Formal Interpretations Task Group Report

Formal Interpretation Task Group: FI LPG-5: Recommend adding text and graphic from handbook (Exhibit 6.1) to annex A of the code. Add “navigable waterway” to “street or highway” caption. 3.3.10 (58-04-3): Recommend the FI be withdrawn because topic is covered in A.3.3.10. 5.9.5 (92-1): Recommend the FI be withdrawn because this is a restatement of the equivalency clause in 1.5. 5.12.4 (58-01-3): Recommend the FI be withdrawn because definition of container appurtenance makes it clear that the ESV does not qualify as a container appurtenance. 6.3.9 (58-08-1): Recommend adding an annex paragraph A.6.3.8 “Building openings in the context of 6.3.8 are any opening that communicates air from the exterior to the interior of the building, including windows, doors, or dryer vent terminations below the level of the relief valve discharge.” Recommend that the FI be withdrawn if such change is made. Table 6.5.3 (95-1): Recommend the making the following changes to line K of the table: K. Flammable and Class II combustible liquid aboveground containers, aboveground containers, and filling connections of containers underground. If such changes are made, recommend withdrawing the FI. 6.12 (79-1): Recommend the FI be withdrawn because 6.12.5 of the current edition covers this explicitly. 6.12 (79-2): Recommend the FI be withdrawn because task group members believe that the interpretation is fundamentally flawed. Subsection 6.12.1 refers to the nominal size of the transfer piping, and does not provide an exclusion for piping that has been reduced downstream. 6.13 (58-04-1) The FI should be retained for now. 6.19.7.1 (FI 89-2) The FI should be retained for now. The task group recommends establishing a new task group to look at 6.19.7.1 and 6.19.7.2 to develop annex text to further define “classroom demonstrations” and “research and experimental purposes”.

6.19.9.1 (FI 89-3) The FI should be withdrawn because the topic is explicitly covered by 6.19.9.4. 6.25.3.1 (FI 58-04-4) The task group recommends adding the following annex text: A.6.25.3.1 Where there are multiple containers of less than 4,000 gallons water capacity each, the term “aggregate water capacity” refers to the total capacity of a group of aboveground containers located closer to one another than the minimum separation required for “Aboveground Containers” between containers and property lines prescribed by Table 6.3.1. Containers must still be installed with the minimum separation distances between each other as specified in Table 6.3.1. If this language is adopted, the task group recommends withdrawing the FI. 6.25.3.2 (FI 58-01-2) The task group recommends modifying A.6.25.3 as follows: The National Fire Protection Association and the National Propane Gas Association, through a grant with the Propane Education and Research Council, have developed and published the “Fire Safety Analysis Manual for LP-Gas Storage Facilities” in order to provide a format and guidance for propane industry personnel or other competent persons to perform the performance of a fire safety analysis in conjunction with the requirements of NFPA 58. If such changes are made, the task group recommends withdrawing the FI. 9.7.2.2 (FI 58-04-2) Add annex text as follows: A.9.7.2.2 The term “congested area” is intended to describe situations where access to the vehicle during an emergency would be impeded or where moving the vehicle away from an emergency would be prevented. If the changes are made, the task group recommends withdrawing the FI. 11.8.4.3 (FI 89-1) Add new annex text as follows: A.11.8.4.3 The intent of 11.8.4.3 does not limit the location of the valve as long as it is protected in accordance with 11.8.2.2 and does not require the use of any tools. If such changes are made, the task group recommends withdrawing the FI.

LP-Gas is received by cargo tank vehicle, railroad tank car, orpipeline, and then distributed by portable container (package) delivery, or by cargo tank vehicle. or through gas piping.Substantiation: The striking out of 'through gas piping' is made in this definition and will appear in three additionalsections titled as Sections 3.3.10.1; 3.3.10.2; and 3.3.10.3.Committee Meeting Action: Accept in PrincipleSee Log #164.Committee Statement: The committee revised the definition in Log #164 to further delineate between bulk plants andindustrial plants. The language approved in Log #164 accomplishes this delineation and further edits the definition bymoving extraneous information to the annex.

LP-Gas is received by cargo tank vehicle,railroad tank car, or pipeline, and then distributed by liquid or vapor through gas piping.Substantiation: This new addition will properly identify the installation and use of this storage facility.Committee Meeting Action: RejectCommittee Statement: The committee does not agree that a new commercial bulk plant definition is needed. Bulkplant is a term well understood in the industry. The committee accomplished the submitter's intent of delineating bulkretail operations from other large bulk storage facilities by creating a definition for an industrial plant in Log #164.

Theprovisions of this chapter shall be applicable to all new and existing installations.Substantiation: This title change will reflect the changes in 3.3.10.Committee Meeting Action: RejectCommittee Statement: The committee rejected the new definitions for commercial, refrigerated and autogas bulkplants, therefore the proposed changes to 14.1 would be inappropriate.

Substantiation: This new section will not require a 6 ft (1.8 m) high industrial type fence, chain-link, or equivalentprotection. These types of bulk container installations are located on private property and have multi use distribution foragricultural uses on site. There is no safety hazard if other provisions of the Code on tampering are in compliance.Committee Meeting Action: RejectCommittee Statement: The committee rejected the new definition for agricultural bulk plant, therefore the newsentence addressing such plants is not appropriate. However, the committee accomplished the submitter's intent of notrequiring security fencing around bulk storage at farms in Log #164.

Container Plants. A facility which is constructed with an excess of 4000 (15.2 m3) water gallon capacity container(s)

designed to store and distribute LP-Gas.3.3.10.1 Bulk Plant. A facility where the primary function is to store LP-Gas prior to further distribution. LP-Gas is

received by cargo tank vehicle, railroad tank car, or pipeline and then distributed by portable container (package)delivery, cargo tank vehicle and motor vehicle containers.3.3.10.2 Commercial Plant. A facility where the primary function is to store LP-Gas prior to further distribution. LP-Gas

is received by cargo tank vehicle, railroad tank car, or pipeline and then distributed by portable container (package)delivery, or by cargo tank vehicle and through gas piping to remote facilities.3.3.10.3 Industrial Plant. A facility where the primary function is to store LP-Gas prior to supplying product to the

interconnected piping system within the site. LP-Gas is received by cargo tank vehicle and railroad tank car. Distributionmay also include portable containers and motor vehicle containers used on site.3.3.10.4 Agricultural Plant. A facility where the primary function is to store LP-Gas prior to supplying product to the

interconnected piping systems within the site. LP-Gas is received by cargo tank vehicle. Distribution may also includeportable container (package) motor fuel (AutoGas) containers. This plant is designed to distribute LP-Gas for agriculturalpurposes only.3.3.10.5 Motor Fuel Plant (AutoGas). A facility where the primary function is to store LP-Gas prior to supplying product

to the interconnected piping system within the site. LP-Gas is received by cargo motor vehicle. Distribution is limited toliquid transfers to motor fuel (AutoGas) containers and motor vehicle containers.3.3.10.6 Refrigerated Plants. A facility which the LP-Gas is stored at temperatures below outside ambient air

temperatures. These installation requirements are located in the provisions of Chapter 12 of this Code. LP-Gas isreceived by cargo tank vehicle, railroad tank car, pipeline or marine shipping vessels.Substantiation: This new description will describe the majority of storage facilities and their intended use. The presentCode has sections which are designed for use in only one of the categories. As modifications or additions are made tothe Code a reference can be made to this section for detailed descriptions of intended purpose. An example in aproposal for 3.3.10.5 has been submitted by NPGA to make an exception for a motor fuel dispenser and allow the liquidoutlet valve to remain open when not in use. See 6.18.1, 6.18.4.2 and 14.2.Committee Meeting Action: Accept in Principle3.3.10* Bulk Plant. A facility that stores more than 4000 gallons of LP-Gas prior to further distribution as a liquid for useat other facilities. where the primary function is to store LP-Gas prior to further distribution. LP-Gas is received by cargotank vehicle, railroad tank car, or pipeline, and then distributed by portable container (package) delivery, by cargo tankvehicle, or through gas piping.A.3.3.10  Bulk Plant. Bulk plants receive gas through a variety of methods, such as railroad tank car, transport, cargotank vehicle, gas piping, or watercraft. These plants are generally utilized store LP-Gas prior to being sent on fordomestic, commercial, agricultural, institutional, and industrial applications or for the storage of product awaiting deliveryto the end user. A facility that transfers LP-Gas from railroad tank cars from a private track directly into cargo tankvehicles is also considered a bulk plant. Such plants could have container-filling and truck loading/unloading facilities onthe premises. Normally, no persons other than the plant management or plant employees have access to thesefacilities. It is not the intent of the definition to exclude facilities that use propane at the site, such as for building heating.

3.3.31 Industrial Plant. A facility that stores more than 4000 gallons of LP-Gas for use at the facility or to distributevapor to other facilities.[Renumber subsequent.]A.3.3.31 Industrial plant is a term used in NFPA 58 to include all LP-Gas storage facilities that use the gas on site. Theyare found at industrial plants, farms, engine fueling stations, schools, hotels, and other locations. It is not the intent ofthe definition to exclude facilities that have a small use of propane off the site, such as for vehicles, where such use isnot the major use of the gas stored.

Report on Proposals – June 2013 NFPA 586.18.4.2 Areas that include features required in 6.18.4.1(2) shall be enclosed with a minimum 6 ft (1.8 m) high industrialtype fence, chain-link fence, or equivalent protection. This requirement shall not apply to containers located at farms notopen to the public.

Committee Statement: The definition of Bulk Plant is revised and a new definition of Industrial Plant is added to claritywhat a Bulk Plant is to differentiate it from an Industrial Plant. The size criterion of > 4000 gallons is added to clearlystate the committee’s intent that the additional requirements for these plants do not apply to smaller storage facilities.Reference to railcar transfer facilities is deleted as the subject is well covered in 7.2.2. The annex text provides guidancewhere a plant is used primarily as a Bulk Plant or Industrial Plant, with other incidental use of the LP-Gas.

The revision to 6.18.4.2 recognizes the significantly lower probability of tampering at Industrial Plants located at farms.It is recognized that some farms may be open to the public for sale of the crop, and that the security requirementsshould apply where the public may have access to the farm.

6.18.2.6(3) Where a facility liquid transfer hose is installed at a bulk storage transfer station which is greater than 4000 (15.2 m3 ) water gallon capacity and designed to interconnect with cargo tank vehicles greater than 3500 (13.2 m3) water gallon capacity, in non-metered service, the transfer hose shall be equipped with a passive shut off device to protect the discharge of product in the event of a hose pull away or rupture.

Compliance with a passive shut off device may be mechanical, pneumatic, and electronic or any combination thereof. 4. The present OSHA and DOT codes require the use of a passive shut off device on the liquid transfer hose which is carried on the cargo tank vehicle which has a capacity of 3500 (13.2 m3) or greater. If the facility hose is used, in lieu of the cargo tank vehicle hose, this will comply with the OSHA and DOT requirements. This new addition will affect new and major piping modifications to the container storage piping. OSHA and DOT will remain the enforcement agencies and this addition will provide the guidance of the proper equipment to be installed. SEE: 49 CFR 177.840(r) and OSHA 29 CFR 1910.110 (14)(3)

The compliance with a passive shut device, as a part of the facility hose, will not affect the liquid transfer from the bulk plant to bobtail trucks in metered service. The proposal will allow the use of existing technology and equipment to be applied to the facility hose for passive shut down and would not require the transfer driver to be within arm’s length of the manual shutoff device. A facility hose which is equipped a hose end valve will reduce the residual LP- Gas discharged from the hose during the bleed down. This proposal would be required on new construction or major repairs and would not affect existing facilities until the facility hose is replaced. 5. Copyright Assignment

In many parts of the country, snow can build-up on the roofs of buildings, either as the result of a seasonal accumulation or from a single severe storm. If the building has a sloped roof and the building is heated, it is not unusual for the snow to reach a depth that causes the snow to spontaneously slide off of the roof. There has been some concern that the snow falling off of the roof may damage items or equipment, such as gas meters and regulators. Both the Federal regulations (49CFR Part 192) and the “Liquefied Petroleum Gas Code (NFPA 58) address those concerns and require that the meter and regulators be protected from the forces anticipated by heavy snow.

When there is a spontaneous sliding of snow off of a sloped roof, the mass of snow accelerates from a stationary position and it gains speed as it slides. The initial mass of snow will break off as it passes over the eaves and will drop straight down. As the remaining mass accelerates, the snow will be projected farther away from the eaves. Thus, the snow that was at the top of the roof will land on the ground at a distance from the eave line. This phenomenon will often be observed in snow country alongside homes with wide eaves that haven’t been subjected to drifting snow, there is a pile of snow outside of the eave line and the ground next to the building itself may be actually bare.

Assume that snow accumulates on the roof of a building. The reach of the roof from eaves to peak = (L). The slope of the roof is (∅) and height of the eaves above grade is (h). The ultimate velocity of the snow sliding off of a roof is a function of the length (L) and the slope (∅). For example: a roof with a 20 ft. length (L) and a slope (∅) of 30° the ultimate velocity (𝜕)of the sliding snow will be 25.4 ft/sec. while a steeper roof of the same length with a slope (∅) of 45° will have an ultimate velocity (𝜕) of 30.2 ft/sec. Finally an even steeper roof, such as might be found in the “Swiss chalet” type home with a slope (∅) of 60° will have an ultimate velocity (𝜕)of 33.4ft/sec.

For a single story structure with an eave height (h) of 12 ft and a slope (∅) of 30° the reach (R) will be 15.1 ft. For a similar two story structure with an eave height (h) of 20 ft. the reach (R) will be 20.5 ft.

Likewise, a single story structure with an eave height (h) of 12 ft and a slope (∅) of 45°, the reach (R) will be 9.0 ft. and the two story structure with the same slop and an eave height (h) of 20 ft. the reach (R) will be 12.6 ft.

In the case of the “Swiss chalet” type home with a slope (∅) of 60° and an eave height (h) of 12 ft the reach will only be 7.6 ft. and the two story version with an eave height (h) of 20 ft. will have a reach (R) of 10.9 ft.

It should be evident that, in those situations where drifting snow does not build up on the sides of a building, equipment installed at the side of the building under wide eaves is probably well protected from the forces caused by snow falling off of the roof of the structure. In the situation where the snow has gradually crept down the roof and is curled under the eaves, the snow will fall straight down and only a small portion of the roof load might impact any equipment behind the drip-line. Likewise, icicles tend to form at the edge of the eaves and will also fall straight down and be unlikely to impact any equipment protected by the wide eaves.

Please be advised that the placement of the liquid withdrawal valve location has been changed by various tank manufacturers of underground tanks, and re-located to the top of the tank riser, and (in this case), an integral component of the valve cluster. The following is a list of 3 basic questions this will now effect as relates to tank installation, codes, and CETEP training for our employees / Propane Emergencies training for firefighters: 1. Will this change the required protection around the underground risers? 2. Will this change modify the code to where these tanks can (or no longer can) be located? 3. Will this change the training requirements for CETP and Propane Emergencies? Since 1992, I have (as a Marketer) experienced approximately 5 incidents involving underground containers. Three of the five were a direct result of a vehicle: (snowplow, backhoe, and excavator clipping the top of a container dome, and snapping the relief valve). All three incidents were mitigated with a wooden plug. My concern reflects the fact that the wooden plug will no longer be effective....especially with a liquid release. My recent research indicates a savings to the tank manufactures (because of this modification) of less than $10 per container. I'm still trying to figure out how this occurred.
