NOTIFICATION

In supersession of the Schedule of Rate – 2006 notified vide notification number 04/GoS/R&B/Gen/04-05/262/R&BPWD/R&B dated 13th March, 2007 and notification number 04/GoS/R&B/Gen/04-05/82PWD/R&B dated 24th March, 2008, the State Government is hereby pleased to notify the Schedule of Rates-2012 for its implementation as under, namely: 1. The Schedule of Rates appended to this Notification shall be termed as Schedule of Rates -

2012 and the same shall be deemed to have been effective from the date of issue of this Notification.

2. The said Schedule of Rates shall be applicable to all the Civil Engineering Works under Government of Sikkim, excluding Electrical Works under Energy and Power Department.

3. For calculation of the price escalation whenever required, the empirical formulae adopted under FIDIC (Federation International Des Ingénieurs-Conseils, French for the International Federation of Consulting Engineers) shall be followed.

4. The labour rates adopted in the analysis shall be for the purpose of analysis only. 5. The Labour CESS shall be added over and above the estimated cost. 6. If any CESS, is notified hence forth by the Government, it shall also be treated as per Sl. No.

5 above. 7. For the items which are not covered by this Schedule of Rates – 2012, the respective

Department shall prepare the Analysis based on Standard Data book of Central Public Works Department (CPWD) / Ministry of Road Transport and Highways (MoRT&H) for Analysis of Rates duly adopting the overheads and Contractor Profit as specified in this Schedule of Rates based on approved Government agencies rates.

8. Ministry of Road Transport and Highways MoRT&H and Indian Road Congress (IRC) Specification shall be followed for Roads and Bridge works and Central Public Works Department (CPWD) Specification for all other works.

NOTICE UNDER SECTION 4(1) OF LAND ACQUISITION ACT, 1894 (ACT I OF 1894)

Whereas it appears to the Governor that land is likely to be needed for a public purpose, not being a purpose of the Union, namely for the construction of J.H.S at Karungthang by Human Resource & Development Department, Government of Sikkim in the block of Gagyong, South Sikkim, it is hereby notified that the pieces of land comprising cadastral Plots Nos. 603, 604,

606 & 602(P) measuring area more or less 0.8340 hectare bounded on the East : SPWD Road,

West : P.F. of Pemdem Bhutia, North : P.F. of Lt.Pemdem Bhutia & Village Road, South :Primary School & D.F. of Pemdem Bhutia is likely to be needed for the aforesaid public purpose at the public expense within the aforesaid block. This notification is made, under the provision of Section 4(1) of L .A.Act, 1894 (Act I of 1894) to all whom it may concern. A plan of land may be inspected in the Office of the District Collector South, Namchi.

In exercise of the powers conferred by the aforesaid Section, the Governor is further pleased to authorize the Officers for the time being engaged in the undertaking, with their servants and workmen, to enter upon and survey the land and do all other acts required or permitted by that section. And whereas there is urgency to acquired the land, the Governor is further pleased to direct under Section 17(4) of Land Acquisition Act, 1894 (Act I of 1894) that the provision of Section 5-A of the Act shall not apply.

NOTIFICATION

In exercise of the powers conferred by the proviso to Article 309 of the Constitution of India, the Governor of Sikkim hereby makes the following rules further to amend Sikkim Travelling Allowances Rules,1980 namely:-

Short title and commencement

1. (1) These rules may be called the Sikkim Travelling Allowances

(Amendment) Rules, 2012. (2) They shall come in to force from1st day of April,2012

2. In Sikkim the Travelling Allowances Rules,1980 (hereinafter referred to as the said rules), for the existing rule six 6 and entries relating thereto, the following shall be substituted namely:-

(1) Grade –I Posts having grade Pay of ` 8700 and above. (2) Grade –II Posts having grade Pay of ` 7200. (3) Grade –III Posts having grade Pay of ` 5000- ` 6700. (4) Grade –IV Posts having grade Pay of ` 3400- ` 4600. (5) Grade –V Posts having grade Pay of ` 3000 and below.

3. In the said rules, in rule 15 for the existing serial number (i), (ii) and (iii) and the entries

relating thereto the following serial number and the entries shall be substituted namely:-

(1) Grade I

Grade Pay of ` 8700 and above AC-I

(2) Grade II

Grade Pay of `7200 AC-II

(3) Grade III Grade Pay of `5000 - `6700

AC-III

(4) Grade IV Grade Pay of `3400- `4600 AC-III/ AC Chair Car

(5) Grade V Grade Pay of `3000 and below AC-III/ AC Chair Car

4. In the said rules, in rule 19, for the words “one rupee”, the words “five rupee” shall be

substituted.

5. In the said rules, in rule 20,

(1) for the words “First Grade”, the words and figure “Grade Pay of ` 7200 and above”; for the words “Second Grade” the words and figure “Grade Pay of ` 5000 - 6700” and for the words “Third Grade” the words and figure “Grade Pay of ` 4600 and below” shall respectively be substituted

(2) for the words “one hundred” the words “two hundred” shall be substituted. 6. In the said rule, in rule 21;

(1) for the words “First Grade” the words and figure “Grade Pay of ` 7200 and above”; for the words “Second Grade” the words and figure “Grade Pay of ` 5000 - 6700” and for the words “Third Grade” the words and figure “Grade Pay of ` 4600 and below”shall respectively be substituted.

(2) in the table ;-

(i) for the words and figure “`40” the words and figure “`80” and for the words and figure “`50” the words and figure “`100” shall respectively be substituted.

(ii) for the words and figure “`35” the words and figure “`70” and for the words and

figure “`45” the words and figure “`90” shall respectively be substituted.

(iii) for the words and figure “`27” the words and figure “`54” and for the words and figure “`40” the words and figure “`80” shall respectively be substituted.

(iv) for the words and figure “`25” the words and figure “`50” and for the words and figure

“`35” the words and figure “`70” shall respectively be substituted. 7. In the said rules, in rule 22, for the existing first and second paragraphs, the following shall be

substituted namely:-

Whereas the function of the Central Government under the Land Acquisition Act, 1894 (Act I of 1894) in relation to the Acquisition of land for the purpose of the Union have been entrusted to the State Government by Notification No. 12018/12/76/LRD of 10.1.1978 issued by the Government of India in the Ministry of Agriculture & Irrigation under Clause I of Article 258 of the Constitution of India.

being a purpose of the Union, namely for the Construction of Bye Pass Road by 86 RCC(FREF) at Chubanban in the block of Chunthang, North Sikkim, it is hereby notified that the land cadastral cadastral plot Nos. 80/P, 81/P, 82/P, 86/P, 87/P & 89/P measuring more or less area 1.0180

hectares bounded on the East: Sikkim Sarkar (Khasmal), West: Sikkim Sarkar (Khasmal), North:

Sikkim Sarkar, Private Holding & Old Road & South: Sikkim Sarkar & Lachen Chu is likely to be needed for the aforesaid public purpose at the public expenses within the aforesaid block of Chungthang, North Sikkim.

Notification

The Sikkim Panchayat and Municipalities (Election of Members of District Planning

Committee and Manner of Convening Meetings and Power and Function of the District

Planning Committee) Rules, 2012. In exercise of the powers conferred by section 127 of the Sikkim Panchayat Act, 1993 and section 255-A of the Sikkim Municipalities Act, 2007 in suppression of the Sikkim Panchayat and Municipalities (Election of Members of District Planning Committee and Manner of Convening Meetings) Rules, 1996, the State Government hereby makes the following rules, namely:-

Short title, extent

and commencement 1. (1) These rules may be called the Sikkim Panchayat and Municipalities (Election of Members of District Planning Committee, Manner of Convening Meetings and Power and Function of the District Planning Committee) Rules, 2012. (2) They shall extend to the whole of Sikkim. (3) They shall come into force at once.

Definitions 2. (1) In these rules, unless the context otherwise requires:- (a) “Act” means the Sikkim Panchayat Act, 1993 and the Sikkim Municipalities Act, 2007, as the case may be; (b) “Ballot Box” means and includes any box or receptacle used for insertion of ballot papers by voters; (c) “Candidate” means a person who has been or claims to have been duly proposed and seconded as a candidate for election by the members; (d) “Form” means a form appended to these rules;

(e) “Government” means the Government of the State of Sikkim; (f) “Prescribed Authority” means the Secretary in the Urban Development and Housing Department, Government of Sikkim; (g) “Presiding Officer” means and includes any Polling Officer under the provisions of these rules; (h) “Municipalities” means a municipality as defined in sub-section (49) of section 2 of the Sikkim Municipalities Act, 2007; (i) “Notification” means a notification published in the Official Gazette; (j) “Section” means a section of the Act; and (k) “Zilla Panchayat” means a Zilla Panchayat of a district constituted under sub-section (1)of section 49 of the Sikkim Panchayat Act, 1993. (2) Words and expressions used in these rules and not defined but defined in the Act, shall have the same meanings respectively assigned to them in the Acts.

Election of

Members of

District Planning

Committee 3. (1) As soon as may be after the constitution of a Zilla Panchayat and the constitution of Municipalities within the district under sub-section (1) of section 49 of the Sikkim Panchayat Act, 1993 and under section 12 of the Sikkim Municipalities Act, 2007, respectively, whichever is later, but not before the expiration of thirty days from the date of publication of the notification constituting such bodies within the district, the Prescribed Authority shall call a joint meeting of all the members of the Zilla Panchayat and Municipalities within the district by serving on each member a notice in Form1 of not less than seven days specifying the dates, place and time of such meeting. (2) Such a meeting shall be presided over by the Prescribed Authority or such other Officer as may be authorized by the Prescribed Authority. The Prescribed Authority or the Officer authorized by him shall not be entitled to vote at the election.

(3) Two-third number of total membership shall form a quorum of the meeting. On the date of the meeting if there is no quorum within an hour of the time fixed for the meeting, the Presiding Officer shall adjourn the meeting. The adjourned meeting shall be held on such date, place and time as may be fixed by the Prescribed Authority and the provisions regarding notice in Form 1 to members of the Zilla Panchayat and Municipalities referred to in sub-rule (1) shall apply.

Provided that no quorum shall be necessary for an adjourned meeting. (4) If in case there is no Zilla Panchayat duly constituted within the district

under the provision of the Sikkim Panchayat Act, 1993, if there is

likelihood of delay in constituting such Zilla Panchayat for more than a period of three months from the date of publication of notification constituting the urban local bodies, the Prescribed Authority may call the meeting of the members of the urban local bodies for constitution of District Planning Committee without further delay. However, in such cases the representation from the Zilla Panchayat as required under Sikkim Panchayat Act, 1993, shall be kept vacant till the constitution of the Zilla Panchayat.

(5) The Presiding Officer shall, immediately after the commencement of

the meeting, call upon the members present to propose and second names of the candidates from amongst themselves for election as members of the District Planning Committee. He shall record the names of the candidates proposed together with the names of the proposers and seconders. The Presiding Officer shall reject any proposal if the candidates has been finalized by him.

(6) If the names proposed and seconded are not more than the seats

allotted to be filled up by such members by election, the Presiding Officer shall declare them duly elected members of the District Planning Committee by filling up Form 2.

(7) If more candidates have been proposed and seconded than the seats

allotted to be filled up by such election and the candidates have agreed to stand for election, the Presiding Officer shall conduct the election in the following manner:-

(a) The Presiding Officer shall cause to be prepared as many ballot papers as there are members present containing the names of the candidates arranged according to the alphabetical order of their surnames in Form 3 in such language or languages, as the Prescribed Authority may direct; (b) The Presiding Officer shall, immediately before the commencement of the election, satisfy all members present that the ballot is empty and also allow the members present to inspect the ballot box and thereafter secure and seal such ballot box and have it kept at a place which can be seen by himself and the members present; (c) The Presiding Officer shall, thereafter, hand over one such ballot paper as prepared under clause (a) of sub-rule (7) of Rule 3 to each member present after putting his initial on the back of each ballot paper. He shall then ask each member in turn to record his vote at a table so placed that no other person can see such member while putting the mark “X” in the place provided for the purpose in the ballot paper opposite the names of the candidate for whom he intends to vote, folds it up and inserts it into the ballot box; (d) If member is unable to write or is physically incapacitated from voting, the Presiding Officer shall, at the request of such member, take him to record his vote to the table so placed, ascertain his choice and accordingly mark the ballot paper, fold it up and insert it into the ballot box. The Presiding Officer shall cause such arrangements to be made as to ensure secrecy of the ballot paper.

(8) Immediately after the voting is over, the Presiding Officer shall open the ballot box in the presence of the members present, take out the ballot paper therefrom, count them and record the number thereof in Form 4. The Presiding Officer shall reject any ballot paper if:-

(a) it bears the signature of the voter or contains any word or sign or visible representation by which such voter can be identified; or (b) the mark “X” is placed against the name or more than one candidates than the seats allotted to be filled by such election; or ( c) the mark “X” is so placed thereon as to make it doubtful for which candidate vote was intended to be given; or (d) it does not bear the signature of the Presiding Officer. (9) After the completion of counting and recording the members of votes received by each candidate, the Presiding Officer shall declare in Form 5 as many candidates as the number of members to be elected from the Municipalities and Zilla Panchayat concerned of the district to whom the largest number of votes has been given, to be duly elected at the election. (10) The Presiding Officer shall forward the names of the elected members of the District Planning Committee to the Prescribed Authority, who shall publish the same in the Official Gazette. (11) The Forms and other papers relating to the election of member of the District Planning Committee shall be sent by the Presiding Officer to the Prescribed Authority for safe custody. The Prescribed Authority shall keep the papers in safe custody for six months after which these Forms and paper shall be destroyed in such manner as the Prescribed Authority may deem fit.

Resignation

of Member 4. The member of a District Planning Committee may resign from his office by submitting his resignation in writing of his intention to do so to the Prescribed Authority. Such resignation having been accepted, the member shall vacate his office and casual vacancy shall be deemed to have occurred in such office.

Provided that a person tendering resignation may withdraw his resignation before it is accepted by the Prescribed Authority.

Removal of

Member 5. (1) The Prescribed Authority may, after giving an opportunity to a member of a District Planning Committee to show cause against the action proposed to be taken against him, by order remove him from office if :-

(a) after his election he is convicted by a criminal court of an offence involving moral turpitude punishable with imprisonment for a period of more than six months; or

(b) he is removed from membership of a Zilla Panchayat or Urban Local Bodies concerned of the district; or

(c) he absents himself from three consecutive meetings of the District Planning Committee without the leave of the District Planning Committee. (2) Any member of District Planning Committee who is removed from office by the Prescribed Authority under sub rule (1) of Rule 5 may, within a period of thirty days from the date of the order, appeal to such authority, as the State Government may by notification, appoint on this behalf. The authority so appointed may stay the operation of the order till the disposal of the appeal and may, after giving notice of appeal to the Prescribed Authority, and after giving the appellant an opportunity of being heard, modify, set aside or confirm the order. (3) The order passed by such authority on such appeal shall be final.

Filling up of

casual vacancy

in place of a

member of

District Planning

Committee 6. If the office of a member of a District Planning Committee becomes vacant by reason of his death, resignation, removal or otherwise, such vacancy shall be filled in by election of another person under these rules. The person elected shall take office forthwith and shall hold such office till the term of his predecessor.

Office, Quorum

and Meeting of the

District Planning

Committee 7. (1) The Office of the District Planning Committee shall be in the Zilla Panchayat Bhavan of the concerned district.

(2) The meeting of the District Planning Committee shall be held in every three months in a year.

(3) The quorum for a valid meeting of the District Planning Committee

shall be two-thirds of its members.

(4) The Chairman, District Planning Committee, who is the Adhakshya of the concerned Zilla Panchayat shall obtain plan proposal from all Gram Panchayat and Municipalities within the district and after consolidating the same prepare a draft plan for the district.

(5) As soon as may be after the preparation of draft plan the Chairman

shall call a meeting of the District Planning Committee intimating each member by a notice indicating therein the date, time venue and agenda of such meeting.

(6) In the absence of the Adhaksha in the meeting of the District Planning

Committee, the elected members of the Committee shall nominate a member from amongst themselves to preside as Chairman.

Allowance to

member 8. The members of the District Planning Committee shall be entitled to such sitting allowance from the concerned Zilla Panchayat Fund at similar rate as are admissible to the members of the Zilla Panchayat and Urban Local Bodies.

Proceeding not to

be vitiated by

any vacancy 9. The Proceedings of the District Planning Committee shall not be vitiated by any vacancy in its membership due to death or resignation of a member or delay in constitution of a Zilla Panchayat or Municipality, as the case may be, for the time being.

Term of

office 10. The term of Office of the members of the District Planning Committee shall expire with the term of the concerned Zilla Panchayat and Municipalities. However, the Government may extend such term by notification till a new District Planning Committee is constituted.

Power and

Function of the

District Planning

Committee 11. The District Planning Committee shall consolidate the plans prepared by the Gram Panchayats, the Zilla Panchayats, the Nagar Panchayats and the Municipal Corporation in the District and prepare draft development plans for the district as a whole.

1. Every District Planning Committee shall, in preparing the draft development plans:- a). having regard to :-

i). matters of common interest between the Panchayats and Municipalities including the spatial planning, sharing of water and other physical and natural resource, the integrated development of infrastructure and environment conservation;

ii). The extent, type of available resources whether financial or otherwise. b). Consult such institutions and organization as the government may, be order, specify.

2. The Chairman of every District Planning Committee shall forward

the development plan, as recommended by the District Planning Committee, to the State Government for consideration, approval and implementation.

3. The District Planning Committee shall review the progress of

approval and implementation of the development plan.

4. The District Planning Committee shall represent the Panchayats and Municipalities in meetings and matters related to the development plans.

It will be applicable for reading taken for electricity consumption on or after 01.04.2012. The rates of charges, conditions of supply and other matters specified in the schedule annexed hereto shall replace the existing rates and charges and corresponding provisions in the existing schedule and in the existing agreement, if any, with the Energy & Power Department, Government of Sikkim with effect from01.04.2012. Notification

In exercise of the powers conferred by section 16 of Sikkim Allotment of House Sites and

Construction of Building (Regulation and Control) Act, 1985, (11 of 1985), the State Government

hereby makes the following rules namely:-

Short title, 1. (1) These rules may be called the Sikkim State Site

extent and Allotment Rules, 2012.

commencement. (2) They shall extend to the whole of Sikkim.

(3) They shall come into force at once.

Definitions. 2. (1) In these rules, unless the context otherwise requires:-

(a) “Act” means the Sikkim Allotment of House Sites and

Construction of Building (Regulation and Control) Act, 1985;

(b) “Allotment “ means allotment of sites for construction of building

for the purpose of residence, commerce, residential-cum-

commercial or any other trade or industry;

(c) “Building” includes a house, out-house, stable, privy, urinal, side

wall (other than a boundary wall, not exceeding ten feet in height )

and any other such structure whether of masonry or, bricks,

wood, mud, metal or any other material whatsoever, and includes

any temporary shed erected on ceremonial or festive occasions;

(d) “Commercial Areas” means an area designated for display and

sale of merchandise such as shops, stores, markets etc, either

wholesale or retail, banking and financial institutions, private

business houses and professional establishments of doctors,

dentists, tailors etc. beauty parlour, barber shops, news-stands,

milk booths, lunch counters and restaurants;

(e) “Family” means applicant’s wife or husband as the case maybe,

minor children and also includes major children living jointly with

the parents;

(f) “Government” means the Government of Sikkim in the Urban

Development and Housing Department and any other Department

as may be authorised by the Government for carrying out the

purpose of this Act;

(g) “Industrial Areas” means an area designated for industrial use

where products or materials of all kinds and properties are

fabricated, assembled or processed e.g., Workshops, Assembly

Plants, Laboratories, Handicrafts, Laundries, Dairies, Saw Mills,

Power Plants etc;

(h) “Institutional Areas” means an area designated for Institutional

use. Buildings and structures under this shall include hospitals,

clinics, homes for the aged, orphanages, colleges, schools,

offices, etc;

(i) “Notified area” means any area notified for purpose of Chapter II

and III of Sikkim Allottment of House Sites and Construction of

Building (Regulation and Control) Act, 1985;

(j) “Notification” means a notification published in the Official Gazette;

(k) “Notified green belt” means the green belt area notified by the

Government and includes such other area which may be so

declared by the Government by notification, from time to time;

(l) “Person with disability or physically challenged” means a person

with a condition or function judged to be significantly impaired

relative to the usual standard of an individual or group. It refers

to individual functioning, including physical impairment, sensory

impairment, cognitive impairment, intellectual impairment mental

illness, and various types of chronic disease;

(m) “Residential Areas” means an area designated for buildings

used for sleeping accommodation or normal residential

purposes;

(n) “Residential cum Commercial Areas” means an areas which has

usage of both commercial and residential as defined above;

(o) “Reserved Category” mean persons falling under Economically

Weaker Section of the society, physically handicapped persons,

victims of natural calamities and people with exemplary records

in the area of Art, Science and Sports;

(p) “Salami” means the amount payable by a person for allotment of

a site under the provision of this Act but does not include ground

rent or other rates, taxes or fees payable under the Act or other

law in force in this State;

(2) Words and expressions used in these rules and not defined in the

rules but defined in the Act shall have the same meaning respectively

assigned to them in the Act.

Mode of 3. (1) Site allotment shall be made primarily for the purpose of allotment.

constructing a residential building in the designated residential

areas only as under, namely:-

(i) in Commercial Areas: by auction/tender;

(ii) in Institutional Areas: by auction/tender;

(iii) in Industrial Areas: by auction/tender;

(iv) in Residential Areas: by lottery system as per specific

reservation category;

(v) in Residential cum Commercial Areas: by lottery system as

per specific reservation category;

(2.) All the eligible applicants shall be considered for allotment through

a draw based on random number technique. The draw shall be

held in the presence of panel of observers.

Eligibility 4. (1) The applicant must possess Sikkim Subject or Certificate of

Identification.

(2) He /She should have attained the age of majority. For this an

applicant should have completed 18 (eighteen) years of age on the

date of filing of the application for allotment of site.

(3) The applicant must not own any residential flat or in part or on lease hold

or free hold basis in the urban area of Sikkim in his/her wife/husband

or in the name of his/her minor or dependent children within the

notified urban area/ municipal area.

(4) One person can submit one application only.

(5) A person who has already been allotted a plot by the Government or any

other land owning department shall not be eligible to apply for another

Government site.

Reservations 5. The details of reservations under this rule shall be as under namely:-

(1) Thirty three percent (33%) of the site area will be reserved for

Economically Weaker Section (EWS) of the society, physically

handicapped persons, victims of natural calamities and people with

exemplerary records in the area of Art, Science and Sports.

(2) Sixty seven percent (67%) of sites for all other possessing

Certificate of Identification or Sikkim Subject Certification.

(3) In case of number of sites in respect of reserved category comes

to fraction i.e., less than 0.5 it would rounded off to zero and if it is

0.5 or more it would be rounded off to one.

Procedure for 6. (1) Any person applying for a site under these rules shall deposit

application registration fee of Rs 5000/- (Rupees five thousand only) by a single

banker’s cheque/ demand draft of State Bank of Sikkim drawn in

favour of Urban Development and Housing Department payable at

Gangtok, Sikkim. In case of reserved category, registration fee of Rs

2500/- ( Rupees two thousand five hundred only) shall be deposited.

(2) The banker’s cheque / demand draft shall be presented along with the

application form and documents completed in all respects to the Town

Planner on working days during the currency of the scheme.

(3) Application forms will not be accepted after the date of closure. In

case it is found at any stage that the dates of issue of payment of

instrument is after the closure of the allotment scheme, such

applications would be summarily rejected and the applicant would be

solely responsible for this. Urban Development and Housing

Department shall not entertain such application in draw of lots.

(4) The application form shall be signed by the applicant himself, who

desires to get a site under the scheme. No applicant shall make

any cutting, erasing or overwriting in the application. In case a person

desires to make changes, it is advised to obtain and fill up a fresh

application.

(5) No conditional application form will be considered. Incomplete application

forms shall be rejected summarily without conveying any reason to the

applicant.

Documents to 7. (1) For all categories:

be submitted The applicant shall furnish the following documents along with the

(ii) proof of residence namely attested copy of passport or identity

card or election card or ration card or driving license or telephone

(iii) no landed property certificate of the applicant and family

members issued by the District Collectorate;

(iv) affidavit stating that the facts mentioned in the application form

is correct and that legal action can be taken against him/her for

misrepresentation of facts;

(v) in case of a woman applicant, certificate of marital status (if she

claims to be single) or Sikkim Subject Certificate or Certificate of

Identification of her spouse (if she is married);

(2) For reserved category:

(a) In addition to sub rule (1) above, persons applying under any of

the reserved categories;

(i) shall submit an attested copy of the original certificate from the District

Collector of the area concerned in case the applicant belongs to the

reserved category of economically weaker section;

(ii) shall submit an attested copy of the original certificate issued

by the Social Welfare Department, Government of Sikkim in case

the applicant is applying under the reserved category of physically

challenged persons;

(iii) shall submit an attested copy of the original certificate from the

District Collector in case the applicant is a victim of natural

calamity;

(iv) should have represented the State at the national and

international levels and won at least one medal or have been

bestowed with a national (sports) award in the area of sport;

(v) should have been bestowed with at least one national or

international award by the Government in the area of art and

science;

(b) The applicant who fails to submit the requisite documents will

not be considered for allotment under the reserved category and

will be treated as general category.

Procedure 8. (1) On being selected as a beneficiary for allotment, the proposal

for allotment order may be collected from Urban Development and Housing Department

within 45 (forty five) days from the date of result of the draw, which

shall be displayed in the Departmental Notice Board failing which the

allotment shall stand cancelled.

(2) The allottee shall deposit the site salami within 90 (ninety) days from

the date of issue of the proposal order failing which the allotment shall

stand cancelled.

(3) For the Economically Weaker Section the period of payment of

site salami shall be 180 (hundred and eighty) days.

(4) If the payment is not made within the stipulated period, allotment of the

site will be automatically cancelled. No show cause notice/intimation

will be given for cancellation. No time extension for payment beyond

the date of automatic cancellation shall be given. Also no restoration is

allowed once the site is automatically canceled due to non-payment.

Status of 10. (1) All allotments shall be made on lease hold basis.

allottee (2) In order to ensure that the concessional provisions meant for the

persons with disability and Economically Weaker Sections do not

lead to misuse or speculation, the letter of allotment of such sites

would specifically state that the transfer of the site prior to ten

years from the date of execution of the lease deed would result in

automatic cancellation of the site. However the Lease deed can be

be transferred to the names of the family members if the allottee

has expired.

Surrender and 11. (1) The successful applicants shall have the option to surrender the

cancellation sites before and after the issue of the allotment order. Sites will

be automatically cancelled if payments are not made within the

prescribed period. No show cause notice shall be issued for the

purpose. The site salami deposited is refundable without any interest.

(2) Following documents shall be submitted for refund in case of

surrender/cancellation namely:-

(i) original allotment order and proposal order issued by Urban

Development and Housing Department in respect of allotted site;

(ii) proof of residence in case there is change of address as

given in the application form;

(iii) copy of the payment made;

(iv) any cancelled /surrendered site shall be advertised in future as a

part of future allotment and allotment procedure shall be

the same as for fresh advertisement and allotment;

(vi) in case the site is cancelled automatically as stated above,

refund shall be made and no interest would be paid on amount

deposited;

Mortgage / 12. The allottee can avail housing loan by mortgaging the site with availing

loan prior approval of Government. Terms and conditions of the

mortgage loan shall be submitted for perusal and consideration

of the Government before approval is accorded. No Objection

Certificate to mortgage the site will be issued only once by the

Department.

Submission of plan 13. The allottee shall submit Blue Print Plan within six months for

approval, after execution of the lease deed. The Blue Print Plan

shall be prepared in accordance with the Building Bye Laws.

Cancellation of site 14. (1) If the construction is not taken up within a year from the date of issue

of the Construction Order, the allotment shall be automatically

cancelled. A show cause notice shall be served before

cancellation. In exceptional cases the above period may be

extended up to two years and not beyond.

(2) The sites allotted under this Act and Rules may be cancelled on

grounds of fraud, misrepresentation of facts or any official mistake.

(3) The site salami deposited shall be refundable without interest in

such a case of cancellation.

Size of the 15. The size of the allotted sites shall be as under, namely:-

allotted sites (1) Maximum size of allotted site for residential use: 1200sft.

(2) Minimum size of allotted site for residential use: 500sft.

(3) All setbacks will be maintained in the local area plan prior

to allotment.

Temporary 16. (1) The Government shall not give temporary permission to any permission

individual, organization, etc for the construction of Pan Ghumti,

parking garages, stores, etc.

(2) Sites already allotted on temporary basis prior to these rule shall not

be transferred to a family member or third party.

(3) Sites already allotted on temporary basis shall not be renewed after

expiry of the designated period/lease and shall be handed back to the

Government.

(4) On demise of the person who has been allotted a temporary site, the

same shall be handed back to the Government.

Allotment of 17. (1) If for reasons of structural stability or genuine difficulties arising

additional sites. due to the land profile, it becomes necessary to allot additional

area, it may be done only for the said reason and not exceeding

the area required for stabilization of the building. The additional

area shall not exceed fifty percent of the initially allotted site. This

permission shall be given only once.

(2) It is further subject to the condition that no additional allotment

will be made on public gullies, public open spaces, etc or as

indicated in the local area plan.

Regularization 18. (1) The Government may make only one time regularization of

of unauthorized unauthorized construction based on the merit of the case. Any

construction. other unauthorized construction shall not be regularized and

will be liable for demolition.

Regularization of 19. (1) The Government may consider regularization of occupied

occupied sites. site on the following grounds on payment of regularization

fees as specified from time to time:-

(i) the site should be in the occupancy of the applicant for twenty

years or above;

(ii) the applicant should fall under Economically Weaker Section

category;

(iii) the applicant must be a Sikkim Subject or Certificate of

Identification holder;

(iv) the applicant must not own any residential flat or plot in full

or in part on lease hold or free hold basis in the notified

urban or municipal area of Sikkim in his/ her own name or in

the name of his/her wife/husband or in the name of his/her

minor or dependent children;

Restriction on 20. (1) No sites shall be allotted in the notified Green Belt Area.

allotment of site (2) No sites shall be allotted on land having a gradient of /additional

site 70 degree and above.

(3) No sites shall be allotted in land slide prone areas and sinking

areas.

(4) A minimum setback of 10’0” shall be maintained from the edge

of the jhora while allotting sites.

(5) A minimum setback of 50’0” shall be maintained from the edge

of the river bank while allotting sites.

(6) No sites shall be allotted below and / or near the high

transmission lines and towers. Setbacks as per the norms of

Energy and Power Department are to be followed.

(7) No sites shall be allotted over public footpath, public

drains, parking spaces and jhoras etc.

Change of building 21. (1) Change of building use and land use shall be in accordance

use/ land use. to the master plan / local area plan and conversion charges

specified by the Government from time to time.

Allotment of land 22. (1) Should a Department other than Urban Development and

by other Housing Department consider allotting sites in the urban/

Departments. municipal area, the same shall be intimated to Urban

Development and Housing Department for it to initiate the

process for allotment as per the rules. On scrutiny of the matter

Urban Development and Housing Department shall submit a

proposal to the concerned Department for transfer of land

accordingly and allotment shall be as per these rules.

Transfer of 23. (1) Transfer of lease deed shall be in accordance with the terms

lease deed. and condition listed in the lease deed.

(2) Sub-leasing of flat / spaces constructed upon allotted site

shall not be permitted.

(3) Transfer of Lease deed shall not take place on vacant land.

Development 24. (1) In case the Department carries out the land development work,

charges. such cost will be borne by the allottee of sites.

NOTIFICATION

In exercise of the powers conferred by section 16 of Sikkim Allotment of House Sites and

Construction of Building (Regulation and Control) Act, 1985, (11 of 1985), the State Government

hereby makes the following rules namely:-

Short title, 1. (1) These rules may be called the Sikkim State Site

extent and Allotment Rules, 2012.

commencement. (2) They shall extend to the whole of Sikkim.

(3) They shall come into force at once.

Definitions. 2. (1) In these rules, unless the context otherwise requires:-

(q) “Act” means the Sikkim Allotment of House Sites and

Construction of Building (Regulation and Control) Act, 1985;

(r) “Allotment “ means allotment of sites for construction of building

for the purpose of residence, commerce, residential-cum-

commercial or any other trade or industry;

(s) “Building” includes a house, out-house, stable, privy, urinal, side

wall (other than a boundary wall, not exceeding ten feet in height )

and any other such structure whether of masonry or, bricks,

wood, mud, metal or any other material whatsoever, and includes

any temporary shed erected on ceremonial or festive occasions;

(t) “Commercial Areas” means an area designated for display and

sale of merchandise such as shops, stores, markets etc, either

wholesale or retail, banking and financial institutions, private

business houses and professional establishments of doctors,

dentists, tailors etc. beauty parlour, barber shops, news-stands,

milk booths, lunch counters and restaurants;

(u) “Family” means applicant’s wife or husband as the case maybe,

minor children and also includes major children living jointly with

the parents;

(v) “Government” means the Government of Sikkim in the Urban

Development and Housing Department and any other Department

as may be authorised by the Government for carrying out the

purpose of this Act;

(w) “Industrial Areas” means an area designated for industrial use

where products or materials of all kinds and properties are

fabricated, assembled or processed e.g., Workshops, Assembly

Plants, Laboratories, Handicrafts, Laundries, Dairies, Saw Mills,

Power Plants etc;

(x) “Institutional Areas” means an area designated for Institutional

use. Buildings and structures under this shall include hospitals,

clinics, homes for the aged, orphanages, colleges, schools,

offices, etc;

(y) “Notified area” means any area notified for purpose of Chapter II

and III of Sikkim Allottment of House Sites and Construction of

Building (Regulation and Control) Act, 1985;

(z) “Notification” means a notification published in the Official Gazette;

(aa) “Notified green belt” means the green belt area notified by the

Government and includes such other area which may be so

declared by the Government by notification, from time to time;

(bb) “Person with disability or physically challenged” means a person

with a condition or function judged to be significantly impaired

relative to the usual standard of an individual or group. It refers

to individual functioning, including physical impairment, sensory

impairment, cognitive impairment, intellectual impairment mental

illness, and various types of chronic disease;

(cc) “Residential Areas” means an area designated for buildings

used for sleeping accommodation or normal residential

purposes;

(dd) “Residential cum Commercial Areas” means an areas which has

usage of both commercial and residential as defined above;

(ee) “Reserved Category” mean persons falling under Economically

Weaker Section of the society, physically handicapped persons,

victims of natural calamities and people with exemplary records

in the area of Art, Science and Sports;

(ff) “Salami” means the amount payable by a person for allotment of

a site under the provision of this Act but does not include ground

rent or other rates, taxes or fees payable under the Act or other

law in force in this State;

(2) Words and expressions used in these rules and not defined in the

rules but defined in the Act shall have the same meaning respectively

assigned to them in the Act.

Mode of 3. (1) Site allotment shall be made primarily for the purpose of allotment.

constructing a residential building in the designated residential

areas only as under, namely:-

(vi) in Commercial Areas: by auction/tender;

(vii) in Institutional Areas: by auction/tender;

(viii) in Industrial Areas: by auction/tender;

(ix) in Residential Areas: by lottery system as per specific

reservation category;

(x) in Residential cum Commercial Areas: by lottery system as

per specific reservation category;

(2.) All the eligible applicants shall be considered for allotment through

a draw based on random number technique. The draw shall be

held in the presence of panel of observers.

Eligibility 4. (1) The applicant must possess Sikkim Subject or Certificate of

Identification.

(2) He /She should have attained the age of majority. For this an

applicant should have completed 18 (eighteen) years of age on the

date of filing of the application for allotment of site.

(3) The applicant must not own any residential flat or in part or on lease hold

or free hold basis in the urban area of Sikkim in his/her wife/husband

or in the name of his/her minor or dependent children within the

notified urban area/ municipal area.

(4) One person can submit one application only.

(5) A person who has already been allotted a plot by the Government or any

other land owning department shall not be eligible to apply for another

Government site.

Reservations 5. The details of reservations under this rule shall be as under namely:-

(4) Thirty three percent (33%) of the site area will be reserved for

Economically Weaker Section (EWS) of the society, physically

handicapped persons, victims of natural calamities and people with

exemplerary records in the area of Art, Science and Sports.

(5) Sixty seven percent (67%) of sites for all other possessing

Certificate of Identification or Sikkim Subject Certification.

(6) In case of number of sites in respect of reserved category comes

to fraction i.e., less than 0.5 it would rounded off to zero and if it is

0.5 or more it would be rounded off to one.

Procedure for 6. (1) Any person applying for a site under these rules shall deposit

application registration fee of Rs 5000/- (Rupees five thousand only) by a single

banker’s cheque/ demand draft of State Bank of Sikkim drawn in

favour of Urban Development and Housing Department payable at

Gangtok, Sikkim. In case of reserved category, registration fee of Rs

2500/- ( Rupees two thousand five hundred only) shall be deposited.

(2) The banker’s cheque / demand draft shall be presented along with the

application form and documents completed in all respects to the Town

Planner on working days during the currency of the scheme.

(3) Application forms will not be accepted after the date of closure. In

case it is found at any stage that the dates of issue of payment of

instrument is after the closure of the allotment scheme, such

applications would be summarily rejected and the applicant would be

solely responsible for this. Urban Development and Housing

Department shall not entertain such application in draw of lots.

(4) The application form shall be signed by the applicant himself, who

desires to get a site under the scheme. No applicant shall make

any cutting, erasing or overwriting in the application. In case a person

desires to make changes, it is advised to obtain and fill up a fresh

application.

(5) No conditional application form will be considered. Incomplete application

forms shall be rejected summarily without conveying any reason to the

applicant.

Documents to 7. (1) For all categories:

application (i) attested copy of Sikkim Subject Certificate (SSC) / Certificate of

(ii) proof of residence namely attested copy of passport or identity

card or election card or ration card or driving license or telephone

(iii) no landed property certificate of the applicant and family

members issued by the District Collectorate;

(iv) affidavit stating that the facts mentioned in the application form

is correct and that legal action can be taken against him/her for

misrepresentation of facts;

(v) in case of a woman applicant, certificate of marital status (if she

claims to be single) or Sikkim Subject Certificate or Certificate of

Identification of her spouse (if she is married);

(2) For reserved category:

(a) In addition to sub rule (1) above, persons applying under any of

the reserved categories;

(vii) shall submit an attested copy of the original certificate from the

District Collector of the area concerned in case the applicant belongs

to the reserved category of economically weaker section;

(viii) shall submit an attested copy of the original certificate issued

by the Social Welfare Department, Government of Sikkim in case

the applicant is applying under the reserved category of physically

challenged persons;

(ix) shall submit an attested copy of the original certificate from the

District Collector in case the applicant is a victim of natural

calamity;

(x) should have represented the State at the national and

international levels and won at least one medal or have been

bestowed with a national (sports) award in the area of sport;

(xi) should have been bestowed with at least one national or

international award by the Government in the area of art and

science;

(b) The applicant who fails to submit the requisite documents will

not be considered for allotment under the reserved category and

will be treated as general category.

Procedure 8. (1) On being selected as a beneficiary for allotment, the proposal

for allotment order may be collected from Urban Development and Housing Department

within 45 (forty five) days from the date of result of the draw, which

shall be displayed in the Departmental Notice Board failing which the

allotment shall stand cancelled.

(2) The allottee shall deposit the site salami within 90 (ninety) days from

the date of issue of the proposal order failing which the allotment shall

stand cancelled.

(3) For the Economically Weaker Section the period of payment of

site salami shall be 180 (hundred and eighty) days.

(4) If the payment is not made within the stipulated period, allotment of the

site will be automatically cancelled. No show cause notice/intimation

will be given for cancellation. No time extension for payment beyond

the date of automatic cancellation shall be given. Also no restoration is

allowed once the site is automatically canceled due to non-payment.

Payment of 9. (1) The Government shall by notification fix different rates of site

percent (50%) of the total site salami applicable for general category

Status of 10. (1) All allotments shall be made on lease hold basis.

allottee (2) In order to ensure that the concessional provisions meant for the

persons with disability and Economically Weaker Sections do not

lead to misuse or speculation, the letter of allotment of such sites

would specifically state that the transfer of the site prior to ten

years from the date of execution of the lease deed would result in

automatic cancellation of the site. However the Lease deed can be

be transferred to the names of the family members if the allottee

has expired.

Surrender and 11. (1) The successful applicants shall have the option to surrender the

cancellation sites before and after the issue of the allotment order. Sites will

be automatically cancelled if payments are not made within the

prescribed period. No show cause notice shall be issued for the

purpose. The site salami deposited is refundable without any interest.

(2) Following documents shall be submitted for refund in case of

surrender/cancellation namely:-

(i) original allotment order and proposal order issued by Urban

Development and Housing Department in respect of allotted site;

(ii) proof of residence in case there is change of address as

given in the application form;

(iii) copy of the payment made;

(iv) any cancelled /surrendered site shall be advertised in future as a

part of future allotment and allotment procedure shall be

the same as for fresh advertisement and allotment;

(xii) in case the site is cancelled automatically as stated above,

refund shall be made and no interest would be paid on amount

deposited;

Mortgage / 12. The allottee can avail housing loan by mortgaging the site with availing

loan prior approval of Government. Terms and conditions of the

mortgage loan shall be submitted for perusal and consideration

of the Government before approval is accorded. No Objection

Certificate to mortgage the site will be issued only once by the

Department.

Submission of plan 13. The allottee shall submit Blue Print Plan within six months for

approval, after execution of the lease deed. The Blue Print Plan

shall be prepared in accordance with the Building Bye Laws.

Cancellation of site 14. (1) If the construction is not taken up within a year from the date of issue

of the Construction Order, the allotment shall be automatically

cancelled. A show cause notice shall be served before

cancellation. In exceptional cases the above period may be

extended up to two years and not beyond.

(4) The sites allotted under this Act and Rules may be cancelled on

grounds of fraud, misrepresentation of facts or any official mistake.

(5) The site salami deposited shall be refundable without interest in

such a case of cancellation.

following charges for the deployment of Police personnel of various ranks for the protection of a

person or his property or for the organization of an event or for the execution of any work by the

competent authority including traffic management, namely:-

(1) Sub-Inspector - Rs. 1800/- per day

(2) Assistant Sub-Inspector - Rs. 1200/- per day

(3) Head Constable - Rs. 1100/- per day

(4) Naik/Lance Mark/Constable - Rs. 1000/- per day

(5) Home Guard - Rs. 250/- per day

2. The charges shall be deposited in the State Bank of Sikkim under Revenue Head “0055-

Police 101-Police supplied to other Government”.
