Resolution No. 388 INTRODUCED BY Qo,t)niH< •bOfiOJ Pjim^nidj idifX3{^i f']<i(ti1olQqjdx](tQiil Gordon, HonQ^an, lac^on, L(<^rda/foc<ioiQOt \Jllkjnu 2t/Ql V illa n flu b ir'i RESOLUTION EXPRESSING THE SENSE OF THE SENATE, SUPPORTING 7 ^ > r PROCLAMATION NO. 216 DATED MAY 23, 2017, ENTITLED ‘DECLARING A STATE OF MARTIAL LAW AND SUSPENDING THE ^ PRIVILEGE OF THE WRIT OF HABEAS CORPUS IN THE WHOLE OF MINDANAO” AND FINDING NO CAUSE TO REVOKE THE SAME WHEREAS, the 1987 Philippine Constitution, Article VII Section 18 provides that: “...In case of invasion or rebellion, when the public safety requires it, he (President) may, for a period not exceeding sixty days, suspend the privilege of the writ of habeas corpus or place the Philippines or any part thereof under martial law...”) WHEREAS, on May 25, 2017, the Office of the President submitted to .he Senate its report on the factual and legal basis of the proclamation of Martial Law for Mindsmao; WHEREAS, part of the reason for the declaration was the series of violent acts committed by the Maute terrorist group, such as the attack on the military output in Butig, Lanao Del Sur in February 2016. The said attack resulted in the killing and wounding of several soldiers and the mass jailbreak in Marawi City in August 2016 which freed the arrested comrades of the terrorist group and other detainees; WHEREAS, on May 23, 2017, the same Maute terrorist group has taken over a hospital in Marawi City, Lanao Del Sur and established several check points within the city. WHEREAS, the 1987 Philippine C onstitu tion , Article VII Section 18 provides that:

WHEREAS, on May 23, 2017, the sam e M aute te rro rist group h as taken over a hospital in Marawi City, Lanao Del S u r and estab lished several check points w ithin the city. They have also b u rn ed down certain governm ent and private facilities and inflicted casua lties on the p a rt of the

G overnm ent forces. They s ta rted flying the flag of the Islam ic S tate of Iraq an d Syria (ISIS) in several areas;

WHEREAS, Article 134 of the Revised Penal Code provides that:

“The crime o f rebellion or insurrection is committed by rising publicly and taking arm s against the Government fo r the pu rpose o f removing from the allegiance to sa id Government or its laws, the territory o f the Philippine Islands or any p a rt thereof, o f any body o f land, naval or other arm ed forces, depriving the Chief Executive or the Legislature, wholly or partially, o f any o f their pow ers or prerogatives.”;

WHEREAS, based on the im m ediately cited Revised Penal Code provision, the ac ts com m itted by the M aute group are a n open a ttem p t to remove from the allegiance to the Philippine G overnm ent the p a rt of M indanao and deprive the Chief Executive of its powers and prerogatives to enforce laws of the land and to m ain tain public order and safety in M indanao, hence constitu tes the crim e of rebellion.

NOW, THEREFORE, BE IT RESOLVED, a s it is hereby resolved, by way of the sense of the Senate, th a t the Senate finds the issu an ce of ■Proclamation No. 216 to be satisfactory, constitu tional an d in accordance with the law. The Senate hereby su p p o rts fully Proclam ation No.216 and finds no compelling reason to revoke the sam e.
