i '3 ' l t shal l come into force on such date as decided by order of the StateGovernment.

Z" APPLICABILITY

2'1' These regulations shatl apply to any Hospital buildings proposed under theseregulations.

3. DEFINTTION

3'1. "Acti'means the Gujarat rorvn planning & urban Development Act 1976. r3'2' "Appropriate Authority" means authority as defined under Act3.3. "Competent Authorityi' means any personf persons or authority or

authorities; authorized by the Prescribed offlcer as the case may be toperlorm such functions as may be specified under these regurations.

3'4. "Developerj' means and incrude a owner/person/persons/ registeredsociery/ association/ firm/ company/ joint ventures/ institution/ trustsentitled to make an application to develop any hospitality project;

3.5. "Escape routes" means any well ventilated corridor, staircase or othercirculation space, or any combination of the same, designed for the purpclse ofevacuation and by r"rn, of which, the occupan,, ."n-r"".h ," ,r; O;;J ;the open air ai ground level.

3'6' "Floor Spacef' means the sum of the area of each floor calculated for thepurpose of FSI;

3'7' "Fire escape stairways and routes" means escape routes designed andplaced as advised and approved by the fire officer;

3.8" "Fire officer-.means the chief fire officer of the Municipal corporation;3'9 ' "GDCR"'means the prevalent General Development Control Regulat ions

applicable for the relevant appropriate authority.

3.10. "Entrance Canopy,'means the canopy at the main entrance.

3.72. "Refuge Area" means an area designed and provided at var ious levels or

f loors in the bui ld ing as per requi rements in NBC, to hold occupants dur ing a

fire or any other emergency

3.13. "Hospi ta l " means under Single l r lanagement, any bui ld ing or group of

bui ld ings or mul t ip le bui ld ings consist ing of a complex accommodat ing

fac i l i t ies to prevent , t reat , and manage i l lness and the preservat ion of menta l

and physical rvell-being through the services offered by the medical and all ied

health professions including research and health club and physiotherapy

cel l tres.

3|J,4. "Global FSI" means FSI permissible under these regulations irrespective of

the zone.

3.15. "Zone" means the zone as designated in the prevalent sanctioned:

development p lan of the appropr iate author i ry

DUTIES OF THE COMPETENT AUTHORITY:

For the purpose of these regulations, the competent authority shall;

Government to approve or refrrse the proposal; j

notif ied water body or any diff icult area;

scheme of the state or central government;

5. PROCEDURE FOR SECURING THE PERM!SSION:

5.1. Subject to the provisions of these regulations and the GDCR, any developer' i.ntending to develop under special planning provisions of these regulations

shal l apply to the competent authori ty under sect ion 26 of t t re Act, along with

the required documents and shal l forward copy to the State Government.

6. PTANNING PROVISION

6'1" The Hospital under these regulations shall be permitted on an approach andor road which is 30 mts or wide.

6.2. F loor Space Index:

6'2'1' Irrespective of any zone, permissible Floor Space Index (FSI) under the.seregulations be as under:

6 '5 ' The refuge and the escape area shal r be regurated as uncrer :

o to hold occupants dur ing a f i re or terror at tack or any other emergency- unti l rescued;

o Refuge Area shal l be shal l be regulated as under:

- one or more refuge spaces, not necessarily be contiguous but connected

with escape routes;

- mi l imum area of 1.5 sq.mts and a min imum width of 3.0 mts' at least one refuge space be provided for every 6 floors or part thereof;

the refuge and the escape area shii l be designed for safety of theoccupants;

design of refuge area should comply wi th the provis ions of NBC6.6. l t farg ins and Bui l t -up area:

6 '6 '1 'Notwi thstanding anyth ing conta ined in GDCR, margins s5al l be regulated asrrnder :

a' Nothing except cabin ancl structures related to security may bepermi t ted in the margins;

b' Vehicle l ifts shall be permitted within the margin spaces. However aclear margin of 9.0 mts in the front and 3.5 mts on other sides shallhave to be maintained.

6'6.2' Built-up Area: Buirt-up area shail ue regurated as under;

o 45 o/o in case of low-rise buitding and 30 o/o in case of High-rise building o

6.7 , Height of Bui ld ing

a. Higher than that permi t ted under the GDCRshal l be knovvn as adt l i t ional

height. The Additional height [AH) shall be regulated as uncler:

b. Maximum height of 70 mts shal l be permi t ted;

a. AH shall be permitted on payment. Such payment shall be based on

applicable rates (AR), which would be equivalent to 15% of the

land jantri rates.

b. The calculations shall be as under:

i. For individual f loors, multiply the floor area foi- rvhich AH

is asked for rvith AR; or

i i. For buildin6 mqltiply the sum of the floor area of all the

floors which are above the permissible height yitn AR;

c. Additionil Floor to Floor Height mor'e floor height then as pre"scribed in

GDCR for public areas, plant rooms, banquets, ball rooms, restaurant,

entrance canopy/porch, enffance lobby, basements can be availecl on

payment as per above sub clauses.

6.8. Basenrcnts:

6.8.1. The following may be permitted in the basements:

6-8.1.1. Parking on more than one levels;

6.8.1 .2. Space for serv ices which may inc lude, e lect r ic cabin, substat ion, a.c .

plant room, boiler, housekeeping, rooms for the care takers,

morgue, collection of waste, such as biomedical, plastic, paper,

gtass, diagnostic, etc., central laundry, CSSD change room, library

room, rest room for the reserye staff. However such services shall

only be permitted on one level of basement. Such uses shall strictly

be ancillary to the principal use. However these areas shall not

exceed 20o/o of the total basement area and for such area payment. .

Security cabins may be permitted at every level of basement;

Basements may be permitted in the marginal spaces. However for

the safety requirements, it shall not be permitted in 3 mts wide

Author i ty of India, Departntent of Forest and Envi ronment for EIA c learance.

8.10. The st ructura l safety of the bui ld ing shal l be the responsib i l i ty of the

developer. The developer shall, at his cost, get an audit of the Structural

Stabil ity and Safety through any independent Competent Authority or a

Structural expert of adequate experience and good reputation identif ied and

advised by the competent authoriW.

B'11 ' Deduct ion as decided by the competent author i ty shal l be appl icable in

case where the plots are not the part of the Town planning Scheme area.

8,12. Fire safety provision shall be made in accordance to GDCR

not exceeding 2.5 mts,

2. QUALTTY CONTROT REQUTREMENTS

(i) The quality of all nrateiials and workmanship shall conformto accepred srandardsand lndian Standard Specifications and Codes as inciuded in Part V BuildingMaterials and Part Vll Constructional Practices and Safery, National Building Codeof lndia.

The provis ior . rs of the Regulat ions are not in tendet l to prevent the use of anymater ia l or method of i les ign of construct ion not speci f ica l ly prescr ibed in themprovided any such a l ternat ive has been approved. Noth ing of the provis io ls ofthese Regulat ions is in tended to prevent the adopt ion or archi tectura l p lanningand layout conceived as an in tegrated development scheme. The Competentauthorily may approve any such alternative if i t conforms to the provisions of there levant par ts of the Nat ional Bui ld ing Code, regarding mater ia l , design andconstruction, and the material, method, or work offered is, for the purposeintendeci, at least equivalent to that prescribed in these Regulations in qualiry,strength, compatibil i ty, effectiveness, f ire and water resistance, durabil ity andsa[ery.

( ivJ Al l bu i ld ings shal l be constructed on a qual i ty contro l requi rement .

(v) In case of existing building under construction based on approved buildingpermission, structural safety requirements shall have to be observed. However, dueto sucnl structural work of strengthening/retiofitt ing if certain setbacks and marginget reduced, special permission may be gfnted on case to case basis.

(3) TESTS:

Whenever there is insufficient evidence of compliance with the prorrisions of theRegulations or evidence that any material or method ,of design or constructiondses not conform to the requirements of the Regulations, in order .tosrtbstantiate clairns for alternative materials, design or rnethocls ofconstruction, the Competent Authorify may require tests, sufficiently in advance,as proof of compliance. These tests shall be made by an approved agency at theexpense oI the owner as fo l lows : -

(i) TEST METHODS:- Test methods shall be as speqified by the Regulations forlhe materials or design or construction in question. If there are noappropriate test methods specified in the Regulations, the CompetentAuthoriry shall determine the test procedure. For methods or tests forbuilding materials, reference shall be made to the relevant lndian Standardsas given in the National Building code of India published by the Bureau oflndian Standards.

(ii) TEST RESULT TO BE PRESERVED:- Copies of the result of all such tests shall beretained by rhe competent Authoiity for not less then two years after theacceptance of th.e alternative material

Tbe testing of the. materials as per Indian Standards shall be carried out .bylaboratories approVed by the competent authority on this behalf.

The laborat oryfagency shall work out in consultation with the constructionagency a testing programme of materials such as cement, steel and quality ofconcrete including its mixing, laying and strength at site as well as in thelaboratorv.

Structura l Stabi l i ry and Fi re Safety of L-x is t ing Bui ld ings

The Competent Author i ry .shal l have the assessment of s t ructura l and/orf i re safety of an ex is t ing bui ld ingls t ructure damaged/undamaged carr iedout at s t ipu lated per iodical in tervals through expert [sJ chosen f rom apanel of experts identif ied by the Competent Authority.The owner/developer/occupant on advise of such expert(s) shall carryout such repai r / restorat ion and st rengthening/ret rof i t t ing of the bui ld ingfound necessary so as to comply with the safety standards laid down inthe Nat ional Bui ld ing Code and the Indian Standards as speci f ied.

In case, the orvner /developer/occupant does not carry out such act ion,the competent authority or any agency authorized by the competentauthority may carry out such action at the cost ofowner/d evelbper/occupa nt.

i i i. Th6 Competent Authoriry shall spe{ciff the period within which such?crnpliance is to be carried out.The Competent Author i ty may a lso d i rect theowner/developer/occupant, whether the building could be occupied ornot dur ing the per iod of compl iance.In case of existing building under construction based on approvedbuilding permission, structural safery requirements shall have to beobserved. However, due to such structural work of strengthening/retrofitt ing if certain setbacks and margin get reduced, specialpermiss ion.

The structural safety of the building shall be the responsibil iry of the developer. Thedeveloper shal l , a t h is cost , get an audi t o f the Structura l Stabi l i ry and Safety throughany independent Competent Author i ty or a Structura l expert of adequate exper ienceand good reputation identjf ied and advised by the competent authoriry.

l . Def in i t ions

1.1. 'domest ic waste water 'means e i ther u/aste water t l ra t is typ ical ly c l ischargecl

i .2 ' 'grey water ' means involv ing non-potable water f rom s inks, tubs, shorvers ancl

washing.

1.3 ' 'pre- t reatment ' means any processing of industr ia l i f /aste or waste designed to

reduce any characteristic in waste, before discharge to the lvaste water system.

1 . 4 . ' p r e m i s e s ' m e a n s e i t h e r

a. A properyr which is held under a separate card of t i t le or for rvh ic l r

plans have been or may be issued, or a building which is in possession as

1.5. 'Non-potable water means the use of water for non-contact uses, non t jontest ic

consumpt ion I ike car washing, to i le t f lushing, gardening, construct icn purposes,

landscaping, dr ip i r r igat ion of t rees/shrubs, sub sur f lace i r r igat ion of larvns and

recharge of ground water & usesis for b idden by v i r tue of powers vested wi th

government .

L.6. 'Prohib i ted. industr ia l waste ' means a industr ia l waste having physical and

chemical character is t ics in excess as decided bv GpCB.

2. Applicabil ityt iu-use of water shall be provided'in case of tollorving categories of

buildings.

2.1. All new buildings under the following use

a. Any low rise / high rise building having number of units 10 or nrore or

having total bui l t up area more than 750 sq meters

b. Hospitals and Nursing homes

c. Hotels, Lodges and guest houses

d. Hostels of schools, Col leges, Training centres

e. Barracks of armed forces, paramilitary forces and police

Note: In case of category of mentioned in "b, c, 8, h & i" above it shall not be

mandatory to provide the solar assisted-hea{ng system.

2.2. Exemptions could be accorcled under follorving circumstances, as decided by the

authority;

a. ln case.the. existing .premises cannot permit the provision of additional

overheid tank for ihe purpose ofthe use oftreated water'

b. tf, in the existing structure, there is no space for installation of treatment

facil ity and. collection chamber'

c. In except ional cases due to dearth of land or water logged areas exempt

[with the approval f rom competent authori ty) f rorn providing faci l i ty for

recYcling the greY water.

3. Installation of the system for the Re:use of rvater

3.1.New Buildings; Clearance gf plan for the construction of new buildings of the

aforesaid categories shall only be given if they have. a provision in the building

design itself for:

3.1.1.gvery developer/builder shall provide with the provision of down take

plimbing for grey watei-, recycling water plant, storage and reuse fittings in

purple colour.

3.7.2. Provide addit ional arrangements for carrying the exCess grey water to lhe

sewerage system may also be provided

3.1.3. No nuisance of foul gases/public hazard or any other aspect endangering

life.

3.1.4.There shal l not be cross-connect ion of f i t t ing of the potable and not potable

- wat€r at any point. The recycled water system shal l be maintained at a lower

operat ing pressure that that of the potable water system. Precaut jons

should be taken at the make-up connect ion to prevent cross contaminat ion'

4'3' The testing of r,vastes and the submission of the results shall be done in a manner in

accordance with the terms and conditions prescribed by the lvlunicipal

Commissioner or the Gujarat pollution control board /the competent authority

4.4'- Installations for Re-use of r4/ater shal] conform to relevant codes of practises

5. General provisions:

5'1'Mandatory disclosure: An occupier/owner of premises shall inform the

competent authorily of any change in the quality, nature of the wastes

discharged from his plant or premises, the manner of.their discharge of water

l ike ly to cause var iat ions or v io lat ion under these regulat ions.

5.2.9orrective action. ln the event it is found any person violating the provisions

of these regulat ions, the competent author i ty shal l issue not ice and af ter

inqui ry and personal hear ing take necessary correct ive act ion"

5.3.Rebate: The competent author i ry may sat is fur i tse l f on the per formance of

recycling of the water and thereafter can give rebate on the taxes / fees leviable

for the development. The colnpetent authority may give such rebate on tlre

capi ta l or recurr ing recover ies which the developer is l iab le to pay.

5.4.Dispute Resolut ion Al l the d isputes ar is ing in the enforcement of th is by these

rules shall be referred .to Municipal Commissioner who in' turn wil l resolve

the disputes in advise with his authorized technical officer orany experts and

intimate to the occupier / builder / developer. The decision of the competent

authoriry wilt be final and binding on rhe occupier.

categories must complete installation of solar water heating systems before

obtaining necessary l icense to commence their business.

Exist ing Bui lc l ings: Insta l la t ion of Solar Assis ted Water l - leat ing systenl in the

exist ing bui ld ing shal l be made mandatory at the t ime of change of u-se to above

said category provided there is a system or installation for supplying hot warer.

Capacity: The capacity of solar water heating system to be installed on the

buitding of different categories shall be decided in consultation with the loc{l

bodies. The recommended minimum capacity shall not be less than 25 l itresper

day for each bathroom and kitchen subject to the condition that maximum of 50 o/o

of the tota l roofarea is prov ided wi th the system.

Speci f icat ion: Insta l la t ion of Solar Assis ted Water Heat ing Systems shal l conform

to BIS (Bureau of Indian Standards) speci f icat ion IS 12933. The solar co l lectors

used in the system shall have the BIS certif ication mark.
