Subordinate Legislation Regulations 2004S.R. No. 91/2004

Version incorporating amendments as at 26 September 2012

1 Objectives

The objectives of these Regulations are to—

(a) prescribe the requirements for the printing and publication of statutory rules that apply, adopt or incorporate matter; and

(b) prescribe a bookshop for the purposes of section 20(1) of the Subordinate Legislation Act 1994.

2 Authorising provision

These Regulations are made under section 28 of the Subordinate Legislation Act 1994.

3 Commencement

These Regulations come into operation on 1 August 2004.

4 Revocation

(1) The Subordinate Legislation Regulations 19941 are revoked.

(2) The Subordinate Legislation (Prescribed Bookshop) Regulations 19992 are revoked.

5 Publishing with table of incorporated matter

(1) If a statutory rule applies, adopts or incorporates any matter contained in a document the statutory rule must be published with a footnote or endnote containing a table—

(a) specifying the document referred to in the statutory rule that contains the matter that is applied, adopted or incorporated; and

(b) indicating the provision of the statutory rule to which the matter applied, adopted or incorporated relates.

(2) Subregulation (1) does not apply to any matter contained in an Act, a Commonwealth Act, a statutory rule, a statutory rule made under a Commonwealth Act or a Code referred to in section 32(2) of the Interpretation of Legislation Act 1984.

6 Prescribed bookshopr. 6

Victorian Government Bookshop, Level 20, 80 Collins Street, Melbourne, is prescribed as the bookshop for the purposes of section 20(1) of the Subordinate Legislation Act 1994 in respect of which the Government Printer must make every effort to ensure that a copy of a statutory rule can be purchased on demand by any member of the public during normal office hours.

1. General InformationThe Subordinate Legislation Regulations 2004, S.R. No. 91/2004 were made on 13 July 2004 by the Lieutenant-Governor as the Governor's Deputy with the advice of the Executive Council under section 28 of the Subordinate Legislation Act 1994, No. 104/1994 and came into operation on 1 August 2004: regulation 3.

The Subordinate Legislation Regulations 2004 will sunset 10 years after the day of making on 13 July 2014 (see section 5 of the Subordinate Legislation Act 1994).
