When can I place water in the pool?

No liner and/or water is to be placed in a pool until all pool fencing and gates have been inspected and approved by a bylaw enforcement officer. It is the property owner’s responsibility to ensure the bylaw enforcement officer has inspected and approved all fencing and gates prior to the placement of water in the pool. To place water in the pool prior to final inspection leaves the owner open to liability and may result in a fine.

Are there any restrictions about where swimming pool filters can be located?

Yes, a swimming pool filter must be setback 60 cm (1.97 ft.) from a rear and side property line. Swimming pool equipment is not permitted in a front yard.

Are you planning to install an outdoor swimming pool?

Aswimmingpoolisdefinedasanyprivatelyownedoutdoor tank or body of water used, or intended to be used, and maintained for swimming or display purposes and capable of holding water in excess of 600 mm (1.97 ft.).Existingnaturalbodiesofwaterorstreamsareexcluded.Itdoesincludeahydro-massagepool.

A temporary pool

Atemporarypoolisaninflatablepoolorotherpool,designed to be removed on a seasonal or more frequent basis and is capable of holding water excess of 600 mm (1.97 ft.).

Is a permit required?

Apermitisrequiredforallswimmingpools.Allswimming pools, including temporary pools, must be enclosed by fencing and gates in accordance with the city’spoolfencingbylaw,(Bylaw,74-2005).

Is the contractor responsible for a pool permit?

The pool contractor may apply for the pool permit on your behalf, but ultimately it is the property owner’s responsibility to get a pool permit.

How do I apply for a pool permit?

To obtain a pool permit, complete and submit a pool permit application to the planning and building department.Besuretoincludetwocopiesofasurvey and two sets of detailed drawings showing the

proposed pool location with setback dimensions from all property lines. Fencing details and gate locations are required on the drawings.

There is a permit fee applicable based on the type of pool(i.e.above-ground,on-groundandtemporary)payable at the time of application.

1. Anapprovedzoningcertificatefromthezoningsectionof the planning and building department is required.

2. Thereisafeeandreviewperiodforazoningcertificate.Questionsregardingzoningcanbedirectedtothecity'szoningsectionoftheplanningandbuildingdepartmentat905-335-7600,ext.7642.

Do you have a private sewage disposal system (septic system) on your property?

If your property contains a private sewage disposal system (active or dormant) the location of the system must be shown on the plot plan. It is critical that during construction the septic bed is not disturbed.

Are there restrictions on where you can locate a swimming pool?

Yes, on lots containing a detached house, a duplex or onedwellingunitofasemi-detached,triplex,fourplexor street townhouse the following regulations apply:

• Onlotslessthan12m(39.37ft.)wide,swimmingpools are permitted in a rear yard only.

• Onlots12m(39.37ft.)wideorgreater,swimmingpools are not permitted in a required front or street side yard.

Fences

Corner Lots

Corner lots may be created by an intersection or a sharp bend in a street. The maximum height of a fence on a corner lot is 2 m (6.56 ft.), EXCEPT within 3 m (9.84 ft.) of the front property line, where the height of the fence must not be higher than 1.2 m (3.94 ft.).

In addition, where two streets intersect, a visibility triangle is required (see diagram). Any solid fence or wall within this triangle may not be higher than 1 m (3.28 ft.) and any trees, shrubs, or hedges may not grow higher than 1 m (3.28 ft.) above the pavement in the middle of the intersection.

Note: Most properties require a 9 m (29.53 ft.) visibility triangle. This may vary however, between different zoning designations. Contact zoning staff for requirements in your area 905-335-7642.

Are you planning to build a fence around your property?

The following regulations apply to fences for single-family or semi-detached houses, duplexes, triplexes, fourplexes, and street townhouses. The maximum allowable height of perimeter fencing depends on its location in relation to the nearest street.

You do not need a permit to erect a fence, however regulations regarding height do apply.

From where do I measure my fence height?

Fence height shall be measured vertically from grade, exclusive of any artificial embankment, to the highest point of each 3 m (9.84 ft.) section of fence, excluding decorative post caps.

Where the grade elevations along the fence vary, maximum fence height may increase to 2.3 m (7.55 ft.), provided that the lowest height of the same 3 m (9.84 ft.) fence section does not exceed 2 m (6.56 ft.) in height.

Fence Height Regulations

Interior Lots

Most lots in the City of Burlington are interior lots, that is, they face onto a street and have other properties on either side. The maximum height of a fence on an interior lot is 2 m (6.56 ft.), EXCEPT within 3 m (9.84 ft.) of the front property line, where the height of the fence must not be higher than 1.2 m (3.94 ft.).

Through Lots

A through lot abuts a street at the front and the rear. The maximum height of a fence on a through lot is 2 m (6.56 ft.), EXCEPT within 3 m (9.84 ft.) of the front property line where the height of the fence must not exceed 1.2 m (3.94 ft.).
