    1.3 DEFINITIONS

    A. MROSDreferstoMidpeninsulaRegionalOpenSpaceDistrict(MROSD),whichistheleadagency.MROSDorMROSDsRepresentative(O.R.)fortheprojectreferstoMidpeninsulaRegionalOpenSpaceDistrict(MROSD)projectmanagers,associates,oragents.

    B. ExistingSoil,SiteSoil,andNativeSoil:Existingsitesoils,eitherundisturbedinnativeconditionorpreviouslygradedsitesoils.Typicallyconsistingofrockymaterial,lowinorganicmatter.

    C. VegetationProtectionZone:AreasurroundingindividualtreesorvegetationtobeprotectedduringconstructionbyVegetationProtectionFencing,anddefinedbythedriplineofindividualtreesortheperimeterdriplineofgroupsoftrees,unlessotherwiseindicated.

    D. TemporarySiteConstructionFencing:FencingusedtosecureProjectLimitofWorkand/orStagingAreas,Fencingincludesfootings,gates,andlocks.

    1.4 MATERIALOWNERSHIP

    A. Artifacts,worksofart,ormaterialsindicatedontheplansorinthespecificationstoremainMROSDproperty,clearedmaterialsshallbecomeContractorspropertyandshallberemovedfromProjectSiteanddisposedofinalegalmanner.Anyartifactsfoundonthesite,whethernotedornotontheplans,shallremainMROSDpropertyunlessotherwisedetermined.IfMROSDorO.R.oragentchoosestorelinquishownershipofanyfoundelement(s),itshallbetheresponsibilityoftheContractortodisposeoftheelement(s)inalegalmanneroffsite.

    1.5 SUBMITTALS

    A. DistrictwillobtainandsubmitallrequiredlocalpermitstocompletetheWork.RegulatorypermitsfromSantaClaraCounty,andRegionalWaterQualityControlBoardwillbeobtainedandpaidforbyMROSD.

    B. ProposedErosionControlPlanorSWPPPutilizingBMPs(BestManagementPractices)whichmeettheleadpermittingagencysrequirementsforProjectSiteconstructionerosioncontrol.Ifagencyrequirementsconflictthemoststringentrequirementsshallbeincorporatedandmetunlessthepermittingagencydeterminesotherwise.

    C. Proposedtrucktirewash,dustcontrol,andconstructionnoiseabatementplan.

    D. ApprovalfromMROSDnotingthattreesindicatedtoremainhavebeenprotectedduringconstructionaccordingtorecognizedstandardsandprojectspecificationsandthattreeswerepromptlyandproperlytreatedandrepairedwhendamaged.

    E. ConstructionStagingPlannotingparking,stockpiling,andhaulroutes

    1. TrafficControl:TheContractorshallsubmitthreecopiesofproposedtrafficcontrolplantoSantaClaraCountyandMROSDatleastfive(5)workingdayspriortocommencementofanyprojectwork.NoworkshallbestartedunlesstheTrafficControlPlanisapproved.Thisplanshallbesubmittedintheformofadrawinglocatingtheprojectareaandallmajorandminoraccessandexitstoandoutofthisarea.Theplanshallalsoincludetheimmediateneighboringareaswherethetrafficshallbedirectlyorindirectlyaffectedasaresultofconstructionintheprojectarea.

    2. TheTrafficControlPlanshallbedevelopedforvarioustrafficsituationsintheProjectSiteandsurroundingareasinfullconformancewiththeCaliforniaDepartmentofTransportationCaliforniaManualonUniformTrafficControlDevicesMUTCD,dated2003Revision1,asamendedtouseinCalifornia,Part6TemporaryTrafficControlforConstructionandMaintenanceWorkZonehereinafterreferredtoasTrafficControlManual.

    3. Atmainentryandexitpointsforconstructionaccess,theContractorshallprovidea30x30signadvisingthepublicoftheanticipatedperiodoftimethattrafficdelaysmaybeanticipated.ThissignshallalsoincludenameandtelephonenumberoftheContractoralongwithstartingandcompletiondatesofthecontract.Signshallbeerected7daysinadvanceofinitiatinganywork.

    4. IftrafficistobedetouredoveracenterlineordetouredinadvanceoftheWork,detourplanmustbeincorporatedinthetrafficcontrolplan.CountyPolice,Fire,andPublicWorksDepartmentandagenciesinvolvedshallbenotifiedatleast48hoursinadvanceofanyworkwhichwillinterferewiththenormalflowofvehicularorpedestriantraffic.Intersectionclosuremayonlyoccurif,inthetrafficplan,thetwoadjacentintersectionsremainopen,unlessotherwiseapprovedbytheO.R.

    5. Allsignsanddevicesproposedtowarn,direct,andcontroltrafficinthevicinityoftheWorkshallconforminsize,shape,andcolortotherequirementssetforthintheTrafficControlManualmentionedaboveandapprovedbyCountyEngineerinaccordancewiththeTrafficControlPlan.

    6. ThefullwidthofthetraveledwayshallbeopenforusebypublictrafficonSaturdays,Sundays,designatedlegalholidays,after3:00P.M.onFridaysandthedayprecedingdesignatedlegalholidays,andwhenconstructionoperationsarenotactivelyinprogress.

    7. Costoftrafficcontrols,includingflagperson,shallbeincludedandspreadamongappropriatebiditemsasdeterminedbytheContractor.

    8. Ifrequired,Contractorshallfurnish,erect,andmaintainallsignsincludingNoParkingsigns.AllNoParkingsignsshallbeplacedasdirectedbytheCountyEngineerandpostednolaterthan48hoursorasdirectedbytheEngineer(s)inadvanceofthetimeofneed.NoParkingsignsshallbearthenameoftheContractorandshallalsospecifytheNoParkingdatesandlocations.

    9. TheContractorshallreplacewithina24hourperiodanysignthathasbeendamaged,lost,orwornout.

    10. TheresponsibleCountyEngineershallhaveauthoritytochangetheTrafficControlPlanandmakerecommendationsaftertheprojecthasstartedandthroughouttheproject.

    F. TheContractorshallcomplywithCountytrafficengineeringrecommendationswithina24hourperiodorimmediatelyifrequested.FailuretocomplywiththisitemshallbeenoughreasonfortheCountyEngineerorO.R.tostoptheproject.
