2. OBJECTIVES

2.2 Immediate Objectives

The project has the purpose of:

• enhancing safety of navigation,• improving efficiency of traffic flow, and• reduction in risks of pollution and maritime casualties,

NPAA Partnership

The NPAA establishes that the Malta Maritime Authority should strengthen itsmonitoring functions in respect of safety of navigation and pollution control. TheMaritime Transport Action Plan submitted to the European Commission in July 2001also highlights the need of further investment in this area.

The NPAA also establishes that under the Fisheries Acquis Malta would need toinvest in a satellite-based vessel monitoring system. This system is obligatory tomonitor fishing vessels with a length in excess of 20 metres. Similar systems wouldalso need to be established to facilitate border controls and search and rescueactivities.

3. DESCRIPTION

3.1 Background and Justification

3.1.1. Introduction

On 27th June 2002 the EU has adopted Directive 2002/59/EC for establishing aCommunity vessel traffic monitoring and information system for maritime traffic(VTMIS) and repealing Directive 93/75/EC. The purpose of this Directive is theimplementation of a system which would enhance the safety and efficiency ofmaritime traffic by allowing public authorities to monitor shipping navigating inwaters under their jurisdiction and to improve response to accidents or potentiallydangerous situations at sea. Eventually this would lead to a reduction in maritimecasualties, loss of persons at sea, damage to property and maritime pollution.

The Maritime Safety Project submitted for funding under the Pre-Accession Funds2002 includes a Twinning component whereby the Pre-Accession Advisor, assistedby short term experts, should provide the Malta Maritime Authority with advice onthe development of the systems that are required to ensure compliance with the EUDirective 93/75 and the new VTMIS Directive 2002/59/EC. Henceforth, thetechnical specifications, human resources and administrative parameters required toestablish the VTMIS would have been identified through the Twinning projectmentioned above. Therefore, this maritime safety project would follow up on theactions recommended during the latter phase, particularly in respect of theimplementation of the VTMIS for Malta. This would involve the procurement of thenecessary equipment, infrastructure, technical hardware and software resources andthe training of personnel who would manage and operate the VTMIS, and itsintegration with the dangerous goods database.

3.1.2. Ports and Shipping Traffic

Ports and maritime services have always played a very important role in the historyand economic development of Malta, mainly because of the islands’ geographicalposition. The importance of maritime activities has increased with the developmentof the manufacturing and tourism industries and international shipping services. Inrecent years Malta has also upgraded its maritime package within a hub concept.Malta is now in a position to offer a comprehensive maritime package includingfacilities for the handling for all types of cargo and passengers, ship repair, bunkeringand the provision of other maritime services.

During the last 5 years the number of ships calling in Maltese ports have increased by18.5% reaching almost 6,300 ships, while the corresponding gross tonnage hasincreased by over 40%. This clearly shows that the local ports had to cater not onlyfor the increase in volumes but more importantly for an increase in the size of vessels.This was mirrored by increases in cargo and passenger throughputs. The amount ofdangerous goods carried, both in packaged form and in bulk, is also significant.

Shipping traffic has also grown in the anchorage areas around Malta, which areprimarily used by vessels receiving bunkers, carrying out minor repairs, effectingcrew changes or receiving supplies and provisions. This kind of traffic has more thandoubled during the last 5 years, and now amounts to almost 2000 vessels per year.

Further more, since Malta is located in the middle of the Mediterranean its shores areoften polluted by oil originating from vessels navigating both through its waters andon the adjacent high seas. It is estimated that 76% of all vessel traffic in theMediterranean passes between Malta and Sicily, and over 70% of this traffic involvetankers carrying polluting goods. This is definitely an area of high concern for Malta.

Malta does not have a Vessel Traffic System. The only facility available forcommunication with ships is a Signalling Station, which often depends on theinformation submitted by ships themselves. Thus it does not provide for real-timeinformation on ships transiting local waters or calling at local ports.

This increase in maritime traffic requires an investment in modern technology to beable to monitor effectively vessels navigating in local waters.

3.1.3. Institutions Relevant to the Project

The main administrative body responsible for maritime transport is the MaltaMaritime Authority through its various Directorates. The Authority, an autonomousGovernment agency set up by law under the aegis of the Ministry for Transport andCommunications, supervises the organisation of the primary maritime services.Therefore, the Authority shall be the designated authority in transposing the relativeMaritime Transport Acquis.

The Merchant Shipping Directorate is responsible for all matters related to merchantshipping. The Directorate carries out most of the functions of a Flag Stateadministration. This includes the registration of ships, the training and certification ofseafarers, flag and port State control, the fostering of Malta’s relations in internationalshipping fora, as well as the administration and implementation of internationalmaritime conventions and agreements.

The Ports Directorate, which is considered as the port authority for all the ports inMalta, has a regulatory and managerial role. It is responsible for port operations andexercises control over all port work. It also regulates commercial sea-craft plyingsolely in Maltese territorial waters. As a port regulator, the Directorate is concernedwith key issues such as good order, navigation and pollution prevention and control inMaltese ports.

The Yachting Centres Directorate is responsible for the regulation, control, promotionand development of yachting centres and the administration of the registration andoperation of small pleasure sea-craft.

The Armed Forces of Malta is responsible to carry out border controls and search andrescue activities, while the Ministry for Fisheries and Acquaculture is responsible tomanage and monitor the fisheries policies, including the fisheries conservation zones.

3.2 Linked Activities

As referred to above the Malta Maritime Authority is involved in a Twinning project,which is lead by France, and financed under the Pre-Accession Funds Programme2002. This project shall provide the basis for institution building of theadministrative capacity and the necessary advice on the procurement of equipment.Its results shall directly affect the outcome of objectives of this Project Fiche.

A very important linked activity in order to be in a better position to implement theacquis and ensure the success of the project is the strengthening of the PortsDirectorate through the recruitment of additional staff, including specialisedpersonnel. In fact at the beginning of 2002 the Directorate had upgraded the MarineDepartment by recruiting a Marine Engineer, Class 2, and a Marine Administrator.Training of personnel is an ongoing concern within the Directorate. The Authorityhas, in fact, throughout the last years sent its employees on short-term training,diploma and post-graduate courses.

Moreover, MMA has concluded a partnership agreement with the Malta College forArts, Science and Technology for the setting up of an Institute of Maritime Studies.The Institute takes over the activities of the previously Nautical School, which has foryears provided high level training leading to examinations for the issue ofinternationally recognised certificates of competency and other certificates at alllevels. The Institute will also embark on a training programme for ship basedpersonnel, such as ship inspectors and possibly also ship surveyors, and also portpersonnel. The Institute has started operating and MMA is funding part of itsoperations to the extent of ?443,000 over the period 2001-2003.

The Maritime Environmental Risk Management System (MERMS) has beendeveloped, through the EU Life Programme, in synergy with specialist environmentalconsultants from the EU. The system provides for the control of environmental andattendant safety risks associated with the Authority’s operational activities and toprovide a structured framework to encourage improved environmental risk and safetymanagement in the activities of other industrial foreshore users. This is achievedthrough the identification of clear responsibilities for environmental and safetymanagement procedures and the development of a system which assesses theoperational and structural objectives on a regular basis.

The Ports Directorate is also actively participating in the EUMEDIS and theMEDCHART projects financed by the MEDA Fund. The objective of these projectsis to upgrade the Mediterranean Hydrographic Offices of the Mediterranean countriesby providing the necessary technical equipment, software and training. The mainresult would be that each country would be in a better position to carry out maritimehydrographic surveys around their coasts and produce their electronic navigationalcharts. The latter charts could effectively serve as valuable information for theVTMIS centre.

EuropAdvice were commissioned to draw up a report for the Ports Directorate on theimpact of the Acquis Communautaire on local ports. The conclusions recommendedon the importance of upgrading health, safety and pollution prevention procedureswithin the port area and in coastal waters.

Malta hosts the IMO International Maritime Law Institute (IMLI) and provides andmaintains free of charge the premises housing the Institute. MMA on its part grants anannual donation equivalent to ?16,000 and from time to time funds part of thebuilding and maintenance programme. The Maltese Administration will continue withits cooperation programme with IMLI, which gives the opportunity to a number ofMaltese graduates to specialise in international maritime law. The total contributionof the Authority for the year 2002 will be ?74,000.

3.3 Results

The outputs of the project are:

• establishment of a vessel reporting and monitoring system for vessels, regardlessof flag, bound for or leaving Maltese ports or transiting local waters;

• enhanced port operations control by providing real-time data to shipping and portsafety personnel (including port officers, pilots and towage);

• provision of shore-based installations with the ability for receiving andevaluating maritime traffic information generated by the appropriate equipment,as described in paragraph 3.4.1 below;

• exchange of information with vessels, including small craft, on all relevant safetymatters, including navigational assistance, vessel traffic conditions, hazards tonavigation, meteorological warnings and the movement of dangerous goods;

• provision of equipment and systems which would allow for the exchange ofinformation and data with other national or regional VTMIS stations.

• facilitation and early assistance to vessels in distress or response to maritimecasualties and pollution incidents;

• reduction in maritime casualties and risks of maritime pollution; and• professionally trained and certified marine safety personnel.

3.4. Activities

Successful implementation of this project anticipates the following.

3.4.1. Training

Human resource development and capacity building is of utmost importance for thesuccessful implementation of this programme. Therefore, this project envisages alsoinvestment in the following training activities:

• Familiarisation visits to VTMIS centre stations in EU member states;• Attendance to induction and post graduate courses for the Authority’s

management personnel involved in maritime safety and pollution prevention; and• Training for 25 persons, including trainers, VTS operators, and other maritime

safety personnel, on IMO/IALA VTS model courses and simulators at traininginstitutions.

3.4.2. Equipment

Investment in the necessary technical resources to establish an integrated vesseltraffic monitoring and management information system. This would include theprocurement of:

• X- band radar antennas to control coastal and port areas and approaches;• Radar Tracking System providing a traffic image of the territorial waters and

specifically the approaches and entrances to the commercial ports;• Radio Direction Finder for vessel identification purposes;• VHF transceivers , DSC-VHF receiver, NAVTEX receiver;• Operator(s) multimedia-VTS workstation(s);• Data Processing System including Database with INTRANET and EXTRANET

connections;• Data Network;• Control and Monitoring System enabling remote control and status management

of the technical components;• System capability for computer-computer links with external systems;• Closed Circuit TV;• Hydrological – Meteorological sensors;• Capability for integration of Automatic Identification System (AIS) Transponder

System.

4. INSTITUTIONAL FRAMEWORK

The beneficiary of the project will be the Malta Maritime Authority.

The Malta Maritime Authority was established as a distinct and autonomous corporate bodyby law in 1991 in order to develop and promote the various maritime activities in Malta andadvice government on matters relating to maritime activity. Its commercial orientationensures that it creates a climate, which further enhances Malta’s maritime standing andassociated business activities by providing excellent services that are both effective andcompetitive. The functions and duties have been delegated to the respective ExecutiveDirectors, Merchant Shipping, Ports and Yachting Centres Directorates, together with aCorporate Office, who report to the Chairman and members of the Board.

The Ports Directorate is responsible for ensuring the provision of services which guarantee theefficient and cost effective operation of Maltese ports. In this role as a service provider it isobliged to ensure, at all times, the provision of port workers, pilotage, fire-fighting facilities,salvage equipment, and landing facilities for inter-island transportation, and the provision offuels and other ship necessities.

As a commercial role the Ports Directorate is involved in the management and developmentof the ports, particularly the Port of Valletta. The upgrading and modernisation ofinfrastructures and superstructures for the handling of cargo and passengers is an ongoingconcern for the Directorate. It has also taken several steps to enhance private investmentwithin various sectors of the port through a number of concessions.

The Ports Directorate also maintains to play an important role as a regulatory body in respectof the preservation of good order in the territorial and internal waters of Malta and theprevention and control of pollution. In this respect the Marine Department has been enhancedby the employment of additional qualified personnel and the updating of environment relatedlegislation. It has been instrumental in safeguarding the safety of navigation and of the ports

through regular inspections in order to ensure the correct procedures in connection with thehandling of dangerous goods is being applied.

The Dangerous Cargo Ships, Marine Terminals and Facilities and Bunkering Regulations,1996 which covers standards to be employed by the industry at foreshore terminals and duringoffshore activities. This subsidiary legislation is primarily environment protection, togetherwith the relative attendant safety risks, oriented. The Directorate shall soon promulgate theCommercial Vessel Regulations which shall provide for the safety standards and manning ofvessels carrying out a trade exclusively within Maltese territorial waters and which are notcovered by the IMO STCW Convention.

The Directorate is continuously involved, in collaboration with other Government agencies, inthe development and implementation of Emergency Response Plans for the Ports and theMarine Environmental Risk Management System mentioned above. The Directorate is also amember-partner in the Eco-Ports Project, financed by the EU and led by the European SeaPorts Organisation.

The investment components of this project all relate to institution building activities and thesupport required. The main benefit that will arise is improvement in safety standards throughimplementation of the maritime transport Acquis.

11. INVESTMENT CRITERIA

11.1 Overall effect

The EU contribution will have an important effect in helping to act as a catalyst for prioritymaritime safety improvements required to implement all EU standards in the fields ofmaritime safety.

11.2 Co-financing

National co-finance will amount to 45% of the whole project budget.

11.3 Additionality

No other financiers will be displaced by the EU intervention.
