(“Defendant”), alleges as follows: NATURE OF THE ACTION 1. Plaintiff, in conjunction with its affiliated entities, organizes and produces the three-day Summer Set Music and Camping Festival (the “Festival”), a music festival held once a year at the Somerset Amphitheater in Somerset, Wisconsin. The 2015 Festival will be the fourth annual Festival organized and produced by Plaintiff. Each year since 2012, the Festival has grown in popularity, scope and profitability. In addition to music, Plaintiff offers festival-goers various onsite camping options to complete the festival experience. Defendantowns andoperatesacampsiteacrossthestreetfrom theFestivalsite.In addition to offering sites for tents, Defendant also rents cabins.As a result of the location ofitscampsite,Defendantinevitably profitsfrom theFestivalby rentingcampsitesandcabinstoPlaintiffsfestival-goers.Butthatoverflow businesswasnotenoughforDefendant.Inanattempttocash-in on Plaintiffshard work andenormous investmentinbuildingitsbrandovertheyears,DefendantisimproperlyexploitingPlaintiffstrademarksandlogo.Forexample,Defendantinfringed Plaintiffs registered trademark Summer SetMusic and Camping Festivalbyregistering,traffickinginandusingthewebsitewww.summersetmusicfestivalcamping.com.Inaddition,DefendantisusingPlaintiffstrademarktopromoteitscampsiteonmultiplewebsitesanditsFacebookpage.Defendantswrongfulactionshaveresultedinfestival-goersrentingDefendantscampsitesratherthanPlaintiffs,causedconfusionamongfestival-goersregarding Defendants affiliation (or lack thereof) with Plaintiff, and dilution of Plaintiffs brand.3. DefendantFloat-Rite,Inc.isaWisconsincorporationwithitsprincipalplaceofbusiness in Somerset, Wisconsin.JURISDICTION AND VENUE6. ThisisacivilactionallegingTrademarkInfringement,UnfairCompetitionandCybersquattingarisingunder15U.S.C.1125(d)(Cyberpiracy);1114(TrademarkInfringement), 1125(a) (Unfair Competition), aswell as a violation of the Wisconsin DeceptiveTrade Practices Act, W.S.A. 100.18.7. This Court has original subjectmatter jurisdiction over this action pursuant to 28U.S.C.1338(a),28U.S.C.1338(b)andsupplementaljurisdictionoverthestatelawclaimalleged herein under 28 U.S.C. 1367(a).8. Venue is proper in this district under 28 U.S.C. 1391(b), (c) and (d).FACTS COMMON TO ALL COUNTSThe Summer Set Music And Camping Festival9. TheFestivalisathree-daymusicfestival,heldannuallysince2012attheSomersetAmphitheaterinSomerset,Wisconsin(theFestivalVenue).The2015Festivalisscheduled to take place August 14-16.Attendees travel to the Festival from all over the country.10. TheFestivalscapacityisover40,000peopleperday.Festivalgoerscanpurchasesingledayticketsorthree-daypasses.InadditiontosellingticketstotheFestival,PlaintiffalsorentsaccesstovariouscampgroundsthatarephysicallyconnectedtotheFestivalCase: 3:15-cv-00490-jdp Document #: 1 Filed: 08/07/15 Page 3 of 234Venue.Plaintiffscampsiteoptionsrangeinpricefromapproximately$125foratent-onlycampsitethatcanaccommodateuptosixpeopleto$500forrecreationalvehiclecamping.Plaintiffhadapproximately2,880campsitesavailableforrentofwhichapproximately445remain available as of the date this Complaint was filed.11. Plaintiff recently reduced the prices of its remaining available campsites.12. PlaintiffexpendssignificantresourcestomarketandadvertisetheFestival.Inparticular, Plaintiff maintains a website at www.summersetfestival.com (Plaintiffs Website)to market the Festival.Individuals visiting Plaintiffs Website can, among other things, purchasetickets to the Festival, see the lineup of musical acts performing at the Festival, and reserve andrentcampsitesattheFestival.PlaintiffalsoaggressivelymarketsandadvertisestheFestivalthrough,among otherthings,varioussocialmedia platforms,a variety ofotheronline outlets,miscellaneousprintadvertisements,streetmarketingteamsandthird-partywebsites.Plaintiffspends approximately $100,000 per year on these marketing efforts.The Summer Set Mark13. On January 22,2013,Plaintifffiledan application with theUnitedStatesPatentandTrademarkOffice(PTO)forthemarkSummerSetMusic&CampingFestival(SerialNo. 85829369).14. On May 13, 2014, the PTO granted Plaintiffs registration of the mark SummerSetMusicandCampingFestivalonthePrincipalRegister,RegistrationNo.4527855(theSummerSetMark).TheSummerSetMarkis primafacie evidenceofthevalidityandownership of, and is constructive notice of ownership, of the mark, as provided by 15 U.S.C. 1057(b) and 1072.Case: 3:15-cv-00490-jdp Document #: 1 Filed: 08/07/15 Page 4 of 23515. Plaintiffhasexpendedconsiderableresourcesmarketing,advertisingandpromoting goods and services under the SummerSetMark and has been using the Summer SetMark since 2012.16. Plaintiffhassold a considerable numberofticketsand camping site rentalsforpast Festivals as well as the 2015 Festival pursuant to and while using the Summer Set Mark.17. Plaintiff has established goodwill in connection with its business, which goodwillthe public associates with the Summer Set Mark.Float-Rite Park18. Defendantownsand operatesa camping facility called Float-Rite Park on landacross the street from the Festival Venue (Float-Rite Park).19. DefendantisusingtheSummerSetMarkandisfalselyandmisleadinglyrepresentinganaffiliationbetweenFloat-RiteParkandtheFestivaltomarket,promoteandadvertiseFloat-RiteParkinanattempttolurefestivalgoerswhootherwisewouldcampatPlaintiffs campsites.In doing so, Defendant is infringing upon the Summer Set Mark, deceivingconsumers,creatingsubstantial confusioninthemarketplaceregardingwhetherFloat-RiteParkis affiliated with Plaintiff and diluting Plaintiffs brand.Defendants Float-Rite Website20. Defendants Summer SetWebsite alsoincludes artwork depicting the silhouettesof people attending a music festival.Float-Rite does not regularly host large music festivals andisnothosting a music festivalthe same weekend asthe SummerSetFestival.The silhouetteartwork is designed to confuse consumers and imply that Defendants campsite is affiliated withPlaintiffs Festival. (See Fig. 2, above.)25. Defendants SummerSetWebsite alsoprominently displaysthe wordsSummerSet Music Festival Camping which directly infringes upon the Summer Set Mark.(See Fig. 2,above.)Case: 3:15-cv-00490-jdp Document #: 1 Filed: 08/07/15 Page 7 of 23826. Causingfurtherconfusion,Defendants SummerSetWebsitedisplaysthelineupof musicians scheduled toplay atthe 2015 Festival. When a user clicks on the link identified by the words View Map in the yellowbox, he or she is taken to a map titled Summer Set Unofficial Map 2015.An official SummerSet logo is incorporated into the map in a prominent position and in a manner that draws the eyedirectlytotheSummerSetMarkandlogoasopposedtotheFloat-RiteParklogowhichisobscured.ThemapalsopurportstodepicttheFestivalVenueandPlaintiffscampsites.TheincorporationoftheSummerSetMarkandlogoinconjunctionwiththeFloat-RiteParklogocreates the false appearance of an affiliation between Float-Rite Park and Plaintiff.29. ThroughDefendantsSummerSetWebsite,DefendantoffersBenefitsofCampingwhichinclude,amongotherthings,NoVehicleSearches.Bycontrast,itisPlaintiffspolicytosearchallvehiclesenteringtheFestivalVenueanditscampsitesforprohibiteditems.DefendantsofferisashamelessinvitationtoFestivalgoerstobringintoFloat-RiteParknarcotics,firearms,fireworksorotheritemsthatareprohibitedattheFestivalVenue and the Festival campgrounds.Defendants offeris an attempttocircumventPlaintiffsCase: 3:15-cv-00490-jdp Document #: 1 Filed: 08/07/15 Page 9 of 2310ability to control safety at the Festival.If anyone dies or is injured as a result of an illicit drug,weapon,fireworksorotheritemthat,whileprohibitedattheFestival,waspermittedbyDefendant, the death or injury will severely tarnish the Summer Set brand.That is particularlytrue because of the confusion created by Defendant regarding its affiliation with Plaintiff.30. Defendant also bid on various ad words so that a Google search of summer setmusic and camping festival produces a search results page for the internet user featuring a paidadvertisementbyDefendantlinkingtoDefendantsSummerSetWebsite.Infact,thevery topresponseinaGooglesearch of theSummerSetMarkleadstoan advertisementforDefendantand a link to Defendants Summer Set Website.The advertisement does not mention Float-RiteParkfurtherperpetuatingafalserelationshipbetweenDefendantsSummerSetWebsiteandPlaintiff. Links to Plaintiffs Website -- the only official Festival website -- appear belowDefendants advertisement in the search results.(See Fig. 5, above.)Defendant Uses The Summer Set Mark ToPromote The Float-Rite Park On Its Facebook Page32. DefendantusestheSummerSetMarktoadvertiseFloat-RiteParkonitsFacebookpage.TheFloatRiteParkontheAppleRiverFacebookpagehasalinktitled:SummerSetMusicFestivalCampingwhichlinkstoaFacebookprofiletitledSummerSetMusic Festival Camping at FloatRite Park on the Apple River.This is another infringing useof the Summer Set Mark.Cease and Desist Letter33. PlaintiffattemptedtoresolveitsdisputewithDefendantwithoutCourtintervention.In particular,afterlearning aboutDefendants SummerSetWebsite,on July 22,2015,Plaintiffsaffiliate,SFXEntertainment,Inc.(SFX),sentaceaseanddesistlettertoDefendant. The letter, among other things, identified the Summer Set Mark, explained that it wasa registered trademark, warned that Defendants use of the Summer Set Mark has and will createconsumer confusion and demanded thatDefendant immediately cease and desist from using theSummer Set Mark.34. OnJuly27,2015,anattorneyrepresentingDefendantsentalettertoSFXacknowledging receiptof the cease and desistletter and promising to respond to the allegationstherein.OnAugust7,2015--thedayof thisfilingand16daysafterSFXsenttheceaseanddesistletter--SFXreceivedasecondletterwithasubstantiveproposalthatwasunacceptablebecause,amongotherthings,itpermittedDefendanttocontinuetoreapthebenefitsoftheinfringing URL for Defendants Summer Set Website.Case: 3:15-cv-00490-jdp Document #: 1 Filed: 08/07/15 Page 11 of 231235. PlaintiffhasneverauthorizedDefendanttousetheSummerSetMarkoranyvariation thereof.Defendants Prior Misuse Of Summer Sets Mark and Logo36. InMarch2015,shortly afterticketswenton saleforthe2015Festival,Plaintifflearned thatDefendantwas using the SummerSetMark and the SummerSetlogo to promoteFloat-RiteParkcampsiteonDefendantsFloat-RiteWebsite.OnoraroundMarch15,2015,Summer Setsenta cease and desist letter to Defendantdemanding thatitremove theinfringinglanguage, logo and cease and desist from all other uses of the Summer Set Mark.37. ByApril 2,2015,DefendantshadremovedtheSummerSetlogoandinfringinglanguagefromDefendantsFloat-RiteWebsite.Defendant,thereafter,placednewinfringinglanguageonDefendantsFloatRiteWebsiteandlaunchedDefendantsSummerSetWebsitesometime prior to July 22, 2015.COUNT I(Cyberpiracy Under Anti-Cybersquatting Consumer Protection Act, 15 U.S.C. 1125(d))38. Plaintiffrepeatsandre-allegesparagraphs1through37aboveasiffullystatedherein.39. The Summer Set Mark is a distinctive, protectable, famous mark.40. DefendantsSummerSetWebsitesummersetmusicfestivalcamping.comisidenticaltothedominantportionoftheSummerSetMark,SummerSetMusic&CampingFestival in sound, appearance, and commercial impression.41. Defendant uses Defendants Summer Set Website in interstate commerce.42. Defendant uses Defendants Summer Set Website to promote Float Rite Park.Oninformationandbelief,DefendantalsoregisteredandpurchasedtherighttouseDefendantsCase: 3:15-cv-00490-jdp Document #: 1 Filed: 08/07/15 Page 12 of 2313SummerSetWebsite.TheSummerSetMarkwasdistinctiveatthetimeDefendantused,registered and/or purchased the right to use Defendants Summer Set Website.43. Defendant committed the acts described herein with a bad faith intention to profitfrom the Summer SetMark.In particular, Defendants intention is to divertinternet users fromPlaintiffs Website to Defendants Summer Set Website by creating a likelihood of confusion.44. AsaresultofDefendantswrongfulconduct,Plaintiffhassufferedandwillcontinue to suffer harm some of which is quantifiable, but some of which is not quantifiable but,rather, is irreparable and for which there is no adequate remedy at law.45. Byreasonoftheforegoingacts,DefendantisliabletoPlaintiffforcyberpiracyunder 15 U.S.C. 1125(d).WHEREFORE, Plaintiff respectfully requests that the Court enter a Judgment in its favorand against Defendant:I. Enjoining Defendant from using Defendants Summer Set Website;II. Ordering Defendant to pay Plaintiffs damages caused by the infringement;III. TheURLfor DefendantsSummerSet Websitesummersetmusicfestivalcamping.comisidenticaltothedominantportionoftheSummerSetMark,SummerSetMusic&CampingFestivalinsound,appearance,andcommercialimpression.Inaddition,DefendantusesthedominantportionoftheSummerSetMarkonDefendantsFloat-RiteWebsite,DefendantsSummerSetWebsiteandDefendantsFacebookpage.49. The contemporaneous use by Plaintiff and Defendant of the Summer SetMark incommerceislikelytocauseconfusionamongtheconsumingpublicbyleadingthepublictobelieve that the goods and services identified by each of them come from the same source.50. Defendant has exacerbated its infringement by bidding on ad words with internetsearchengines,increasingthelikelihoodthatconsumerssearchingforinformationabouttheFestival will instead be lead to Defendants Summer Set Website.51. DefendantsFloat-RiteWebsite,DefendantsSummerSetWebsite,DefendantsFacebook page and the Summer Set Mark are all used to identify camping facilities in Somerset,Wisconsin.Guests travel to these campsites from all over the country.52. Defendanthasadvertised and continuesto advertise FloatRite Park by using aURL (sometimesreferredtoasadomainname)thatisidenticaltothedominantportion of theSummer SetMark and by using the dominantportion of the Summer SetMark on DefendantsFloat-Rite Website, Defendants Summer Set Website and Defendants Facebook page.53. Defendants actionsanddeceptionhaveandwillcontinuetodeprivePlaintiffoftheability tocontrol theperceptionby thepublicof thenatureandquality of theproductsandservices it offers, causing irreparable harm to Plaintiff for which there is no adequate remedy atlaw.Case: 3:15-cv-00490-jdp Document #: 1 Filed: 08/07/15 Page 14 of 231554.
