Dear golf course lot and homeowners, The original developer placed a minimum of a 15’ easement on every golf course lot. This easement is the greater of 15’ or the distance for the golf course easement shown on any plat, and is for the construction, installation, maintenance, repair and replacement of the golf course. This easement gives The Club at Fairvue Plantation the right to install, maintain, and replace landscaping and related improvements within the easement. No buildings, fences, or other improvements of any nature may be made within the golf course easement without prior written approval from the Club. No landscaping or related improvements placed within the golf course easement shall be destroyed, removed, or altered in any way without the prior written approval of the Club. The Golf Course Easement Guide will simplify the approval process and provide clarity of approvals that are allowed. For all landscaping and improvement projects, property corners and pins must be visible.

How to use the Golf Course Easement Guide: 1. Locate your lot on the following slides and identify the easement regulations

affecting your lot by using the key within this guide. 2. If you are seeking to make improvements to your lot that requires an approval (ie

landscaping not on the pre-approved list or a lot need of a special exception) from The Club at Fairvue Plantation:

a. Submit an application to the HOA – Architectural Review Board along with the required documentation. (A site plan clearly showing the property lines and easement lines is required on all applications.)

b. After the Fairvue Plantation HOA – Architectural Review Board has approved the request, conditioned upon Gallatin Golf Easement Agreement approval, submit an approval letter of the request, the plot plan, and a check to The Club at Fairvue Plantation (property corners must be marked with stakes).

c. The Club at Fairvue Plantation will provide an easement agreement for your signature and upon execution, record the agreement.

d. Upon recordation you may commence with your improvements. Landscape- Landscape bed-homeowners may request a landscape bed at a maximum of 5’ from the rear of the home (landscape beds may include plantings other than approved trees, but must be approved by the ARB). Homeowners may plant any of the pre-approved trees, and no fee is required).

a. All trees must be a minimum of 10’ from the cart path within the easement (The Club at Fairvue Plantation reserves the right to trim any branches to avoid potential injuries).

b. All fences must be a minimum of 3’ from the cart path. Special exceptions- Property owners may request special exceptions for landscaping within the golf easement: $1400 Easement Encroachment Fee must be submitted with request to The Club at Fairvue Plantation. Refundable if not approved. $1400 fee for 2015, subsequent years may be adjusted for inflation. Cost includes easement agreement draft and recordation, cost of survey dated 1.17.13, and administrative charges. Encroachments onto golf course property- These encroachments may remain until the property is transferred to another owner or if requested by The Club at Fairvue Plantation.

Key: Blue boxes-Fences and/or hardscapes must be located outside golf easement. Property owner may request special exception (see special exception paragraph). Orange boxes-Fences or hardscapes within the golf easement which existed as of 1.17.13 may remain unless otherwise notified. No additional fencing, hardscapes or unauthorized landscaping is allowed. The Club at Fairvue Plantation reserves the right to request any item existing prior to 1..17.13 within the easement to be removed within 30 days’ notice. Orange boxes with asterisk-Fences allowed within the golf easement with the payment of an Easement Encroachment Fee. Checks are to be made to The Club at Fairvue Plantation for $800.* $800 fee for 2015, subsequent years may be adjusted for inflation. Applicant shall submit application through ARB and must provide receipt for payment from the Club. Cost includes easement agreement draft and recordation, cost of survey dated 1.17.13, and administrative charges. Purple boxes-Fences allowed within the golf easement with the payment of the Easement Encroachment Fee. Check to be made out to The Club at Fairvue Plantation for $800. *$800 fee for 2015, subsequent years may be adjusted for inflation. Applicant shall submit application through ARB and must provide receipt for payment from the Club. Cost includes easement agreement draft and recordation, cost of survey dated 1.17.13, and administrative charges.
