1. Introduction

TheSustainableGroundwaterManagementAct(SGMA)requireslocalagenciestoform

groundwatersustainabilityagenciesbyJune30,2017andpreparegroundwater

sustainabilityplans(GSPs)byJanuary31,2022formediumprioritybasins.DuringtheGSP

preparationprocess,GSPregulationsrequirepublicoutreachandengagementwithbasin

stakeholders.Thepurposeofthisstakeholdercommunicationandengagementplan(C&E

plan)istooutlinetheprocessforensuringpublicandstakeholders’involvementinthe

developmentofthesingleGSPfortheEastBayPlainSubbasin,amediumprioritybasin

whichextendsacrossportionsofContraCostaCountyandAlamedaCounty.

EastBayPlainSubbasin(BasinNo.2‐009.04)isboundbytheHaywardFaultzoneinthe

eastandtheSanFranciscoBayinthenorthandthewest.Inthesouth,itislocatedadjacent

totheNileConesSubbasin(BasinNo.2‐009.01).Figure1indicatestheportionsoftheEast

BayPlainSubbasincoveredbyEBMUDandtheCityofHaywardastheGroundwater

SustainabilityAgency(GSA)intheirrespectiveareas.OnNovember6,2017,EBMUDand

theCityofHaywardfiledanotificationofintenttocollaborativelydevelopasingle

GroundwaterSustainabilityPlan(GSP)fortheentireSubbasin.EBMUDandtheCityof

Haywardwilljointlyimplementstakeholdercommunicationandengagementactivitiesfor

theSubbasinandbotharereferencedinthisdocumentasGSAs.

SGMArequirespublicnotificationsandhearings,aswellasactivestakeholder

communicationandengagementinGSPdevelopment.EBMUD and the City of Hayward’s

websites (www.ebmud.com/sgma and www.hayward-ca.gov/sgma) are available for GSAs’

current SGMA compliance information, documents, and useful links. Stakeholders can also sign

up for the GSAs’ SGMA email lists. ThisC&Eplanoutlinesaroadmaptomeetthese

requirementsandmoreimportantlytocreatecommonunderstandingandtransparency

throughouttheGSPpreparationandapprovalprocess.TheGSAswillusethisplanto

engagewithandgatherinputfromvariousstakeholderstosupportthedevelopmentofa

singleGSPfortheEastBayPlainSubbasin.

2. Objectives

IncompliancewithGSPRegulations(Section354.10),theobjectivesofthisplanare:

implementingthePlan,includingthestatusofprojectsandactions

OurgoalistoinvolvestakeholdersandthepublicthroughouttheGSPdevelopmentprocess

toensurestakeholders’concerns,issuesandaspirationsareconsistentlyunderstoodand

consideredintheGSAs’decision‐makingprocess.

4. CommitmenttothePublicandStakeholders

EBMUDandtheCityofHaywardareworkingtogethertodevelopasingleGSPfortheentire

EastBayPlainSubbasin.Wecommittosafeguardourlocalgroundwaterresourcesthrough

sustainablemanagementandtopreservethisinvaluablewatersupplysourceforfuture

generations.Wecommittoworkwithstakeholderstoensurethattheirconcernsand

inputsareconsideredintheGSPdevelopment.

5. OurStakeholders

The East Bay Plain Subbasin spans over two counties and several cities with industrial zones,

urban areas, transportation corridors, and natural landscape. It covers a wide range of stakeholder

interests – general public, land use authorities, private users, urban users, business interests,

public agencies, water service providers, and environmental interests.

California Water Code (CWC) §10723.4 requires GSAs to establish and maintain a list of

persons interested in receiving notices regarding plan preparation, meeting announcements, and

availability of draft plans, maps, and other relevant documents. Any person may request, in

writing, to be placed on the list of interested persons. Appendix C includes a tabulated list of

stakeholders identified at this time. The stakeholder list will be periodically updated as needed.

6. GSAsDecision‐MakingProcess

HaywardandEBMUDhavebeenapprovedastheexclusiveGSAsfortheentireEastBay

PlainSubbasinwithintheirrespectiveboundaries.OnJuly31,2017theGSAsenteredintoa

MemorandumofUnderstandingforcoordinationandcooperationinplanningand

implementingSGMAcomplianceactivitiesfortheEastBayPlainSubbasin.OnNovember6,

2017,EBMUDandtheCityofHaywardfiledanotificationofintenttodevelopasingleGSP

fortheentireSubbasin.ThefollowingflowchartshowstheEastBayPlainSubbasinGSAs’

JointDecision‐MakingProcesstodeveloptheGSPfortheEastBayPlainSubbasin.

AsSGMAintended,theGSPdevelopmentisalocallydrivenprocesswithstakeholderactive

participation.OncethedraftGSPissubmittedforapproval,DWRwillhaveauthoritiesto

reviewandapprove,approvewithmodificationorrejectitentirely.Stakeholdersandthe

publicwillbegivena90‐daywindowtoreviewandcommentonthesubmitteddraftGSP

duringtheDWR’sapprovalprocess.UponcompletionofDWR’sreview,EBMUDandthe

CityofHaywardwillberesponsibleforfinalizingtheGSPormodifyingittomeetDWR’s

requirements.

EBMUDGSA

EBMUDisapublicly‐ownedutilityformedundertheMunicipalUtilityDistrictAct(MUD

Act)passedbytheCaliforniaLegislaturein1921.TheMUDAct,ascodifiedbythePublic

UtilitiesCodeoftheStateofCalifornia,authorizestheformationandgovernanceofthe

District.EBMUDhasaseven‐memberBoardofDirectorspubliclyelectedfromwards

withintheEBMUDservicearea.TheBoardiscommittedtodevelopingpolicythroughan

open,publicprocess.TheBoardofDirectorsmeetstwiceamonthonthesecondandfourth

Tuesdayandatothertimesasneeded.EBMUDBoardofDirectorswillbethegoverning

bodyoftheEBMUDGSAanditwillholdultimatedecision‐makingauthority.

HaywardGSA

TheCityofHaywardisachartercity,governedbyaMayorandsix‐memberCityCouncil,

electedatlargeandrepresentingtheentireCity.Haywardiscommittedtocommunity

engagementandtransparencyindecisionmaking.TheCityCouncilmeetsthefirst,third

andfourthTuesdaysofeachmonthat7p.m.andwillbethegoverningauthorityofthe

HaywardGSA.

GSAs’GoverningBodies

TheGSAs’governingbodiesaretheBoardofDirectorsforEBMUD,andtheMayorand

CityCouncilfortheCityofHayward.Thesebodieswillhaveultimatedecision‐making

authorityandcanoverridetheSteeringCommittee’srecommendations.Stakeholderswill

haveanoptiontoappearbeforethesebodiesiftheyfindthattheirconcernsand/orissues

werenotsufficientlyaddressed.

SteeringCommittee

TheSteeringCommitteewillbecomposedofseniorstafffromthetwoGSAswhowill

overseeandguidetheTechnicalTeamindevelopingtheGSP.Itwillalsoberesponsiblefor

briefingthegoverningbodiesofGSAsandseekingapprovals.

TechnicalTeam

TheTechnicalTeam,consistingofstafffromEBMUDandtheCityofHayward,is

responsiblefordevelopingtheGSP,overseeingconsultantsandmanagingtheentireGSP

developmentandassociatedprojects.TheTechnicalTeamwillactivelyengagewithall

stakeholders.ItwillbealsokeeptheSteeringCommitteeupdatedandmake

recommendationsatkeydecisionpoints.

Consultants

Ateamofconsultantswillconducttechnicalstudiesandinvestigations,including

groundwatermodeling,anddrafttheGSPdocuments.TheTechnicalTeamwilloverseethe

consultantworkandmanagetheGSPdevelopmentproject.

Public/InterestedParties

Thiscategorywillcovermostofthestakeholders.Membersofthepublicandinterested

partiesfromtheSubbasinareacanparticipateinpublicmeetingsandhearings,and

communicatewithGSAstafftoprovideinput,obtaininformation,andreviewandcomment

onGSPdocuments.TheTechnicalTeamwilltakepublicinputintoconsiderationin

developingtheGSP.

TACFormationProcess: • Interestedapplicantswillbeaskedtocompleteabriefstatementofinterestand

qualifications.(SeeAttachmentB)• TechnicalTeamwillreviewstatementsandrecommendindividualswithrelevant

expertiseandexperience.Effortswillbemadetoensureabroadrangeofenvironmental,science,academic,technicalandotherfields,aswellasdiversityinperspectives.

• SteeringCommitteewillmakefinaldecisionsonTACmembers.• TACmemberswillbeaskedtoparticipateinorientationsessiontoreviewthe

mission,objectives,groundrulesanddecision‐makingprocess.

TechnicalAdvisoryCommittee(TAC)

TheTACwillbecomprisedofindividualswhohaverelevanttechnicalbackgroundsrelated

togroundwaterorwatersupplymanagement,includinggroundwaterusers,regulators,

environmentalspecialistsandresearchers.TheroleoftheTACteamistoreviewtechnical

workproducts,commentandofferrecommendations.

GSAswillseekoutindividualswithtechnicalexpertisetoserveontheTAC.TACmembers

willanalyzegroundwatersustainabilityplancomponentsincludingmodelingstudiesand

makerecommendationstotheGSPTechnicalTeaminitsefforttoachievegroundwater

sustainabilityintheEastBayPlainSubbasin.Eachmemberwillbechosenfortheir

experienceaswellasthediversityoftheirperspective.GSAs’TechnicalTeamwillconsider

thesecommentsandrecommendationsinthedecision‐makingprocess.

Inter‐basinWorkingGroup(IWG)

TheIWGwillbecomprisedofrepresentativesfromneighboringbasins/subbasinsand

regionalgroundwaterinterests.TheIWGwillreceiveGSPdevelopmentupdates,

informationanddatasharing,SGMAcompliancecoordinationandopportunitiestoprovide

input.

7. Howcanmembersofthepublicandstakeholdersgetinvolvedin

thesustainablegroundwatermanagementprocess?

Thesustainablegroundwatermanagementprocessincludesthegroundwater

sustainabilityplan(GSP)developmentfortheEastBayPlainSubbasinandimplementing

theGSP.PublicandstakeholderparticipationisvitaltothedevelopmentofaGSP.Afirst

stepistoreviewthecontentonthewebsites(www.ebmud.com/sgmaandwww.hayward‐

ca.gov/sgma)andsignupfortheGSAs’SGMAemaillists.Stakeholdermeetingsare

scheduledonaregularbasistoprovideinformationtothepublicandopportunitiestoask

questionsandmakesuggestions.Thesewillbepostedonthewebsitesandannouncedvia

email.

TheGSPDevelopmentProcessfortheEastBaySubbasin(Figure2)showskeytasksand

theirrelationshipindevelopingtheGSP.ThekeytasksofGSPdevelopmentwillinclude

conductingtechnicalstudies,especiallygroundwatermodeling,definingthesubbasin’s

characteristics,accountingforcurrentandplannedgroundwateruses,considering

groundwaterdependentecosystems(GDEs),incorporatinglanduseplanningand

developingsustainablemanagementcriteria.AsshownontheFigure2,technicaland

policydecisionmakingwillbeinterconnected.

AppendixAincludesapreliminaryscheduleshowingcompletedmilestonesandplanned

stakeholderC&Eactivities.Asshownontheschedule,stakeholdermeetingswillbeheldat

regularintervals,andtheTACwillmeetmorefrequently.Inaddition,TechnicalTeamstaff

willbeavailablethroughouttheprocesstocommunicateandengagewithstakeholdersand

thepublic.

MembersofthepublicandstakeholderscanbeinvolvedinGSPdevelopmentbyproviding

inputthroughouttheprocessofcompletingthesetasks.Periodicupdatesandmaterialswill

bepostedontheSGMAwebpagesandpresentedatthemeetingsforstakeholderreview

andcommentthroughouttheprocess.

GSPRegulations(Section355.4)requirethatGSA’sconsidertheinterestsofthebeneficial

usesandusersofgroundwaterinthebasin.Inaddition,wewillconsidertheeffectsonland

useandpropertyinterestsfromtheGSP.Publicinputisessentialinunderstandingand

consideringtheseinterestsandeffects.

DuringtheGSPreviewandapprovalprocess,DWRwilltakeintoaccountpubliccomments

whendeterminingwhetherornotinterestswithinthebasinhavebeenconsideredinthe

developmentandimplementationoftheGSP(Section353.8).

9. CommunicationandEngagementVenues

StakeholdercommunicationandengagementwilltakeplaceSubbasin‐wideandforGSA

area‐specificstakeholders.EachGSAareamayincludeasetofstakeholderswithspecific

interestsrelevantonlytoaparticularGSAormanagementarea.EachGSAwilldecide

requiredlevelsofcommunicationforitsownGSAareaandengagewiththesestakeholders

initsGSAareaandmanagementareasasappropriate.ForSubbasin‐wideinterestsand

issues,EBMUDandHaywardwilljointlycommunicatewithallstakeholders.

Stakeholdercommunicationandengagementwillbeconductedthroughmultiplevenues

includingnewspaperadvertisements,publichearings,individualandgroupmeetings,

interactivewebpages,socialmediaposts,telephone,andemailcommunication.Following

arethedescriptionofthesevenues:

DedicatedSGMAwebpagesforeachGSAareactivelyupdatedandaccessibleat

newslettersascommunicationvehicles.BothGSAswilluseexistingsocialmediaplatforms,

aswellaspotentialnewplatformsastheybecomeavailable,toupdatefollowersonSGMA

complianceactivitiesasappropriate.

PublicHearings

Noticesofpublichearingsarepublishedinlocalnewspapersinformingthepublicon

meetinginformation,subject,andhowtoprovidecommentspriortodecision‐making.

IndividualMeetings

Uponrequest,GSAstaffareavailabletomeetwithinterestedpartiestodiscusstheSGMA

complianceactivitiesorreceiveinput.

StakeholderOutreachMeetings

Currently,stakeholderoutreachmeetingsareheldtwiceannuallyinthefirstandthird

quartersofcalendaryears.Meetinginvitationsaresentouttoindividualsandentitieson

thestakeholdermailinglist,andinformationisalsopostedonthewebsitesandsocial

mediaplatforms.ThesemeetingswillcoverabroadrangeofagendaitemsincludingGSP

developmentupdates,technicalstudies,environmentaltopics,andanystakeholder

interests.Ifnecessary,follow‐upmeetingscouldbescheduledtofocusparticulartopics.

TechnicalAdvisoryCommitteeMeetings

TheTechnicalAdvisoryCommitteeisaworkinggroupwhichwillreviewtechnicalwork

productsandmeetmorefrequently.Themeetingsmaybeconductedthroughweb

conferencingaswellasin‐personmeetings.

Inter‐basinWorkingGroup(IWG)Meetings

MembersofIWGcanparticipateinregularlyscheduledstakeholdersmeetingsaswellas

individualmeetingswithGSAsasnecessary.Inaddition,IWGmeetingswillbeheldat

regularintervalstoprovideupdatesandcoordinatewithmembers.

10.Summary

StakeholdercommunicationandoutreachactivitiesareessentialinGSPdevelopment.Only

througheffectivecommunicationandoutreach,wewillbeabletoensurethose

stakeholders’concerns,issuesandaspirationsareconsistentlyunderstoodandconsidered

intheGSAs’decision‐makingprocess.

Moreover,thestakeholderC&Eprocesswillbeongoing,startingwithGSPdevelopment

andthroughimplementationoftheapprovedGSPfortheEastBayPlainSubbasin.Asin

GSPdevelopment,periodicreviewsandadjustmentsoftheC&Eprocessmaybenecessary.

TheultimategoalistodevelopandimplementarobuststakeholderC&Eprocesssowe

mayachievesustainabilityinmanagingourvaluablelocalgroundwaterresourceforfuture

generations.

GROUNDWATER SUSTAINABILITY PLAN TECHNICAL ADVISORY COMMITTEE PURPOSE

The Groundwater Sustainability Plan (GSP) Technical Advisory Committee will be responsible for reviewing the scope of work, draft products and materials prepared by consultants, analyzing them and providing recommendations to the GSP Technical Team to develop a technically sound GSP. The East Bay Plain Subbasin Stakeholder Communication and Engagement Plan (C&E Plan) outlines further details. The draft C&E Plan is available at http:/www.ebmud.com/sgma.

The members of the TAC will be selected to represent GSP-related subject areas, including but not limited to environmental, technical, and land use planning fields. GSP TAC members will work collaboratively with EBMUD and the City of Hayward staff.

Participation in the TAC is a volunteer activity and participants’ time for the TAC activities will not be compensated by the GSAs. The TAC will meet on a more frequent interval than the stakeholder meetings depending upon need for reviews. Participants must be available to attend regular TAC meetings, review the materials, and provide recommendations, in accordance with deadlines, from July 2018 through January 2022. Specific time commitments to complete the work will vary throughout the process.

Personal information on this form will become a matter of public record subject to disclosure under the California Public Records Act (California Government Code section 6250 et. seq.).
