General Information & Instructions to the A pplicant

1. Brief about the project:-1.1 Ja ipur Developm ent A uthor i ty , Ja ipur intends to con s truc t sewerage and

Industrial effluent treatment plant (2 MLD S TP, 1MLD ETP) & O& M for 5 years atone location at Kartarpura Nallah on Sahkar m arg to treat water for reuse.

1.2 It is proposed to treat the open drain water of Kartarpura N allah near SahkarMarg by constructing STP of capacity 2 ML D and by constructing CETP ofcapaci ty 1 M LD to t reat mixture of sewage and Industr ial Eff luent ofSudarshanpura Industrial Area including O& M for 5 years.

The treatment plant can be a com bined unit or 2 separate parallel units.Some of such components can be kept common.

The plant site is located along the road between Sahkar Marg and Railwayline (to Delhi) in JDA land near Imli Phatak Railway Crossing.

The purpose of the treatment plant is to reuse waste water after treatmentfor horticulture works, washing railway wagons/bogies etc.

The op eration and maintenance period after construction of the plant is 5years.

The technology for treatment should be flexible to accommodate change ininput quality of Effluent especially in case of ETP.

The technology should be latest, proven and cost effective.2. BID PROCEDURE

2.1 Bid docum ent can be purchased from the office of Executive Engineer PHE -I,JDA , Jaipur Room No. 135, Ma in Building, Indira Circle, JLN M arg, Jaipurby deposi ting the D emand Draf t in favor of Secre tary , JDA am ount to Rs.1000/- or can be dow nloaded f rom JDA websi te www .ja ipur ida .org. Theapplicant will have to deposit the DD of Rs. 1000/- at the tim e of subm issionof bid. Two envelope system wou ld be adopted, Envelope-I being technical bidand Envelope-II being financial bid. Each envelope should be sealedseparately and subscribed as Envelope-I "Technical Bid" and Envelope-II"Financial Bid" . Both en velopes wou ld be placed in thi rd envelope dulysea led bear ing the nam e of a ppl icant. In this thi rd envelope , envelope ofearnest mone y (DD of Rs.25000/-) and bid cost (DD of Rs. 1000/-) in favorof Secretary, JDA, Jaipur if docum ent is downloaded from internet should bekept.

2.2 The bid shall be submitted to the office of Ex ecutive Engineer PHE-I on or

before the time specified i.e 3.00 pm on 15.3.13.2.3 The Technical Bid would be opened on 15.03.2013 at 3:30 pm of bidders

whose earnest money and bid cost (if downloaded) are found to be in order.2.4 The Technical Bid would be opened in the Chamb er of Superintending

Engineer-5, JDA, Jaipur.2.5 The F inancial Bid would be op ened on ly of those bidders who fulfill all thepost qualification criteria. The date and time of opening of financial bid shall

be intimated.3. CRITERIA3.1 The applicant should have successfully done the consultancy work of similar

nature of work like consultancy of Sew age Treatm ent Plant/ EffluentTreatment Plant/ combination of both Treatment Plant for any G ovt./SemiGovt. Department.

3.2 Com pletion of at least one project of value not less than Rs.5.0 crore in whichthe consultancy work was don e by the bidders.

3.3 Annual Turnover n ot less than 25 lacs.3.4 The above information m ust be supported with docum ents/ Certificate issued

by com petent authority not below rank o f Executive engineer. The documentsshall be duly attested by notary public.

3.5 Affidavit in the form of Annexure -I (To be given on Non-Judicial stamp Paperof Rs. 10/- only, duly attested by Oath-Commissioner/Notary Public)

4. Scope of Work

4.1 Collect ing sam ple of sewag e & industrial Effluent and get i t tested from anyrecognized laboratory/ any G ovt. Department.

4.2 Preliminary design giving technical parameters.4.3 Preparat ion of Gen eral arrangem ent draw ing as per site condi t ions/

measurements with tentative dimensions/ parameters4.4 Preparation of DPR giving the technology to be adopted and cost estimates based

on current rates.4.5 Preparation of tender documen ts.4.6 Preparation of O&M manuals4.7 Modification in design/tender documents etc if required by the department shall

have to be done without any additional cost.4.8 Assisting in evaluation of tenders and selection of executing agency.5. REPORTS TO BE SUBMITTED BY THE CONSULTANTThe consultant shall furnish to the Client reports and documents strictly in given time.The draft repo rts can be subm itted in single copy bu t the final report shall besubmitted in 3 copies with soft copy of all the documents, report and drawings etc.

CONDITIONS OF CONTRACT

1. PROGRAMME OF THE WORKTime is the essence of the contract and it shall be clearly understood that theconsultant is bound to complete the w ork in all respects within the timespecified.The tender program me of w ork shall include a progress schedule of the jobsmen tioned in the scope of work w hich shall be related to the total timeprescribed for the completion.This progress schedule, after modification, if any, during the progress of seekingclarification while examining the tender, shall form a part of the contract.The present schedule may be amended as and when necessary by agreementbetween the Engineer-In-Charge and the con sultant within the limitation of timeimposed by the contract.The acceptance of the above programm e by the Engineer-In-Charge shall notrelieve the consultant of any of his respon sibility to comp lete the whole of theworks by prescribed time or extended time, if any.In order to monitor the progress of w ork, the Engineer-In-Charge shall be givenby the consultant on every Monday.

2. EXTENSION OF TIMEIf the consultant shall desire an extension of time for com pletion of the work o nthe grounds of his having been unavoidably hindered due to reasons begon e hiscontrol, he shall apply in writing to the Executive En gineer (PHE -I), JDA , Jaipurwithin 5 days of the date of the h indrance on account of w hich he desires suchextension as aforesaid or other duly authorized ground have been shown therefor , authorized such ex tension of t ime, if any, as ma y, in his opinion b enecessary or proper.

3. SUB LETTINGThe co ntract shall not be assigned or sub let without the written approval of theExecutive En gineer (PHE -I), JDA, Jaipur and if the con sultant shall assign orsublet his contract or attempt to do so, or becom e insolvent or comm ence anyinsolvency proceeding or m ake any com position with his creditors, or attempt todo, or if an y bribe, gratuity, gift, loan, requisite reward or advan tage, pecuniaryor otherw ise, shall either directly or indirectly be given, promised o r agents toany public officer or person in the employ of G overnm ent in any way relating tohis office or em ployment, or if any such officer or person shall become in anyway directly or indirectly interested in the contract, the Executive Engineer(PH E-I), JDA , Jaipur there-upo n by notice in writing rescind the contract, andthe security deposit of the con sultant shall there-upon stand forfeited and be

absolutely at the disposal of Executive Engineer (PH E-I), JDA, Jaipur and inaddition the consultant shall not be entitled to recover or be paid for a ny worktherefore actually performed under the contract.

4. SUSPENSION OF WORKThe consultant shall on the written order of the Engineer-In-Charge suspendthe progress of the consultancy work or any part thereof for such time or timesand in such manner as the Engineer-In-charge may consider necessary.If the suspension is orde red for no fault of the consultant, he sha ll be entitled toreasonable extension of time but no compensation of any kind whatsoever shallbe claimed.

5. WORK TO BE E XECUTED UNDER DIRECTION OF EXECUTIVE ENGINEER(PHE-I ), JDA, JAIPURAll the works to be executed under the contract shall be executed under thedirection and subject to be approval in all respects of the Executive Eng ineer(PHE-I), JDA , Jaipur for time being, who shall be entitled to direct at whatpoints and in what manner they are to be commenced and from time to timecarried on.

6. COMPENSATION FOR UNREASONABLE DELAYIf the consultant fails to complete the various jobs assigned to him as per thescope of the work in the given time, he is liable for compensation (% 1% per weekor such smaller amount as m ay be fixed, by the accepting authority on thecontract value.When delay in completion of the work/part work amounts to less than a weekthe compensation payable shall be proportional to the number of days involvedprovided that the total amount of com pensation for delay to be paid under thiscondition shall not exceed 10% of the contract value of the work.The am ount of compensat ion may be ad jus ted or se t o ff agains t any sumpayab le to the consultant under this or any other contract with the JDA ,Jaipur.The Engineer-In-charge shall keep a watch as to w hether the actual progress ofwo rk is as per the time schedu le and in case the consultant defaults inachieving progress on w orks at intermediate stage as per this schedule andcontinue to do so even after one month after a notice in writing from theEngineer-In-charge , the consultant will render himself liable to action asprovided above.

7. ARBITRATIONIf any qu estion, difference or objection what so ever shall arise in any way inconnection with or arising out of this instrument o r the mean ing of operation ofany p art thereof or the rights, duties or liabilities of either party, then save in sofar as the decis ion of any such m atter as herein before provided for and h asbeen so decided ev ery such m atter constituting a total claim of Rs. 5,000/- orabove, whether its decision has been finally decided accordingly or whether thecontract should be term inated. or has been rightly terminated as regard s therights or obligations of the parties as the result of such term ination shall bereferred for a djudication to a sole arbitrator to be app ointed as hereinafterprovided.For the purpose of appointing the sole arbitrator referred to above, the DirectorEngineering-I, JDA w ill on receipt of notice from the consultant, send a panel of2 names n ot below the rank of superintending Engineer and who shall all bepresently unconnected w ith the contract. The consultant shall on receipt of the

names as aforesaid select any one of the persons named, to be appointed as asole arbitrator and com municate his name to the Director Engineer-I, JDA,Jaipur. The Director Engineer-I, JDA shall thereupon appoint the said personas the sole arbitrator without delay. The arbitrator shall give reasons for award.Subject to the aforesaid, the provisions of the arbitration and conciliation Act,,1996 or any statutory modification or re-enactment thereof and the rules madethere under and for the time being on force shall apply to the arbitrationproceedings under this clause.

8. FINAL CERTIFICATION FORMW ithin 10 days after the full job is com pleted the consultant shall give notice ofsuch completion to the Engineer-In-charge and within thirty days of receipt ofsuch no t ice the Engineer-In-charg e af ter veri f icat ion shal l furnish theconsultant with a certificate indicating the date of com pletion. However, if in theopinion of the E ngineer-In-charge there are any jobs incomplete he shallintimate the consu ltant at the earl iest abou t the incom plete job. Neithercertificate of comp letion shall be issued nor shall the jobs mentioned in thescope of works are fully completed.

9. TERMINATION OF THE CONTRACT(For closure in full or in part due to amend ment or reduction in scope of w ork.)If at any time after accep tance of the tender, the Deptt. Decides to abandon o rreduce the scope of the works for any reasons w hat so ever, and hence notrequire the wh ole or any part of the wo rks to be carried out, the consultant shallhave no claim to any paymen t of compensation or other wish what so ever onaccount of any profi t or advantage w hich he might have derived from theexecution of the w orks in full but which he did not derive in consequ ence of thefore-closure of the whole or part of the w orks. The consultant shall be paid atcontract rate due amoun ts for the jobs comp leted.

10. CHANGE OF CONSTITUTION OF THE CONSULTING FIRMW here the consultant is a partnership firm, the prior line approv al in writing ofthe accepting authori ty shal l be obtained before any chan ges are m ade inconstitution or the firm.W here the consultant is an individual Hindu Undivided Fam ily businessconcern such approval as aforesaid shall likewise be obtained before theconsultant enters into any partnership agreement where under the partnershipfirm would have the right to carry out the works hereby un dertaken by theconsultant.If prior approva l as aforesaid is not obtained the contract shall be cancelled asprovided above.

11. INSTRUCTIONS AND NOTICESSubject as otherwise provided in this contract, all notices to be given on behalfof JDA and all other actions to be given on behalf may be given or taken by theEngineer-In-charge or any officer for the time being entrusted with thefunctions, duties and powers of the Engineer-In-chargeAll instructions, notice and comm unications etc. under the contract shall begiven in writing and if sent by registered post to the last known place of ab odeor business of the consultant shall be deemed to have been served on the datewhen in ordinary course of post these could have been delivered to him

12. RECOVERY FROM CONSULTANTWhenever any claim against the consultant for the payment of a sum of moneyarises out of or under the con tract the JDA shall be entitled to recover suchsum s by appro priating, in part or whole of the Sec urity deposit of theconsultant. In the event of the security being insufficient or if no security hasbeen taken then the balance of the total sum recoverable, as the case may be,shall be deducted from any sum then due or which at any time thereafter maybecome du e to the consultant under this or any other contract with the JDA.Should his sum be not sufficient to cover the full amount recoverable, theconsultant shall pay to the JDA on dem and the balance remaining due. TheJDA shall further have the right to effec t such recoveries under P.D.R. Act.

13. JURISDICTION OF COURTIn the event of any dispute arising between the parties here to in respect of anyof the matters com prised in this agreemen t, the same shall be settled by acompetent court having jurisdiction over the place w here agreement is executedat Jaipur and by no other court.
