    This is the overall theme and direction of FHWA to emphasize transportation system management and operations improving reliability, safety and security through what we have called 21st century operations using 21st century technology (ITS) We believe that to move in this direction, we need to establish TSM&O in Title23, identify and encourage the advancement of elements of a 21st century operating culture, and emphasize the need to measure the PERFORMANCE of the system and base transportation decision-making on the measured performance. This will result in outcomes:Mitigate congestionImprove freight production cargo tonnage double, Gateway (LA/Long beach) expected to tripleSave lives (40,000 killed annually)Enhance security (with DHS)In addition to building, additional transportation system capacity, we must also manage and operate the capacity that already exists.

    A 21st century operations culture is characterized by Proactive approach, Customer view, Regional system base, 24/7, Performance based, Real-time information and using ITS to do things differently that could not have been done without technology

    Contrast with current environment of Reactive approach, Public agency view, jurisdiction based, 8/5, output based, historical data

    Before I discuss Operations reauthorization, I want to introduce you to our program objectives. Understanding these objects will provide you with a basis to form a relationship between our program activities and our proposed reauthorization provisions.

    We have been and will continue to accelerate the deployment of ITS in an effort to enhance the performance of transportation systems through R&D, T2, Technical Assistance, Policy, Programs

    Through investigations and case studies conducted on areas that have implemented advanced operational systems, we have been able to identify some of the organizational arrangements necessary for effective operations.

    Our programs continue to investigate, develop, and disseminate new operational strategies and techniques that can enhance operational capabilities related to areas such as freeway management, arterial management, work zone management, incident management, emergency evacuations, freight management, and assessing the performance of the system.

    To increase the transportation communitys use of effective operations through technical and policy guidance, technical assistance, and training.

    Reauthorization objectives track program objectives and support:System reliability, safety, securityEstablishing a 21st Century culture and technology with the appropriate tools, mechanisms

    Our first objective is to establish a foundation for Transportation Systems Management and Operations.The philosophy behind this is to begin to make operating the system as important and visible as building and maintaining it.

    We have also proposed provisions that facilitate the implementation of various key elements that are believed to be essential to effective 21st Century operations. The provisions provide for specific actions concerning:establishment of monitoring capabilities on major highways establishing regional collaboration and coordination increasing resource flexibility, procurement flexibility, and operational flexibility

    In relation to Freight Management, provisions have been included to facilitate addressing freight more systematically and focus on the particular chokepoints and bottlenecks.

    To support the 21st Century technology needed to support 21st Century operations, a strong ITS research program and ITS deployment incentive program to underpin and enable advanced operations.

    To put all this into perspective, I have categorized the Transportation Systems Management and Operations reauthorization sections. The next few charts will offer brief descriptions of the individual initiatives under each category. Thereafter, well go a little deeper into each initiative and flesh-out the rationale and value each one brings to the bill.

    Establishing a foundation for TSM&O is parsed between many sections. The language proposed in section 1701 provides a TSM&O definition to differentiate it from other transportation alternatives. The definition readsThe term TSM&O means an integrated program to optimize the performance of existing infrastructure through the implementation of multi- and intermodal, cross-jurisdictional systems, services, and projects designed to preserve capacity and improve security, safety, and reliability of Federal-aid highways. (partial definition)

    Planning factors now include language that incorporates a requirement to consider operational improvements.

    In States and metropolitan areas, the Transportation Plan at a minimum shall contain operational and management strategies to improve performance, relieve congestion, and maximize the safety and mobility of people and goods.

    The provisions in section 5201 establish TSM&O as separate area of researchTo assist entities enhance system performance, Section 1701 encourages regional operations collaboration and coordination. (A KEY COMPONENT TO FOSTER OPERATIONS.) Regional operation collaboration and coordination activities that promote enhanced system performance at a minimum include:Regular interfacing between transportation system operators and public agencies in a State or metropolitan regionestablishing a system of basic real-time monitoring capability for the surface transportation systemdefining a regional operations strategy or concept of operationssharing of information between system operators and with travelersguiding in a regionally-coordinated manner, the implementation of regional transportation system management and operations initiatives such as emergency management, traffic incident management, traffic control, and traveler information systems delivery The provisions clarify the STP funding eligibility of these activities.Legislative provisions differentiate TSM&O from construction and provide the option of issuing new procurement guidance will provide procurement flexibility that will remove the burden of using a low bid approach that is not conducive when procuring technological systems.

    Provisions in section 1503 SPR include clarifying the eligibility of TSM&O planning activities. The TSM&O planning activities include support for Regional Operations Coordination and Collaboration activities.

    Sec. 1702 identifies the need for and encourages the establishment of nationwide capabilities to monitor in real time travel conditions on our nations major highways. It promotes the sharing of this information with State, local governments and the traveling public. Real-Time information supportsDay-to-day congestion managementTraveler information Evacuation in emergencyWeatherterroristThe requirements include language that instructs the Secretary to establish data exchange formats local, state, national- requires States to establish a statewide reporting systems to facilitate real-time reporting of transportation capacity curtailing or demand inducing events within 2 years relatively low cost potentially high impact- And requires that Real-time monitoring systems conform to the regional ITS architecture. Existing requirement Real-time monitoring system eligibility:- STP and or NHS funds eligible for the planning and deployment- State Planning and Research (SPR) funds only for the planning of Real-time monitoring systems.

    Section 1201 provisions establish a program to specifically address system preservation needs and traffic chokepoints. Only projects for system preservation, preventive maintenance, or operational improvements that are already eligible for funds through the Interstate Maintenance, NHS, and STP funding categories are eligible. In addition to the funding category eligibility, projects eligible for IPAM funds must also demonstrate that they will produce near-term performance benefits and support a near-term economic stimulus.

    The program provides $1 billion of funds for each fiscal year apportioned using the STP formula. Funds must be obligated within 6-months of apportionment or they will withdrawn and redistributed. Sec. 1610 allows States to exempt Low emission and energy efficient vehicles as defined as vehicles that meet EPAs Tier II standards, and have a fuel efficiency rating of 45 mpg or greater and deadheading or not-in-service transit vehicles from HOV requirements Sec. 1610 along with Sec.1615 also allows states to toll non-HOV vehicles using HOV facilities, otherwise known as HOT lanes; Agencies exercising HOV options must:Establish program participation, labeling, tolling;Continuously monitor system performance;Ensure performance of HOV lane or HOV system does not seriously degrade.

    - Section 1703 establishes the ITS Performance Incentives program. The program provides funding to States based on progress in achieving specific milestones directly related to the operational performance of the system.The funds will be apportioned to States per a funding formula developed by DOT based on:Reductions in delay due to incidentsImprovements in the operation and safety of signalized intersectionsReductions in delay and improvements in safety of work zones on the NHSImprovements in the efficiency and reliability of transit servicesOverall improvement in integrated regional transportation operationsImprovements in the quality and availability of traveler informationImproved crash notificationImprovements in the safety and productivity of commercial vehicle operations on the NHS Funding distributed by NHS formula until new formula developed phase in 3 years 100/0, 50/50. 25/75, 0/100 This Program replaces the ITS Integration program.$135 million/year

    Section 1704 continues the deployment of CVISN and advances both core and expanded deployments. (E-registration, electronic clearance, safety data exchange at roadside)

    Replaces Commercial Vehicle Infrastructure Program

    $25 million per year

    The legislation includes two grant types Core deployment grants and Expanded deployment grants. Core Deployment Grants can be used to support deployment of capabilities to establish the system. Expanded grants can be granted to States who have completed core deployments to expand their systems.Eligibility for Core Deployment grants is based on a State having a CVISN plan, an approved system design, certifying the system conforms with the National ITS and CVIS architectures,and agreeing to execute an interoperability test developed by FMCSA.Core Grants = $2.5 mil max per State includes TEA-21 funds, Expanded Grants = from remaining funds $1 mil per State 80% federal

    Next generation R&D, Op Test, T2, Standards, Architecture, EvaluationA doubling of trade over the last decade has placed a strain on many of our intermodal ports and gateways, and has contributed to increases in congestion. The freight transportation gateways program: O facilitates and supports multimodal freight transportation initiatives at the State and local levels in order to improve freight transportation gateways and mitigate congestion in the area of such gateways;O provides capital funding to address infrastructure and freight operational needs at freight transportation gateways; andO encourages adoption of new financing strategies to leverage State, local, and private investment in freight transportation gateways; andO supports military mobilization and readiness. Freight Gateway definition - means a nationally or regionally significant transportation port of entry or hub for domestic and global trade, military mobilization, and includes freight intermodal and Strategic Highway Network connections that provide access to and from these gateways. In relation to Freight, States are required to: - ensure that intermodal freight transportation, trade facilitation, and economic development needs are adequately addressed and fully integrated into the project development process, - Each State required to designate a freight transportation coordinator. Highway agency culture lacks professional expertise. Designating a freight transportation coordinator will provide freight a voice. The coordinator can be existing or new staff and full or part time. - update the list of STRANET and NHS connectors within 3 years of enactment.O To ensure we are providing the needed freight training and technical assistance to States and MPOs, we are developing a freight professional development program that is part of the larger FHWA Planning Capacity Building.O The institutionalization of freight is also needed to support the corridors program to ensure freight intermodal considerations are heard and understood at the State and MPO levels. The bill language defines gateways as: A nationally or regionally significant transportation port of entry or hub for domestic and global trade, military mobilization and includes freight intermodal and Strategic Highway Network connections that provide access to and from these gateways.

    The purpose of the expanded eligibility of STP (1205) and TIFIA (1304) is to provide states flexibility in obligating highway trust funds for freight intermodal transfer facility projects (and access to facilities) that relive bottlenecks. The distinction between STP and TIFIA eligibility is TIFIA allows for both public and privately owned intermodal facility investments while STP is for publicly-owned only. STP supports transportation infrastructure and intermodal access

    The NHS connectors Last Mile intermodal connectors defined in Report to Congress (1205) that bridge the NHS to ports, intermodal facilities, and military installations are in disrepair and need attention. The set aside targets funding for this need. The formula is derived by adding the number of freight and STRAHNET connector miles in a State and dividing it by the total number of NHS miles in the State to derive a percentage. We use that percentage or a minimum of 2%, whichever is greater, to determine the set aside percentage. The percentage is then applied to the NHS apportionment for that State to determine the dollar amount.

    Exemption if connectors are already in good condition/provide good service

    Lastly, we are proposing that a Federal Share of 90% be instituted for freight and STRAHNET connectors. Most connectors are in local ownership and the match is often a problem for the local jurisdictions.
