement as per GETCO’s rule, in the prescribed Performa of the GETCO. The cost of the required stamp paper will have to be borne by the contractor.

04 PAYMENT OF BILLS : Normally one R,A Bill will be paid every Month. However looking to the progress of the work it will be reviewed mull way. The 90% cost of the work done will be paid to the contractor on his presentation of R.A. Bills along with giving the material account and singing the joint measurement of the work done with our D.E.(TR/Const.) concerned. The bill should be submitted to the D.E.(TR/Const.) concerned with a copy to the E.E.(TR/Const.) concern. The final bill will be prepared by our D.E.(TR/Const.) concerned within about fortnight from the date of completion of the work by the contractor. The Contractor have to submit the final bill with complete material account of the work contract to enable the D.E.(TR/Const.) for submission to E.E.(TR/Const.) for passing and payment thereof.

05 DEPARTURE FROM SPECIFICATION AND DRAWINGS :Should be tenderer wish to depart from the specification in any respect, they should draw attention to such departure giving his reasons thereof and should get approved the case. However, in case of any clarification the decision of Engineer-in-charge will be final and binding.

06 AVAILABILITY OF MATERIALS AND IDLE LABOUR CHARGES :Most of the materials are readily available and arrangements are made to procure the rest. However, the contractor should be prepared to carry out the work as and when the materials are received. No idle labour arises due to want of any materials will be allowed. However, this idle period will be counted for the period of assessing the limit for completing of work as mentioned in the work order.

07 Board does not accept any responsibility as regards to factory acts or any other acts. Rules or regulations that have to be observed by the contractor for carrying out the work.

08 The contract will be governed by the General condition of works contract of the GETCO. A copy of booklet will be available along with the tender, the contractor is deemed to have studied the same thoroughly before filling up the tenders.



09 ACCOUNTING OF BOARD’S MATERIALS :The contractor will be fully answerable and responsible for all the materials issued to him for the work by the GETCO for any theft, loss or pilferage and shall have to submit the account for the final bill. If the loss referred to above is not made good before the preparation of the final bill, the cost of the materials will be recovered from the final bill as per the rules of the GETCO.

10 PROGRESS OF WORK AND PENALTY :If it is found that the work is unsatisfactory or not progressing as per schedule, then any action be taken by the GETCO as may be deemed fit to see that work is completed at the risk and cost of contractor. If the work is not completed within the schedule period ½% penalty per week of the balance value of the work subject to the maximum of 10% will be levied.

11 SPECIAL CONDITIONS OF THE CONTRACT :The tenderer will abide by and fulfill all the terms and provisions of the tenderer and contract for work’s as applicable and in case of any default there to the GETCO shall forfeit the deposit etc. and the money due in respect of completion of works through other agency on failure of tenderer to complete the work as required in the order.

12 BANK GAURANTEE OR SOLVENCY CERTIFICATE :The successful contractor will have to produce solvency certificate of Rs 50000/- and shall have to execute the agreement on the stamp paper as may be required as per the rules of GETCO in force.

13 SPECIAL CONDITION OF CONTRACT :(a) Should this tender be accepted, I / We hereby agree to abide by and fulfill all the terms

and conditions of the Tender contract for work’s as applicable and in default thereof to forfeit and pay GETCO the same sum of money due.

(b) The full value of the ‘Earnest Money Deposit’ paid herewith should be absolutely forfeitedby the GETCO. Should I / We not deposit the full amount of specified security deposit.

14 GAURANTEE :The tenderer have to give guarantee for the period of ONE year from the date of commissioning for the work attended by them.

15 TIME LIMIT :The work will have to be completed within the time limit specified in the tenders and tender have to complete the same within the time limit only. The time is the essence of this contract, the same will have to be adhered to the tenderer otherwise the penalty as per the GETCO’s rules will be recovered which should be noted.

16 SPECIAL NOTES :1. The rate should be quoted both in words and figures as per unites specified in the tender.

Should there be any discrepancy between the rate a quoted in words and figure, the rate quoted in words shall prevail. Further should there be any discrepancy between rates and amount the rates will prevail.



2. Quantities mentioned in scheduled are approximate and before ordering any materials prior permission from the Deputy Engineer in-charge shall be taken and nothing extra will be paid for the material collected in excess.

3. Two books viz. tender and contract for works and detailed specification for various Civil Engineering works are available for reference in this office.The contractors quoting for this tender are deemed to have gone through both these books and same will be treated as binding upon them.

17 TERMS AND CONDICTIONS REGARDING INDUSTRIAL LAW AND RELATED MATTERS TO BE INCORPORATED IN THE TENDER DOCUMENTS.

1. WAGES TO BE PAID IN TIME BY THE CONTRACTOR.The contractor shall pay minimum wages to labour per day as per government min. wage circular for skilled / unskilled labour. The wages of every contract labour employed by him under this contract shall be paid by him before the expiry of 7 days of the last day of the month in respect of which the wages are payable i.e. wages of a month have to be paid by him before the first week of the next month. The payment shall be disbursed in the presence of Management representative during the work hours in factory premises and the contractor shall get the entries certified in the register of wages by the representative of the GETCO. Any default will result in cancellation of the contract forth with or else the contractor shall be punishable to the extent of Rs. 100 – fine per each day.

2. The contractor shall give his telephone number and address to the GETCO so that incase of labour trouble etc. the contractor can be contacted the contractor shall arrange to have his office the factory premises and the contractor keep himself present through the working hours.

3. LABOURS LAWS :

Person below the age of 18 years shall not be employed for this work.

No female worker shall be employed in the night shift between 7p.m. to 6a.m.

Contractor shall maintain a valid labour license under the contractor Labour (Relation and abolition) Act for employing necessary manpower to required by him in the absence of such license the contract shall be liable to be terminated without aligning any reasons thereof.

The contractor shall at his own expenses comply with all labour laws and keep the GETCO indemnified in respect thereof. Some of the major liabilities under various labours and industrial laws which the contractor shall comply which are as under.

Payment of contribution by way of employer’s contribution towards provident payment fund Family Pension Scheme, Deposit Scheme deposit liked Insurance Scheme administrative charges etc. at the rates made applicable from time to time by Government of Gujarat / Government of India or other statutory authority.



Payment of deposit in respect of each contract labour at the rates of Rs. 30/- with the office of the Commissioner of the labours per the contract labour (Regulation and Abolition Act)

License fee as prescribed under the contract Labour (Regulation and Abolition) Act rules formed there under depending upon the number of workmen employee be the contractor.

Paid leave facility and wages as per the provision of the factories Act and the rate of one day for every 20 days of working.

Identity cards as prescribed under the factories Act. with photo affixed there to the same for identification.

Payment of retrenchment compensation Notice pay other liabilities as per industrial disputes Act any payment to the contractor’s employees arising out of any claim of disputes under the industrial Disputes Act 1947 or any other labour laws.

Payment of compensation in case of accidental injury.

Provision of charge if the female labours employed are more than 30 members.

Maternity leaves as per the provision of the Maternity benefit Act.

4. PROVIDENT FUND AND FAMILY PENSION SCHEME :

The contractor shall submit along with his bill (month wise) statement regarding deduction against employees provident fund and family pension scheme in respect of each concerned employee provident and family pension scheme at the rate of Rs. 8.33 % (or at the rate made applicable by the Government form time to time) of the wages the contractor’s contribution and his workers contribution towards provident fund and family pension scheme shall be deposited by the contractor with Regional provident Fund Commissioner, Ahmedabad.

5. DEPOSIT LINED INSURANCE SHCEME :

The contractor shall have deposit ½% of the wages in respect of a employees who is a member of the Provident Fund as the contribution to the deposit link insurance scheme with Regional Provident Fund Commissioner, Ahmedabad.

6. ADMINISTRATIVE CHARGES :

Administrative charges for maintaining Provident Fund Administrative A/c shall be deposited by the contractor with Regional Provident Fund Commissioner, Ahmedabad at the rate applicable.

7. PAID LEAVE FACILITY :

Paid leave facility at the rate of one day for every twenty days worked by the contractor labour shall be provided by the contractor to his workers. He shall maintain leave Record,



Leave cards for individual labourer which shall be duty verified and approved / certified by the authorized officer of the GETCO.

8. Workmen’s Compensation Fund and Employer’s Liabilities Insurance. The contractor shall cover all his employees under workmen’s compensation Fund and under the liability insurance.

The contractor shall employ adequate number of experienced staff at site for daily supervision and for maintenance of various registers and records required under the law and contract. No payment for supervision shall be admissible under the law and contract. No payment for supervision shall be admissible.

9. CONTRACT TO INDEMNITY THE BOARD :

The contractor shall identify the GETCO and every member office and employees of GETCO also Engineer-In-Charge and his staff against all actions proceeding claims, demands costs and expenses what so arising out of or in connection with the matter referred in here in above elsewhere and against all actions proceedings claims demands cost and expenses which may be made against the GETCO of Government for or in respect of or for manse of his obligation under the contract documents. The GETCO shall not be liable for or in respect of or in consequence of any accident or injury to any workmen or other person in the employment of any accident or injury to any workmen or other person in the employment of the contractor or sub-contractor and the contractor shall indemnity any keep indemnified the GETCO against all such damage and compensation so ever in respect thereof or in relation thereof.

10. WORKMENS COMPENSATION AND EMPLOYER INSURANCE :

Insurance shall be affected or the entire contractor’s employee engaged in the performance of this contract if any of the work is subject the contraqctor shall require the sub-contractor to provide workmen’s compensation and employee. Liability Insurance for the letter’s employees unless employee are covered under the contractor’s insurance.

11. The GETCO reserves the right to terminate this rate contract at any time during its tendency without giving notice of termination or any reasons thereof.

12. The GETCO will be entitled to deduct directly from the bills to be paid to the contractor any sums payable by you and which sums the GETCO is required to pay as a principal employer on account of your default in respect of all liabilities referred to in above clause.

Additional General Terms and conditions::

1. Prior intimation for starting the job will be given by the GETCO through Phone / Fax / e-Mail as and when required.

2. Contractor will have to make his own arrangement for all tools, tackles, manpower etc.

3. No tools, tackles, manpower will be provided by the GETCO.

4. Contractor will be fully and solely responsible for any shortage, damage, leakages to any materials / equipments while executing the work.

5. Works completion certificate to that effect must be taken from Engineer-in-charge after completion of whole job and should be attached with the bill to be produced in triplicate, to concerned Divisionwith a copy to Circle Office, NADIAD.

6. The cost of damages, shortages, breakages will be recovered from the contractor’s bill. The assessment of which will be done by field Engineer at his sole discretion and his decision shall be binding to the contractor and shall be considered as final and unchallengeable.

7. The GETCO will not be responsible for any accident, injury etc. to the Contractor’s labour or any disability to those persons while execution of the job. Any shortages / loss / damage to Contractor`s equipments / tools-tackles during execution of work will be liability of the contractor.

8. Contractor will have to give indemnity bond to GETCO against any possible claim of compensation for damage to GETCO equipments or staff or any other third party during the execution of whole job. If for any reason, GETCO is called up on to pay any such claim or compensation, the same will be recovered from the contractor`s bill any where pending with GETCO even at any later date.

9. For attending the work by contractor will be informed in advance, so as to keep ready skilled labours, tools, tackles and other require materials. The GETCO will not be in any case responsible for any delay in completing the job. No extra charge for any matter whatsoever will be paid to thecontractor. If contractor fails to execute the job in reasonable time, the job will be done at contractors risk and cost. Penalty/additional expenditure as per GETCO rules will be levied and will be recovered from the contractors running bills/deposit etc. will be forfeited, reserving all rights of the GETCO to recover from balanced dues.

10. Contractor or his authorized representative should constantly remain present while executing complete job to avoid any complication.

11. Contractor must engage sufficient skilled labours and competent experienced supervisory staff for executing the job, so as to avoid unnecessary delay, to complete the timely and as per requirement of order.

12. Contractor will have to complete entire job as per instruction, if fails, to do so, entire work will be carried out at contractor’s risk and cost.

13. A Solvency Certificate to the extent of 20% of ordered value will have to be produced by the contractor.

14. Contractor will abide by and fulfill all the terms and conditions and general terms & conditions of the contract for works as prescribed by GETCO.



15. You will have to enter into agreement will GETCO on stamp paper of appropriation value. The cost of the same will be borne by the contractor.

16. Contractor will be solely and fully responsible for any accident, damage either to private or public properties or any human being during execution of the entire job.

17. Other general terms and conditions as prevailing in the GETCO will also apply to these jobs.

18. This order shall remain in force up to one year from the date of issue and same can be extended on mutual understanding.

19. Concerned Executive Engineer shall intimate the contractor telephonically to attend the site and to commence the work within 12 hrs. Based on actual quantum of work the bill shall be paid within 30 days by concerned Division, if feasible or otherwise.

20. This order is meant for annual work order and sub-order will be placed by concerned Ex. Engineer of Tr. Circle / Const. Circle under NADIAD Tr. Circle GETCO.

21. In case of any dispute or doubt, the decision of Superintending Engineer (TR), NADIAD shall be final and binding to the contractor.

22. All the general terms and conditions of the GETCO’S contract booklet shall be applicable in this contract.

23. The GETCO reserves the right to terminate this rate contract at any time during its tendency without giving notice of termination or any reason thereof. GETCO reserves the right to reject any OR all tenders without assigning any reasons thereof.

24. If the contractor will fail to arrange to execute the job in time and due to this any revenue loss occurs, the same will be recovered from the contractor.

25. The GETCO shall deduct the income-tax or any other levy duly as per Government Law/prevailing rules from each & every bill.

26. Any dispute arising out of these tender documents will be subject to NADIAD jurisdiction.

27. If the work is not completed in time after issue of sub-order, the contractor shall be liable to pay penalty up to ½% per week of the total amount subject to maximum of 10% recovered on the contract value for particular sub-order.

28. Over all lowest shall be considered as L1 for awarding the order.

29. The contractor has to quote rates inclusive of all local & other taxes.

30. The contractor has to submit attested copy of PAN No, service tax, professional tax No. etc with Technical Bid.

ADDITIONAL COMMERCIAL TERMS & CONDITIONS:

1. The quantities of work to be carried out will be according to the required site conditions. The amount of works executed will be calculated at the rate given in the schedule of order.

2. The contractor shall be responsible for the breakages / losses and theft of materials from site and the appropriate cost will be recovered from the contractor for any damage / loss to the GETCO’s equipments.

3. As regards damages to the materials / equipments and worker of the Contractor, the Contractor will only be responsible and the Contractor is liable to pay compensation as per the “WORKMAN COMPENSATION ACT”.

4. The competent authority can delete any item in the schedule of Tender if he feels that the rate quoted by the Contractor for that particular estimate are abnormally high.

5. The successful tenderer will have to pay the security deposit of 5% value of the work contract.

6. The Contractor will be covered by the GETCO’s general conditions working contract.

7. The payment shall be made against the work carried out as per the actual requirement.

8. The party has to carry out the work immediately and the sub-order will be issued by the concerned EE(TR)/(Const.).




SAFETY PENALTY CLAUSE:

1. Penalty:

In case if any safety related fatal Elect. /Mech. Accident occurred to any employee of the agency or

outsider due to negligence or non-compliance of GETCO safety norms then in addition to the

compensation and liability as per statutory requirement, contractor/agency shall be penalized as

under.

2. Reporting:

The contractor shall inform concerned Ex. Engineer TR in Writing within 24 Hours of Fatal

/ Non-Fatal accident occurred to human being.

The GETCO investigating officer findings in to accident shall be final and binding to the Contractor /

Agency

3. Safety requirements :

Kick-Off meeting exclusively for safety shall be done in each contract in presence of contractor’s site

in charge and supervisor. Safety document shall be handed over and vital safety norms & key points

of safety related to project shall be explained and recorded for commitment by erection contractor.

Such records are mandatory for clearing first bill.

During site visit by GETCO official of Executive engineer & above rank, the following checks during

the execution of work shall be covered.

1. If any additional deviation in specification please clearly mention in separate on this page of Technical Bid, dully signed. In no circumstances price should be quoted on this page

2. Party has to accept Payment terms as per GETCO.

3. Bidder should give minimum required validity for 120 days, otherwise your tender will be treated as cancelled

4. Outside Gujarat material should come through RR sale at destination (i.e. at FOR)

5. Guarantee: If the goods/stores and equipment are found defective due to bad design materials or workmanship the same should be repaired or replace by you free of charge if reported within 18 month of the receipt at site or 12 months from the date of commissioning of equipment whichever is earlier. You will be responsible for the proper performance of the equipment for 18 months after receipt of the stores by the consignee and for 12 months after commissioning of equipments whichever is earlier.

6. Purformance Bank Guarantee (If applicable): The supplier/contractor/party (i.e. tenderee) has to give Bank Guarantee with validity period of additional 01 (one) month i.e. more than actual Guarantee/Warranty period of 6/12/18/24/36/48/60 months (depending upon product) to safeguard Company’s interest in case of any eventuality happening on the last day of the Guarantee/Warrantee period after office hours of the Bank or Bank holidays.

7. Bidder should confirm delivery period as per GETCO requirement and same should be confirmed in Technical bid.

8. Any delay that may take place in supply and / or erection, testing and commissioning activities beyond contractual cut off date / stipulated period in the order shall be subjected to penalty (not



liquidated damages) at the rate of ½% of the contract price / order price per week or part thereof subject to a maximum of 10% of the total contract value / order value (i.e. End cost including all taxes & duties) and not on uncompleted portion.

9. “Party shall have to quote their rates in Schedule“B “of Price bid only along with commercial terms and conditions. The details of applicable taxes/duties, service charges, packing & forwarding charges, freight, and insurancae, F.O.R. etc. with or without taxes or duties shall be indicated clearly in Price Bid if applicable.

13. GETCO reserves the right to prefer the overall lowest party if deem fit.

15. Supplier shall have to submit Invoice alongwith material to get “C” form wherever applicable. In short “C” form can not be issued in absence of Invoice.
