Sub-section A:1

RECRUITMENT RULES1. TITLE AND APPLICATION

i.These rules will be called "NHDC Ltd. Recruitment Rules".

ii.Except as otherwise provided by or under these Rules they shall apply to all persons appointed against regular posts in connection with the affairs of the Corporation or any of the Projects / Units / Power Stations under its administrative control. These Rules shall not apply to appointments on casual or on contract basis for specific jobs and periods.

2.DEFINITIONS

i."Corporation" means "NHDC Ltd." and includes Projects / Units / Power Stations under its administrative control.

ii."Board" means the Board of Directors of the Corporation.

iii.CMD" means the Chairman and Managing Director of the Corporation.

iv.CED shall mean the Chief Executive Director of the Corporation

v."Appointing Authority" means the authority empowered to make appointments to the posts under the Corporation

(See statement appended as Annexure I to these Rules.)

3. CLASSIFICATION OF POSTSFor purposes of recruitment the posts under the Corporation are classified in the following cadres / groups:

4. SOURCES OF RECRUITMENTResorting to one or more of the following methods shall fill in the posts under the Corporation:

a.Promotion of existing employees from the lower scales who meet the prescribed standards

b.Direct recruitment from outside candidates or through Press Advertisement in Employment News, National Dailies or local News Paper, as the need be or through internal induction by issue of internal advertisement/circular for employees who meet the prescribed qualification, job specifications, subject to any instructions issued by the Central Government in this regard from time to time.

(Government instructions placed at Annexure-II to these Rules)

c.Through Employment Exchanges as per provisions of the Employment Exchanges (Compulsory Notification of Vacancies) Act, 1959.

dDeputation from Central/State Governments or Public Sector Enterprises.

eRecruitment of persons declared as surplus by the Government and other Public Enterprises, etc. as per directives of the Central Government.

f. Recruitment of candidates through campus interview which will be initially applicable to allow recruitment from ICAI /ICWAI in Finance Discipline.

5.METHOD AND PRINCIPLES OF RECRUITMENT5.1LEVELS OF RECRUITMENT

Recruitment shall generally be made to the induction grades in each cadre/group, as indicated below, but recruitment at middle level or higher level can also be made only in extreme situation where employees on deputation / transfer or not available and it is not possible to carry out the assignment with the existing manpower.

5.2DIRECT RECRUITMENT FROM OUTSIDE

When a post is to be filled in by direct recruitment, including recruitment from the sources indicated at items (b) to (e) under Rule 4 above, the governing principle shall be to secure the services of the candidates most suitable to the post(s). To achieve this objective, the method of recruitment shall be :

i. To invite applications by open advertisement giving full information regarding the nature and duties of the post, qualifications, experience and age limits, prospects of promotion and other relevant information.

Ordinarily for each post not less than three and not more than five candidates shall be called for interview. The same ratio shall be applicable in case of usage of Graduate Aptitude Test in Engineering (GATE) score for calling the candidates for Group Discussion and interview.

ii.Where direct recruitment is resorted to, existing employees of the Corporation (including its Projects/Units/Power Stations) may also apply for the post(s) advertised in the press, provided they fulfill the prescribed requirements. Relaxation inthe qualifications / experience of internal candidates may be considered by the Appointing Authority.

iii.To prescribe where necessary, written competitive examination, test and/or oral examination by means of interview of candidates by a Selection Committee to be constituted by the Chairman and Managing Director/ CED/ General Manager / Chief Engineer / Chief/ depending upon the status of the post.

Where the mode of Recruitment is by using Graduate Aptitude Test in Engineering (GATE) score for technical Discipline at Induction Level, to be followed by Group Discussion and Interview by Committee to be constituted by CMD.

iv. The Selection Committee will arrange the names of selected candidates in order of their merit and the Appointing Authority will make appointments in that order, unless for any special reasons, to be recorded, it is found necessary to vary that order in any particular case. Panel of selected candidates (kept in reserve), which normallyshall not exceed 50 per cent of the number of advertised vacancies, will remain alive for a period of one year.

v. Recruitment in workmen cadre (Group C & D Level) will be advertised locally in addition to intimation to Employment Exchange in order to attract local candidates.

Clarifications(1)

The application fee for posts advertised by the Corporation will be Rs. 500/- for all categories of posts. However no application fee shall be charged from SC/ST candidates and from departmental candidates applying for higher posts. Candidates applying for W-0 and W-4/W-5/W6 posts shall be exempted from payment of any application fee.

(2) Employees of the Government/Public Sector undertakings who are appointed in NHDC on the basis of open advertisement shall not be allowed to retain lien in their previous organisations and that they will be allowed to join the Corporation on immediate absorption basis only. Such employees will be allowed to join the Corporation only on production of a letter from the Competent Authority / Authorities in their previous organization clearly mentioning therein that they have been relieved after acceptance of their resignation or after their premature/ voluntary retirement from the said organisation.

(3) In event of inadequate response from external sources to the notified Posts, Competent Authority shall have discretion to consider relaxation in age, experience and educational qualification as per the guidelines furnished at Annexure- III (A).

5.3RECRUITMENT BY DEPUTATION

When a post is to be filled in by deputation, no organisation will normally be approached to lend a particular officer by name, but such relevant particulars will be supplied to the concerned organisation as will enable it to suggest name / names of suitable persons for the post(s) in question. Deputation of employees from NHDC to other organisation within India as well as Foreign shall be regulated as per the provisions appended in Annexure-V and employees to NHDC LIMITED from sources other than the central Government Shall be regulated as per provisions appended in Annexure-VI.

The deputation period will not normally be allowed to exceed the limits prescribed by the Department of Public Enterprises from time to time for various categories of posts.

In the case of each deputationists, the management will decide within a period of one year from the date of appointment or at least three months before expiry of the deputation period, whichever is later, whether the deputationists has to be continuedon deputation, absorbed or reverted.The retirement and other benefits such as Seniority, Leave, Provident Fund, Gratuity, etc. to be allowed to deputationists on absorption shall be regulated as per the provisions in the "Guidelines for Absorption of Deputationists" appended in Annexure-III to these Rules.

5.4APPOINTMENT BY PROMOTIONThe Corporation will lay down rules relating to promotion of employees separately.

5.5EXTENT OF RECRUITMENTRecruitment shall be in adherence to the overall manpower budget for the year.

5.5(i) Job Specifications & Job Description

Job specification for each regular post to be notified and filled through any of above sources will be got approved from the competent authority as per administrative requirement and description of job. The basic qualification & experience required for recruitment of different Para-medical posts are laid down in Annexure-IV. However, as per administrative requirement and description of the job pertaining to the particular post and will be finalized as per the actual/additional requirement of job.

Job specifications for recruitment purpose shall be as per market requirement time to time and will not have any affect on qualification described in the Promotion Policy. Everything being equal, preferential weightage will be given to land oustees of NHDC Projects.

5.6PAY FIXATIONThe Selection Committee may recommend higher start normally not exceeding five increments in the scale applicable to the post and other terms of service depending upon the experience, qualifications, etc. of the candidate at the time of interview.

5.7AGEAge of a person at the time of appointment to the services of the Corporation shall not be less than 18 years.

There is no age bar for departmental candidates.

5.8RESERVATION OF POSTS AND RELAXATION IN AGE LIMITSThe directives of Central Government regarding reservation and age relaxation for Scheduled Castes, Scheduled Tribes, OBCs, Ex-servicemen and other categories, if any, issued from time to time, shall be followed.

Internal candidate belonging to SC/ST/PWD category will be eligible to apply if they have obtained pass marks in the qualification. However General and OBC category candidates have been allowed a concession of 10% of marks as against the prescribed percentage of marks, wherever applicable, against the posts advertised.

5.9BIGAMOUS MARRIAGENo candidate who has more than one spouse living or who, having a spouse living, contracts another marriage which is void by reason of its taking place during the life-time of such spouse, shall be eligible for appointment to any of the posts in the Corporation, except where this may be permitted under the Central Government rules for its employees.

5.10MEDICAL FITNESSNo person shall be appointed in the service of the Corporation unless such person has been certified by a duly qualified and registered medical practitioner or medical board approved by the Corporation to be medically fit to discharge his duties, except that in case of persons appointed from the Government or Public Enterprises such a certification, at the option of the Corporation will not be necessary, if he had been earlier medically examined for the previous employment. The employees may be subject to periodical medical examination for determining their suitability for further continuance in service as may be decided by the Chairman and Managing Director or an officer nominated by him from time to time.

Clarification The fee, if any, for the medical examination shall be reimbursed by the Corporation on production of the receipt by the person concerned

Female candidates with pregnancy being temporarily unfit are not allowed to join on fresh appointment. However, such appointment are held in abeyance until confinement is over and the vacancy is kept reserved. Six weeks after confinement they are required to be medically examined and their joining is accepted against receipt of medical fitness certification as prescribed in the offer of appointment and allowed the seniority as admissible under the NHDC Seniority Rules.

5.11VERIFICATION OF CHARACTER AND ANTECEDENTS5.11.1Appointment of any person in the service of the Corporation or his continuance in service, shall be subject to his character and antecedents being verified and found satisfactory, in the prescribed manner.

5.11.2In case of a person appointed from the Government or other Pubic Enterprises, the Corporation may accept the verification of character and antecedents done by his previous employer.

5.12PROBATION5.12.1All initial appointments, except transfers / deputation from the Government or Public Enterprises shall be on probation for a minimum period of twelve months.

5.12.2During the period of probation, an employee shall be liable to be discharged from the service of the Corporation without notice, or without assigning any reason, at the sole discretion of the Corporation.

5.12.3 The period of probation may be extended or curtailed in individual cases by the Appointing Authority, on the merits of each case depending upon probationers performance.

5.12.4On satisfactory completion of the period of probation, the employee shall be regularized in the post, but shall not be regarded as having been automatically regularized, unless an order to this effect is issued to him in writing.

5.13SENIORITYSeniority in essence means length of service in a particular post or grade. Thus the seniority shall be determined with reference to the date of appointment to a particular post or grade.

If an appointment order contains names of more than one person the seniority shall be according to the merit list drawn after the selection and the person whose name figures first in the merit list will be senior to the one whose name appears next to his and so on.

5.14.LIABILITY FOR SERVICE

A person recruited to a post under the Corporation shall be liable to be posted / transferred within the Corporation or in its holding company in India or abroad. 5.15LIABILITY TO SERVE IN DEFENCE SERVICEGraduate engineers and doctors entering the service of the Corporation shall be liable to serve for a minimum period of four years including the period spent on training in the Defence Service or on work relating to defence efforts anywhere in India or abroad, if so required. The liability to serve in the Defence Services shall be limited to the first ten years of service and will not ordinarily apply to graduate engineers above 40 years of age and doctors above 45 years of age, unless the Government of India decides otherwise.

5.16TRAININGAll employees are liable to undergo such theoretical and / or practical training for such period and undertake such examination, as may be prescribed by the Corporation from time to time.

5.17RETIREMENT / SUPERANNUATIONRetirement age of the employees of the Corporation will be 60 years.

The employees shall retire from service with effect from the last day of the month in which they attain the age of 60 years. In case of employees whose date of birth falls on the 1st day of a month, the date of retirement will be the afternoon of the last day of the preceding month. This will also be applicable to personnel reemployed before attaining the age of 60 years.

Employee who have attained the age of 58 years and put in at least 20 years of service or more in NHDC by giving notice in writing to the appointing authority of not less than 3 months or 1 months as the case may be and on acceptance thereof, retire from service of NHDC.

The employee released under this order will be entitled to all benefits as in the case of normal Superannuation including membership under REHS. However, such employee will be entitled to benefits of Gratuity as per relevant provisions of payment of gratuity act 1972 and Pension as per relevant provisions of Employee Pension Scheme 1995 under EPF Act and other benefits which are payable under concerned Acts/enactments/Rules, as per provisions.

5.18TERMINATION OF SERVICEThe services of Executive/Supervisor are liable to termination by giving three months notice or payment of salary in lieu there of by either side. However, in the case of Workmen, such period of notice is one month.

No request for waiver of notice period will be considered and legal course of action will be initiated against the defaulters.

6. APPOINTING AUTHORITY6.1The Chairman & Managing Director shall be the Appointing Authority for all appointments to posts in the grade above E-7 level other than the top posts for which the appointing authority is the President of India.

6.2Appointments to posts in the grades of E-7 and below shall be made by the Chairman & Managing Director, provided that in respect of those posts for which subordinates have been delegated powers of appointment, such appointments may be made by those authorities, provided further that such delegation or sub-delegation shall not be made to an authority lower in rank than that of an Assistant Manager.

7. ADDITIONS / ALTERATIONSThe Recruitment Rules are liable to modifications / changes depending upon the future needs of the Corporation. Notwithstanding whatever is contained in these rules, the Board may at its discretion relax any of the provisions of these rules.

OFFICE MEMORANDUMSub: Recruitment to posts in Public Sector Enterprises through National Employment Service issue of revised guidelines regarding. 1.The undersigned is directed to say that the scheme of Employment Exchange procedure came under the judicial scrutiny of the Supreme Court in the case of Excise Superintendent, Malkapatnam Krishan Distt., Andhra Pradesh Vs. K.P.N. Visweshwara Rao & others (1996 (6) SCALE 676 ). The Supreme Court, inter-alia, directed as follows:

"It should be mandatory for the requisitioning authority/establishment to intimate the employment exchange and employment exchange should sponsor the names of the candidates to the requisitioning Departments for Selection Strictly according to seniority and reservation, as per requisition. In addition, the appropriate Department or undertaking or establishment, should call for the names by publication in the newspapers having wider circulation and also display on their office notice boards or announce on radio, television and employment news bulletins and consider the cases of all the candidates who have applied."

2.In view of the need to incorporate the directions of the Supreme Court, it has been decided to consolidate all existing instructions in this regard and issue revised guidelines as follows:

PSEs are required to notify all vacancies meant for recruitment to the post carrying scales of pay, the maximum of which does not exceed Rs.2500/- per month pre-revised as indicated in DPEs OM No. 2(48)/91-DPE (WC) dated 6th April, 1992 to the Employment Exchanges/Central Employment Exchanges in the manner and form prescribed in Rule 4 of the Employment Exchanges (CNV) Rule, 1960 and make recruitment through National Employment Service. In addition to notifying the vacancies for the relevant categories to the Employment Exchange, the requisitioning authority/establishment may, keeping in view administrative/budgetary conveniences, arrange for the publication or the recruitment notice for such categories in the "Employment News" published by the Publication Division of the Ministry of Information & Broadcasting, Govt. of India and then consider the cases of all the candidates who have applied. In addition to above, such recruitment notices should be displayed on the office notice boards also for wider publicity.

3.These guidelines will take effect from the date of issue and will not apply to such cases where process of recruitment through employment exchanges/open advertisement has been initiated before the said date.

4.All the administrative Ministries/Deptts. are requested to bring the aforesaid instructions to the notice of PSUs under their administrative control for strict adherence.

ANNEXURE -IIIGUIDELINES FOR ABSORPTION OF EMPLOYEES WORKING ON DEPUTATION / TRANSFER IN NHDC LTD1.PROCEDURE

Absorption shall be done only in the E-2A in Executive Cadre, S-1 in Supervisory Cadre and W-4 / W-0 in Workmen cadre, for which seniority weightage will be provided on account of their service in NHDC while considering for promotion to next higher grade / post. However, in extreme cases where experienced personnel are required, absorption at Senior Level may be considered. Henceforth, following procedure is proposed to be adopted:

a)Circular will be issued for inviting application for absorption in the required post from the employee working in NHDC, who are on transfer / deputation from NHPC / State Govt.

b)Corporation will consider their permanent absorption depending upon the merit of individual case as per requirement / availability of post.

However, at least three months before completion of the period of deputation agreed to between the Corporation, the employee and the lending department, or even earlier if considered necessary, the Corporation will review the cases of each individual to decide whether:-

(a) the employee should be permanently absorbed in the corporation, or

(b) the employee should be sent back to the parent department.

In case the employee is considered for permanent absorption in the corporation, he shall be asked to exercise an option between the above two alternatives.Such option shall have to be exercised by the employee concerned within the time limits stipulated in the relevant instructions of the Government. Where the period of deputation is already indicated in the deputation terms, the option may be allowed to be exercised keeping the prescribed deputation period in view.No employee shall be permanently absorbed in the Corporation against his will and unless he has exercised his option and given his consent in writing for such absorption.

2.In the event of the corporation having decided to permanently absorb an employee and the employee having exercised his option and given his consent in writing, the Corporation shall consider the terms to be offered to the employee for permanent absorption, depending upon the merits of each individual case, keeping in view :

a) the desirability of protecting the total emoluments being drawn by the employee prior to absorption.

b) length of service in the parent department in various positions and scale of pay.

c) experience in any other department / field and

d) benefits to the Corporation from permanent retention of the employee.

2.1The employee who exercises option for permanent absorption in the corporation shall resign or take retirement from his parent department in accordance with the procedure laid down in this behalf by his parent department and on permanent absorption in the Corporation shall be governed by the corporations rules and regulations in force from time to time.

3.RETIREMENT BENEFITSThe benefits / facilities in respect of the pre-absorption service of the employee will be as laid down in the relevant orders of the parent department.

4.SENIORITY

Seniority of the deputationists to be absorbed in the Corporation, vis-a vis those already existing in the same cadre, shall be fixed in accordance with the guidelines laid down on this subject by the Corporation.

5.CONTRIBUTORY PROVIDENT FUND

The persons permanently absorbed in the corporation shall be eligible for membership of the Contributory Provident fund of the Corporation as and when instituted or from the date their resignation from Government service/Parent Department take effect and they are permanently absorbed in the Corporation, whichever is later. The amount of subscription together with interest thereon standing to their credit in the Provident fund Account shall be transferred to their new ( Contributory ) Provident Fund Account in the Corporation, provided the same is agreed to between the employees and the Corporation.

6.LEAVE

On Permanent absorption of deputationist, the Corporation will take over the liability in regard to leave on average pay / earned leave standing to the credit of the optees at the time leaving the parent organisation, provided the previous organisation has remitted a lump-sum leave salary equal to pay to the Corporation.

Annexure-III(A)

IMPORTANT INSTRUCTIONS

GUIDELINES FORDETERMINING ELIGIBILITY OF APPLICANTS AGAINST VARIOUS POSTS

1.EDUCATIONAL/ PROFESSIONAL QUALIFICATION

No relaxation should be considered in the educational / professional qualifications as prescribed for various posts.

2.EXPERIENCE

Generally relaxation in the length of prescribed experience (total as well as at particular level) need not be considered. However, if the response is inadequate and the requirement is urgent, a relaxation in length of experience may be given up-to a maximum period of six months, in terms of total number of years and also at specified levels. Experience in the related field only has to be considered while determining the eligibility of the candidates.

3.AGE

No relaxation in the prescribed age need be given for posts at basic induction levels. Relaxation in age may, however, be considered for recruitment at other than basic induction levels, provided the need is urgent and response is inadequate. The relaxation in such cases may be given up-to a maximum of five years subject to the condition that the selected will be available for service for a minimum period of three years in the Corporation.

The guiding principal in deciding the suitability of candidates for being called for interview / test should be the fulfillment of prescribed specification with relaxation as detailed above (depending upon the requirements in each case). In case, however, sufficient number of candidates are not available, the posts should be readvertised with lower specification or in higher scale, as may be considered necessary.

Annexure-V

STANDARD TERMS & CONDITIONS GOVERNING DEPUTATION OF EMPLOYEES FROM NHDC TO OTHER ORGANIZATIONS WITHIN INDIA

1.PERIODICITY

1.1 Date of commencement and expiry of Foreign Service.

The Foreign Service will commence from the date succeeding the date the employee is relieved for deputation and will expire on the date he joins back in NHDC provided the employee has availed normal joining time.

1.2 Period

The period of Foreign Service will be two years in the first instance. The period of Foreign Service may however, be extended by the borrowing department with the prior approval of NHDC up to a maximum period of 4 years and such an employee shall stand reverted to NHDC on expiry of extension granted.

1.3 Pre-matured repatriation

The Corporation reserves the right to recall the employee deputed on foreign service by giving one month notice to the borrowing department and the employee concerned. The borrowing department can also repatriate the employee by giving one month's notice after seeking the permission from NHDC.

2.PAY AND ALLOWANCES2.1 Pay

NHDC employees on Foreign Service may elect to draw pay either in the scale of pay of deputation post of borrowing department or to draw pay in the scale of NHDC plus Deputation (Duty) Allowance. The option once exercised shall be final except in case of promotion as well as on revision of pay scales of the deputation post or pay scales of NHDC, either prospectively or retrospectively. The option shall, in any case, be exercised within one month from the date of joining the deputation post / on promotion / revision of pay scales.

2.2 Deputation (Duty) Allowance

The rates of Deputation (Duty) Allowance to those opting NHDC scales shall be as under :

a) 5% of Basic pay + Personal Pay, subject to a ceiling of Rs. 500 per month for posting at the same station.

b) 10% of Basic pay + Personal Pay, subject to a ceiling of Rs. 1000per month in all other cases.

Further Basic Pay + Deputation allowance shall not exceed the maximum of the scale of pay of the deputation post.

2.3Dearness Allowance

The employee shall be entitled to Dearness Allowance at the rates prevailing in the borrowing organization or in NHDC depending on whether he has opted to draw pay in the scale of borrowing organization or in NHDC plus Deputation (Duty) Allowance.

2.4 Pay Fixation

NHDC employee while on foreign service opting to draw the pay in the scale of pay attached to deputation post, his pay will be fixed as under :

a) When the pay scale of NHDC and that attached to deputation post are based on same index level and the D.A. pattern is also same, NHDC employee on foreign service will continue to draw pay drawn in NHDC which will not be less than minimum of the scale of pay attached to deputation post.

b) If the appointment is made to a post whose pay structure and DA pattern is dissimilar to NHDC to that in the borrowing organization, pay will be fixed by adding to his grade pay, one increment in the NHDC scale of pay (and if he was drawing pay at the maximum of the scale, by the increment last drawn) and equating the pay so raised plus dearness allowance of all kind admissible plus interim relief if any, with emoluments comprising of pay plus DA, ADA, interim relief, etc., if any admissible in the borrowing organization and the pay will be fixed at the stage in the pay scale of the ex-cadre post at which total emoluments admissible in ex-cadre post as above equal the emoluments drawn in the cadre and if there is no such state, the pay may be fixed at the next higher state.

c) Pay fixed under (a) and (b) shall neither be less than the minimum of scale of the deputation post nor shall exceed the maximum of that scale.

2.5 Other allowances such as HRA, CCA, Transport Allowance etc. including locational and Compensatory Allowance

Other allowances such as HRA, CCA, Conveyance Allowance and other compensatory allowances shall be payable as per orders of the borrowing department as applicable to officers of equivalent status of the deputationist and grade in the borrowing department. The payment of above allowances during the period of leave while on deputation as well as during joining time shall be borne by the borrowing organization.

HRA shall not be less than that admissible in NHDC. In NHDC, HRA in satellite townships like Gurgaon, Faridabad, NOIDA and Ghaziabad is being allowed at the rates as admissible in Delhi.

3.OTHER BENEFITS3.1 JOINING TIME / JOINING TIME PAY ADN T.T.A. ON TRANSFER / TOUR

Joining time, Joining time pay and T.A. on Transfer on deputation to the borrowing department & back to NHDC including tour while on deputation shall be regulated as per rules of the borrowing department with the condition that entitlement of T.A. on Transfer shall not be in any case less than that provided in NHDC Rules.

3.2 LEAVE, ENCASHMENT OF LEAVE

Leave including special disability leave and encashment of leave while on deputation shall be governed under the rules of NHDC.

3.3 MEDICAL ATTENDANCE

For Govt. and Semi Govt. Organizations

Employees on Foreign Service shall be entitled to medical facilities prevailing in borrowing department, however, these will not be inferior to those admissible in NHDC.

For PSU's

Employees on Foreign Service shall be entitled to medical facilities prevailing in borrowing department which will not in any case be inferior to those admissible in NHDC.

3.4 INCENTIVE UNDER FAMILY WELFARE SCHEME

Employees while on Foreign Service shall continue to be governed under the rules of NHDC for the purpose of payment or grant of incentive for undertaking sterilization operation. In case employee sterilization operation during the period of deputation, the borrowing department will forward the claim of deputationist to NHDC where the incentive will be sanctioned. The borrowing department will make all the payments as per sanction and expenditure on this account will be borne by the borrowing department.

4.RECOVERY / PAYMENT OF ADVANCES / CONTRIBUTIONS TO BE PAID BY EMPLOYEES AND BORROWING DEPARTMENT.

4.1 RECOVERY OF ADVANCES

Outstanding advances shall be recovered by the borrowing department from the pay of the deputationist in monthly installments and remitted to NHDC regularly on monthly basis.

4.2 EMPLOYER'S AND EMPLOYEE'S CONTRIBUTION TOWARDS EMPLOYEES PROVIDENT FUND / EMPLOYEES PENSION SCHEME 1995.

During the period of Foreign Service employees shall continue to be governed under the Employees Provident Fund Scheme of NHDC Ltd. The borrowing department shall deduct the employee's contribution @ 12% of Pay + D.A. + Canteen Subsidy + Deputation (Duty) Allowance if any from pay of the deputationist and remit the same along with equal amount of matching contributions to be borne by borrowing department within seven days through demand draft drawn in favour of NHDC Ltd. payable at Bhopal.

In addition, administration charges of PF @ 0.185% of Basic pay + DA + Canteen Subsidy + Deputation (Duty) Allowance, if any, will also be remitted. It is clarified that deputationist will continue to be governed by EPF Rules. Further, rate of administrative charges is subject of change linked to guidelines issued by RPFC from time to time.

4.3 EMPLYEE PENSION SCHEME

In case any Pension Scheme other than Employee's Pension Scheme 1995 is framed and implemented in NHDC, the borrowing department will pay such contributions as payable by NHDC and recover the contributions payable by the deputationist. The contribution if any, payable by the borrowing department and amount recovered from the deputationist shall be remitted to NHDC regularly by demand draft drawn in favour of NHDC Ltd., payable at Bhopal.

4.4 LEAVE SALARY CONTRIBUTION

Borrowing department will pay leave salary contribution for 40 days on account of EL and HPL at the end of each year within 15 days or at the end of the agreed tenure of deputation. The salary will include Basic Pay, Dearness Allowance, Deputation (Duty) Allowance of last salary drawn, for part period, this will be paid on pro-rate basis for the deputation period including joining time, by demand draft drawn in favour of NHDC Ltd. payable at Bhopal.

4.5 GRATUITY

Borrowing department will remit to NHDC Gratuity Contributions @ 4.81% of salary consisting basic pay (including PP if any) +DA + Deputation (Duty) Allowance for every completed years of service or part thereof in excess of six months. The payment of gratuity contribution will be made by the borrowing organization annually within 15 days from the end of each year or at the end of the agreed tenure of deputation. If the payment is not made within the said period, interest will be paid by the borrowing organization on the unpaid contribution at applicable rate as decided by NHDC for delayed period till the date of payment.

4.6 GROUP INSURANCE SCHEME

Employees during the Foreign Service will continue to be a member of Group Insurance Scheme and contribution as per existing scheme will be made by the borrowing department and sent to the Corporation at the rates notified from time to time.

4.7 NHDC EMPLOYEES (HBA)/(Motor Vehicle) GROUP INSURANCE SCHEME

Employees during the Foreign Service will continue to be a member of NHDC Employees (HBA)/(Motor Vehicle) Group Insurance Scheme and contribution as per existing scheme will be made by the borrowing department and sent to the Corporation at the rates notified from time to time.

4.8 REMITTANCE OF ADVANCES / CONTRIBUTIONS TO BE PAID BY EMPLOYEES AND BORROWING DEPARTMENT.

The amount recovered from the deputationist on account of Advances, contributions towards various social security Schemes to be contributed by the deputationist as well as borrowing organization shall be remitted to NHDC regularly. If the payment is not made within the said period, interest will be paid by the borrowing organization on the unpaid contribution at applicable rate as decided by NHDC for delayed period till the date of payment.

5.GENERAL5.1 PERKS AND BENEFITS

For Govt. & Semi Govt. Organizations perks and benefits Will be regulated as per instructions of the Central Government from time to time.

For PSU's

In case perks and benefits offered by the borrowing organization are inferior to those available in NHDC, the perks / facilities of the NHDC will be applicable to the deputationist at the cost of borrowing organization.

5.2 RESIDENTIAL ACCOMMODATION / LEASED ACCOMMODATION

Employee will be entitled to residential accommodation according to the rules of the borrowing department to which he is deputed.

In case, the employee keeps the family other than the place of posting and having the leased accommodation, the rules of NHDC shall be applicable in such cases. However, the expenditure shall be borne by borrowing department.

5.3BONUS / PRODUCTIVITY LINKED INCENTIVE / EX-GRATIA/PRPBonus / Productivity linked Incentive / Ex-gratia/PRP shall be payable as per rules / orders of the borrowing department.

5.4 TRANSFER DURING DEPUTATION

NHDC employees on Foreign Service shall not be transferred to another post / station or entrusted with any additional charge or promoted to higher post by the borrowing department without obtaining the prior approval of NHDC Ltd.

5.5 CONDUCT, DISCIPLINE AND APPEAL RULES

The employee shall continue to be governed under the provision of NHDC Conduct, Discipline and Appeal Rules. The borrowing organization shall not initiate any proceedings without the consent of the NHDC.

5.6 INTERPRETATION OF TERMS & CONDITIONS OF FOREIGN SERVICE

If there is any doubt regarding interpretation of terms and conditions of deputation / Foreign Service and also any additional facilities / allowances to be extended to the employee, the decision of the NHDC shall be final and binding on the borrowing organization.

Annexure-VI

STANDARD TERMS AND CONDITIONS TO GOVERN TRANSFER EMPLOYEES TO NHDC LIMITED ON FOREIGN SERVICES (DEPUTATION) FROM SORUCES OTHER THAN THE CENTRAL GOVERNMENT.

1.FOREIGN SERVICE (DEPUTATION) PERIOD :1.1 Appointment on foreign services (deputation) will initially be for a period of two years, extendable upto One more year depending upon (a) Actual requirement of the Corporation, and (b) performance of the deputationist. In exceptional cases, subject to acceptance of lending organization and deputationist concerned, the deputation period can be extended for the 4th year and such an employee shall stand reverted to parent department on expiry of extension so granted.

1.2 In case the deputation period is extended, under any circumstances beyond four years no Deputation Duty Allowance shall be payable beyond 4 years.

2.AGE LIMIT FOR FOREIGN SERVICE :

The maximum age limit for appointment by transfer on foreign service shall not exceed 56 years as on the closing date of the receipt of applications.

3.ABSORPTION OF DEPUTATIONIST :

Deputationists will not be considered for absorption in NHDC save in exceptional cases of high merit as per the policy of the Corporation (Adjudged and recommended by a duly constituted Board). This will, however, be subject to requirement and vacancies being available.

4.PROMOTION DURING DEPUTATION :4.1During the period of deputation with NHDC deputationist will not be entitled to any promotion. In case an employee is promoted in his parent department he will be reverted to his parent department within six months from the date such occasion arises.

4.2However, in case where NHDC decides to continue a deputationist who has been promoted by his parent department during deputation period, he can be retained after his consent in writing and approval of his parent department, in his existing deputation post.

5.PRE-MATURED REPATRIATION :

In case the Corporation / parent organization decides to repatriate / recall the concerned deputationist before expiry of the period of deputation, one month's notice will be given by either side. In exceptional cases the officer / official could be reverted immediately without any notice.

6.PAY:

An employee on deputation shall draw his basic pay in the parent department from time to time. under Para 6.2(A).

A deputationist will draw pay last drawn immediately before joining the Corporation on deputation.

NOTE:

'Pay' drawn in the parent department pay scale shall mean :

I)'Basic Pay' drawn in the pay scale of the substantive appointment held or the pay in the pay scale of the officiating appointment in the employee's parent department provided that the officiating appointment so held was not in a tenure post and is so certified by the appointing authority that but for deputation the employee would have continued to hold the officiating appointment indefinitely (Necessary Certificate in this regard should be obtained from the parent department)

II)Personal Pay, if any, drawn by a person in his parent department will continue to be admissible until it is absorbed in other increase in pay e.g. increment or other increases of pay on promotion etc.

III)Special Pay granted to the deputationist in parent department will not be admissible in the deputation post.

6.1DEPUTATION (DUTY) ALLOWANCE:

The rates of Deputation (Duty) Allowance are as under :-

a)@5% of basic pay, subject to a ceiling of Rs. 500/- per month for posting at the same station.

b)@10% of basic pay, subject to a ceiling of Rs. 1000/- per month in all other cases.

The Deputation (Duty) Allowance as above shall further be restricted as under

(i)Pay plus Deputation (Duty) Allowance shall not exceed the maximum of scale of pay of the deputation post in NHDC.

(ii)The sum total of Basic Pay, Personal Pay, if any and other emoluments in the nature of Pay, DA, ADA, IR / Ad-hoc relief and deputation pay (by whatever name it is called) under these orders shall not exceed atany time the maximum of the pay scale of the post held in the Corporation on deputation plus DA, IR, Adhoc Relief ect. (by whatever name it is called) as applicable on the maximum of the pay scale in the Corporation. However, in any case total amount to be drawn by the employee will not be less than the basic pay & personal pay (if any) plus DA, ADA, IR, Ad-hoc Relief which he would have drawn had he not joined NHDC on foreign service / deputation.

NOTE:

'Deputation (Duty) Allowance' will not be treated as Pay for drawal of DA & other Allowance, perks etc.

When an employee earlier posted at Station 'A' in his parent department is taken on deputation by NHDC and posted to Station 'B', he will be entitled to deputation duty allowance of 10% of pay subject to a maximum of Rs. 1000/-. In case however, the same employee is posted / transferred back to station 'A', while on deputation to that station, he will draw DDA @ 5% of pay subject to a maximum Rs. 500/- per month from the date of joining at Station 'A'.

7.INCENTIVE UNDER FAMILY WELFARE :

7.1Deputationist shall continue to draw increment sanctioned for promoting small family in the parent department.

7.2In case a deputationist becomes entitled to the incentive during deputation the same shall be sanctioned as per rules of his parent department and with reference to his parent pay scale.

8.PAYMENT OF ALLOWANCES / PERKS :8.1The payment of local allowances and other perks like HRA, CCA, Site Compensatory Allowance, etc. shall be governed as per Parent Department Rules.

8.2The deputationists will be entitled to Ex-gratia, incentive etc. as per the NHDC Rules. They will not be entitled to any perks / allowances of the parent department.

9.INCREMENTS :

Employees will be entitled to annual increment as per the rules of the parent department.

10.RESIDENTIAL ACCOMMODATION :

Deputationists shall be entitled to unfurnished accommodation at Projects subject to availability wherever admissible or HRA as per rules.

At rates as notified by the corporation from time to time shall be charged for accommodation provided by the Corporation, as per Rules.

11.LEAVE :

Leave Rules of the parent department shall be applicable to the deputationists. a copy of the leave sanction orders shall be sent to parent department.

12.LEAVE TRAVEL CONCESSION / LEAVE TRAVEL ASSISTANCE :

Deputationists will be entitled to LTC/LTA as per the rules of the parent department and cost thereon during the period of Deputation / Foreign Service shall be borne by NHDC.

13.LEAVE SALARY AND PENSION CONTRIBUTION :Leave salary contribution (except for the period of leave availed on foreign service) and pension contribution / CPF (Employer's share) contribution shall be paid to the parent department as per the rules of the lending Organization.

14.MEDICAL ATTENDANCE AND TREATMENT :

Medical facilities shall be provided as per NHDC Medical Attendance Rules applicable to NHDC employees.

15.PAY AND ALLOWANCE DURING JOINING TIME :

Pay and allowance for joining time as admissible both on joining on foreign service and on reversion there from will be regulated and paid under the rules of Parent Department. No Deputation (Duty) Allowance shall be paid during joining time.

16.TRAVELLING ALLOWANCE / TRANSFER TRAVELLING ALLOWANCE DURING FOREIGN SERVICE :

The employee shall be governed as per NHDC TA rules during the period of foreign service.

17.DATE OF COMMENCEMENT AND EXPIRY OF FOREIGN SERVICE

The foreign service will commence from the date succeeding the date, the employees is relieved for deputation by his parent department and will expire on the date preceding the date he joins back in the parent department provided the employee has taken normal joining time otherwise the foreign service shall expire the expiry of normal admissible joining time. He will be entitled to joining time as per rules of his parent department.

18.GENERAL :Matters which are not specifically covered under these terms & conditions shall be regulated as per Parent Department Rules.

OFFICE MEMORANDUM

Subject :-Implications of overstay while on deputation.

It has been brought to notice of the Government that that even though the terms and conditions of deputation issued by the various Ministries/Departments/Offices specify the period of deputation there have been a number of cases of overstay without the approval of the Competent Authority it is necessary to ensure that there is no laxity on the part of the controlling authorities in relieving the deputationists and the deputationists should not go by the presumption that he needs to join his parent cadre only after being formally relieved by the borrowing department it has therefore been decided that in future all cases of deputation shall be regulated by the following conditions viz :-

(i) The terms and conditions of deputation shall clearly lay down not only period of deputation as per the Recruitment Rules for the post or as approved by the competent authority but also the date of relieving of the deputationists. No further orders for relieving the officer will be necessary.

(ii) The deputationist officer including those who are presently on deputation would be deemed to have been relieved on the date of expiry of the deputation period unless the competent authority has with requisite approvals, extended the period of deputation in writing prior to the date of its officer to ensure that the deputations does not overstay. In cases where officers are on deputation on the date of issue of these orders and the normal tenures are getting over in a period of six months the concerned officers/Organizations may be allowed an extension of not more than one month on a case to case basis with the approval of the DOPT.

(iii) That in the event of the officer overstaying for any reason whatsoever he is liable to disciplinary action and other adverse Civil/Service consequences which would include that the period of unauthorized overstay shall not count against service for the purpose of pension and that any increment due during the period of unauthorized overstay shall be deferred with cumulative effect till the date on which the officer rejoins his parent cadre.

2. Written consent of the officer concerned shall be taken to the terms and conditions of deputation (inclusive of the conditions in para 1 ibid) before the deputation orders are issued. The contents of these instructions will be conveyed to all officers presently on deputation for information/compliance.

3. These instructions will apply to all deputationists including Sate Government Officers/All India Services officers joining Central Government posts on deputation and to officers proceeding on deputation to State Government/autonomous & statutory institutions/foreign Bodies etc.

4. If the borrowing Organisations would like a relaxation from these terms they should obtain approval of DoPT to it prior to the start of deputation.
